RESOLUTION
The Respondent, Adonis Bigueja Zumba King, was charged of the crime of
FALSIFICATION as defined under Article 172 of the Revised Penal Code (Falsification
by private individuals and use of falsified documents) in the complaint filed by RAUL
CITY OF PAMPANGA
Statement of Facts
That sometime in August 2016, the mother of the complainant, RAUL CITY OF
PAMPANGA, received a summon from the Office of the City Prosecutor of Naga City
regarding a case filed by a certain Staying Mabounce against the above-named
respondent, RAUL CITY OF PAMPANGA.
That in the complaint affidavit of Staying Mabounce, he stated:
That sometime in February 2016, respondents went to my office in
Naga City and introduced to me by the name of Raul City of Pampanga
That respondent told me that he is helping Raul City of Pampanga
to sell his property in Pineapple Homes Subdivision in Pakupsitan
Compound, Naga City and more particularly described under TCT No.
069-69696969 of the registry of deeds of Naga City.
That after a series of negotiation respondents were able to
convinced me to buy the property at the price of P 500,000.00.
That respondent Adonis Bigueja Zumba King, as well as two other persons knew
for a fact that they were using a falsified/false I.Ds in introducing Raul City of
Pampanga to Staying Mabounce.
That Raul City of Pampanga was totally surprised of the fact that respondents
were able to falsify their owners copy of Transfer Certificate of Tile No. 0862014002323 and offer the same for sale.
That Raul City of Pampanga is the true owner of the land described under the
Transfer Certificate of Title No. 069-69696969 and all improvements found thereon.
And the owners copy is under their possession.
That the acts committed by respondent Adonis Bigueja Zumba King of falsifying
his owners copy of TCT No. 069-69696969 and in knowingly using a falsified IDs

caused great damage to the Raul City of Pampanga and dragged him into a situation
where they have no participation.
The respondent did not file his answers against the accusations against him by
the complainant.
Analyses/ Findings and Recommendation
Article 172 of the Revised Penal Code provides that:
Falsification by private individual and use of falsified documents. - The
penalty of prision correccional in its medium and maximum periods and a fine of not
more than P5,000 pesos shall be imposed upon:
1. Any private individual who shall commit any of the falsifications enumerated in
the next preceding article in any public or official document or letter of exchange
or any other kind of commercial document; and
2. Any person who, to the damage of a third party, or with the intent to cause
such damage, shall in any private document commit any of the acts of
falsification enumerated in the next preceding article.
Any person who shall knowingly introduce in evidence in any judicial proceeding or to
the damage of another or who, with the intent to cause such damage, shall use any of the
false documents embraced in the next preceding article, or in any of the foregoing
subdivisions of this article, shall be punished by the penalty next lower in degree.
The fact of the case before us squarely falls on the crime of Falsification as
defined in Article 172 (2) of the Revised Penal Code. The intent, misrepresentation and
falsification of the TCT No. 086-2014002323 made by the respondents Nuez and
Bermido caused great damage to the Sps. Bulahan and dragged them to a situation
where they have no participation
On the part of the Respondent Adonis Bigueja Zumba King, he refused and failed
to answer the accusation of the complainant.
WHEREFORE, IN VIEW OF TE FOREGOING, it is most respectfully
recommended that an information for the crime of FALSIFICATION UNDER ARTICLE
172 OF THE REVISED PENAL CODE be filed against the respondents Adonis Bigueja
Zumba King
