"board"meanstheBoardofExaminersoftheassociation
"certificateholder"meansthecorporation,partnershiporotherlegalentity
thatholdsavalidcertificateofauthorization
"certificateofauthorization"meanstheauthorizationgivenundertheseal
oftheassociationthatpermitscorporations,partnershipsorotherlegal
entitiestopractiseprofessionalengineeringorprofessionalgeoscience
throughemployeeswhoaremembersorlicensees

"licensee"meansanonresidentengineerorgeoscientistlicensedunderthis
ActortheholderofalimitedlicenceunderthisAct
"limitedlicence"meanstheofficialauthorizationgivenunderthesealofthe
associationthatpermitsapersontopractiseprofessionalengineeringor
professionalgeosciencewithinthescopespecifiedinthelimitedlicence
"member"meansaregisteredmemberoftheassociation
"practiceofprofessionalengineering"meansthecarryingonofchemical,
civil,electrical,forest,geological,mechanical,metallurgical,miningor
structuralengineering,andotherdisciplinesofengineeringthatmaybe
designatedbythecouncilandforwhichuniversityengineeringprogramshave
beenaccreditedbytheCanadianEngineeringAccreditationBoardorbya
bodywhich,intheopinionofthecouncil,isitsequivalent,andincludes
reportingon,designing,ordirectingtheconstructionofanyworksthat
requirefortheirdesign,orthesupervisionoftheirconstruction,orthe
supervisionoftheirmaintenance,suchexperienceandtechnicalknowledge
asarerequiredunderthisActfortheadmissionbyexaminationto
membershipintheassociation,and,withoutlimitation,includesreportingon,
designingordirectingtheconstructionofpublicutilities,industrialworks,
railways,bridges,highways,canals,harbourworks,riverimprovements,
lighthouses,wetdocks,drydocks,floatingdocks,launchways,marineways,
steamengines,turbines,pumps,internalcombustionengines,airshipsand
airplanes,electricalmachineryandapparatus,chemicaloperations,
machinery,andworksforthedevelopment,transmissionorapplicationof
power,lightandheat,grainelevators,municipalworks,irrigationworks,
sewagedisposalworks,drainageworks,incinerators,hydraulicworks,andall
otherengineeringworks,andallbuildingsnecessarytotheproperhousing,
installationandoperationoftheengineeringworksembracedinthis
definition
"practiceofprofessionalgeoscience"meansreporting,advising,
acquiring,processing,evaluating,interpreting,surveying,samplingor
examiningrelatedtoanyactivitythat
(a)isdirectedtowardsthediscoveryordevelopmentofoil,naturalgas,
coal,metallicornonmetallicminerals,preciousstones,othernatural
resourcesorwater,ortheinvestigationofsurfaceorsubsurface
geologicalconditions,and
(b)requirestheprofessionalapplicationoftheprinciplesofgeology,
geophysicsorgeochemistry
"president"meansthepresidentoftheassociation

"professionalengineer"meansapersonwhoisregisteredorlicensedasa
professionalengineerunderthisAct
"professionalgeoscientist"meansapersonwhoisregisteredorlicensed
asaprofessionalgeoscientistunderthisAct
"register"meanstheregisterkeptbytheregistrarunderthisActand
formerlykeptundertheformerAct
"registrar"meanstheregistraroftheassociation
"registration"meansentryintheregisterofthenameoftheperson
admittedtomembershipintheassociation.
(2)Forthepurposesofthedefinitionof"practiceofprofessionalengineering"
insubsection(1),theperformanceasacontractorofworkdesignedbya
professionalengineer,thesupervisionofconstructionofworkasforepersonor
superintendentorasaninspector,orasaroadmaster,trackmaster,bridgeor
buildingmaster,orsuperintendentofmaintenance,isdeemednottobethe
practiceofprofessionalengineeringwithinthemeaningofthisAct.
Exemptions

2(1)NothinginthisActpreventsapersonregisteredasanarchitectunderanyAct
relatingtothepracticeofarchitecturefrompractisingtheprofessionof
architectureorrequireshimorhertoberegisteredunderthisActifhisorher
practiceisconfinedtoarchitecture.
(2)NothinginthisActappliestoaBritishColumbiaorCanadalandsurveyor
practisinghisorherprofession,exceptthatthelandsurveyormustnotstyle
himselforherselforholdhimselforherselfoutasaprofessionalengineerunless
thelandsurveyorisregisteredorlicensedunderthisAct.
(3)ThisActdoesnotapplytoaprofessionalforesterasdefinedintheForesters
Actaslongastheprofessionalforesterdoesnotholdhimselforherselfoutasa
professionalengineerorprofessionalgeoscientist.
(4)ThisActdoesnotapplytoanymemberofHerMajesty'sCanadianforceswhile
actuallyemployedonduty.
(5)ThisActdoesnotaffecttherights,powersorprivilegesofaperson
(a)todoregulatedworkinrelationtoboiler,pressurevesseland
refrigerationsystemsandequipmentundertheSafetyStandardsAct,or
(b)undertheMinesAct.
(6)Subjecttothebylawsmadeundersection10(1)(b.2),nothinginthisActor
thebylawspreventsapersonfromassistingintheperformanceofany
professionalserviceorworkofthekinddescribedinthedefinitionof"practiceof
professionalengineering"insection1(1)ifaprofessionalengineerdirectly
supervisesandassumesfullresponsibilityfortheserviceorwork.

(7)Subjecttothebylawsmadeundersection10(1)(b.2),nothinginthisActor
thebylawspreventsapersonfromassistingintheperformanceofany
professionalserviceorworkofthekinddescribedinthedefinitionof"practiceof
professionalgeoscience"insection1(1)ifaprofessionalgeoscientistdirectly
supervisesandassumesfullresponsibilityfortheserviceorwork.
(8)Workasacontractorofworkdesignedbyaprofessionalengineeror
professionalgeoscientistorasaforeperson,superintendentorinspector
supervisingconstructionorasasuperintendentofmaintenanceisnotdeemedto
bethepracticeofprofessionalengineeringorthepracticeofprofessional
geoscience.
(9)ThisActdoesnotapplytopreventpersonsfromacquiringmineraltitlesor
fromperformingworkonmineraltitlesrequiredundertheMinesActortheMineral
TenureActtomaintainthosetitlesingoodstandingaslongastheydonothold
themselvesoutasprofessionalengineersorprofessionalgeoscientists.
Associationcontinuedasacorporation

3(1)TheAssociationofProfessionalEngineersandGeoscientistsoftheProvinceof
BritishColumbiaiscontinuedasacorporation.
(2)ForthepurposesofthisAct,theassociationhasthepowersandcapacityofa
naturalperson,includingthepowertoacquireanddisposeofpropertyandthe
powertoenterintocontracts.
(3)TheBusinessCorporationsActdoesnotapplytotheassociationunlessthe
LieutenantGovernorinCouncil,byorder,providesthatspecifiedprovisionsofthat
Actapplytotheassociation,inwhichcasethespecifiedprovisionsapply.

Dutiesandobjectsoftheassociation

4.1(1)Itisthedutyoftheassociation
(a)toupholdandprotectthepublicinterestrespectingthepracticeof
professionalengineeringandthepracticeofprofessionalgeoscience,
(b)toexerciseitspowersandfunctions,andperformitsduties,under
thisAct,and
(c)toenforcethisAct.
(2)Theassociationhasthefollowingobjects:
(a)subjecttosubsection(1),toupholdandprotecttheinterestsofits
membersandlicensees
(b)toestablish,maintainandenforcestandardsforthequalifications
andpracticeofitsmembersandlicensees

(c)topromotetheprofessionsofprofessionalengineeringand

Membership

5Themembershipoftheassociationconsistsofallmembersoftheassociation
whowereingoodstandingundertheformerActatthetimeofitsrepealandall
personsadmittedtomembershipbythecouncilunderthisActaslongasthey
remainontheregister.
Presidentandvicepresidents

6(1)Thepresidentmustbeelectedannuallybythemembersoftheassociation
andholdersoflimitedlicences,andholdsofficeuntilasuccessoriselected.
(2)Thepresident,ifpresent,presidesatallmeetingsoftheassociationandthe
councilunlessthepresidentrequeststhemeetingtoappointsomeotherpersonto
preside.
(3)Thepresident,orthepersonappointedinthepresident'splace,votesonly
whenthevotesofthemembersareequallydivided.
(4)Oneormorevicepresidents,oneofwhommustbedesignatedbythecouncil
tohaveallthepowersandrightsofthepresidentduringthepresident'sabsence,
mustbeelectedannuallybythemembersoftheassociationandholdersoflimited
licences.
(5)Avicepresidentmayholdofficeuntilasuccessoriselected.
Registrarandexecutivedirector

7(1)Thecouncilmustappointaregistrar,whomustbeamemberofthe
association.
(2)Thecouncilmustappointanexecutivedirector.
(3)Theofficesofregistrarandexecutivedirectorareheldatthepleasureofthe
councilandmaybeheldbythesameperson.
Functionsofcouncil

8(1)Thepowersconferredontheassociationaretobeexercisedbythecouncil.
(2)SubjecttothisActandthebylawsoftheassociation,thecouncil
(a)mustgovern,controlandadministertheaffairsoftheassociation,
(b)mustexerciseallrightsandpowersvestedinitunderthisAct,and
(c)maypassresolutionsnecessaryforthepurposesofparagraphs(a)
and(b).

9(1)Thecouncilconsistsofthepresident,allvicepresidents,theimmediatepast
presidentandcouncillorsappointedundersubsection(4)or(7)orelectedunder
subsection(6).
(2)Despitesubsections(4),(6)and(7),acouncillorwhosetermofofficehas
expiredmaycontinuetoholdofficeuntilasuccessorisappointedorelected.
(3)Thecouncilincludes
(a)4councillorsappointedundersubsection(4),
(b)afurthernumber,setbybylawoftheassociationandbeingatleast
8,ofcouncillorselectedbythemembersandholdersoflimitedlicences
undersubsection(6),and
(c)thecouncillors,ifany,appointedundersubsection(7).
(4)TheLieutenantGovernorinCouncilmustappoint4councillorswhoarenot
membersoftheassociationand,subjecttosubsection(8),eachservesfora2

beelectedbythemembersandholdersoflimitedlicences,
(b)intheeventofatievote,thewinneristhecandidatewithgreater
seniorityasamemberorholderofalimitedlicence,and
(c)eachcouncillorelectedbythemembersandholdersoflimited
licencesmust,subjecttosubsection(8),servefora2yearterm.
(7)IfnomemberofaFacultyofAppliedScience,EngineeringorGeosciencein
BritishColumbiaornoprofessionalgeoscientistiselectedundersubsection(6)or
section6(1)or(4),thecouncilmustappointamemberofaFacultyofApplied
Science,EngineeringorGeoscienceinBritishColumbiaoraprofessional
geoscientisttothecouncilforaoneyearterm.
(8)Ifamemberofthecouncildies,resignsorisincapableofacting,
(a)theothermembersofthecouncilmustappointamemberofthe
associationorholderofalimitedlicencetofillthevacancyifthe
councillorisanelectedmember,and
(b)thevacancymustbefilledbyappointmentmadebytheLieutenant
GovernorinCouncilifthecouncillorisagovernmentappointee.

(t)allotherpurposesreasonablynecessaryforthemanagement,
regulationandwellbeingoftheassociation.
(1.1)Forthepurposesofbylawsundersubsection(1)(e),(e.1)or(e.2),the
council,bybylaw,may
(a)establishclassesofmembers,licenseesorcertificateholders,
(b)specifydifferentcategoriesofprofessionalliabilityinsurance,and
(c)requirethatdifferentclassesofmembers,licenseesorcertificate
holdersholddifferentcategoriesofprofessionalliabilityinsurance.
(1.2)Thecouncilmaymakebylawsundersubsection(1)establishingstandardsof
practice,acodeofconductoraqualitymanagementprogramthathavebeen
developedinconcertwiththegoverningbodyofanotherprofession.
(2)Abylawdoesnotcomeintoforceuntil
(a)therequirementsofsection11havebeenmet,and
(b)the45dayperiodsetbysection11(3)ends.
Ratificationofbylaws

11(1)Abylawdoesnotcomeintoforceunlessratifiedbyatleast2/3ofthevotes
castbyballottakenundersection12(7).

(2)Theexecutivedirectormustfilewiththeministeracopyofeachbylaw,
certifiedunderthesealoftheassociation,within14daysafterratification.
(3)AbylawmaybedisallowedbytheLieutenantGovernorinCouncilwithin45
daysafterthefilingofitundersubsection(2).
Meetingsofassociation

12(1)Anannualmeetingoftheassociationmustbeheld,atthetimeandplace
appointedbythecouncil,atleastonceineverycalendaryearandnotmorethan
15monthsaftertheprecedingannualmeeting.
(2)Ifanyannualmeetingisnotheldasrequiredundersubsection(1),the
SupremeCourt,ontheapplicationofamemberoftheassociationorholderofa
limitedlicence,maycallordirectthecallingofanannualmeeting.
(3)Thecouncil,atanytimeofitsownmotion,maycallageneralmeetingofthe
association.
(4)Thecouncil,onthewrittenrequestof25membersoftheassociationor
holdersoflimitedlicencesorof5councilmembers,mustcallageneralmeetingof
theassociation.
(5)Ameetingcalledundersubsection(4)mustbeheldwithin6weeksafter
receiptoftherequestbytheexecutivedirector.
(6)Twentyonedays'writtennoticeofthetimeandplaceofanymeetingofthe
associationmustbesentbyprepaidposttoeverymemberoftheassociationin
goodstandingandtoeveryholderofalimitedlicenceingoodstandingatthe
member'sorholder's,asthecasemaybe,lastrecordedaddress.
(7)Thecouncilmay,andonwrittenrequestof25membersoftheassociationor
holdersoflimitedlicencesmust,takeavoteofthemembersoftheassociation
andtheholdersoflimitedlicencesbyballotinthemannerdeterminedbythe
councilonanymatterthat,underthisAct,canbevotedonatageneralmeeting
oftheassociation.
(8)Avotetakenundersubsection(7)hasthesameforceasifthevotehadbeen
takenatageneralmeetingoftheassociation.
Admissiontomembership

13(1)Thecouncilmustadmitapersontomembershipintheassociationif
(a)bothofthefollowingapply:
(i)thepersonisaCanadiancitizenorapermanentresidentof
Canada
(ii)thepersonhassubmittedtothecounciltheevidencereferred
toinsubsection(1.1),or
(b)thepersonisapersonwhomthecouncilisobligedundertheLabour
MobilityActtoadmittomembershipintheassociation.

(1.1)Anapplicantundersubsection(1)(a)mustsubmittothecouncilevidence
satisfactorytothecouncilofthefollowing:
(a)thattheapplicanthaseither
(i)graduatedinappliedscience,engineeringorgeosciencefrom
aninstituteoflearningapprovedbythecouncilinaprogram
approvedbythecouncil,or
(ii)passedexaminationsestablishedbythebylawsofthe
associationorpassedexaminations,requiringspecialknowledge
inbranchesoflearningspecifiedbythecouncil,ofanassociation
orinstituteapprovedbythecouncil
(b)thattheapplicanthaspassedspecialexaminationsrequiredbythe
council
(c)thattheexperienceinengineeringorgeoscienceworkestablished
bythebylawshasbeenobtained
(d)thattheapplicantisofgoodcharacterandgoodrepute
(e)thatallexaminationandregistrationfeeshavebeenpaidtothe
association.
(2)Despitesubsection(1)or(5),thecouncilmayrefuseregistrationoralicence
toapersonif
(a)thecouncilhasreasonableandprobablegroundstobelievethatthe
personhasbeenconvictedinCanadaorelsewhereofanoffencethat,if
committedinBritishColumbia,wouldbeanoffenceunderanenactment
oftheProvinceorofCanada,andthatthenatureorcircumstancesof
theoffencerenderthepersonunsuitableforregistrationorlicensing,or
(b)thepersonhascontravenedthisActorthebylaws.
(3)Apersonreferredtoinsubsection(1)(a)whodesirestobecomeamember
mustcomplywiththebylawsrelatingtoapplicationformembership,and,if
requiredtoqualifybyexamination,mustcomplywithsection16(4)and(5).
(4)ApersonwhoisneitheracitizenorpermanentresidentofCanadanora
personreferredtoinsubsection(1)(b),whosequalificationsarethoserequired
bysubsection(1.1)(a)to(d),andwhodesirestoengagetemporarilyinthe
practiceofprofessionalengineeringorprofessionalgeoscienceintheProvince,
mustfirstobtainalicencefromthecouncilwhichwillentitlehimorhertoengage
inthepracticeofprofessionalengineeringorprofessionalgeoscienceinrespectof
aparticularworkorforatemporaryperiod,orboth,asthecouncildecides.
(5)Apersontowhomsubsection(4)appliesmustbegrantedthelicencereferred
tointhatsubsectionon
(a)producingevidencesatisfactorytothecouncilofhisorher
qualificationsundersubsection(4),and
(b)payingtheestablishedfees.

(6)Neithercorporationsnorpartnershipsassuchmaybecomemembersofthe
association.
(7)Ifprofessionalengineersorprofessionalgeoscientistsareemployedby
corporationsoraremembersofpartnerships,theyindividuallymustassumethe
functionsofandmustbeheldresponsibleasprofessionalengineersor
professionalgeoscientists.
(8)Thecouncilmay,inwriting,delegatesomeorallofitspowersandduties
underthissectiontotheregistrar,onthetermsorconditionsthecouncilconsiders
advisable.
Issueofcertificatesofauthorization

14(1)Thecouncilmustissueacertificateofauthorizationtoacorporation,
partnershiporotherlegalentityforthepracticeofprofessionalengineeringorfor
thepracticeofprofessionalgeoscienceifthecouncilissatisfiedthatthe
corporation,partnershiporotherlegalentity
(a)hasonitsactivestaffmembersorlicenseeswhodirectlysupervise
andassumeresponsibilityforthepracticeofprofessionalengineeringor
forthepracticeofprofessionalgeoscienceundertakenbythe
corporation,partnershiporotherlegalentity,and
(b)hassatisfiedtherequirementsofthissectionandthebylawsofthe
association.
(2)Anapplicationforacertificateofauthorization,onaformprovidedbythe
council,mustbefiledwiththeregistrar,togetherwiththeapplicationfeespecified
bythecouncil,and,toremainvalid,thecertificateholdermustpayallfees
specifiedbythecouncilforcertificateholders.
(3)Ifthepracticeofprofessionalengineeringorthepracticeofprofessional
geoscienceiscarriedonbyacertificateholderaspermittedundersubsection(1),
theestimates,specifications,reports,documentsorplanspreparedanddelivered
must
(a)besignedanddatedby,andsealedwiththestampof,themember
orlicenseeoftheassociationwhoisresponsibleforthemandwho
supervisedthepreparationofthem,and
(b)showinamannerspecifiedbythecouncilthewords"APEGBC
CERTIFICATEOFAUTHORIZATION",togetherwiththecertificatenumber
andexpirydate.
(4)Acertificateholderengagedinthepracticeofprofessionalengineeringorin
thepracticeofprofessionalgeoscienceinitsownnameaspermittedunder
subsection(1)mustkeeptheassociationadvisedofthenamesofthemembersor
licenseesoftheassociationwhoareontheactivestaffofthecertificateholder
andwhoaredirectlysupervisingandassumingresponsibilityforthepracticeof
professionalengineeringorforthepracticeofprofessionalgeoscience.

(5)Themembersorlicenseesnamedforthepurposesofsubsection(4)bya
certificateholder
(a)aretheauthorizedrepresentativesofthecertificateholderforall
purposesunderthisAct,
(b)aresubjecttoanyinquiriesundertheAct,and
(c)mustimmediatelyadvisetheregistraronrelinquishingforany
reasonthisresponsibilityforthecertificateholder.
(6)Acertificateofauthorizationissuedtoacorporation,partnershiporotherlegal
entityisvalidforthecalendaryearforwhichitwasissuedprovidedthecertificate
holdercomplieswiththisActandthebylawsgoverningcertificateholders.
(7)Acorporation,partnershiporotherlegalentitythatholdsacertificateof
authorizationmustberegisteredbytheregistrarasacertificateholderbutnotas
amemberorlicensee.
(8)Despitesubsection(1),thecouncilmayrefusetoissueorrenewacertificate
ofauthorizationiftheapplicantforthecertificateofauthorizationorthecertificate
holder,asthecasemaybe,oramemberorlicenseedescribedinsubsection(1)
(a),
(a)hasbeenconvictedinCanadaorelsewhereofanoffencethat,if
committedinBritishColumbia,wouldbeanoffenceunderanenactment
oftheProvinceorofCanadaand,inthecircumstances,rendersthe
personunsuitableforthepracticeofprofessionalengineeringorforthe
practiceofprofessionalgeoscience,
(b)hascontravenedthisAct,thebylawsorthecodeofethicsofthe
association,or
(c)hasdemonstratedincompetence,negligenceorunprofessional
conduct.

14.1(1)Inthissection,"governingbody"meansthegoverningbodyofprofessional
engineeringorprofessionalgeoscienceinanotherprovinceofCanada.

bodytopermitanengineerorageoscientistwhoisqualifiedintheprovinceofthe

14.2(1)Inthissection,"governingbody"meansthegoverningbodyofprofessional
engineeringorprofessionalgeoscience,oraprofessionconsideredbythecouncil
tobeequivalenttooneorbothofthose,inajurisdictionthatisoutsideof
Canada.
(2)Despitesection13,thecouncilmayenterintoanagreementwithagoverning
bodytopermitanengineerorageoscientistwhoisqualifiedinthatjurisdictionto
practiseprofessionalengineeringorprofessionalgeoscience,asthecasemaybe,
inBritishColumbia.
(3)Anagreementreferredtoinsubsection(2)mayspecifyqualificationsthatare
consideredbythecounciltobeequivalenttothoserequiredunderthisActfor

Boardofexaminers

15(1)Thecouncilmust
(a)appointaboardofexaminersannually,and
(b)fillvacanciesintheboardastheyoccur.
(2)Theboardmustexamineallcandidatesforadmissiontomembershipwhenan
examinationisrequiredunderthisAct.
Examinations

16(1)RegularexaminationsofcandidatesforadmissionmustbeheldinBritish
Columbiaatleastonceineachyearatplacesandtimesdecidedbythecouncil.
(2)Specialexaminations,atthediscretionofcouncil,maybeheldifthecandidate
orcandidatesforthemdepositinadvancewiththeregistrarbothasumsufficient
todefraytheexpensesofthespecialexaminationsandtheappropriate
examinationfeesestablishedunderthebylaws.
(3)Thecouncilmustestablishthescopeofandprocedureatexaminations.
(4)Acandidateforexaminationmustgiveatleast2months'noticeinwritingto
theregistrarofthecandidate'sintentiontotaketheexamination,andwiththe
noticemustpaythefeesestablishedunderthebylawsforthegradeof
examinationtobetaken.
(5)Ifthecandidatepassesthefinalexamination,heorshemustpaythe
remainderoftheadmissionfeesestablishedunderthebylawsbeforereceivinga
certificateofregistration.

(6)Assoonaspossible,andnotlaterthan21daysafterthecloseofeach
examination,themembersoftheboardwhohaveconductedtheexamination
mustmakeandfilewiththeregistraracertificateshowingtheresultsofthe
examination.
(7)Onthefilingofacertificateundersubsection(6),thecouncilmustnotifythe
candidateoftheresultoftheexaminationandofitsdecisiononthecandidate's
application.
(8)Theboardmustfilewiththeregistrartheexaminationpaperssubmittedtothe
candidates,togetherwiththeanswersofeachcandidate,andmustattachto
themacertifiedcopyofitsreportwiththemarksawardedtoeachcandidatein
eachsubjectoftheexamination.
(9)Thedocumentsreferredtoinsubsection(8)mustremainonfileintheoffice
oftheregistrar,andareopentoinspectionbyanycandidate,orbyanyperson
authorizedinwritingbythecandidate,duringregularofficehoursforaperiodofat
least6monthsfollowingtheexamination.
(10)Ifthecandidatefailsanexamination,thecandidatemay,onpaymentofthe
establishedfee,takeanysubsequentregularexamination.
(11)Ifacandidatehasfailedanexamination3times,heorshemayonlytakethe
examinationagainwiththepermissionofthecouncil.
Investigationofcertificates

17(1)Thecouncilmustcausetheexaminationofalldegrees,diplomas,certificates
andothercredentialspresentedorgiveninevidenceforthepurposeofobtaining
registration.
(2)Thecouncilmayrequiretheholderofcredentialsreferredtoinsubsection(1)
toattest,byoathoraffidavit,anymatterinvolvedinhisorherapplication.
Centralexaminingboard

18(1)Thecouncilmay
(a)establishjointlywiththecouncilofanyotherassociationsimilarly
constituted,inoneormoreoftheotherprovinces,acentralexamining
board,and
(b)delegatetothecentralexaminingboardalloranyofthepowers
possessedbytheboardrespectingtheexaminationsofcandidates.
(2)Anyexaminationconductedbythecentralexaminingboardmustbeheldinat
leastoneplaceinBritishColumbiaifsorequestedbythecouncil.

(b)assume,verballyorotherwise,thetitleofprofessionalengineeror
professionalgeoscientist
(c)advertiseoruse,orpermittobeadvertisedorused,inanymanner
whatsoever,inconnectionwiththenameoftheindividual,corporation,
partnershiporotherlegalentity,orotherwise,
(i)thetitleofprofessionalengineerorprofessionalgeoscientist,
(ii)anyword,name,titleordesignationmentionedinthe
definitionof"practiceofprofessionalengineering"or"practiceof
professionalgeoscience",oranycombinationorabbreviationof

(iii)anyotherword,name,title,designation,descriptivetermor

entityreadyorentitledtoengageinthepracticeofprofessional
engineeringorprofessionalgeoscienceorholdingouttheindividual,
corporation,partnershiporotherlegalentitytobeaprofessional
engineer,professionalgeoscientistorcertificateholder.
(2)Subsection(1)doesnotapply
(a)toanindividualwhoisamemberoftheassociationorholdsa
licence,otherthanalimitedlicence,issuedbytheassociation,or
(b)toacorporation,partnershiporotherlegalentitythathasonits
activestaffmembersorlicenseeswhodirectlysuperviseandassume
responsibilityasthisActprovidesforthepracticeofprofessional
engineeringorprofessionalgeoscienceundertakenbythecorporation,
partnershiporotherlegalentity.
(3)Anindividualwhoholdsalimitedlicencemustnotengageinthepracticeof
professionalengineeringorprofessionalgeoscienceexceptinamannerconsistent
withthescopeofthelimitedlicenceandaccordingtotheprovisionsofthatlimited
licence.
Injunction

23(1)Ifthereisabreachorthreatenedbreachbyanypersonorcorporation,
partnershiporotherlegalentityofanyprovisionofthisAct,theassociationis
entitled,inanactionbroughtforthatpurpose,toaninjunctiontorestrainthe
personorcorporation,partnershiporotherlegalentityfromcontinuingor
committingthebreach.
(2)Untilthetrialoftheactionandadjudicationonit,thecourt,onbeingsatisfied
thatthereisreasontobelievethatthepersonorcorporation,partnershiporother
legalentityhascommittedorislikelytocommitabreachofthisAct,mustgrant
aninteriminjunction.

24(1)ExceptasprovidedinthisAct,apersonisnotentitledtorecoveranyfeeor

practicerevieworconductreviewcommitteetowhichacomplaintisreferred
undersubsection(1)considersthatfurtherinvestigationiswarranted,the
memberorthecommittee,asthecasemaybe,mustsubmitareporttothe
investigationcommitteerecommendingfurtherinvestigationandstatingthe
reasonsfortherecommendation.
(3)Ifaninquiryundersection32isnotheldinresponsetoacomplaint,the
councilmusthavethecomplainant,andthemember,licenseeorcertificateholder
againstwhomthecomplaintwasmade,informedofthereasons.

30(1)Thecouncilmustappointaninvestigationcommitteeofatleast5persons,of
whomonemaybeanonmemberoftheassociation,toholdofficeforaterm
determinedbythecouncil.

(b)answer,withinareasonabletimeandinthemannerspecifiedbythe
committeeorsubcommittee,anyinquiriesofthecommitteeor
subcommittee,and
(c)appear,onrequest,beforethecommitteeorsubcommittee.
(5)Amember,licenseeorcertificateholdermustnotrefusetocomplywiththis
sectiononthegroundsofconfidentiality.

(a)makerecommendationstothemember,licenseeorcertificate
holderthatwasinvestigated
(i)followinganinvestigationundersubsection(3),or
(ii)onreceiptofareportundersubsection(6),or
(b)referthematterforreviewtothepracticerevieworconductreview
committeeestablishedunderthebylawsrecommendingapractice
revieworconductreviewandstatingthereasonsforthe
recommendation.
(7.1)Onconclusionofareview,thepracticerevieworconductreviewcommittee
may,asitconsidersappropriate,
(a)makerecommendationstothemember,licenseeorcertificate
holderthatwasthesubjectofthereview,and
(b)prepareareportofitsfindingsandrecommendationsforthe
registrar,investigationcommitteeorsubcommittee,asthecasemay
be.
(8)Theinvestigationcommitteeorsubcommitteemayinformthecomplainant,if
any,oftherecommendationsmadeundersubsection(7)(a)or(7.1)(a).
(9)Subjecttosubsection(10),iftheinvestigationcommitteehasreasonableand
probablegroundstobelievethatamember,licenseeorcertificateholder
(a)hasbeenconvictedinCanadaorelsewhereofanoffencethat,if
committedinBritishColumbia,wouldbeanoffenceunderanenactment
oftheProvinceorofCanada,andthatthenatureorcircumstancesof

licencehasbeenrefusedundersection13(1)(d)or13(2),mayappealfromthe
orderorrefusaloftheapplicationtotheSupremeCourtwithin42daysfromthe
dateofthatorderorrefusal.
(2)Acorporation,partnershiporotherlegalentity,otherthananindividual,
aggrievedbyanorderofthedisciplinecommitteeundersection33(2),orwhose

45OnapplicationbythecounciltotheSupremeCourt,theSupremeCourtmay
orderthatapersonproduceanyrecordorthingtoanofficer,committeeor
subcommitteeoftheassociation,ortoapersondesignatedbythecouncil,ifthe
courtissatisfiedthatitisrelevanttoandreasonablyrequiredbytheofficer,
committeeorsubcommitteefor
(a)aninvestigationoftheconductofacurrentmember,licenseeor
certificateholder,or
(b)areviewoftheprofessionalpracticeofacurrentmember,licensee
orcertificateholder.
Confidentiality

46(1)ApersonactingunderthisActmustkeepconfidentialallfacts,information
andrecordsobtainedorprovidedunderthisActorunderaformerenactment,
exceptsofaraspublicdutyrequiresorthisActorthebylawspermitthepersonto
makedisclosureofthemortoreportortakeofficialactiononthem.
(2)ExceptinaproceedingunderthisAct,apersontowhomsubsection(1)
appliesmustnotinanycivilproceedingbecompelledtogiveevidencerespecting
anyfacts,informationorrecordsobtainedinthecourseoftheperson'sduties.
