ARTICLE 14 - EQUALITY BEFORE LAW
The purpose of this research is to identify the general principle of right to equality the word
Right to equality need no explanation because it tell its meaning itself. And it is one the
fundamental right. But there are some hidden points which are needed to explain & this research
project highlights those points & exception, which are admissible by our Indian constitution. It
also helps to know why discrimination accepted under constitution law of India. Right to
equality given under article 14 of Indian law. It is one of the fundamental right. It ensure the
guarantees to every person the right to equality before law & equal protection of the laws .It is
not only right of Indian citizens but also right of noncitizens.
1.1 Equality before law
The state shall not deny to any person equality before the law.
1.2 Meaning of right to equality
This means that every person, who lives within territory of India, has the equal right before
the law. The meaning of this all are equal in same line. No discrimination based on religion,
race, caste, sex, and place of birth. Its mean that all will be treated as equality among equal
and there will be no discrimination based on lower or higher class.
Wherever, therefore, there is arbitrariness in State action whether it be the legislature or of the
executive or of an "authority" under Article 14 immediately springs into action and strikes down
such State action. In fact the concept of reasonableness and non-arbitrariness pervades the entire
constitutional scheme and is a golden thread which runs through the whole of the fabric of the
Constitution.
OBJECTIVES/AIMS OF THE STUDY
The primary objective of the study is to explain clearly the provisions which are provided under
Article 14 to protect the right to equality of people.
SIGNIFICANCE & BENEFIT OF THE STUDY
This study helps to know the rights guaranteed under the Article14.

The problem thats visible to naked eye is the proliferation of various personal laws, which are
exploited by the heads of these local bodies. There had been several occasions when panchayats
have pronounced judgments that are unconstitutional. Instances such as honour killings and
female foeticide are country-wide phenomena which not only damage the concept of equal
protection of laws but also perpetrate human rights violations.
The importance of Article 14 seems to have eroded gradually with the emergence of an alternate
judicial system with a medieval mindset. The only silver lining is the fact that the Indian
judiciary has consistently disapproved of these extra-constitutional entities and their
pronouncements.
Article 14 of the constitution guarantee the right to equality to every citizen of India . It
embodies the general principles of equality before law and prohibits unreasonable discrimination
between persons. Article 14 embodies the idea of equality expressed in preamble.
ARTICLE 14- EQUALITY BEFORE LAW
Article 14 declares that the State shall not deny to any person equality before the law or equal
protection of law within the territory of India.. thus article 14 uses the two expressions equality
before law and equal protection of law. The phrase equality before law find a place in
almost in written constitution that guarantees fundamental right both these expression .both this
expression aim at establishing what is called equality of status While both the expression are
kind of identical but they dont give similar meaning.
EQUALITY BEFORE LAW
Its origin is from America. And somehow it is negative concept. It aims at implying the absence
of any special privilege by reason of birth, sex, religion etc in favour of individuals and the equal
subject of all the classes to the ordinary law
The above Rule of equality is however not an absolute rule and there are number exception to it
Equality of Law does not mean the power of the private citizens are the same as the power of
the public officials. Thus a police officer has the power to arrest you while no other private
person has this power. This is not violation of rule of law. But rule of law does require that these
powers should be clearly defined by law and that abuse of authority by public officers must be
punished by ordinary courts.
The rule of law does not prevent certain class of persons being subject to special rules. Thus
members of armed forces are controlled by military rules. Similarly medical practitioners are
controlled by medical council of India
Certain members of society are governed by special rules in their profession i.e. lawyers, doctors,
nurses, members of armed forces and police. Such classes of people are treated differently from
ordinary citizens.
ARTICLE 14 PERMITS CLASSIFICATION BUT PROHIBITS CLASS LEGISLATION
The equal protection of laws guaranteed by Article 14 does not mean that all laws must be
general in character. It does not mean that the same laws should apply to all persons. It does not
attainment or circumstances in the same position. The varying needs of different classes of
persons often require separate treatment. From the very nature of society there should be
different laws in different places and the legitimate controls the policy and enacts laws in the best
interest of the safety and security of the state. In fact identical treatment in unequal
circumstances would amount to inequality. So a reasonable classification is only not permitted
but is necessary if society is to progress.
Thus what Article 14 forbids is class-legislation but it does not forbid reasonable classification.
The classification however must not be arbitrary, artificial or evasive but must be based on
some real and substantial bearing a just and reasonable relation to the object sought to be
achieved by the legislation. Article 14 applies where equals are treated differently without any
reasonable basis. But where equals and unequals are treated differently, Article 14 does not
apply. Class legislation is that which makes an improper discrimination by conferring particular
privileges upon a class of persons arbitrarily selected from a large number of persons all of
whom stand in the same relation to the privilege granted that between whom and the persons not
so favoured no reasonable distinction or substantial difference can be found justifying the
inclusion of one and the exclusion of the other from such privilege.
TEST OF REASONABLE CLASSIFICATION
While Article 14 forbids class legislation it does not forbid reasonable classification of persons,
objects, and transactions by the legislature for the purpose of achieving specific ends. But
classification must not be arbitrary, artificial or evasive. It must always rest upon some real
upon some real and substantial distinction bearing a just and reasonable relation to the object
sought to be achieved by the legislation. Classification to be reasonable must fulfil the following
two conditions
Firstly the classification must be founded on the intelligible differentia which distinguishes
persons or thing that are grouped together from others left out of the group
Secondly the differentia must have a rational relation to the object sought to be achieved by the
act.
The differentia which is the basis of the classification and the object of the act are two distinct
things. What is necessary is that there must be nexus between the basis of classification and the
object of the act which makes the classification. It is only when there is no reasonable basis for a
classification that legislation making such classification may be declared discriminatory. Thus
the legislature may fix the age at which persons shall be deemed competent to contract between
themselves but no one will claim that competency. No contract can be made to depend upon the
stature or colour of the hair. Such a classification will be arbitrary.
The true meaning and scope of Article 14 have been explained in a number of cases by the
Supreme Court. In view of this the propositions laid down in "Dalmia's case" still hold good
governing a valid classification and are as follows.
1. A law may be constitutional even though it relates to a single individual if on account of some
special circumstances or reasons applicable to him and not applicable to others, that single
individual may be treated as a class by itself
2. There is always presumption in favour of the constitutionality of a statute and the burden is
upon him who attacks it to show that there has been a clear transgression of constitutional
principles.
3. The presumption may be rebutted in certain cases by showing that on the fact of the statue,
there is no classification and no difference peculiar to any individual or class and not applicable
to any other individual or class, and yet the law hits only a particular individual or class
4. It must be assumed that Legislature correctly understand and appreciates the need of its own
people that its law are directed to problem made manifest by experience and that its
discrimination are based on adequate grounds
5. In order to sustain the presumption of constitutionality the court may take into consideration
maters of common knowledge, matters of report, and the history of the times and may assume
every state of facts which can be conceived existing at the time of the legislation.
6. Thus the legislation is free to recognize degrees of harm and may confine its restriction to
those cases where the need is deemed to be the clearest.
7. While good faith and knowledge of the existing conditions on the part of a legislature are to be
presumed, if there is nothing on the face of the law or the surrounding circumstances brought to
the notice of the court on which the classification may reasonable be regarded as based, the
presumption of constitutionality cannot be carried to extent always that there must be some
undisclosed and unknown reason for subjecting certain individuals or corporation to be hostile
or discriminating legislation
8. The classification may be made on different bases e.g. geographical or according to object or
occupation or the like.
9. The classification made by the legislature need not be scientifically perfect or logically
complete. Mathematical nicety and perfect equality are not required.
Equality before the law does not require mathematical equality of all persons in all
circumstances. Equal treatment does not mean identical treatment. Similarly not identity of
treatment is enough.
10. There can be discrimination both in the substantive as well as the procedural law. Article 14
applies to both.
If the classification satisfies the test laid down in the above propositions, the law will be declared
constitutional. The question whether a classification is reasonable and proper and not must
however, be judged more on commonsense than on legal subtitles.
PRINCIPLES OF NATURAL JUSTICE:
The Principles of Natural Justice have come out from the need of man to protect himself from
the excesses of organized power man has always appealed to someone beyond his own creation.
Such someone is the God and His laws, divine law or natural law, to which all temporal laws and
actions must confirm.
Two core points in the concept of principles of natural justice
1. Nemo in propria causa judex, esse debet - No one should be made a judge in his own
case, or the rule against bias.
2. Audi Alteram partem - Hear the other party, or the rule of fair hearing, or the rule that no
one should be condemned unheard.
These two are the basic pillars of the Principles of Natural Justice. No system of law can survive
without these two basic pillars.
The concepts of social and economic justice that can be seen in the Preamble of the Constitution
are based on the principles of natural justice. Article 311 incorporates many of the features of the
natural justice without explicitly mentioning it. Violation of natural justice is equal to violation of
Equality of the Article 14.
LEGITIMATE EXPECTATION:
Expecting that or anticipating that it would be continued in future also because of the past
transactions, actions, conduct.
EXCEPTION: If the public interest is dominant factor.
The Doctrine of "Legitimate Expectation" is not a legal right in itself embedded in some statute
of Code readily available for its inference and applicability. However it is a right to be treated
fairly and the same has been fashioned by judicial precedents of various courts over a period
time and is still in its evolving stage.
Explaining the nature and scope of the doctrine of legitimate expectation, in Food Corporation
of India vs. M/s Kamdhenu Cattle Feed Industries, a three-Judge Bench of this Court had
observed thus:
"The mere reasonable or legitimate expectation of a citizen, in such a situation, may not by itself
be a distinct enforceable right, but failure to consider and give due weight to it may render the
decision arbitrary, and this is how the requirement of due consideration of a legitimate
expectation forms part of the principle of non-arbitrariness, a necessary concomitant of the rule
of law. Every legitimate expectation is a relevant factor requiring due consideration in a fair
decision-making process. Whether the expectation of the claimant is reasonable or legitimate in
the context is a question of fact in each case. Whenever the question arises, it is to be determined
not according to the claimant's perception but in larger public interest wherein other more
important considerations may outweigh what would otherwise have been the legitimate
expectation of the claimant. A bona fide decision of the public authority reached in this manner
would satisfy the requirement of non arbitrariness and withstand judicial scrutiny. The doctrine
of legitimate expectation gets assimilated in the rule of law and operates in our legal system in
this manner and to this extent."
"The doctrine of "legitimate expectation" has its genesis in the field of administrative law. The
Government and its departments, in administering the affairs of the country, are expected to
honour their statements of policy or intention and treat the citizens with full personal
consideration without any iota of abuse of discretion. The policy statements cannot be
disregarded unfairly or applied selectively. Unfairness in the form of unreasonableness is akin to
violation of natural justice. It was in this context that the doctrine of "legitimate expectation" was
evolved which today has become a source of substantive as well as procedural rights. But claims
based on "legitimate expectation" have been held to require reliance on representations and
resulting detriment to the claimant in the same way as claims based on promissory estoppel."
ANY PERSON UNDER ARTICLE 14
Citizens, non citizens, companies, corporations, natural persons and juristic personalities can
claim under Article 14.
National Legal Service Authority v. union of India
The SC held that Article 14 doesn't restrict the world person and its application only to male or
female and Hizras or transgender person who is neither male nor female fall within the expressed
person. They are entitled for legal protection of laws in all spheres of state activity including
employment, health care, and education. The expression sex is not limited to biological sex of
male or female but intended to include people who consider themselves to be neither male or
female.
Declarations made by SC
1. Hizras or transgender apart from binary gender be treated as 3rd gender for the purpose
of safeguarding their rights under Part III of our constitution and the laws made by the
parliament and state legislatures.
2. Trans gender person's right to decide their self identified gender is also upheld and the
centre state government's are directed to grant legal recognisition as identity such as
male, female, and 3rd gender.
3. The centre and state governments to take steps to treat them as socially and
educationally backward classes of citizens and extends all kinds of reservations in the
case of educational institutions admissions and for public appointments.
4. The central or state governments have to address the problems being faced by 3rd
gender such as fear, shame, social pressure, depression, suicidal tendencies and social
stigma, etc.
5. The centre and state governments should also take necessary steps for various social
welfare schemes for their betterment.
CASES
SC held that Rule of Law requires "that no person shall be subjected to harsh or uncivilized or
discriminatory treatment even then the object is the securing par amount exigencies of law and
order."
Justice Khanna said that, "it was held that Rule of Law is the antithesis of arbitrariness. Rule of
Law is now the accepted norm of all civilized societies."
This is the case related to violation of principles of natural justice. SC held that, under our
constitution the Rule of Law pervades over the entire field of administration and every organ of
the state is regulated by the rule of law. The concept of rule of Law would lose its voitality if
instrumentalities of the state are not charged with the duty of discharging in a fair and just
manner.
The Government issued an office memorandum announcing a liberalized pension scheme for
retired government servants but made it applicable to those who had retired after 31 March 1979.
The Supreme Court held that the fixing of the cut off date to be discriminatory as violating
Article 14. The division of pensioners into two classes on the basis of the date of retirement was
not based on any rational principle because a difference of two days in the matter of retirement
could have a traumatic effect on the pensioner. Such a classification held to be arbitrary and
unprincipled as there was no acceptable or persuasive reason in its favour. The said classification
had no rational nexus with the object sought to be achieved.
The SC held that, Rule of Law is the basic structure of the constitution which can't be destroyed
even by a constitutional amendment even by a constitutional amendment even by a Article 369
of constitution.
Equality is a dynamic concept with many aspects and dimensions and it can't be imprisoned
within traditional and doctrinaire limits. Article 14 strikes as arbitrariness in state actions and
ensures fairness and equality of treatment. The principle of reasonableness which legally as well
as philosophically, is an essential element of equality or non arbitrariness pervades Article14 like
a brooding Omni presence.
The court held that Article 14 is not meant to perpetuate illegality or fraud even by wrong
decision made in other cases if some other similarly situated persons have been granted relief or
benefit iardvently or by mistake such an order doesn't confer any legal rights to get the same
relief as well. If the wrong is committed in an earlier case it can't be perpetuated. If an illegality
and irregularity has been committed in favour of an individuals or a group of individuals or
wrong order has been passed by judicial forum or others can't revoke the jurisdiction o a higher
court for repeating or multiplying the same irregularity, illegality for passing a similarly wrong
order.
There were Indian and European Prisoners. Both were treated differently. European gets better
diet. Court held that difference between Indian and European prisoners in the matter of treatment
and diet violates right to equality under Article 14 of Indian prisoners. They all are prisoners they
must treat equally.
In Andhra Pradesh, they formulate a scheme for prevention of crime against women. In prisons
also prisoners were classify in to two category

The employees were governed by the contributory provident fund scheme. With effect from 1-71986 a scheme was introduced. The question was whether the pension scheme ought to be
applied to those who had already retired before the introduction of the pension scheme the
Supreme Court rejected the claim. As per the rules prevalent at the time the retirees had received
all their retrial benefits. If the pension scheme was made applicable to all past retirees, the
resulting financial burden would be Rs.200crore's which would be beyond the capacity of
employer. The reason given for introducing the scheme was financial constraint- a valid ground.
The court held that retired employees and those who were in employment on 1-7-1986 cannot be
treated alike as they do not belong to one class. Te workmen who had retired and received all the
benefits under the contributory provident fund scheme cease to be employees of the appellant
board i.e. the date of their retirement. They form a separate class. Thus there was no illegality in
introducing the pension scheme and not making it applicable retrospectively to those who had
retired before the date.
CONCLUSION
What article 14 forbids is discrimination by law that is treating persons similarly circumstanced
differently and treating those not similarly circumstanced in the same way or as has been pithily
put treating equals as unequals, unequals as equals. Article 14 prohibits hostile classification by
law and is directed against discriminatory class legislation.
A legislature for the purpose of dealing with the complex problem that arise out of an infinite
variety of human relations cannot but proceed on some sort of selection or classification of
persons upon whom the legislation is to operate.
It is well settled that Article 14 forbid classification for the purpose of legislation. It is equally
well settled that in order to meet the test of Article 14
(i) Classification must be based on intelligible differentia which distinguishes persons or things
that are grouped together from those that are left out of group and
(ii) The differentia must have a rational nexus to the objects sought to be achieved by the
executive or legislative action under challenge.
Article 14 contains a guarantee of equality before law to all persons and protection to them
against discrimination by law. It forbids class legislation.
