The Minister of State for Justice and Parliamentary Affairs
(Mr. Mir Nawaz Khan Marwat): Sir, I beg to introduce a Bill further
. to amend the Pakistan Penal Code and the Code of Criminal Procedure, 1898, [The Criminal Law (Amendment) Bill, 1986].
Mr. Speaker: The Bill has been introduced.

Mr. Mir Nawaz Khan Marwat: Sir, before I move the second
motion, I would like to see the mood of the House whether the
House will continue, because this will be pertaining to the dispensation of the requirements of rule 91 and thereafter the subsequent
one.

"That the Bill further to amend the Pakistan Penal Code
and the Code of Criminal Procedure, 1898 [The Criminal
Law (Amendment) Bill, 1986], be taken into consideration at once."

"That the Bill further to amend the Pakistan Penal Code
and the Code of, Criminal Procedure, 1898 [The Criminal
Law (Amendment) Bill, 1986], be taken into consideration at once. "
Honourable Minister of State for Justice.
Mr. Mir Nawaz Khan Marwat: As correctly pointed out by
the honourable members of this august House, Mr. Liaqat Baluch
and Maulana Gohar Rehman, it is correct that we had a meeting and
wanted that this Bill pertaining to the Holy Prophet of Islam (peace
be upon him) should be in a way that it should be acceptable to
every Muslim and it should meet the ends of justice; as the person
who passes any derogatory remarks pertaining to the Holy Prophet,
defiles the holy name of the Holy Prophet, he should be dealt with
in a way! in a manner that lie is calpable of, because no person can
be tolerated in Pakistan the base of which is Islam and which the
Quaid-e-Azam, the Father of the Nation, had correctly stated that
there will be an era of Islam and the future law of the country would
be based on Quran and Sunnah.
Sir, the Holy Prophet is not only the Prophet of Pakistan
but he is the Holy Prophet of Islam and the last of all the Pr~phets

of God. No Prophet after the Holy Prophet Muhammad (peace be

upon him) has to come. So, in the law, it was pointed out that there
was no such appropriate section to meet the ends of justice pertaining to this offence. Thus this Bill was introduced and subsequently
a meeting' was held in which the Ulema from different schools of
thought in this august House and myself participated. In the Bill, we
have proposed that the sentence would be imprisonment for life and
fme~'I mean, b~th. It is not 'or'. It was mutually agreed upon in the
light of religion, the Quran, the Sunnah and the Shariah, and it was
the mutual agreement of all of ..us that there will be an amendment
in the Bill and and I introduce it, with your permission, Sir, here,
which will satisfy every Muslim of'this country, because we cannot
tolerate anyone who passes any
remarks against the Holy Prophet

Sir, the amendment would be to clause 2, the new section ...

Mr. Speaker: Minister of State, before you proceed any
further, we have not received a copy of the amendment.

Mr. Mir Nawaz Khan Marwat: The amendment can be proposed orally also.
Mr. Speaker: It cannot be proposed orally. I have to repeat
it and, unless I have it, I cannot repeat it. All right, you read it and
then I will read.
Mr. Mir Nawaz Khan Marwat: Only a word is to be substituted, a word or two in one place and a word or two in another
place. The Deputy Secretary can write that down. In cluase 2, where
section 295-C concludes, the words are "punished with imprisonment for life, and shall also be liable to fine." Here, after "punished
with", I would add the word "death", then comma, then "or imprisonment for life, and shall also be liable to fine."
Here, Sir,as in the murder case under 302 PPC, the punishment provided for the offence ...

Mr. Speaker: Please continue. We can move it when we discuss this clause by clause.
}dr. Mir Nawaz Khan Marwat: So, the amendment is that he
"shall be punished with death, or imprisonment for life, and shall
also be liable to fine."
Then again, Sir; there is an amendment in clause 3. In section
295-C, in column 7, for "imprisonment for life" there will be "death,
or imprisonment for life" and fme." Similarly, Sir, in column 8,
where the "Court of Session" is written and below is given "Ditto",
it will be "Court of Session which will U~presided over by a Muslim."
This is the entite amendment, Sir.
