I am the attorney for Thomas Alfred Taylor and am fu lly fam iliar with

the fa c ts and circumstances of th is case.

age 12, of 724 E. Johnson, Springdale, Arkansas.
I have made an Investigation of the fa c ts and circumstances In th is ease

and v e rily believe th a t a psy ch iatric examination of the complainant, |

I have been Informed th a t the complainant la emotionally unstable with a

tendency to seek out older me.. and to engage ... fan tasizin g .

I have also been

informed th a t she has In the past made false accusations about persona, claiming
they had attacked her body.

Also th at she exhibits an unusual stubbornness and

temper when she does not get her vay.

I have also been told by an expert In child psychology th a t children In

early adolescence tend to exaggerate or romanticize sexual experiences and th a t


adolescents with disorganized fam ilies, such as the complainantJA, are even more
prone to such behavior.

Prosecuting Attorney, Mahlon Gibson and Thomas Taylor, through h is attorney,
H illary Rodham, and fo r the purpose of th is motion, show the Court:
1.

That th is notion is the r e s u lt of a mutual decision by the Prosecuting

Attorney and the defendant because they believe the in te re s ts of Ju stic e


w ill be served by a postponement of th is m atter beyond September 16, 1975,
the date se t fo r t r i a l .
2.

That the Prosecuting Attorney had to be out of the county from

September 6 through September 11, 1975 and did not have time to discuss
the case fu rth e r with the defendant's attorney and to prepare adequately
for the t r i a l of th is m atter.
3.

That the defendant because of the Prosecuting A ttorney's absence

was not able to resolve c e rta in questions th a t a ffe c t the conduct of h is


defense.
WHEREFORE, the defendant and the Prosecuting Attorney resp ectfu lly
pray th a t the heretofore scheduled t r i a l be postponed.

First Degree Rape which charge is reduced to Unlawful Fondling
of a Child under the Age of Fourteen, by recommendation of
the Deputy Prosecuting Attorney, and appearing by his attorney
Hillary Rodham, and the State of Arkansas, appearing by
Kim Smith, Deputy Prosecuting Attorney.
After both sides announced ready for trial, the
defendant waived a jury and entered a plea of guilty,
which plea of guilty was accepted by the Court after advising
the defendant of his right to trial by jury and other
statutory and constitutional rights and determining the plea
was voluntary and supported by material facts.
IT IS THEREFORE ORDERED AND ADJUDGED, that Bruce Alfred
Taylor, be and is hereby found guilty of Unlawful Fondling
of a Child Under the Age of Fourteen on or about the 10th
day of May, 1975, and upon recommendation of the prosecuting
attorney, punishment is fixed at five (5) years in the State
Penitentiary, suspending four years with the remaining one
year to be spent in the county jail.

Defendant is given credit

for two months already spent in the county jail.
