EFF COMMANDER IN CHIEF HAS BEEN ISSUED WITH SUMMONS BY THE SOUTH

AFRICAN POLICE SERVICE (SAPS) TO APPEAR IN COURT FOR SPEAKING ABOUT


LAND OCUPATION PROGRAMME:
13 October 2016
Today, the 13th of October 2016, a delegation of South African Police Service (SAPS)
investigators led by the Director of Priority crimes served the EFF Commander in Chief
Julius Malema with summons to appear in Newcastle and Bloemfontein Magistrate Courts
for crimes he allegedly committed in December 2014 and August 2016.
The 2014 charge reads as follows;
CONTRAVENTION OF SECTION 18(2) (b) OF THE RIOTOUS ASSEMBLIES ACT,
ACT 17 OF 1956 READ WITH SECTION 2(1) OF TRESPASS ACT, ACT 6 OF 1959 AS
AMENDED BY CRIMINLA LAW AMENDMENT ACT 59 OF 1983.
In that on or about the 16th December 2014 and at or near Mangaung, Bloemfontein, Free
State, the accused contravention of section 18(2) (b) of the Riotous Assemblies Act, Act 17 of
1956 in that he incited instigated, commanded or procured his Economic Freedom Fighters
followers to commit a crime, to wit trespass, in contravention of Section 1 (1) of the Trespass
Act of 1959 by illegally occupying any vacant land wherever they found same.
The 2016 charge reads as follows;

In that on or about the 26th of June 2016 and at or near Madadeni, Newcastle, in the Regional
Division of KwaZulu-Natal, the accused contravention of section 18(2) (b) of the Riotous
Assemblies Act, Act 17 of 1956 in that he incited instigated, commanded or procured his
Economic Freedom Fighters followers to commit a crime, to wit trespass, in contravention of
Section 1 (1) of the Trespass Act of 1959 by illegally occupying any vacant land wherever
they found same.
The National Director of Public Prosecutions (NDPP) took a decision on the 10th of October
2016 to proceed with the charges against the Commander in Chief Julius Malema in the same
meeting that decided to charge Minister of Finance Pravin Gordhan for contravention of
administrative and human resources laws when he was Commissioner of the South African
Revenue Services more than 6 years ago.
The National Prosecutions Authority has since directed that the CIC Julius Malema must
appear in the Newcastle Magistrate Court on the 7th of November 2016 and Bloemfontein
Magistrate Court on the 14th of November 2016 to answer to the charges brought against
him.
It must be noted that the Act which the NPA uses to charge the CiC Julius Malema is an
apartheid law, which from the beginning was meant to suppress black resistance against
apartheid. The Act that the NPA uses to charge Commander in Chief Julius Malema starts by
stating that "To consolidate the laws relating to riotous assemblies and the prohibition of the

engendering of feelings of hostility between the European and non-European inhabitants of


the Union and matters incidental thereto, and the laws relating to certain offences".
That's what the ZUMA ANC uses to charge the EFF President. This is a sign of desperation
by a corrupt regime, which has run out of options. The EFF is reliably informed that Mr.
Jacob Zuma now consults with apartheid murderers and spooks such as Neil Bernard to seek
advice on how to suppress political opponents.
The charges against the CIC Julius Malema are a full proof and unadulterated evidence that
the NDPP was given a political instruction to criminally prosecute all the people who made
submissions to the Public Protector on the matter of State Capture by the Gupta family.
Despite the apparent political motives that underpin the charges against the CIC Julius
Malema, he will subject himself to the Court process because he respects the rule of law, even
when such is abused by the politicians. This means that on the 7th of November 2016, CIC
Julius Malema will be appearing in the Newcastle Magistrate Court and on the 14th of
November 2016, he will appear in the Bloemfontein Magistrate Court.
The EFF is fully behind the Commander in Chief and President Julius Malema because
everything he says represent the resolutions of the EFF 1st National Peoples Assembly and
political programme of the EFF. We are fully aware that the charges are a political decision of
a captured government which is surely becoming a despotic regime and seek to do everything
in its power to defend its corrupt gains.
The EFF once again calls on all South African to be part of the mass protests on the 2nd of
November 2016 for FREE EDUCATION, DEFENCE OF SOUTH AFRICAS
DEMOCRACY AND AGAINST STATE CAPTURE. The EFF calls on all South Africans of
all creed, from all religious backgrounds, all strata, and all races to unite in the struggle for
FREE EDUCATION, DEFENCE OF SOUTH AFRICAS DEMOCRACY AND AGAINST
STATE CAPTURE. All these things happen because of a captured South African government
which is now degenerating into a politically intolerant dictatorship.
