Barloworld Equipment confirms that the application for the liquidation of Optimum Coal
Mine (Pty) Ltd has been withdrawn, as it has received payment of a portion of the
outstanding monies due this morning. In terms of a court order granted on 25 October
2016, OCM agreed to pay under protest a portion of the amount owing to Barloworld
Equipment. The balance would be placed in an attorneys trust account pending a
determination by an independent auditor of that balance.
Barloworld Equipment maintains that the amount claimed in the liquidation proceedings
is due, owing and payable by OCM. Barloworld Equipment has always been open to
discuss any items which may be in dispute, even when OCM was under business rescue.
All invoices were made available to OCM before it went into business rescue.
