from the responsibility of opening the device, setting it, offering it and
generating it. We know that this responsibility is not shared with the parties
involved, it is clearly our task, we are in charge of installing this
mechanism. We just want to outline one the conditions to make this
possible: the neutrality and its correlation with the active listening. Cecchin
refers to curiosity as a position and hypothesis making as a technique that
derives from curiosity. Therefore, we can say that neutrality is a position
and active listening as suspension of our own judgment is the technique
that correlates with it.

elements that make the change possible. As these moments occur in the
context of a relationship, they alter the relationship, as well as the space in
which that relationship resides, the relational container, the between space
where personal identities are inextricably intertwined and overlapping.

liminal zone of indeterminacy spaces on the margin of meaning.
Elaborating the nature of liminality via this case study it will be argued that
: a) liminal spaces are implicated in tipping points within negotiation
process;

asks for mediation, the neutral third and/or the arbitration. Dr. Kemelmajer
makes reference to the greatest challenge that the Judicial Power faces
which is to make people trust in the system integrated by judges, lawyers,
civil servants and employees. Argentine society is partially supported by the
administration of justice, moreover neither the penal justice nor the civil
justice meet the expectations of society. Therefore, as the arbitration is not
yet considered efficient and trustworthy, the mediation is giving better
results. On the basis of the results obtained in the province, in the filed of
family mediation through family courts, it is considered that mediation
directed by efficient people, can bring about a qualitative jump in conflict
resolution. Monitoring and continuous improvement are presented are

La primera parte del artculo desarrolla las concepciones que provocan
distintas formas de tratar con el poder, resaltando que la consideracin del
poder como algo que se tiene, equivale a reducir sus capacidades a la
construccin de una relacin de sometimiento (faz negativa), mientras que
considerarlo como algo que se ejerce y se co-construye en relacin
utilizando como base terica las enseanzas de Foucault-, permite que la
relacin de poder pueda ser vista por los participantes en una mediacin
como una relacin de co-control de recursos y co-dependencia para la
satisfaccin de los intereses y necesidades (faz generativa). La segunda
parte analiza a la mediacin como un proceso creativo y asimismo
desarrolla los contenidos del pensamiento creativo, considerndolo una de
las herramientas ms tiles para ser aplicadas en mediacin a las luchas
de poder, dado que es motor y potenciador de la sinergia en los procesos
de resolucin de conflictos y, adems, conforma una metaestrategia para
trabajar
