FAILURE OF CONCILIATION: PERCEPTIONS AND REALITIES

The author attempts to show that the perceptions research cannot adequately explain the
phenomenon of failure of conciliation. We need more convincing explanations by studying the
attitudes and experiences of the disputant parties as also the role dispensation of various
representatives who participate in the conciliation system. The failure perceptions are compared
with the actual cases of conciliation failure. The author concludes that the participants like
labour,management and parties representatives may not be adequate to gauge the real causes of
failure of conciliation it has been so structured that it is used by employers to avoid workers'
collectives as interest groups. The researcher agrees with the author that those participants alone
are not enough to gauge the reasons for failure of the conciliation process

The author in this article tries to demonstrate the weaknesses of Indian labor legislation. First,
the legislation allows for a multiplicity of unions thereby resulting in an intense interunion
rivalry that generates a large number of industrial disputes and the author suggests that there is a
need to encourage parties to use collective bargaining, rather than rely on third party dispute
resolution the author also does a comparison with the American system of industrial dispute
settlement procedures and indicates that India would benefit substantially if certain aspects of
United States legislation were adopted in that country therefore the researcher will give an
overview about the fact that is it really necessary to adopt collective bargaining rather than
dispute settlement through conciliation.
