El Colegio de Ingenieros y Agrimensores de Puerto Rico (CIAPR) reconoce la utilidad de este mtodo
de contratacin, as como su aceptacin en la industria.
Advierte sobre el caso de CIAPR V. A.A.A., 131 D.P.R. 135 (1997) donde se cuestiono un contrato que
asignaba funciones de ingeniera a una corporacin no autorizada para ello.
Seala que por lo regular la empresa seleccionada para actuar como D/C por lo general ya ha
identificado al momento de su contratacin quienes sern los profesionales que tendrn a su cargo
estas funciones.
Conociendo de antemano quienes sern estos profesionales y para salvar cualquier viso de ilegalidad, es
la recomendacin del CIAPR que en dicha contratacin y sin menoscabar la responsabilidad primaria del
D/C hacia el dueo, elemento central a la misma, se establezcan los mecanismos contractuales
adecuados que permitan la comparecencia directa de los profesionales envueltos, y que aseguren
que las funciones que conlleven la prctica de las profesiones en sta contratacin le sean delegadas a y
asumidas directamente por estos.
Menciona en una nota al calce las posibles consideraciones ticas que pueda tener la contratacin de

los profesionales por una entidad que no es la beneficiaria ltima de la obra pero no lo discuten.

Sometimes referred to as a cost plus or a time and materials
basis.
The owner agrees to reimburse the costs incurred by the
provider of the services and, in addition, to pay a fee equal to
a fixed percentage of incurred costs that is stipulated in the

In this form of commercial terms, the owner reimburses
all of the service provider's costs and pays a fee that is
fixed at the beginning of the contract. This fee will not
change unless the scope of the services provided is
expanded by change order to the contract.
Same advantages and disadvantages as the Cost Plus
Percentage Fee Terms.
The Contractor will not benefit by an increase fee due to
the changes.

Guaranteed Maximum Price Terms
This form is similar to the target estimate form in that the
parties agree on an initial estimate for the cost of the
contemplated services and on a fee for the provider based on
this estimated cost.
Risk - Risks of overrun is on the Contractor. The owner
receives the total benefit of the savings.
Contractor - Incentivized to be efficient since he will pay for
the overrun.
Worst situation for the contractor. All risk on him and no
opportunity to make additional profits.
