NOTICE OF APPEAL


NOTICE IS HEREBY GIVEN that the TEMPLE OF LONO, pursuant to Hawaii
Revised Statutes (H.R.S.) Section 91-14, as amended; H.R.S. 602-5; H.R.S. Chapter
183 as amended (by Act 48, Session Laws of Hawaii 2016); and the Hawaii Rules of
Appellate Procedure (HRAP) Rule 3, appeals to the Supreme Court of the State of
Hawaii from a series of rulings and omissions by the Board of Land and Natural
Resources of the State of Hawaii (Board) and/or the designated Hearing Officer [In
the Matter of Contested Case Hearing Re Conservation District Use Application
(CDUA) HA03568 for the Thirty Meter Telescope at the Mauna Kea Science Reserve,
Kaohe Mauka, Hamakua District, Island of Hawaii, TMK (3) 4-4-015:009];
referenced as BLNR-CC-16-002 and previously referenced as DLNR Docket No. HA-
11-05 that systematically violated the Temple of Lonos due process rights as a
party to the proceeding below by (1) refusing to permit the Temple to raise the
question: Has the Applicant demonstrated a hostility toward the Traditional
Hawaiian Faith that disqualifies the Applicant from receiving the permit requested
and (2) denying the Temples due process right to full participation as a party to the

proceeding below by refusing, without explanation, to take up numerous motions

filed by the Temple. The relevant orders and omissions are set forth in the
accompanying memorandum and Declaration of Representative. Alternatively,
Appellants submit that said orders and omissions are appealable under the
collateral order doctrine.
