Hefurthersubmittedthatthefirstinformationreportgivingrisetotheimpugnedcriminalprosecutionoftheapplicantwas
lodgedbytheoppositepartyno.2atthebehestofthelocalpoliceagainstunknownpersonsallegingthereinthatherson
SagarhadgonetowatchamusicalprogrammeorganizedbytheapplicantatSohanSinghTowerRoad,Nakudandwhilethe
programmewasinprogress,therewasastampedeandfiringalsobrokeoutinwhichhersonreceivedfirearminjury.
Althoughneithertheapplicantisnamedinthefirstinformationreportnoranyovertactofanykindhasbeenattributedtohim
eitherbytheinjuredortheotherwitnessesintheirstatementsrecordedduringtheinvestigationyetchargesheethasillegally
beensubmittedagainsthimandinthecircumstancestheprosecutionoftheapplicantwhichismanifestlyattendedwith
malafides,isnothingbutabuseoftheprocessofthecourtandthesameisliabletobequashed.
Insupportofhissubmissions,learnedcounselfortheapplicanthasrelieduponthejudgementoftheHon'bleApexCourtin
AllCargoMoversPvt.Ltd.AndothersVersusDhaneshBadarmalJainandanotherreportedin2008(60)SCC375.
