AFFIDAVIT
I, DAVID L. MAHUSAY, of legal age, married, Filipino, with address at
Purok VI, Barangay Botongon, Estancia, Iloilo City, after having been sworn in
accordance with law, do hereby depose and say:
1. That, I am the driver of the tricycle of Melvin Carriaga;
2. That, on November 29, 2011, the said tricycle with Plate Number WH
7951, Engine Number KR 20004X00916E, Chasis Number KR 200-04Y-009126,
was stolen by unknown person/s while parked outside my house at Brgy.
Botongon, Estancia Iloilo.
3. That, I discovered that the tricycle was stolen when I woke up at around
5 oclock in the morning;
4. That, I immediately texted the owner, Melvin Carriaga, and informed him
of what just happened;
5. That, I then reported the matter at Estancia Municipal Police Station. A
copy of the police blotter is attached as Annex D in the complaint-affidavit of
Melvin Carriaga;
6. That, on November 30, 2011, I was asked by Melvin Carriaga to
determine whether the spare parts shown to him by Edmark Manila were actually
parts of the stolen tricycle. Upon seeing the items, I immediately recognized that
those were some of the parts of the stolen tricycle since I am very much familiar to
it.
7. That, I, together with the owner, his parents and Edmark Manila, went to
the police station and brought with us a sack containing the spare parts. We
informed the police that these spare parts of the stolen tricycle were from a certain
Danilo Deputado;

5. That, together with the police officers, we went to the place of Danilo
Deputado at Barangay Gogo, Estancia, Iloilo. He was then invited by the police
officers for questioning;
6. That, upon arriving at the police station, when Danilo Deputado saw a
sack containing spare parts of the tricycle, he said to Melvin Carriaga Didto sa
Lotud-lotud gin manihar ang tricycle;
9. That, the police officers further inquired from him if who are the persons
responsible for car napping the tricycle, he mentioned the names Regie Mar
Franciso and a certain Alias Agaw, the respondents;
8. That, I execute this affidavit to attest to the truthfulness of the foregoing
facts.
