The ELECTION CODE of the NATIONAL FEDERATION OF JUNIOR

PHILIPPINE INSTITUTE OF ACCOUNTANTS-REGION XI COUNCIL for the


FEDERATION YEAR 2015-2016
Be it enacted by the Commission on Elections en banc:
ARTICLE I GENERAL PROVISIONS
Section 1: Title. This Code shall be known as the Election Code of the National
Federation of Junior Philippine Institute of Accountants-Region XI Council for the
Federation Year 2015-2016.
Section 2: Applicability. This Code shall govern the election of National
Federation of Junior Philippine Institute of Accountants-Region XI Council
Executive Officers for the Federation Year 2015-2016.
Section 3: Obligations to Vote. It shall be the obligation of the elector as
representative of his/her attending recognized Local Chapter to cast his/her
vote.
Section 4: Objectives. The objectives of this code shall be:
a. To establish standard procedures for application and admission as
aspirants for the next set of Regional Executive Officers
b. To define the necessary requirements including the documents that shall
be submitted by the aspirants for the Regional Executive Officers
c. To define the rights, responsibilities and duties of the applicants
d. To provide guidelines in the conduct of the orderly election
Section 5: Definition of Terms. For the purpose of this Code, the following
terms shall be defined as follows:
a. National Federation of Junior Philippine Institute of Accountants-Region XI
Council Executive Officers. This shall refer to the duly constituted national
governing body of all JPIA Entities of Davao Region.
b. Regional Executive Officers Elections. This shall refer to elections for all
positions in the NFJPIA-Region XI Council, namely:

c. Commission on Elections. This shall refer to a constitutional independent


body composed of commissioners representing each Local Chapter. The
number of commissioners shall not be lower than five (5) and 2/3 of the
registered Local Chapter Members

ARTICLE II THE COMMISSION ON ELECTIONS


Section 1: Composition of the ComElec. The ComElec shall be composed of
commissioners representing each Local Chapter. The number of commissioners
shall not be lower than five (5) and 2/3 of the registered Local Chapter
Members.
Section 2: Appointments of the Members of the ComElec. The Executive
Board shall appoint a chairman, a vice chairman, and members of the
Commission on Elections during a special meeting called for such purpose.
Other positions may be created for practical reasons.
Section 3: Powers and Functions of the ComElec. The ComElec shall have
the following Powers and Functions:
a. To devise effective and efficient methods to conduct an election and the
same shall be implemented
b. To schedule the date, time, and place of the election
c. To safe keep all records and documents pertaining to the election and the
same shall be forwarded to the Executive Board
d. To be the sole judge of all electoral protests and violations of promulgated
rules and procedures of electoral process and the same shall be resolved
e. To report the result of the election to the Executive Board
Section 4: Positions and Functions. The ComElec shall have the following
field offices with their respective functions:
a. Chairman
a. calls and presides over meetings of members of the ComElec
b. acts as official representative of the ComElec
c. Formulates the guidelines for the conduct of the Regional Election
b. Vice Chairman

a. performs the duties of the Chairman as a whole or in representation


b. assists the Chairman in his duties
c. performs such other duties as the Chairman may from time to time
impose upon his office
c. Secretary
a. keeps records of all the minutes and activities of the ComElec
b. keeps an account of all official records of the ComElec
c. performs such other duties as the Chairman may from time to time
impose upon his office
d. Treasurer
a. handle and safeguard all funds of the council
b. keep all documents pertaining to cash receipts and disbursements
c. prepare the financial statements of the council semi-annually
e. Commissioner
a. Acts as the ComElecs representative of the Local Chapter
represented
b. Tasked to ensure information dissemination to the Local Chapter in
his jurisdiction
c. Serve as the bridge between the ComElec and the Local Chapters
with regards to information transfer such as announcements,
questions, protest and other forms information needed to be
communicated
Section 5: Qualification of Members of the ComElec. A member of the
ComElec must:
a. be a bona fide member on any JPIA local chapter duly recognized as a
member of the council
b. have attended the special meeting called for such purpose
c. have submitted the following requirements:
a. Resume
b. Filled-up application form provided by the Executive Board
c. Certificate of good moral character from the school registrar or
Office of Student of Affairs or its equivalent office
d. Two (2) recent 2x2 ID pictures
ARTICLE III THE ELECTION OF REGIONAL EXECUTIVE OFFICERS

Section 1: Composition. The Regional Executive Officers shall be composed


of:
1. President
2. Vice President for Academic Affairs
3. Vice President for Non-Academic Affairs
4. Vice President for Membership
5. Vice President for Finance
6. Vice President for Communications and Media
7. Vice President for Audit
8. Vice President for Logistics
9. Vice President for Ways and Means
10.
Secretary-General
Section 2: Regular Elections. The regular election for the Regional Executive
Officers shall be held during the Annual Regional Convention. The Officers-elect
shall assume office upon taking oath of office.
Section 3: Special Elections. If after the declaration of the winners, should
there be any unfilled office in the Regional Executive Officers; a special election
shall be called for by the ComElec.
Section 4: Manner of Election of the Regional Executive Officers. The
Election of the Regional Executive Officers during the Annual Regional
Convention shall be collegial. There is no specific position to be elected during
the said convention, the top ten (10) candidates garnering the highest votes
shall be declared by the Commission on Elections as the Regional Executive
Officers for Federation Year 2015-2016. The Officers-elect shall convene with the
outgoing Executive Board within ninety (90) following the convention to elect
among them the President and respective Vice Presidents, including the
Secretary-General.
Section 5: Term of Office. The term of office of the duly elected Regional
Executive Officers shall end on the day the new set of Regional Executive
Officers have taken their oath.

Section 6: End of Tenure. The term of office of any incumbent Regional


Executive Officer shall automatically terminate for any of the causes specified
hereunder:
a. upon death, sickness, resignation or inability to fulfill the powers and
duties of the said office
b. upon disqualification from re-enrolment for any semester during the
school semester of his term for academic reasons, provided that
automatic termination shall take effect only upon official written notice
from the Dean or Chairman of his College or Department
c. upon his receipt of the official written notice issued by competent
college/university authority of any of the following:
a. honorable dismissal
b. suspension for more than one month
c. expulsion
d. upon failure to re-enroll for any semester during his term
Section 7: Filing of Vacancy. Vacancies arising from the above mentioned
causes shall be filled in the following manner:
a. Vacancies in the Executive Offices by reason of incapacity, resignation,
impeachment, failure of elections, or death shall be filled through special
elections.
b. However, if the vacancy is less than six (6) months from the end of the
federation year, the Executive Board through a majority vote may opt to
fill the vacancy through appointment.
ARTICLE IV QUALIFICATION OF CANDIDATES
Section 1: Qualification for Regional Executive Officer. A candidate for
Regional Executive Officer must be:
a. be a bona fide member of NFJPIA-Region XI Council and his/her Local
Chapter must be recognized and accredited by the Regional Council
b. be enrolled for the current semester (2nd semester 2014-2015)
c. be an accounting major/accounting-related course student with good
moral character

d. not have a failing grade with a maximum of 6 units non professional


subject buffer
e. not hold any major or executive position in any organization for the next
federation year
f. have attended at least one (1) major activity of the Regional Council
g. have considerable knowledge of the Constitution and By-Laws and
Election Code of the Regional Council
Section 2: Disqualification. Any candidate who, declared by final decision by
the ComElec, guilty of having:
a. given money or other material consideration to influence, induce, or
corrupt voters
b. committed acts of terrorism to enhance his candidacy
c. spent in his election campaign an amount in excess of that allowed by this
Code, shall be disqualified from continuing as a candidate, or if he has
been elected, shall terminate the term of office
Section 3: Nuisance Candidates. The ComElec may motu proprio or upon a
verified petition of an interested party, refuse to give due course to or cancel a
certificate of candidacy if it is shown that said certificate has been filed to put
the election process in mockery or disrepute or to cause confusion among the
voters by the similarity of the names of the registered candidates or by other
circumstances or acts which clearly demonstrate that the candidate has no
bona fide intention to run for the office for which the certificate of candidacy has
been filed and thus prevent a faithful determination of the true will of the
electorate.
ARTICLE V QUALIFICATION OF ELECTORS
Section 1: Number of Electors. The Number of Electors per Local Chapter
shall be based at the lower of eighty per cent (80%) of the member-delegates of
the Local Chapter with the lowest attendees and eighty per cent (80%) of the
members of the Local Chapter with lowest membership, provided that the

lowest number of delegates from a Local Chapter shall not be less than twenty
(20) delegates.
Section 2: Determination of the Electors. The Local Chapter President shall
select among his/her members the qualified electors representing his/her Local
Chapter, noted by the Local Chapter Adviser. The Local Chapter President shall
submit the list of the Qualified Electors in three (3) copies at least one (1) hour
before start of the Elections. Members of the Executive Board are not allowed to
vote during the Annual Regional Convention.
Section 3: Qualifications of Electors. In order to qualify as an elector in the
elections, the elector must be:
a. a bona fide member of NFJPIA-Region XI Council and a student of
Accountancy or any accounting-related course
b. authorized by the Local Chapter President of the Local Chapter he/she
represents, or an incumbent NFJPIA-Region XI Council Executive Officer
c. a registered participant of the Annual Regional Convention 2015
Section 4: Disqualification of an Elector. An elector is disqualified to vote in
any electoral exercise when he/she has found guilty:
a. Of demanding or receiving money or any material consideration in
exchange for the favor of his vote or of the Local Chapter he/she
represents
b. Of facilitating or participating in any act of terrorism to enhance any
candidates candidacy
ARTICLE VI REQUIREMENTS FOR CANDIDACY
Section 1: Submission of the Requirements. No person shall be eligible for
any elective public office unless he submits his/her requirements within the
period fixed herein.
Section 2: Requirements. The requirements for Filing the Certificate of
Candidacy shall be as follows:
a. Duly accomplished Certificate of Candidacy (Soft Copy and Hard Copy)
b. Comprehensive Resume (Soft Copy and Hard Copy)

c. Endorsement from the Local Chapter President and/or Adviser of the


aspirants respective Local Chapter (Soft Copy and Hard Copy)
d. Certificate of Good Moral Character from the Office of the Registrar and/or
Office of the Prefect of Discipline (Hard Copy)
e. Certificate of grades or temporary transcript of record (Hard Copy)
f. Two (2) copies of 2x2 (or larger) size pictures with white background in
decent attire (Hard Copy)
Section 3: Deadlines and Penalties. Soft copy requirements shall be
submitted on or before February 18, 2015, Wednesday. Failure to complete the
soft copy requirements during the deadline shall constitute a Penalty of P20.00
per every requirement. All hard copy requirements shall be submitted during
Annual Regional Convention, one hour before start of Miting de Avance. Failure
to submit the entire hard copy requirement shall constitute a Penalty of P50.00
per every requirement.
Section 4: Withdrawal of Certificate of Candidacy. No Requirements duly
filed shall be considered withdrawn, unless the candidate presents his notice of
withdrawal, duly signed by the candidate, to the ComElec an hour before the
time of the elections.
ARTICLE VII REGULAR ELECTIONS OF THE NFJPIA-REGION XI COUNCIL
OFFICERS
Section 1: Time and Date. Regular elections of the Regional Executive
Officers shall be held during the Annual Regional Convention.
Section 2: Tie-Breaking. In case of tie, the ComElec shall call upon the
attention of the concerned Candidates to perform Tossing of Coin or Drawing of
Lots. It shall be witnessed by the ComElec Commissioners and Majority of the
Members of the Executive Board.
Section 3: Proclamation. The ComElec shall announce the result of the
elections for Regional Executive Officers during the awarding ceremony of the
Annual Regional Convention.

ARTICLE VIII SPECIAL ELECTIONS


Section 1: Special Elections. A separate Code shall be adopted by the
ComElec pertaining to Special Elections.
ARTICLE IX OTHER PROVISIONS
Section 1: Separability Clause. Should any provision of this Code be declared
unconstitutional or illegal by the higher authority of competent jurisdiction,
those parts or provisions hereof which are not affected thereby shall be in full
force.
Section 2: Repealing Clause. All Codes or parts thereof which are
inconsistent with the provisions of this Code are hereby deemed repealed or
amended accordingly.
Section 3: Amendments Clause. This Code shall be amended upon by 2/3
votes of the Commission on Election en banc.
Section 4: Effectivity Clause. This Code shall take effect immediately upon
approval.
