Australian Labour
Market and Immigration
The Australian labour market has a decisive influence
on constantly changing immigration regulations and
policies of the country. Though Australia welcomes
many types of migrants such as students and
protection seekers, it has its soft corner for highly
skilled migrants. It is for this class that Australian
General Skilled Migration visas have become quite
popular in the respective skills.

While the 457 visa is one such visa as a part of employer sponsored visa programme, following are the three major
categories of the Employer Sponsored Migration programs.
Employers can sponsor overseas workers under one of the different employer sponsored visa programmes.
Following are three major categories that are available in Employer Sponsorship Programmes.
1. Temporary Work Visa (Commonly Known as 457 visa)
2. Employer Nomination Scheme (Permanent Visa, Subclass 186)
3. Regional Sponsored Migration Scheme (Permanent Visa, Subclass 187)
Though each of these visas entitles Australian employers to sponsor offshore workers, they need to meet certain
requirements and obligations.

General Obligations
There are certain obligations that approved sponsors
need to meet. Generally, approved sponsors need to

? Cooperate with inspectors
? Ensure equivalent terms and conditions of
employment
? Keep records
? Make information available to the department on
specific occasions
? Make sure that the primary sponsored person
works or participates in the nominated
occupation, program or activity
? Not to recover, transfer or take actions that would
result in another person paying certain costs
? Pay travel costs to enable sponsored persons to
leave Australia
? Pay costs incurred by the Commonwealth to
locate and remove unlawful non-citizens.
Immigration department compels the sponsors to
meet all these and other sponsorship obligations
even if someone else including a migration agent has
been appointed to act on behalf of the sponsor.
Lets take a look at what the Immigration Department can do to you if you are an employer
who can sponsor overseas workers:
? It monitors your compliance and whether the visa holders you sponsor are upholding their visa conditions.
? The department monitors you while you are a sponsor and for up to five years after you cease being a sponsor.
? The department can take a number of sanction actions against a sponsor if the sponsor does not comply
with the obligations.
This visa may also be used in cases where a foreign company wants to transfer a foreign employee to Australia.

457 Visa
AUSSIZZ

Also known as Temporary Work Visa, 457 visa allows an Australian Employers to hire and sponsor a qualified overseas
worker to workfor their business up to 4 years.
Overseas businesses may also use this program to facilitate an i ntra-company transfer of an overseas worker to
deliver their services in Australia.
The program involves a three-stage process where an employer applies to become an approved sponsor and then
nominates a skilled overseas worker to fill the specific position. The skilled worker completes the process by lodging a
linked temporary work skilled visa application.
This is a temporary work visa for up to 4 years (renewable).
Sponsorship
At the outset, employers must take an approval for sponsoring and appointing overseas employees to be posted in
Australia. Once approved, a company might appoint overseas employees as per requirement for a period of up to four
years. The major premise is the businesss genuine need of the employee and business ability to meet its financial and
other obligations.

Nomination
An approved sponsor may nominate the position to be filled which could not be filled by an Australian Citizen or
Permanent Resident due to skilled shortage and propose an applicant for the visa, who will work in the nominated
occupation. Such Position must also have a minimum salary as declared in the gazette notice. Employer must
demonstrate genuine need of nominated position for the growth of the business. Provide employment terms and
conditions which are equivalent to those applies to an Australian Citizen Or Permanent Resident in the same position.

Application
This phase requires the overseas worker for any vacant position to submit an Australian 457 visa application for entering
and staying in Australia. An applicant must prove his worth as a suitable candidate for a nominated post and accordingly
is offered employment as per nominated terms and conditions. Certain specific health and character requirements must
also be fulfilled by a 457 visa applicant.
In case, a candidate fails to get a sponsor, an 'Expression of Interest' might be lodged thereby allowing potential
employers to view profile and offer sponsorship as and when required.

186 Visa
The 186 visa is a permanent visa also known as the
Employer Nomination Scheme. Employees can be
nominated under this visa in either metropolitan or
regional Australia. However, Subclass 186 visa
focuses more onto skills of the prospective nominee
as compared to the 457 visa.
The 186 visa allows nominee and their family to live
and work as much as they want in Australia. It also
allows them to study in Australia. They can benefit
from Medicare, the Australian health system and also
have access to some compensation through social
security. They can also request an Australian
citizenship and sponsor eligible relatives to obtain
permanent resident status.
If a person is under 50 years of age and have
qualifications/skills for a nominated position by an
approved Australian employer then they are eligible to
apply for the 186 visa. You must include proof of
appropriate English language skills and also meet the
health and character requirements in order to apply
for this visa.

187 Visa
This Permanent Visa is called Regional Sponsored Migration Scheme or abbreviated as RSMS Visa. This visa is
designed for regional Australian business to sponsor overseas workers. The processing of this visa is slightly different
than the other visas. Similar to Employer Nomination Scheme, this visa also identifies three streams.

Unlike, the 457 visa, the employer nominating positions in regional Australia needs to obtain advice from a regional
certifying body about the position they want to fill. The advice provided by a regional certifying body is intended to
ensure all RSMS Direct Entry stream nominations have been scrutinised by a third party which is familiar with local
labour market conditions and which may be able to provide information on regional matters which the department may
not be aware of. The regional certifying body assesses the nomination against the following criteria:
? There is a genuine need for a paid employee in a business operated by the employer that is
actively and lawfully operating in a regional area of Australia
? The terms and conditions of employment are the same as those that would apply to an
Australian citizen or Australian permanent resident performing the same work in the same location
? The nominated position cannot be reasonably filled from the local labour market.
Nominee needs to provide competent English level under Direct Entry Stream.
Skills assessment is not required unless the nomination is for a trade occupation and nominee
has obtained trade qualifications overseas.
