Officer J. Valverde #2431 working as unit 2S248 was dispatched to the listed address in reference to

an assault. Upon arrival the officer met with Wi-01 who stated his wife (Vi-01) was assaulted by

OF-01 inside the restaurant, Vi-01 stated she did not feel pain but the contact made by OF-01 was

offensive. Prosecution is desired and Vi-01 was issued a case number.

THE INFORMATION BELOW IS CONFIDENTIAL - FOR USE BY AUTHORIZED PERSONNEL ONLY

Officer J. Valverde #2431 working as unit 2S248 was dispatched to the Thyme Matters in reference to an

assault. Upon arrival the officer met with Wi-01 who stated that his wife (Vi-01) was assaulted by OF-01

inside the restaurant. Wi-01 stated that he and his wife walked in to the restaurant and saw OF-01 and his

Wife IO-01 sitting at another table. Wi-01 stated he greeted OF-01 and IO-01 and then sat down. Wi-01

stated that OF-01 started to give him a hard time about a decision he had made in reference to an arena

that was supposed to be built downtown but Wi-01 changed his mind because he stated he could not make

people leave their homes.

Wi-01 stated that he and OF-01 were arguing back and forth and that OF-01 had called him a wimp. Wi-01

stated IO-01 came up to his table and spoke to him briefly and walked outside and waited for OF-01. Wi-01

stated that OF-01 approached his table where he was sitting with Vi-01. Wi-01 stated he stood up and told

OF-01 that he was recording him. Vi-01 who was sitting adj acent to Wi-01 also stood up and got between

OF-01 and Wi-01. OF-01 attempted to swipe the phone away from Wi-01 and in doing so pushed Vi-01. OF-01

then walked out of the restaurant and left with IO-01. Officer Valverde contacted communications so that

another unit could be dispatched in attempt to locate Of-01 and IO-01. Officer Sidransky and Samples

arrived and were given a description of the vehicle. Officer Valverde also contacted Sgt. Romaner and

advised him of the situation. Sgt. Romaner arrived and was able to give information to officer Sidransky

and Samples so that they would speak with OF-01 and IO-01.

Officer Valverde also met with Wi-02 who is a waiter at the resteraunt who stated he did not see the who

confrontation between OF-01 and Wi-01. He could see that OF-01 and Wi-01 had an argument but did not see

Vi-01 get pushed. Officer Valverde also spoke with Wi-03 who was having dinner at the time who also stated

he could see that OF-01 and Wi-01 were having some kind of disagreement but could not hear what the

disagreement was about. He saw Of-01 stand up and walk towards where Wi-01 and Vi-01 were sitting but did

not see Vi-01 get pushed.

Officer Valverde met with IO-02 the manager of the restaurant and asked if there was video of the incident.

With the assistance of IO-02 the officer observed when OF-01 walked over to the table of Wi-01 and his

wife. The officer could see that Wi-01 stood up as Of-01 approached the table. Wi-01 as his phone in

front of him and Of-01 attempts to take it and then Vi-01 stands up front of Wi-01 and during the time that

OF-01 attempting to swipe the phone away she is slightly pushed by OF-01. The officer took video of the

incident off the computer of IO-02` s desk top and downloaded it at the WSRC as evidence.

The officer met with Vi-01 who stated while she was sitting with Wi-01 ( husband) Of-01 approached their

table and Wi-01 pulled his phone to record OF-01. Vi-01 stated she stood up in an attempt to diffuse any

type of situation that may occur between OF-01 and Wi-01. Vi-01 stated when she stood up she was shoved by

OF-01 and that was when she told Wi-01 to call the police. The officer asked Vi-01 if she felt any pain or

sustained any type of injury as a result. Vi-01 stated she did not feel pain but the contact made by OF-01

was offensive and had not sustained any injuries. Vi-01 was issued an incident information card with case

number and advised accordingly.
