Prayer of the Faithful, we Pray for the names written in our book of Intentions.
TREASURES FROM OUR TRADITION
Life hands us many epiphanies or wake-up calls. A few years ago, a young couple adopted a two-year-old child in a morass of red tape, complications,
and court hearings. At the babys baptism, the priest suggested appending an adoption blessing, wherein the new relationship was expressed and
affirmed. There is a place in that rite for the child to speak, and instead the priest said, Can you give Daddy a kiss? Standing in the midst of his church,
the young adoptive father suddenly welled up with tears as he embraced the child. Afterward, he explained that through all the hassles and legal struggles
he never until that moment in church understood that he was the parent of this child. The ritual claimed them for each other, gave expression to their
relationship that the legal documents never could, and firmly cemented this child into the heart of a community as everyone erupted into heartfelt
applause. This assembly witnessed in a powerful way what happens in every baptism: the mystery of adoption, the free flow of grace, the overwhelming
sense of Gods presence at the heart of our lifes journey.

CANONICAL- LITURGICAL FORUM

BY FR. GEM BANDIVAS, JCL, MBA, PhD

DONATIONS OR BEQUEST TO THE CHURCH

Dear Father Gem: My elderly mother, all her children,

and some of her grandchildren went to St. Peter the Apostle
school. We consider St. Peters as our church, alma mater,
and our home. Lately, my mother is thinking about making a
big donation to the parish, or maybe leaving it in her will, to
build additional building and possibly revive the school. She
also wanted that the building would be named for our family.
I ran into one of the church volunteers and mentioned my
moms idea to her, and she got really excited. She said that
even if the church doesnt build a new building, at least the
church could use the money to pay off debt and/or other
things. But thats not what my mother wants to give the
money for! Is there a way to insist that her donation be used
for this one purpose? Or is my mother being unreasonable?
She doesnt want the money to be spent just on heating bills
and similar things; she wants something permanent to
remain at the school in memory of our family. Please advise.
Ann, Parishioner
Dear Ann: Your mother is certainly not being unreasonable. It is
perfectly natural that when someone makes a large gift for a
charitable purpose, the donor may specify the manner in which it
is to be used. The Churchs laws concerning bequests and other
donations are fundamentally consistent with those found in Civil
Law.
The 1983 Code of Canon Law (c.1300) couldnt be clearer:
the intentions of those who give goods to pious causes, once they
are lawfully accepted, must be carefully observed. This holds true
regardless of whether the donor gives the gift while still living or
includes it in his will. The bishop is ultimately responsible for
ensuring that such donations are used for the intended purposes
(c. 1301.1).
Note that canon 1300 states that a donation must be used
for its stated purpose if it is lawfully accepted. So, if your mother
wants to give money to the parish to build a new building for the
school, that money cannot be used for other purposes, like
renovating our church. But what if the parish doesnt want to
revive the school? If thats case, with gratitude and tact, the gift
must be refused and inform the potential donor that it simply is not
feasible to revive the school. The donor cannot force unwilling
church officials to take the money and use it as the donor wants!
In general, if someone writes a will in which he leaves
some money to a young relative to be used specifically for his
education, that heir cannot take the money and spend it on a new
car. The intentions of the donor must, as a rule, be respected.
You may remember that after the September 11 tragedy,
the American Red Cross was deluged with donations, which were
specifically intended to help the families of those who were killed
or injured in the attacks. Some in the Red Cross evidently judged
that the total amount collected was more than could ever
reasonably be expended on the victims and their families, and
tried to divert some of the money to other, unrelated relief efforts.
When this became public knowledge, the outcry was so strident
that the head of the American Red Cross ultimately resigned.
Aiding the needy who were not 9-11 victims is, of course, a

laudable intention, but the fact

remains that the donors did not give
their money for that purpose! It was
entirely natural that they should object
to its being used in a way other than they had wished.
We have been discussing here only those donations,
which the giver specifically wanted to be used for a particular
reason. What strings, if any, are attached to donations that are
given without any specific instructions?
In the absence of any explicit directives from donors, a
Catholic institution (or indeed any charity) can use the money or
goods as its administrators see fit. When the average Catholic
tosses money into the regular Sunday collection, that sum goes
toward the general expenses of the parish. Perhaps it will be used
to pay the staffs salary, or repair or maintenance of the church or
the rectory, or be sent to the diocese as part of the regular parish
assessment. (Canon 1263 gives the bishop the specific right to
levy assessments on parishes and other institutions in his
diocese.)
You can only trust that the pastor and the Parish Finance
Council will manage the money you give as skillfully as they can.
It is natural that at times we may disagree about the way that
some of our money is being spent, but we have no authority to
micromanage the financial affairs for the parish.
If it were to become apparent that money was truly being
mismanagedlets say the pastor spent lavishly on redecorating
the rectory while the electric bill was left unpaid for monthsit
would ultimately be the responsibility of the diocesan bishop to
address this. While we would naturally be unhappy about our
hard-earned money being used for frivolous things, withholding
our financial support for the Church would not be an option, no
matter how tempting a protest it might be. From a moral point of
view, Catholics cannot neglect their obligation to economically
support the Church.
Cardinal Carlos Amigo Vallejo, Archbishop of Seville,
called on the faithful not to fall in to the irresponsibility of not
designating the 0.7% of their income to the Church on their tax
returns because they dont like their pastor or because their parish
has changed Mass times. Such reasons for not contributing
would be unacceptable, he said.
Ann, there is a serious obligation to support the work and
mission of the Church through our giving. What we give to the
Church is part and parcel of our giving to God. It should, therefore,
be something that bears a real relationship to our income as well
as to our essential financial commitments. Above all, it should be
something, which is thought out before we come to Mass. To give
one's spare change on the spur of the moment is not fulfilling the
obligation of giving in a thought-out and sacrificial way.
As we begin the New Year 2017, Id like to take this
opportunity on behalf of the St. Peter the Apostle Faith
Community to express our thanks and appreciation to you and to
all who supported St. Peters all this time. We will never forget the
goodness of your heart. May you be blessed with all the graces
you so deserved. Remember, God is more than happy to bless a
cheerful giver!
