OFFICE MEMORANDUM
Sub: Recovery of subsidy released under TUFS - Preliminary Enquiry Report
in PE JDH 2012 A0001/CBI/Jodhpur received through Vigilance Section
of the Ministry of Textiles in connection with misuse of TUF Scheme by 25
textile units in Rajasthan- Reg.
Central Bureau of Investigation (CBI), Jodhpur has submitted a preliminary enquiry
report to Ministry of Textiles against 25 suspected textile units from Rajasthan availing TUFS
benefit fraudulently. In view of the irregularities pointed out in the said Report, the Ministry
of Textiles vide its letter No. 6/2/2013-TUFS dated 22 Jan 2013 has directed this office to
take necessary action to recover the TUF Subsidy amount along with penal interest in these
cases.

In the above connection, a list of the 25 units is enclosed for ready reference to all
concerned in which the subsidy released to the respective unit so far through the respective
lending agency (except in case of State Bank of India, since State Bank of India has not
uploaded related data in the online system of this office) has been indicated based on the
online data uploaded by the concerned lending agency. The indicated subsidy value under
TUFS against each unit is tentative hence the same should be confirmed by the respective
lending agency and amount to be remitted in Government Account may be calculated with
penal interest accordingly.

As per the Preliminary Enquiry Report of CBI, ten units (at Sr. No. 1 to 10 of the
enclosure) have been found to be prime facie involved in irregularities CBI has also
recommended that the benefit of TUFS extended to these ten units may be considered for
withdrawal. Accordingly, the concerned lending agencies are hereby instructed to recover the
subsidy released along with penal interest @ 10% p.a. and remit the same to Pay and
Accounts Officer, Ministry of Textiles, New Delhi, under intimation to this office
immediately.

As regards the remaining fifteen units (at Sr. No. 11 to 25 of the enclosure) the same
are suspected cases and presently under investigation. In view of this, the concerned lending
agencies are hereby advised that they should ensure that sufficient collateral security to cover
the subsidy released so far and penal interest may be maintained for possible recovery.

Further, in all the twenty five (25) cases the lending agencies are hereby instructed
that no further subsidy claims in respect of these units should be forwarded for release of
subsidy.

All concerned Lending Agencies are again requested to take immediate follow-up
action to recover the actual TUF Subsidy amount disbursed plus penal interest as stipulated
through their institution to these units and remit the same to Pay and Accounts Officer,
Ministry of Textiles, New Delhi, under intimation to this office immediately.
7.
Action taken in this connection may please be intimated within 7 days of receipt of
this Memorandum.
