The Court, Mr. Kimberlin and counsel for Mr. Frey had a call on December 22,2016 to
discuss the status of the above referenced case. The parties agreed that a briefing schedule to file
dispositive mot}ons in the case was appropriate. The briefing will proceed as follows:
1. Plaintiffs Motion for Summary Judgment will be filed by February 1,2017;
2. Defendant's Cross Motion for Summary Judgment and Opposition to Plaintiffs
