JUDICIAL AFFIDAVIT OF NAHBS MANSUL

I, NAHBS MANSUL, of legal age, Filipino, and with address at 415 Muslim
Center, Quiapo, Metro Manila, after having been sworn in accordance with
law, hereby depose and state:

PRELIMINARY STATEMENT

The person examining me is Atty. Joshua Polido, office of the city prosecutor,
manila city hall, manila. The examination being held at the same address. I
am answering her questions voluntarily, to the best of my knowledge and
fully conscious that I do so under oath and may face criminal liability for false
testimony and perjury.

PURPOSE

This affidavit/testimony of eye witness Nahbs Mansul is being offered to


prove the existence of criminal liability of the herein accused.

Q1:

Please state your name and other personal circumstances for the

record.
A1: I am Nabral Mansul, of legal age, single, with residence at 415 Muslim
Center, Quiapo, Metro Manila.

Q2: What are you doing in that place during the incident?
A2: At that time, I was at the right side of the road along TIP and about to go
home to Muslim center after playing DOTA in a nearby Computer shop. As I
walked, I saw a red car heading to Ayala bridge bumped the biker that
resulted to his fall. The two engaged in a verbal altercation.

Q3: Can you still recall about the details of the confrontation?
A3: I heard them arguing about who should be on the right lane and who is
right of wrong. The man inside the car was very angry and aggressive.
Although I was a little far from the red car and the man riding the bicycle,
they were still talking to each other.

Q4:

What did you witness next?

A4: The man riding the bicycle alighted and the driver of the small red car
got off. The driver of the red car suddenly went straight to the bicycle rider
and they exchanged punches, they even reached further, opposite of my
direction. I also stayed at that moment out of curiosity and I watched them
fighting for few more minutes until the car driver can no longer fight.

Because there were also a car parking on the side, the two men fighting
reach that corner of the parked car.
After that, the two suddenly released each other. The man driving the red car
went back and open the driver seat door while the cyclist took off his bike
and it looks like the dispute ended, although there were still exchanges of
verbal confrontation.

Q5: What happened after the fistfight?


A5: My first position was in the street to see a good view of the fight, when I
feel that the fight is over, I went up to the easement of the road but
continuously watched them leave.
After the cyclist walk with his bike for few meters away, the red car driver
went out again this time he was holding a handgun, he said to the biker
what now while running directly to the biker and point the gun right at his
face and fired it. The biker last words was Pare, Sagit.

Q6: What did you do after the shooting happened?


A7: Mixed emotions. I was shocked, scared and feared for my life. I suddenly
run to hide. While I am running I heard more gunshots fired.

Q8: What happened next to the driver of the red car?


A8: He fled and drove towards Ayala Bridge.

Affiant further sayeth naught.
