The Rules of Procedure for
Environmental
Cases
were
formulated by the Supreme Court
to provide swift resolution of
environmental cases and to effect
immediate grant of its remedies.
Its provisions are intended to be
applied to favor the constitutional
right of the people to a balanced
and healthful ecology. However,
the
incorporation
of
the
precautionary principle in the
Rules and the lack of definite
standards for the enforcement of
the Writ of Kalikasan to limit the
discretion of claimants, or of the
Court, in asserting or granting,
respectively,
the
remedies
provided by the Writ go against
the policy of the State in
encouraging private enterprise
and needed investments. This
thesis aims to propose the proper
standards for the enforcement of
the said remedies in view of the

seem to clash with emerging
practices on reproductive health
and embryo research. Via a
review

international
documents,
trends,
and
customary laws, this thesis aims
to resolve the apparent conflicts,
ambiguities,

gaps

international

unborn children to clear the
ground for a working recognition
of their rights and to craft local

The United Nations Convention
Against Corruption (UNCAC)
provides that each State Party
shall adopt and maintain
systems for the recruitment,
hiring, retention, promotion, and
retirement of civil servants and
non-elected public officials that
include adequate procedures for
the selection of individuals for
public positions considered
especially vulnerable to
corruption. Past events and
disclosures of individuals (e.g.,
PNP officials, Senators,
Committee hearings, and news
articles), suggest that the
current procedure wherein
local chief executives are given
the authority to select the PNP
chiefs (as provided in Section
51, Republic Act 6975) in their
jurisdiction is vulnerable to
corruption. There is therefore a
need to examine whether
our municipal law is consistent
with the objectives of the
UNCAC and to take legislative
measures, if appropriate.

1982 United Nations Convention
on the Law of the Sea, the
Philippines has the obligation to

living resources in its exclusive
economic zone. Despite having
