The Rules of Procedure for
Environmental
Cases

formulated by the Supreme Court
to provide swift resolution of
environmental cases and to effect
immediate grant of its remedies.
Its provisions are intended to be
applied to favor the constitutional
right of the people to a balanced
and healthful ecology. However,
the
incorporation
of
the
precautionary principle in the
Rules and the lack of definite
standards for the enforcement of
the Writ of Kalikasan to limit the
discretion of claimants, or of the
Court, in asserting or granting,
respectively,
the
remedies
provided by the Writ go against
the policy of the State in
encouraging private enterprise
and needed investments. This
