I. COURSE DESCRIPTION AND OBJECTIVES

The Rules in Special Proceeding is part of Remedial or Procedural law.


These Rules govern proceedings in special cases mainly for the
purpose of establishing a right and status of a person,or merely to
establish a particular fact.

The Rules of Court identified fourteen(14) subject matters governed


by these rules. These 14 subject matters are set forth from Rules 73 to
108 of the Rules of Court. Noted are the amendatory laws on the
following rules of procedure: Rules 99 on Adoption and Rule 100 on
revocation of Adoption have been repealed by the passage of R.A
8552on Domestic Adoption Act and R.A. 8043 on Intercountry
Adoption while Rule 104 on voluntary dissolution of corporations have
been repealed by Section 19 of the Corporation Code of the
Philippines

Furthermore, Rule 105 on the procedure for judicial approval of


voluntary recognition of minor natural children and Rule 106 on the
procedure for the constitution of family home have been rendered
obsolete by the passage of the Family Code.

By virtue of these aforementioned amendatory laws, the subject


matters governed by the rules on Special proceedings have now been
reduced from fourteen(14) to ten(10) subject matters The procedures
applicable to these subject matters as enumerated in the rules of
court, as well as the governing laws, and applicable principles and
jurisprudential rulings in special proceedings cases and the
amendatory laws on adoption and other related amendments shall be
the principal focus of this course.

Upon completion of this course, students will be able to:a)gain


knowledge of the intricacies and procedural mechanics of court
litigation involving cases governed by rules of special

proceedings;.b)to know and understand the essential concepts and
applicability of the rules governing special proceedings in a
theoretical court litigation setting and;c)to gain skills and develop the
power of methodical thinking through case analysis and comparative
learning.

Methodology

The course will focus on lectures, oral recitations and group


discussions which shall be conducted in every session. Oral
recitations on assigned cases and case analysis shall also be
conducted on a regular basis in order to develop the students
ability to analyze and discern the theory of each case in line
with the study of procedural rules relative to special
proceedings. This is designed to develop the students skill and
power of deep thinking and analysis, reasoning and facility for
expression. Surprise quizzes and participatory academic
discussion will also be conducted to challenge their knowledge
of the assigned laws and stimulate their analytical mind and
develop their argumentative capability.

The course will also be taught through individual and group


reports, submission and discussion of written reports and
comparative analysis of cases assigned; interdisciplinary study
and participatory academic discussion; hypothetical cases-
problem solving and case reporting.

V. COURSE POLICIES

The use of electronic device is permissible during lecture and


class discussion but not during examination. The use of
cellphones and other electronic devices like IPADare prohibited
during the exam.
