andproceduresofademocraticregimeandforHumanRights
Yourresponsewithin45daysiskindlyrequestedpursuanttotheAdministrative
ProcedureReformAct(1958).
DearDrMatania:
Instantinquiryfollowsmediareportsregardingreorganizationofthecyberarea,and
aspartofmyongoingresearchinegovernment.Mypublicationsinthefieldofe
governmentinIsraelandintheUShavebeenpublishedinacademicperiodicalsand
incorporatedintointernationalofficialreports.MymaininterestisinITsystemsthat
arecritical/vitalforthesafeguardofdemocraticinstitutionsandHumanRights.
PursuanttotheShinBetAct(2002):"TheShinBetischargedwiththesafeguardof
Statesecurity,proceduresandinstitutionsofademocraticregime"Ihavenotfound
similarlanguageinpublicationspertainingtothenewNationalCyberBureauorthe
newNationalCyberAuthority.
However,tothebestofmyunderstanding,pursuanttotheNationalInstitutions
SecurityAct(1998),evenpriortothereorganization,theShinBetwasnotcharged
withcertificationandsecurityofITsystemsoftheentities,listedbelow.Moreover,in
allthecases,listedbelow,ITsystemswerefoundseriouslylackinginvalidity,
integrityandinternalsecurity:
1. CentralElectionCommitteeparticularlytheDemocracysystem.Inits
responseonaFOIArequest,theCommitteestatedthattheShinBet(Reem)
examinedandcertifieditssystems.However,inresponseoninquirywithShinBet
HeadNadavArgamanIreceivedcompletedenialoftheCommitteesstatement.
Moreover,theCommitteesresponseasawholeexhibitedseriouslackofintegrity.
2. KnessetparticularlyITsystemswhichareusedformaintainprotocolsand
recordsoflegalnature.TheKnessetfailedtodulyansweronFOIArequests
pertainingtoauthorities,certificationandsecurityoftheKnesset'sITsystems.
3. SupremeCourtparticularlyITsystemsthatareusedtomaintainelectronic
renditionsoftheoriginaldecisionandjudgmentpaperrecords.TheSupreme
Courtselectronicsystemsshowacriticalsecurityandintegritycompromising
eventaround2002.TheAdministrationofCourtsfailedtodulyansweronFOIA
requestsrelatedtothe2002event,orpertainingtoauthorities,certificationand
securityofITsystemsoftheSupremeCourt.

4. DistrictandMagistrateCourtsNetHaMishpatcasemanagementsystem,fully
implementedaround2010.Lackofintegrityandsecurityhasbeendocumentedin
numerouscases,theJudgeVardaAlshech"FabricatedProtocols"scandalbeingthe
mostwidelyknown.TheextremeexampleisStateofIsraelvRomanZadorov
(50207)intheNazarethDistrictCourt,wherenovalid2010Verdictand
Sentencingrecordsaretobefound,andwheretheCourtdenieddueaccessto
inspectjudicialrecords.AdministrationofCourtsfailedtodulyansweronFOIA
requestspertainingtoauthorities,certificationandsecurityofNetHaMishpat
system.
5. PrisonServiceparticularlyITsystemsthatareusedforadmissionandreleaseof
personsfromprison.ThecapabilityofthePrisonServicerelativetodetecting
validityofelectronicrecords,originatinginthecourtsisdoubted.ThePrison
ServicefailedtodulyansweronFOIArequestspertainingtoauthorities,
certificationandsecurityofITsystemsofthePrisonService.
6. MinistryofJustice:a)EnforcementandCollectionAuthorityparticularlyIT
systemsthatareusedintheDebtors'Courts,suchasKelimShluvim,implemented
around2015,b)DetaineesCourtsITsystemsthatareusedforcase
management.TheMinistryofJusticeandEnforcementandCollectionAuthority
failedtodulyansweronFOIArequestspertainingtoauthorities,certificationand
securityofthecorrespondingITsystems.
Therefore,followingthereorganizationofthecyberarea,Ihereinkindlyrequestthat
youclarify,whichagencyoftheStateofIsraelischargedwithcertificationand
securityofITsystemsthatarevital/criticalfordemocraticinstitutionsandprocedures
andforHumanRightsintheStateofIsraelingeneral,andintheabovelistedentities
inparticular.
