ofBasilan,doherebystateunderoaththat:

1. ThataccusedRodegelioTurco,Jr.isoflegalage,single,Filipino
citizenandresidentof#124Km.6,BegangBarangay,MunicipalityofIsabela,
ProvinceofBasilan;

2. Thatthevictim,EsceleaTabada,thirteen(13)yearsofage,single,
Filipinoandresidentof#123Km.6,BegangBarangay,MunicipalityofIsabela,
ProvinceofBasilan,andthedaughteroftheaffiant;

3. Iaccuseandherebychargetheaccused,RodegelioTurco,Jr.,ofthe
crimeofRapeunderArticle266AoftheRevisedPenalCode,asamendedby
the AntiRape Law of 1997, having carnal knowledge of the abovenamed
victimthroughforce,threat,orintimidation;

4. That onorabout7:00pmon8thdayof July,1998,withinthe

grassypartatKm.6,BegangBarangay,MunicipalityofIsabela,Provinceof
Basilan,Philippines,theabove namedaccused,calledoutthevictiminher
house,andwhensheopenedthedoor,theaccusedcoveredthevictimsface
withtheuseofatowelandbidthevictimtowalk.

5. Afterwalkingforabout10minutesandreachingagrassypartnear
apigpen,theabovenamedaccused,bytheuseofforce,threatandintimidation,
didthenandtherewillfully,unlawfullyandfeloniouslygrabtheabovenamed
byherneck,coverhermouthandforciblymakeherliedown,afterwhichthe
saidaccused mounted ontopof her andremovedher shortpantandpanty.
Thereafter,thesaidaccused,bytheuseofforce,threatandintimidation,inserted
hispenisintothevaginaoftheundersignedcomplainantandfinallysucceeded
tohavecarnalknowledgeofher,againstherwill;

6. Forthecrimecommittedbytheaccusedonthevictim,thelatterhas
endureddamagephysicalandpsychologicaldamage,forachildofonlytwelve
(12)yearsofage.Theactcommittedalsoinjuredthenameandreputationofthe
family.Forthisreason,IamholdingtheaccusedRodegelioTurcoJr.civilly
liableforFiftyThousandPesos(P50,000)innominaldamages,FiftyThousand
Pesos (P50,000) in moral damages, and Fifty Thousand Pesos (P50,000) in
exemplarydamages.

INFORMATION

The Undersigned accuses RODEGELIO TURCO, JR., of the

crime of Rape under Article266AoftheRevisedPenalCode,as
amendedbytheAntiRapeLawof1997,committedasfollows:

Thatonoraboutthe8thdayofJuly,1998,andwithinthe
jurisdiction of this Honorable Court, viz., at Km. 6, Begang
Barangay, Municipality of Isabela, Province of Basilan,
Philippines,theabovenamedaccused,bytheuseofforce,threat
and intimidation, did then and there willfully, unlawfully and
feloniouslygrabtheundersignedcomplainant,byherneck,cover
hermouthandforciblymakeherliedown,afterwhichthesaid
accusedmountedontopofherandremovedhershortpantand
panty.Thereafter,thesaidaccused,bytheuseofforce,threatand
intimidation,insertedhispenisintothevaginaoftheundersigned
complainantandfinallysucceededtohavecarnalknowledgeof
her,againstherwill.

I, Rodegelio Turco, Jr., Filipino, with assistance of counsel, and a

Basilan,doherebystateunderoaththat:

1. IrecentlylearnedthatIhavebeenaccusedofthecrimeofrape
underArticle266AoftheRevisedPenalCodeinI.S.No.1613,filedbya
certain Alejandra Tabada on 9 September 1998 before the Office of the
ProvincialProsecutorforBasilan;

2. ThatthechargeisbasedallegedlyontheactsthatIcommitted,
havingcarnalknowledgeoftheabovenamedvictimthroughforce,threat,or
intimidationonacertainEsceleaTabada,twelve(12)yearsofageanddaughter
ofthecomplainantAlejandraTabada,onorabout7:00pmon8thdayofJuly,
1998, within the grassy part at Km. 6, Begang Barangay, Municipality of
Isabela,ProvinceofBasilan;

3. There is no truth to the allegations in Alejandra Tabladas

complaint.ThereisnofactualnorlegalbasistochargemeofthecrimeofRape
underArticle266AoftheRevisedPenalCodeasamendedbyAntiRapelawof
1997. The Complaint must be dismissed. To rebut and contradict Alejandra
Tabladascomplaint,Isetforthtruecircumstancesoftheeventsthattranspired:

3.1. That I and the victim Escelea Tabada were formerly

sweetheartsatthetimethatthesaidactwassupposedlycommitted;

3.1. ThatthecomplainantAlejandraTabladadoesnotapproveof
myrelationshipwiththeallegedvictim,aswearesecondcousins;

3.2. ThatonJuly8,1998,about5:30pmintheafternoon,Iwent
tothehouseoftheallegedvictimtoborrowaguitar,whichIwouldneed
onaschoolplaythatwouldtranspireonabout7:00pmonDiLasalle
Basilan.TheallegedvictimrepliedthatIwouldhavetoaskherfathers
permission,andtoldthemetocomebackat6:00pm;

3.3. Onabout6:00pm,Ireturnedtothehouse,butthealleged
 victimsfatherwasnotyetaround.Sincethevictimwasmysweetheart,I
pleaded her to borrow the guitar even without the permission of her
father.Shethenletmeborrowtheguitar.Rightafter,IleftandwenttoDi
LasalleBasilanfortheschoolplay;

3.4. On about 7:00 pm, when the crime of rape of allegedly

committed,theIwasalreadyatDilasalleBasilanintimefortheschool
play;

4. ItisutterlyinexplicablethatAlejandraTabladawouldaccusemeof
thecrimeofrapewhenallIdidatthattimewastoperforminaschool.The
complaintmayhavebeeninstitutedduetothefactthatthecomplainantdoesnot
approveofmyrelationshipwiththeallegedvictim,aswearesecondcousins;

5. Forthisreason,itiscertainlyincomprehensiblethatIshouldstand
accusedofthecrimeofrapeofEsceleaTabadabythecomplainant.Iperformed
noactofcarnalknowledgethroughforce,threat,orintimidationon Escelea
Tabada.IperformedNOACTthatevenremotelyresemblesanyoftheacts
punishedunderArticle266AoftheRevisedPenalCode,asamendedby
theAntiRapeActof1997.

4. Consideringtheforegoing,Irespectfullysubmitthatthereis no
primafaciebasistoconclusethatthecrimeofrapeorthatanycrimeatallhas
beencommitted.Thecomplaintagainstmeshould,thus,bedismissed.

MOTION TO QUASH

THE ACCUSED, RODEGELIO TURCO, JR., by counsel, respectfully

moves to quash the Information for the crime of rape on the following:

GROUNDS

1. THIS COURT IS WITHOUT JURISDICTION OVER THE

OFFENSE CHARGED.

In support, the accused respectfully states that:

ARGUMENT

The information was filed in the Regional Trial Court, Branch 3 of

Basilan, which is located in the municipality of Lantawan. As stated in the
information, the offense was committed in Km. 6, Begang Barangay,
MunicipalityofIsabela,ProvinceofBasilan.

InaccordancewithRule110,Section15(a)underCriminalProcedureof
theRulesofCourt,criminalactionshouldbeinstitutedandtriedinthecourtof
themunicipalityorterritorywheretheoffensewascommitted,orwhereanyof
theessential ingredients occurred. Since the information alleges thatall acts
constitutingthecrimeofrapeoccurredintheMunicipalityofIsabela,Province
ofBasilan,theRegionalTrialCourt,Branch1locatedinMunicipalityofIsabela
isthecourtofproperjurisdictiontotrythecriminalcase,notthishonorable
court.
 WHEREFORE,itisrespectfullyprayedthattheInformationagainstthe
accused be QUASHED and that the accused be released immediately from
detention.
