COMPLAINT-AFFIDAVIT

I, CHRISTINE AMISOLA RAMOS, Filipino, of legal age,

and with residence at Gomez Street, Brgy. Capitol Site, Cebu
City, after having been duly sworn in accordance with law,
hereby depose and state that:

(1) This complaint-affidavit is being filed to charge Nilo P.

Marquez, Filipino, of legal age, and with residence at
Burgos Street, Brgy. Capitol Site, Cebu City, of the crime of
Rape under Article (Art.) 266 of the Revised Penal Code
(RPC), committed as follows:

(a) On 14 January 2017, at around 08:00 in the

evening, I was on my way home, walking along Burgos
Street and was about to turn left at the corner towards
Gomez Street when Nilo Marquez, approached me.

(b) He asked me about some products he said he

bought in one branch of the company I was working
with and later asked me to come over their house to
see if the products were genuine.

(c) Since he was a childhood friend and a neighbor, I

decided to heed his invitation.

(d) On the way to their house, we passed by a narrow

path where Marquez suddenly pushed me inside a
small, low building, which turned out to be Marquezs
stock room.

 (e) Marquez then barred the door, whipped out a fan
knife and poked it against me and told me Huwag
kang mag-iingay, kung hindi papatayin kita!

(f) Marquez then asked me to lie on the table, I resisted

and shouted but he would cover and would whip out
his fan knife, poking it to me. Out of fear for my life, I
followed his orders.

(g) He tied my hands and legs while I was lying on the

table and with my legs apart Marquez drew his short
pants down to his knees, and after lowering my
underpants, he inserted his penis into my vagina.

(h) I was crying and shouting but he later on decided

to cover my mouth with a handkerchief.

(i) Thereafter, he reiterated his threats to kill me and my

family should I tell anyone about what happened.

(2) It took me several days before I was able to overcome

my fear and told my mother, Teresita Ramos, what
happened to me because Marquez would send me
threatening messages.

(3) Enraged by what happened, my mother and I went to

the police station to report the crime committed by
Marquez against my person. The police took my sworn
statement, a copy of which is hereto attached and made
an integral part hereof as Annex A. Thereafter, I was
examined by their medico-legal officer. A copy of the
Medico-Legal Report is likewise hereto attached and made
an integral part hereof as Annex B.

(4) The elements of rape are carnal knowledge, force or

intimidation, and the commission of the act without the
consent or against the will of the woman, or when the
latter is under twelve (12) years of age or when she is
deprived of reason or otherwise unconscious.

(5) Based on the foregoing, it is beyond cavil that

respondent Nilo Marquez committed the crime of rape
punishable under Art. 266 of the RPC. He had sexual
intercourse with me against my consent and will, and with
force and intimidation.

(6) Further, whenever the crime of rape is committed with
the use of a deadly weapon or by two or more persons,
the penalty shall be reclusion perpetua to death.
AFFIANT FURTHER SAYETH NAUGHT.
