despite my 27 February 2017 request to withdraw the notice dated 10 February 2017 this to my
knowledge didnt occur prior to 1 March 2017.
10 While I was attending to the trees a passenger by stopped and I understood from his comments that
more than likely Banyule City Council was targeting to get back on me for my past comments such as
opposing the amendment to the federal constitution to be recognised as a level of government, etc.
As you are aware I stood as an opponent in a precious council election against you.
For sure when I planted the trees some 16 years ago I all along counted on it that one day Banyule
15 city council would be on my back about those trees overhanging my property fence, and well it
obviously did so, this regardless that in the past I kept the trees within boundary line.
Again, in my view a height of 2.5 metres is absurd as I yesterday read the tallest man of about 2.3
metres recently died at age 32 and surely the world wouldnt have been worried about the entire
world having clearance of footpaths just in case this man may happen to venture onto a footpath. It
20 would have been unlikely he would visit every country in the world let alone travel specifically to
Graham Road, unless wanting to talk to me personally about the crappy municipal council I have.
But realistically council itself must be a model citizen and so if this officer Craig Tipson wasnt sent
out merely as to become some cash revenue collector and for this issue notices for up to $2,000 fines
then surely one would have expected that instead of what I consider this form of terrorism upon
25 citizen she would have done a proper job to ensure that Banyule City council itself complied with its
own by-laws.

It must be clear that council trees are failing to provide a 2.5metres clearance OVER FOOTPATHS AS
WELL AS OVER THE ROADWAY.

The arrow shows a background tree on a nature strip not to be confused with the trees on my
property. This as the red line indicates it is at the about 2.5 metres mark clear from the footpath.

An owner or occupier of land must not cause or allow any tree, hedge, plant or
vegetation of any kind to:
(a) overhang or encroach any road or footway at a height less than 2500mm; or
(b) obstruct a footpath.

If Officer Craig Tipson therefore is unable to notice the low hanging trees along roads and over
footpaths then clearly it in my view no sense to have him employed. Neither to have a councilor
10 being a mayor who cannot understand that is nothing more but as I view it a form of terrorism
upon a citizen when the 2.5 metres clearance is ignored repeatedly by Banyule City Council
itself.

On 7 January 2016 I was driving along past Austin Hospital when I noticed an overturned
wheelchair. I pulled over to come to the assistance of this person. I made a photo of the
inappropriate filling of the footpath and of this person in the wheelchair. While since then this
area has been attended to the issue is that Banyule City Council I view clearly failed its duty as
20 toward pedestrians to allow such a dangerous condition to exist in the first place.
On 28 February 2017 this fire danger existed (and I understand still does) at Rosanna Railway
station (Image on the left) and 16 January 2017 at Bell Street. One have to wonder why have a
mayor and a deputy major if they cannot even have attended to fire danger growth? Pestering
25 citizens while blatantly disregarding councils own DUTY OF CARE I view cannot be accepted
as appropriate conduct. Indeed, to me it underlines that Banyule City Council is no more but
seeking to misuse legal provisions as some backdoor manner to collect monies, as itself clearly
in different ways blatantly ignore its own DUTY OF CARE and responsibilities in general.
