DELPHOS — School dis-
trict voters will see the 1
percent Earned Income Tax

November General Election
Ballot.
The district faces a def-
icit of nearly $100,000 in
Fiscal Year 2010-11; nearly
$500,000 in FY 2011-12; and
more than $750,000 in FY
2012-13.
The district has also prom-
ised to allow two upcoming
operating expense levies to
lapse: in 2013 and 2014;
that will shave approximate-
ly 3.9 mills from property
owners.
The Earned Income Tax, if
passed, will be collected from
wages and self-employment
earnings, to include earnings
from partnerships. This does

$1.5 million per year.
The net gain to the dis-
trict will be the equivalent
of approximately 5 mills or
$850,000.
The tax excludes Social
Security, unemployment and
welfare benefits, interest,
dividends, capital gains, pen-

nings and income earned by
estates.
If passed, it would take
18 months before the district
begins to fully collect the
tax.

plies down to below what is
really needed and the only

sort. Some municipalities say
‘OK, if you’re not a prop-
erty owner, before we put
the water in your name, we
need a deposit to ensure we
get our money.’ The reason
we have it in the property
owner’s name is because the
city can file a lien against the
property.”
Berquist said landlords
are not without precaution-
ary measures, such as screen-
ing prospective tenants with
a background check. He also
said they can call the city’s
administrative office to make
sure water bills are being
paid. That way, unpaid bills
will not become as steep as
Lehmkule indicated.
“Of the 2,600 services
we have, we get less than
a dozen issues every quar-
ter. It’s not a huge prob-
lem. What we have here
are complaints from people
who want the city to collect
their bills for them and we
can’t get in the middle of
that. There are four that we
see every time and they are
the same four who don’t
want to go through the evic-
tion process because they
don’t want to hire an attor-
ney,” he said. “They would
also have to file paper-
work and that would cost
them money. They should
do what they need to do
through the courts to evict
them. My understanding is
that it only takes about four
weeks to evict someone, so
some property-owners are
not being diligent to protect
their own interests.”

cap installed on oil leak

cap on top of the leaking well
in the Gulf of Mexico, BP
prepared today to begin tests
to see if it will hold and stop
fresh oil from polluting the
waters for the first time in
nearly three months.
The oil giant expects to
know within 48 hours if
the new cap, which landed
Monday after almost three
days of painstaking, around-
the-clock work a mile below
the Gulf’s surface, can stanch
the flow. The solution is only
temporary, but it offers the
best hope yet for cutting off
the gush of billowing brown
oil.
The cap’s installation

Gulf Coast residents who

make good on its promise to

warned that even if the oil
is stopped, the consequences
are far from over.

WASHINGTON — The
words of the Obama admin-
istration were unequivocal:
Sudan must do more to fight
terror and improve human
rights. If it did, it would be
rewarded. If not, it would be
punished.
Nine months later, prob-
lems with Sudan have grown
worse. Yet the administration
has not clamped down. If
anything, it has made small
conciliatory gestures.
Activists say the back-
tracking sends a message
that the United States is not
serious about confronting
Sudanese President Omar
al-Bashir, whom an inter-
national court charged with
genocide on Monday.
“They had a fine strategy.
They just haven’t implement-
ed it,” said Amir Osman, a
senior director at the Save
Darfur Coalition. “Nobody
will take them seriously until
they do what they said they
would do.”
The White House denies
it has abandoned the strict
course it set. It says there
have been signs of progress
in Sudan despite a recent rise
in violence in Darfur and a
crackdown on opposition by
the government.

report strong earnings starting
this week. Not so for small
businesses that can’t get loans
— or hire freely until they
do.
The gap helps explain why
the economic rebound isn’t
stronger and could even stall.
Federal Reserve Chairman
Ben Bernanke stepped up
pressure Monday on banks
to break the logjam and
lend more to smaller firms,
which employ at least half of
American workers.
Small business owners
are relying on personal credit
cards or raiding retirement
accounts to stay afloat, the
Fed chairman said.
Bernanke and other regu-
lators have urged banks for
months to lend more to small-
er companies. Lawmakers
have complained that small
businesses that want loans are
having trouble getting them.
Banks have countered by say-
ing demand remains weak.
The Fed does have author-
ity to create programs to
increase lending, such as
providing low-cost loans to
banks. But economic condi-
tions would probably have to
weaken considerably before
the Fed would propose such a
move. One such program set
up during the 2008 financial
crisis was recently closed.
Fiorina faces fundraising challenge in California

SACRAMENTO, Calif.
— Republican U.S. Senate
candidate Carly Fiorina is at
a fundraising disadvantage
in many parts of California,
including her home turf in the
Silicon Valley, as she tries
to unseat three-term incum-
bent Sen. Barbara Boxer, an
Associated Press review of
campaign finance data shows.
That means the former
Hewlett-Packard Co. chief
executive will have to look
outside California for dona-
tions or write checks from her
personal fortune if she hopes
to be competitive in a state
where it’s notoriously expen-
sive to campaign statewide.
Although Fiorina is a mul-
timillionaire, it’s unclear how
much of her personal fortune
she’s willing to spend in her
first run for public office.
When she announced last fall,
Fiorina said she would not
self-fund her campaign and so
far she has given $5.5 million
in loans, meaning she expects
to be repaid.

gubernatorial candidate
Meg Whitman, a billionaire,
already has spent more than
$90 million of her own money
in her campaign, not in the
accused it of sponsoring ter-
rorism. The genocide charges
against al-Bashir follow war
crime charges filed against
him last year. Militias backed
by his government are
accused of slaughtering civil-
ians in the Darfur region in
a conflict that has killed an
estimated 300,000 people.
The United States also is
concerned about preserving
a 2005 peace agreement from
a separate conflict between
the mostly Muslim north and
predominantly animist and
Christian south. Under the
deal, the south is to hold
a referendum in January in
which it is likely to vote to
secede. Details have not been
worked out, however, and
there are fears the vote could
ignite another war.
U.S. officials have been
divided about how to deal
with Sudan. Some argue that
only a tough line can end
Sudan’s violence. Others,
notably White House envoy
Scott Gration, say it is critical
to work with the government
to ensure that any secession
by the south occurs peace-
fully.
President Barack Obama
settled on something of a
compromise. On Oct. 19, his
administration announced
that the Sudanese government
would be rewarded for mak-
ing progress, but punished if
it failed to do so.

access to loans. One of them
is Marilyn Landis of Basic
Business Concepts Inc. of
Pittsburgh, which compiles
financial documents for other
small businesses.
Landis says she would
like to hire one or two more
people for her 10-person firm
and wants to expand into New
England. Yet even though she
says she’s never missed a
payment, Landis says her line
of credit was cut about 18
months ago.
She relies on credit cards
to pay for everything from
supplies to payrolls. Without
additional credit, she says, “It
is impossible to expand, and I
can’t hire.”
Nearly one-third of small
business borrowers report
difficulty arranging credit,
the National Federation of
Independent Businesses says.
By contrast, big business-

second-quarter earnings this

The money race is impor-
tant because of the high cost of
running a statewide campaign
in California, where millions
of dollars are required for can-
didates to buy television and
radio ads critical for making
an impression on voters and
driving up name recognition.

recent campaign-finance
reports, Boxer had raised
$17.3 million through June
5, compared to $3.5 million
for Fiorina when not counting
her personal loans. Of that,
39 percent of Boxer’s total, or
$6.8 million, came from out-
of-state donations, compared
with 32 percent, or $1.1 mil-
lion, for Fiorina.
“The fact that she has
not done as well in raising
money from sources other
than herself compared to
Boxer may suggest a certain
lack of enthusiasm among
her potential donors,” said
Marty Kaplan, director of
the Norman Lear Center at
the University of Southern
California Annenberg School
of Communication.

together with Norway and the
United Kingdom, criticizing
Sudan for worsening human
rights violations throughout
the country and for breaking
cease-fires in Darfur, noting
its use of aerial bombardment
and the deployment of local
militias.
Yet the U.S. has not pun-
ished Sudan. Instead, it has
offered small incentives. The
State Department recently
expanded visa services for
Sudanese citizens in its
embassy in Khartoum. It also
sent a low-level representa-
tive to al-Bashir’s inaugura-
tion.

say how much the organiza-
tion will invest in Fiorina,
but said she definitely will
get help.
“We will work to make
sure Carly has all the resources
she needs to run a competitive
race and win in November,”

Dillon takes Earnhardt’s
No. 3 to Victory Lane

CHARLOTTE, N.C. — Dale
Earnhardt last drove his famed
No. 3 to Victory Lane almost
10 years ago, at Talladega, in
the final win of his illustrious
career.
He was killed less than a
year later in an accident on the
last lap of the Daytona 500 and
there’s been a long debate since
over how his storied number
should be used. The answer for
Richard Childress, who holds
the rights to the number, was
sparingly.
He’s allowed Dale Earnhardt
Jr. to use it three times, most
recently two weeks ago at
Daytona, where he drove it to a
victory in the Nationwide Series
race. And he’s assigned it to
his grandson, Austin Dillon, a
rookie in the Truck Series.
What did Dillon do? Drove
the black No. 3 to Victory Lane
on Sunday at Iowa for his first
career victory at NASCAR’s
national level. It marked con-
secutive weeks that a driver took
the No. 3 to Victory Lane and
just the third win with that num-
ber since Earnhardt’s death.
It’s perhaps the most icon-
ic number in NASCAR and
elicits more emotion than
Richard Petty’s No. 43 or the
Wood Brothers’ No. 21. Since
NASCAR doesn’t retire num-
bers, the 43 and 21 have been
used long beyond their heyday.

Racing with The Intimidator’s
stamp on the side of the car is
pressure-packed for the driver.
And watching it on the track
can provide mixed emotions for
fans, who can feel both somber
and elated by the sight of the 3.
It’s why Earnhardt Jr. is ada-
mant he won’t use the number
again. He’s 2-for-3 borrow-
ing his father’s number, with
his other victory coming in a
Nationwide race at Daytona in
2002.
Dillon doesn’t have the same
emotional pull.
The 20-year-old sophomore
at High Point University was in
middle school when Earnhardt
was killed and his history with
the number is based more on
legend than what he remembers.
But he understands the impor-
tance of the No. 3, particularly
to race fans.
And unlike Earnhardt Jr.,
Dillon enjoys using the num-
ber.
Dillon’s use of the num-
ber doesn’t resonate with fans
the same way it does as when
Earnhardt Jr. is in a No. 3 car.
But he’s NASCAR’s most pop-
ular driver and the son of the
7-time champion.
Dillon is a young driver who
hasn’t had much time to build
a following. And in his grand-
father’s equipment at Richard
Childress Racing, he’s on a
fast-track to stardom that’s not
afforded to other young drivers.

Steinbrenner dies at 80

NEW YORK — George
Steinbrenner, who rebuilt
the New York Yankees into
a sports empire with a mix
of bluster and big bucks that
polarized fans all across
America, died today. He had
just celebrated his 80th birth-
day July 4.
Steinbrenner had a heart
attack, was taken to St. Joseph’s
Hospital in Tampa, Fla., and
died at about 6:30 a.m, a per-
son close to the owner told The
Associated Press. The person
spoke on condition of ano-
nymity because the team had
not disclosed those details.
His death was the sec-
ond in three days to rock the
Yankees. Bob Sheppard, the
team’s revered public address
announcer from 1951-07, died
Sunday at 99.
For more than 30 years,
Steinbrenner lived up to his
billing as “the Boss,” a nick-
name he earned and clearly
enjoyed as he ruled with an
iron fist.
He was known for feuds,
clashing with Yankees great
Yogi Berra and hiring manager
Billy Martin five times while
repeatedly clashing with him.
But as his health declined,
Steinbrenner let sons Hal and
Hank run more of the family
business.

Delphos Pirates had the best
regular-season record in the
Tri-County Little League in
2010.
That didn’t matter Monday
night at Art Mosier Field of
Van Wert’s Smiley Park.
The Greif Rangers, behind
the 14-strikeout pitching of
Drew Myers, knocked them
out in the semifinals of the
season-ending tournament
with an emphatic 11-2 vic-
tory.
Myers tossed 110 pitch-
es (62 for strikes) in ceding
three hits and two earned runs,
walking four.
The Pirates (23-2) got
their only runs on the night in
the top of the first. With one
down, Josh Warnecke walked,
moved up on a wild pitch and
scored on Jace Stockwell’s
single to right center, taking
second on the throw home. He
advanced on a wild pitch and
scored on a ground ball by
Hunter Binkley. Two errors
on the play allowed Binkley
to reach second and a 2-out
David Ortiz wins HR Derby with 11-homer final

David Ortiz believes his
power swing is all the way
back. After a big finish in the
Home Run Derby, Boston’s
beloved slugger has a trophy
to prove it.
Big Papi won his first derby
title Monday night, hitting 11
homers in the final round to
beat Florida’s Hanley Ramirez
at Angel Stadium.
Showing plenty of potency
in the fierce swing that once
made him one of the majors’
most feared hitters, the Red
Sox star put a relentless series
of drives into the elevated
stands above the right-field
wall.
With Yankees bench coach
Tony Pena crossing rivalry
lines to feed fastballs straight
into his wheelhouse, Ortiz hit
21 homers in the first two
rounds of his fourth derby
before holding off Ramirez to
emerge from a field missing
most of baseball’s top power
hitters.
“This is my fourth time, so
I just kind of used the experi-
ence,” Ortiz said. “I wanted to
come here and make sure the
fans enjoy what we do.”
Ortiz triumphantly held
up the trophy featuring two
crossed bats. He dedicated his
performance to former major-
league pitcher Jose Lima, a
Dominican Republic native
who passed away in May
after paramedics found him in
cardiac arrest at his Southern
California home.
Steinbrenner was in fragile
health for years, resulting in
fewer public appearances and
pronouncements. Yet dressed
in his trademark navy blue
blazer and white turtleneck,
he was the model of success:
the Yankees won seven World
Series titles and 11 American
League pennants after his reign
began in 1973.
He appeared at the new
Yankee Stadium just four times:
for the opener in April 2009,
for the first two games of last
year’s World Series and for this
year’s home opener, when cap-
tain Derek Jeter and manager
Joe Girardi went to his suite and
personally delivered his seventh
World Series ring.
Till the end, Steinbrenner
demanded championships. He
barbed Joe Torre during the
2007 AL playoffs, then let the
popular manager leave after
another loss in the opening
round. The team responded last
year by winning another title.
Steinbrenner fainted at a
memorial service for NFL star
Otto Graham in 2003, appeared
weak in 2006 at the ground-
breaking for the new Yankee
Stadium and later became ill
while watching his grand-
daughter in a college play.
Still, the former Big Ten
football coach took umbrage
when others questioned his
fitness.
“No, I did not have a stroke.

Greif pieced together three
hits in the fourth, includ-
ing a leadoff solo home run
to left by Myers (4-for-4, 2
Ramirez, Ortiz’s fellow
Dominican slugger and former
Boston teammate, matched
Papi’s 21 homers in the first
two rounds, pulling most of
his shots over the left-field
wall. But Ortiz became just the
second slugger to reach double
digits in the final round, while
Ramirez managed only five.
“It’s good for him,”
Ramirez said. “He’s been
through a tough time. I know
he’s going to come back in the
second half.”
Ortiz reached the derby
semifinals in 2005 and 2006
but hadn’t been back in the
field since. His entire career
was on the skids after he strug-
gled in 2009 and again in
April but Boston’s longtime
star is back on his game with
18 homers and 57 RBIs this
season, earning his sixth All-
Star berth.
“I’ve been dealing with
so many things the past few
years,” Ortiz said. “Coming
back here (to another All-
Star game), I want to thank
the players for giving me the
opportunity to be here. This
is a job that we have but it’s
called a game. That’s what I
try to do during the season —
have fun with my teammates
and make sure everything goes
the right way.”

Cabrera were eliminated in
the second round, with Hart
failing to connect after hitting
13 in the opening round and
then waiting about 90 minutes
for his second crack. Ortiz
finished with 13 in the second

often with one stipulation; that
no one be told who made the
donation.
The Yankees paid off for
him, too, with their value
increasing more than 100-fold
from the $8.7 million net price
his group paid in January 1973.
He freely spent his money,
shelling out huge amounts for
Jeter, Reggie Jackson, Alex
Rodriguez, Torre and others in
hopes of yet another title.
All along, he envisioned
himself as a true Yankee

five first-time competitors and
no returning champions.
Ryan Howard, Albert Pujols,

co-leaders Adam Dunn and
Joey Votto and Texas’ Josh
Hamilton, who hit 28 homers
in a single round at Yankee

Still, eight sluggers took
aim at the artificial rock pile,
moss and trees behind the
center-field wall at Angel
Stadium, the long-standing
Orange County park that
underwent a thorough renova-
tion in recent years.
The Anaheim crowd booed
Ortiz during pregame intro-
ductions, still remembering
several years of postseason
clashes between his Red Sox
and the Los Angeles Angels.
But Ortiz hadn’t homered at
Angel Stadium since hitting a
shot during the 2007 AL divi-
sion series.
Ortiz hit eight homers in
the opening round, which
included plateside delivery of
a towel and a refreshing drink
from laughing Tampa Bay
closer Rafael Soriano.
Ortiz took control of the last
round with consecutive hom-
ers on his first four swings.
Ramirez couldn’t catch up, hit-
ting three straight before ending
it by making outs on six of his

To many, though, the
Yankees and Steinbrenner
were synonymous.
His fans applauded his win-
at-all-costs style. His detrac-
tors blamed him for spiraling
salaries and wrecking base-
ball’s competitive balance.
Steinbrenner made no apol-
ogies for bombast and behav-
ior, even when it cost him
dearly.
He served two long suspen-
sions: he was banned for 2 1/2
years for paying self-described
gambler Howie Spira to dig
up negative information about
Winfield; and for 15 months
following a guilty plea in feder-
al court for conspiring to make
illegal campaign contributions
during the Watergate era.

Jimenez, Price to start
tonight: Ubaldo Jimenez is always
eager to share his accomplish-
ments with a support system that
runs from Denver to the Dominican
Republic.
His home nation and adopted
hometown will be tuned in when
Jimenez takes the mound for one
of his most memorable outings
yet. The Colorado ace will start for
the National League in the All-Star
game, while the AL will counter with
Tampa Bay’s David Price.
In this year of the pitcher,
Jimenez was a fitting pick Monday
by Phillies manager Charlie Manuel
over Florida’s Josh Johnson.
The NL will try tonight to end
a 13-year drought in baseball’s
Midsummer Classic. Jimenez (15-
1) has a 2.20 ERA in 18 starts and
127 innings for the surging Rockies.
Price is 12-4 with a 2.42 ERA.
Johnson is 9-3 with a majors-best
1.70 ERA for the Marlins.
Jimenez’s parents will be in the
stands at Angel Stadium, along with
his host family from Colorado and
other family and friends.
Philadelphia slugger Howard
will be the National League’s desig-
nated hitter and bat cleanup for his
regular skipper, Manuel.
There was some confusion,
however, about Boston 3B Adrian
Beltre. AL manager Joe Girardi
announced that Texas 3B Michael
Young would replace Beltre, who
left Sunday’s game at Toronto with
a strained left hamstring.
But less than an hour later,
Beltre said he planned to play.
He worked out at Angel Stadium
on Monday afternoon and was
deemed ready to go.

Els feels like he’s in good shape for British Open

— Nothing like a trip to the
Old Course to get Ernie Els
out of his U.S. Open funk.
Els has been look-
ing forward to coming
to St. Andrews since he
stormed out of Pebble
Beach, enraged he’d let
a chance at a third U.S.
Open title slip away.
Though he missed the cut at
the next two events he played,
Els arrived at the British Open
filled with confidence and
enthusiasm.
“I’m obviously not the big
story here this week but I
feel I’m playing OK,” he said
today. “I feel I’ve got a good
chance this week. I’ve got a
lot of experience and I think
it’ll help me.”
At 40, Els is having his
best season in years — and
one of the best of his career.
He ended a 2-year drought at
the World Golf Championship
at Doral, then became the
tour’s first double winner of
the year two weeks later with
a victory at the Arnold Palmer
Invitational. It was the first
time the South African had
won back-to-back tourna-
ments in seven years.
He has six top-10 finish-
es in 13 starts on the PGA
Tour. He’s also second on the
European Tour’s money list
and is sixth in the world golf
rankings.
And if not for a bad 3-hole
swing at Pebble Beach, he
might have a fourth major
title.

“I have so much expe-
rience that I know what not
to do and to hit that shot I did
on 10 near the ocean there
and making double there, I
just couldn’t forgive myself,”
said Els, who finished third,
two strokes behind Graeme
McDowell. “I just felt very
disappointed there because I
had the perfect start and I
just had to keep it alive and I
probably would have been, at
worst, in a playoff. But I just
self-destructed a little bit.”
Hard to come by at any
age, major titles are a rarity
for players over 40. But Els
said he wasn’t bothered so
much by the ticking clock as
he was letting an opportunity
get away from him.
And the next one starts
Thursday.
Els has loved St. Andrews
since he first played it at 17.
This is his fourth British Open
on the Old Course, where
experience can be as big a
factor as talent.
“I think I still have a decent
chance of playing well here
this week and maybe having
a chance,” Els added. “If I can
get into position like I was at
the U.S. Open Championship,
I’d like to finish it off.”

Barefoot Bandit’s hometown applauds capture

CAMANO ISLAND, Wash. — Residents
of the rural island where the “Barefoot Bandit”
first learned to dodge police through thick ferns
and cedar trees are lashing out at the teen’s
mother, saying it wouldn’t be right for her to
profit off a two-year crime spree that has finally
landed him in a Bahamian jail.
Authorities and victims of Colton Harris-
Moore, 19, have long suggested that his mother
is at least partly to blame for his alleged behav-
ior — breaking into unoccupied vacation homes
and using credit cards that weren’t his, stealing
cash, cars, boats and even five airplanes. His
first conviction for stolen property came at age
12.
But recent word that she has hired a well-
known Seattle entertainment and intellectual
property lawyer who has represented the likes
of Courtney Love and the father of Jimi Hendrix
drew widespread derision here. Many residents
assume she’s trying to profit from her son’s
crimes through movies or books.
“Of course she wants the money. She doesn’t
work,” said Joshua Flickner, whose family
owns a grocery store on Camano Island. “What
makes me more angry than the fact that she’s
trying to profit off this is that there’s any profit
to be had. There shouldn’t be a profit — he’s
a criminal. He’s damaged people — average
people, middle-class people.”
Harris-Moore was due in court Tuesday in
Nassau on suspicion of illegal weapons posses-
sion and what officials described as a “litany”
of other charges stemming from his week in the
Bahamas.
Having apparently made his way across the
U.S. in a series of stolen vehicles, he arrived in
the Bahamas on July 4 in a plane taken from an
Indiana airport. He was captured early Sunday
after a high-speed boat chase during which
police shot out his motor.
Prosecutors in the U.S. are also preparing
cases against him. He is suspected in about 70
property crimes across eight states and British
Columbia, many of them in the bucolic islands
of Washington state.
Harris-Moore’s mother, Pam Kohler, lives
in the trailer where she raised him on Camano
Island. It sits deep in thick woods, down a long
gravel drive past a spraypainted sign warning
trespassers that they’ll be shot. She did not
return a call seeking comment, but issued a
statement through her lawyer.
“I am very relieved that Colt is now safe and
that no one was hurt during his capture,” it said.
“I have not yet been able to speak to him. It has
been over two-and-a-half years since I have
seen him, and I miss him terribly.”
Harris-Moore spent Monday being ques-
tioned by investigators. Police Commissioner
Ellison Greenslade described him as eloquent,
calm, cooperative and “obviously a very intel-
ligent young man,” but declined to say whether
he made any confession.
Greenslade said the defendant could be
extradited to the U.S. relatively quickly, but
declined to comment further on the handling
of the case.
Kohler spent several hours Monday meeting
with her attorney, O. Yale Lewis, who down-
played any profit motive his new client might
have. He said she contacted him for advice after
being inundated by requests from news report-
ers as well as inquiries about book and movie
deals.
“Her feelings are relief and exhaustion,”
Lewis said. “Obviously, there is enormous
interest in this story, and she wants to be careful
about how to proceed. But her first concern has
been to make sure her son is safe, and I think
she hasn’t given much thought beyond that.”
Kohler’s older sister, Sandra Puttmann, of
Arlington, was the first relative to hear from
Harris-Moore after his arrest Sunday. She said
he’s “holding up” but scared now that he’s in
custody for the first time since he walked away
from a halfway house south of Seattle and began
his two-year theft spree. Harris-Moore didn’t
have his mother’s phone number, she said.
She gave it to him, but as of Monday night,
he still had not spoken with Kohler.
“I’m so glad he got through to me,” Puttmann
said. “At least he heard a friendly voice. We
cried together.”
Puttmann declined to divulge further details
of what she described as their brief phone con-
versation Sunday. But she angrily criticized
news stories about her nephew, saying reporters
typically gloss over his difficult upbringing.
Police routinely accused him of stealing even
when he hadn’t and school officials didn’t give
him a chance, she alleged — something police
and school officials have adamantly denied.
Harris-Moore told a psychologist in 2008 that
his mother was abusive when she’d been drink-
ing, according to a court document cited Monday
by The Herald newspaper of Everett. His father
left when he was a toddler, and his stepfather
died when he was 7, Kohler has said.

United States vows to
keep pursuing Polanski

LOS ANGELES — The pursuit of Roman Polanski will con-
tinue, but only to the extent the director allows it.
Authorities in the United States roundly denounced the decision
by the Swiss government to set Polanski free, dealing another twist
in a sex case that has spanned three decades and two continents.
From prosecutors in Los Angeles to justice officials in
Washington, D.C., the Swiss decision was described as a disap-
pointment and to some, an injustice.
Los Angeles County District Attorney Steve Cooley called it a
“disservice to justice and other victims as a whole.”
The Swiss, for their part, described Polanski as “a free man.”
That largely depends on the director’s movements. A warrant for
his arrest remains active, effectively barring the 76-year-old from
returning to the U.S., which he fled in 1978 on the eve of sentencing
for a charge of having unlawful sex with a 13-year-old girl.
The ruling cannot be appealed, and within hours of the ruling
Polanksi appeared to have left the multimillion dollar chalet where
he had been confined on house arrest since last year. He is free to
return to his native France, which does not extradite its citizens.
Prosecutors have tried to arrest Polanski during his travels
before, and vowed to continue the effort after Monday’s ruling.
“The United States believes that the rape of a 13-year-old child
by an adult is a crime, and we continue to pursue justice in this
case,” State Department spokesman P.J. Crowley said.
Cooley, who is running for California attorney general, said his
office will work with federal officials to have Polanski returned for
sentencing if he’s arrested in a country with a favorable extradition
treaty. Cooley’s office said last September after Polanski’s arrest
that it had previously sought his arrest in England, Thailand and
Israel.
The Oscar-winning director of “Rosemary’s Baby,” “Chinatown”
and “The Pianist” was accused of plying his victim with champagne
and part of a Quaalude during a 1977 modeling shoot and raping
her. He was initially indicted on six felony counts, including rape
by use of drugs, child molesting and sodomy, but pleaded guilty to
one count of unlawful sexual intercourse.
The Swiss government said its decision to reject extradition for
Polanski was based in part on U.S. authorities failing to turn over
transcripts of secret testimony given by the attorney who originally
handled the director’s case. The testimony remains sealed, and can
only be used if the former prosecutor was unavailable for an eviden-
tiary hearing, a Los Angeles court spokesman said.
The testimony “should prove” that Polanski actually served his
sentence while undergoing a court-ordered diagnostic study after
charges were filed, the Swiss Justice Ministry said.
Prosecutors: Blago owed $1.2M

CHICAGO — Rod Blagojevich owed his defense attorneys
more than $1.2 million in early 2008 after years of federal inves-
tigations into his administration, prosecutors said Monday at the
ousted Illinois governor’s corruption trial.
In March 2008, prosecutors said, the Chicago law firm of
Winston & Strawn was pressing the governor for payment after
receiving nothing since the previous year, and that Blagojevich
eventually settled the bill for $750,000 — much of it from cam-
paign contributions.
Prosecutors offered into evidence an FBI chart showing
the campaign money flowing into Blagojevich’s legal defense
— designed to illustrate that the former governor personally
benefited from the political donations jurors have heard him
pressing hard to get.
Blagojevich’s defense team tried to get U.S. District Judge
James B. Zagel to bar the government from showing jurors the
chart. Zagel said it was too detailed and called on the govern-
ment to produce a toned-down version.
“There isn’t a scintilla of evidence in the document the gov-
ernment wants to present that shows that Gov. Blagojevich is
guilty of the crimes that are charged,” defense attorney Sheldon
Sorosky said. He also said that the bills were from Blagojevich’s
former attorneys and that his current defense team isn’t getting
close to the same high rates.
Prosecutors brought out their chart as the defense called for a
delay of two weeks or longer in the trial. Blagojevich’s lawyers
said the government — which is expected to rest its case this
week — is so far ahead of schedule that they are having trouble
rounding up witnesses who had not expected to take the stand
until August.
“We have a constitutional guarantee to call witnesses,”
defense attorney Sam Adam Sr. told reporters. He said lawyers
for some of the subpoenaed defense witnesses are on vacation.
“Here we are, stuck with very few witnesses” who would be
available immediately, he said.
Blagojevich, 53, has pleaded not guilty to scheming to trade
or sell President Barack Obama’s former Senate seat and plot-
ting to launch a racketeering operation in the governor’s office.
His brother, Robert Blagojevich, 54, has pleaded not guilty to
taking part in the alleged scheme involving the Senate seat and
plotting to pressure businessmen for donations.
Winston & Strawn is the large Chicago firm that, when it
was headed by former Gov. James R. Thompson, provided a
free legal defense to former Gov. George H. Ryan — who was
eventually convicted of racketeering and fraud and is serving a
6 1/2-year sentence.
Blagojevich retained the firm to defend him as the scandals
surrounding his administration grew, but parted ways after set-
tling his bill there. His defense team now consists of Adam and
his son, Sam Adam Jr., Sorosky and Aaron Goldstein as well
as a group of lawyers who do the behind-the-scenes work. The
new team has still been billing the campaign fund with court
approval.
Gunman shoots girlfriend, kills 2

ALBUQUERQUE, N.M. — Officers raced past dead and
injured bodies in a New Mexico manufacturing plant as they
looked for a gunman who had wounded his girlfriend during
a confrontation before fatally shooting two of her co-workers
then himself.
Three others were wounded during Monday’s rampage at
Emcore Corp., which police say capped a bitter child custody
dispute between the man and his girlfriend.
Authorities identified the gunman as Robert Reza, 37, a
former employee at the Albuquerque plant. Reza had addresses
in Rio Rancho and Albuquerque.
The girlfriend remained hospitalized in critical condi-
tion with gunshot wounds Monday night. Two of the other
wounded people were in stable condition at University of New
Mexico Hospital, while the third was treated and released,
hospital spokesman Billy Sparks said.
No other names were released.
Police Chief Ray Schultz said the girlfriend had told co-
workers she planned to report domestic violence to authorities.
He said Reza acted alone.
“His primary target was his girlfriend at the facility,”
Schultz said. “He knew her routine and confronted her outside
the business.”
Schultz said the only criminal background discovered for
Reza were drunken driving arrests in 2003 and 2000. The
chief said there was at least one previous domestic violence
call involving the gunman outside Albuquerque but he didn’t
have details.
It wasn’t known how Reza was able to force his way past
Emcore security. He went through the building firing shots at
several workers and leaving behind a gruesome scene of blood
and shell casings across the company headquarters.
Responding officers had to step past several victims — one
dead and several wounded — as they raced into the building
to stop the gunman. Mayhem unfolded as Reza opened fire,
sending employees fleeing for cover as police locked down the
entire neighborhood.
“This is the worst nightmare you can think of,” Schultz
said. “No one wants to have a situation like this occur in their
community.”
He said the gunman and his girlfriend had children who
live in Rio Rancho and said they were taken into custody by
“another agency.”
Schultz called the Emcore campus a “very secure facil-
ity” and said detectives and FBI agents reviewed surveillance
video, which confirmed witnesses’ accounts.
“It’s a large and complex shooting scene,” he said.
He said more than 220 people were transported by bus from
Emcore buildings to a community center, where detectives
interviewed them. Employees also were offered grief counsel-
ing and treatment for asthma or diabetic conditions.
US may keep Iroquois from
tourney over global travel rules

NEW YORK — The teams participating in the World Lacrosse
Championships in England represent 30 nations, from Argentina
to Latvia to South Korea to Iroquois.
The Iroquois helped invent lacrosse and, in a rare example
of international recognition of Native American sovereignty,
they participate at every tournament as a separate nation. But
they might not be at this year’s world championship tournament
because of a dispute over the validity of their passports.
The 23 players have passports issued by the Iroquois
Confederacy, a group of six Native American nations overseeing
land that stretches from upstate New York into Ontario, Canada.
The U.S. government says it will only let players back into
the country if they have U.S. passports, a team official said. The
British government, meanwhile, won’t give the players visas if
they cannot guarantee they’ll be allowed to go home, the official
said.
Iroquois team members born within U.S. borders have been
offered U.S. passports, but the players refuse to carry them,
because they see the government-issued documents as an attack
on their identity, said Tonya Gonnella Frichner, a member of the
Onondaga Nation who works with the team.
“It’s about sovereignty, citizenship and self-identification,” said
Frichner, who also is the North American Regional Representative
to the U.N. Permanent Forum on Indigenous Issues.
The Iroquois have used their own passports in the past, but
State Department spokesman P.J. Crowley said the new dispute
can be traced to the Western Hemisphere Travel Initiative, which
went into effect last year. The new rules require, among other
things, that Americans carry passports or high-tech documents to
cross the country’s borders.
Tribes’ efforts to meet the new security requirements have been
ongoing. A group of Native American leaders requested funding
from the Department of Homeland Security in 2009 to develop
cards that would comply with the new rules, according to an
agency document. Idaho’s Kootenai tribe and U.S. Customs and
Border Protection agreed last year to develop the first enhanced
tribal card acceptable under the new guidelines.
Asked whether the Iroquois passport could be acceptably
modified to meet the stricter standards, Crowley referred ques-
tions to the Department of Homeland Security.
That agency declined to discuss the specifics of the case. Matt
Chandler, a Homeland Security spokesman, said his agency was
working with the Department of State and others to resolve the
issue.
Today, the Iroquois team is ranked No. 4 by the Federation of
International Lacrosse and represents the Haudenosaunee — an
Iroquois Confederacy of the Oneida, Seneca, Mohawk, Tuscarora,
Cayuga and Onondaga nations.
Mate piloting tug in duck boat
crash pleads 5th Amendment

PHILADELPHIA — A crew member refusing to talk to fed-
eral investigators about a fatal duck boat crash in Philadelphia
was piloting the tugboat pushing a barge that slammed into the
duck boat, a Coast Guard official said Monday.
The mate exercised his Fifth Amendment right against self-
incrimination and refused to meet with investigators over the
weekend, according to the National Transportation and Safety
Board.
U.S. Coast Guard Capt. Todd Gatlin confirmed to The
Associated Press that the mate was on duty as the tug pushed
a 250-foot barge up the Delaware River. The crew of the duck
boat told the NTSB that its radio calls to the tug “received no
response,” although other boat operators nearby reported hear-
ing them.
The collision last week sank the tourist vessel, dumping 37
people overboard and killing two young Hungarians.
The tug, The Caribbean Sea, had been moved to Philadelphia
on June 24, Gatlin said. It previously had been in New York
Harbor, according to Joseph Dady, a national tug safety advo-
cate who once piloted the vessel.
The tug’s crew consisted of a captain, the mate, an engineer
and two deckhands, the NTSB said.
“The mate was on duty ... and the captain was off,” Gatlin
told the AP.
By law, either the captain or mate must be at the wheel
at all times, said Dady, president of the National Mariners
Association and a member of the Coast Guard’s Towing Safety
Advisory Commission.
An 18-year-old trainee had been at the wheel of the duck
boat when it entered the water, but the captain took over when
the engine appeared to smoke, a passenger said Monday. The
pair cut the engine, dropped anchor and were waiting calmly
for help for several minutes when they saw the hulking barge
bear down on them.
“Our younger fellow was out there flailing and calling, and
obviously nobody saw him. I came to find out that nobody was
on deck on the barge,” passenger Sandy Cohen said Monday
from her home in Durham, N.C. “And then they couldn’t reach
them by radio.”
Mel’s meltdown gets worse as
another taped argument is released

LOS ANGELES — Mel Gibson was heard allegedly acknowl-
edging he hit the mother of his 8-month-old daughter in a recording
released Monday by a celebrity news website.
The eight-minute recording posted by RadarOnline.com was
purportedly a phone argument between Gibson and then-girlfriend
Oksana Grigorieva.
A voice sounding distinctively like the Academy Award-winner
was heard telling Grigorieva that she “deserved” to be hit after she
chastised him for allegedly punching her in the face and breaking
two of her teeth.
“What kind of a man is that?” she was heard saying. “Hitting a
woman when she’s holding a child in her hands? Breaking her teeth
twice in the face! What kind of man is that?”
“Oh, you’re all angry now!” Gibson allegedly responds. “You
know what, you ... (expletive) deserved it!”
Alan Nierob, a spokesman for Gibson, declined comment on the
tape.
The former couple have been locked in a bitter custody dispute in
Los Angeles. The 40-year-old singer has accused Gibson of domestic
violence, prompting sheriff’s officials to launch an investigation.
Los Angeles County Sheriff’s Department spokesman Steve
Whitmore said investigators will evaluate the recordings.
“There apparently are audio recordings that we will also review,”
Whitmore said Monday. He declined to say where detectives would
obtain the recordings, or if Gibson had been interviewed by authori-
ties.
“Everything is part of the investigation,” he said. “Anything that is
connected to the case we will investigate.”
He said there was no timeframe for the inquiry to be concluded.
After detectives conclude their work, the case will be turned over
to the district attorney’s office, which will decide whether to pursue
criminal charges.
