MOTION TO RESET HEARING

The Republic of the Philippines, through the Office of the Solicitor

General, respectfully states:

1. On 19 December 2011, undersigned counsel received a copy

of the Court's Order dated 1 December 2011, setting the continuance of

the presentation of applicant's evidence on 1 March 2012 at 8:30 in the

morning.

2. However, undersigned counsel will not be able to attend the

said scheduled hearing as he has a previously set hearing in Civil Case

No. 02-102561 entitled Bureau of Customs, Plaintiff, versus First

Nationwide Assurance Corporation, Defendant at Branch 45, Regional

3. Thus, undersigned counsel humbly begs the indulgence

of the Honorable Court that the hearing in this case be reset to a

later date at the Honorable Court's convenience.

4. This motion is not intended for delay but solely for the

purpose above mentioned.

Wherefore, it is respectfully prayed that the scheduled hearing

be reset to a later date at the Honorable Court's convenience.
