Sir,

I am a woman employee of Birla Shloka Edutech Limited, located at

Birla Shloka Edutech Limited, Melstar House, G-4, M.I.D.C. Cross
Road A, Andheri (East), Mumbai-400 093. Mr. Mohandas Shenoy Adige
and Mr. Jignesh Mehta are the Directors of the Company and Mr.
Girdharilal Lath is the Managing Director of the Company. Mr.
Yashovardhan Birla is the Chairman of the Company.

I had a meeting with Mr. Vijay Mishra, the Company

Secretary/Compliance Officer/C.E.O. of the Company on 07.05.2013
and apprised him about my pregnancy and requested him to sanction
me leave for 10 days from 07.05.2013 17.05.2013 on medical
grounds on account of my pregnancy. I assured him that even though I
would be on leave, I would attend to mails and phone calls and would
respond to vendors as well as internal queries as regards the business
of the Company and would report on duty on 20.05.2013. The said Mr.
Vijay Mishra duly sanctioned my said leave during the said meeting. I
therefore was on leave from 08.05.2013 and addressed an e-mail in
the morning on 08.05.2013 to the said Mr. Mishra placing on record
therein the above mentioned facts.

To my utter shock and consternation, I was addressed an e-mail

08.05.2013 in the evening by the Company through Wing Commander
Mr. Sanjay Shukla terminating my services with effect from the same
day itself.

I addressed a letter dated 12.05.2013 to the said Wing Commander Mr.

Sanjay Shukla placing all facts on record and requesting to recall my
illegal termination and reinstate me. I thereafter reported to the
Company for duty on 20.05.2013 but was not allowed to even enter the
office. However, I was thereafter called by the said Wing Commander
Mr. Sanjay Shukla wherein I was asked to forward my sonography
reports to prove my pregnancy. I therefore addressed an e-mail dated
22.05.2013 to the said Wing Commander Mr. Sanjay Shukla enclosing
therewith my sonography report dated 02.05.2013. Despite the same, I
was still not allowed to report on duty and therefore I addressed two
Legal Notices dated 01.08.2013 and 30.09.2013 to the Company
through my Advocates M/s. Sanjay Udeshi and Company. The

Company responded to my letter and notices by giving totally

disingenuous and evasive replies and refused to reinstate me. I say
that I was unable to follow-up the matter as I was in advanced stage of
pregnancy. I delivered on 07.12.2013. I am annexing herewith as
Annexure-A colly all the above-referred documents.

I say that the termination of my services by the Company during my

pregnancy is totally illegal and malafide and the same is against the
provisions of the Maternity Benefit Act, 1961. I therefore request you to
kindly intervene in the matter at your earliest by taking appropriate
action against the Company and its Directors/Chairman/Officials
mentioned herein above and also set aside the illegal order of
termination of my services and reinstate me with full back wages and
consequential benefits w.e.f. 08.05.2013.I also request you to direct
the Company to pay my earned wages for the months of March, April
and May 2013.
