1. AN ORDINANCE CREATING A FAUQUIER COUNTY BROADBAND AUTHORITY AND A


RESOLUTION ESTABLISHING ARTICLES OF INCORPORATION FOR THE AUTHORITY -
The attached Ordinance and Resolution adopts an ordinance establishing a Broadband
Authority and a resolution creating the Articles of Incorporation for the Authority. (Richard

2. A RESOLUTION TO ADOPT THE 2017-2018 THROUGH 2022-2023 SIX-YEAR PLAN FOR
SECONDARY ROADS (SSYP) AND THE 2017-2018 FISCAL YEAR BUDGET - Pursuant to
Section 33.2-331 of the Code of Virginia, 2014, as amended, a joint public hearing will be held
with the Board of Supervisors and a representative from the Virginia Department of
Transportation (VDOT) to receive public comment on the proposed Secondary System
Construction Program for Fiscal Year 2017-2018 through Fiscal Year 2022-2023. The
Transportation Committee considered the Secondary Six-Year Plan (SSYP) at its meetings on
January 25, 2017 and February 22, 2017. On February 22, 2017, the Committee
recommended to the Board that the project list and priorities outlined in the attached resolution
be forwarded to VDOT by the June 1, 2017 deadline. (Richard Gerhardt, Cedar Run District

3. A ZONING ORDINANCE TEXT AMENDMENT TO ARTICLE 4 PART 6 TO REQUIRE ALL
POWER LINES SERVING A DATA CENTER TO BE UNDERGROUND AND TO ALLOW AN
ELECTRICAL SUBSTATION WITH APPROVAL OF A SPECIAL EXCEPTION - The proposed
text amendment affects only the Planned Commercial Industrial Development (PCID)
District. Currently, the district allows data centers by-right if they utilize recycled water;
otherwise, a Special Exception is required. The amendment would extend the Special
Exception requirement to any data center not served exclusively by underground power
lines. The amendment also adds an electrical substation as a use that can be approved by
Special Exception in the PCID district. On March 16, 2017, the Planning Commission
recommended approval of the proposed text amendment, as revised. (R. Holder Trumbo, Jr.,

4. A SUBDIVISION ORDINANCE TEXT AMENDMENT TO SECTION 3-2B TO ADD SIBLINGS
AS AN ELIGIBLE GRANTEE FOR A FAMILY DIVISION - The current family division provisions
in the Subdivision Ordinance allow the division to be created only for the child, grandchild,
parent or grandparent of the grantor. The proposed text amendment would add siblings as an
eligible grantee. On March 16, 2017, the Planning Commission unanimously recommended

5. A ZONING ORDINANCE TEXT AMENDMENT TO SECTION 14-101 TO CLARIFY THE LONG
STANDING ROLE OF THE PLANNING COMMISSION AS IT PERTAINS TO THE CAPITAL
IMPROVEMENTS PROGRAM - On February 9, 2017, the Board of Supervisors initiated a
review of Article 14 of the Zoning Ordinance as it pertains to the Planning Commission's role in
reviewing the County's Capital Improvements Program (CIP). Under 15.2-2239 of the Code of
Virginia, the Planning Commission may annually prepare and revise the County's CIP. This
responsibility is reflected in the County's Zoning Ordinance (Section 14-101.4) which directs the
Planning Commission, with the advice and assistance of County staff, to "Prepare and
recommend amendments to a Capital Improvements Program." In practice the County's CIP
has been prepared by the County Administrator and the Office of Management and Budget in
consultation with County Departments. Revising this provision would bring the Ordinance in line
with current practice. The Planning Commission would maintain its current role in evaluating
public facilities for substantial accordance with the Comprehensive Plan. The Planning
Commission reviewed the proposed amendment in March and unanimously recommended it for

6. A RESOLUTION TO CONSIDER REZONING REZN-16-006277 - ASPEN CLUB - AN
APPLICATION TO REZONE APPROXIMATELY 10.154 ACRES FROM PLANNED
RESIDENTIAL DEVELOPMENT (PRD) WITH PROFFERS TO GARDEN APARTMENT (GA)
WITH PROFFERS (PIN 6899-35-6574-000), LEE DISTRICT - The application is seeking to
rezone 10.154 acres from the existing Planned Residential Development (PRD) District with
proffers to Residential - Garden Apartment (GA), to allow for the development of an additional
24 multi-family units at Aspen Club. The property is located at 6337 Village Center Drive,
Bealeton. On February 16, 2017, the Planning Commission voted 5 to 0 to forward the
application to the Board of Supervisors with a recommendation of denial. (North Forty Aspen,
