ANALYSIS BYLAW

There are 28 by-laws used by Majlis Perbandaran Kajang (MPKj). We choose two by-laws to
be analysis. Firstly, Undang-Undang Kecil Pelesenan, Tred Perniagaan Dan Perindustrian
(MPKj) 2007.This UUK enacted to control all activities related to licensing, business trade
and industry within the Council area. It defines the powers reserved to the Council in terms of
licensing, fees charged and enforcement action can be taken including the prosecution of
offenses under the by-laws and also determine the conditions for an activity to be licensed
under this by-laws. This UUK enacted based on Section 102 and 102A of Local Government
Act 1976 (Act 171) .It divided into 5 parts and consists of 48 Undang-Undang Kecil
(UUK). This by-laws effective starting on 19th July 2007.There are several amendment on 19th
December 2013. One of the amendment is on Undang-Undang Kecil 43 which is to change
the word of premis berlesen with the word premis. Another amendment is replacement of
Second Schedule. This Undang-Undang Kecil Pelesenan, Tred Perniagaan Dan Perindustrian
(MPKj) 2007 now cited as Undang-Undang Kecil Pelesenan, Tred Perniagaan Dan
Perindustrian (MPKj) (Pindaan) 2013.This by-laws effective starting on the date its
publication in the gazette which is 19th December 2013.

Another by-laws used by MPKj is Perintah Pengangkutan Jalan (Peruntukan Tempat Letak
Kereta) (MPKj) 2007. This order is enacted to regulate activities related to the provision of
car parking within the Council area. It aims to control the flow of traffic and educate
consumers to park in parking spaces provided while ensuring that users pay charges charged.
It also defines the powers reserved to the Council for the implementation of enforcement
actions including prosecutions against offenses under this order. This UUK enacted based on
Section 72 of Akta Pengangkutan Jalan 1987 (Act 333). It divided into 9 parts and consists of
57 paragraph. This by-laws effective starting on 19th July 2007 and only apply to the
administrative area of MPKj. There are several amendment made on 2012 and 2013. One of
the amendment is inserting new paragraph 36A after paragraph 36. The paragraph 36A is
about clamping,removal and detention of motor vehicle. Another amendment is substitution
of paragraph 51. Paragraph 51 is about special parking spaces. This order is cited as Perintah
Pengangkutan Jalan (Peruntukan Tempat Letak Kereta) (MPKj) (Pindaan) 2012. On 2013,
there are several amendment to that Order. One of the amendment is new heading of Part IIIA
which is Part IIIA Season Parking Place. Another amendment is amendment of the First
Schedule and also substitution of the Second and Third Schedule. This order is now cited as
Perintah Pengangkutan Jalan (Peruntukan Tempat Letak Kereta) (MPKj) (Pindaan) 2013.This
by-laws effective starting on the date its publication in the Gazette.
