Kelas E / Ruang 303
pada tahun 1973 konflik antara Indonesia dengan Malaysia mencuat ketika dalam pertemuan
teknis hukum laut antara kedua negara, masing-masing negara ternyata memasukkan pulau
Sipadan dan pulau Ligitan ke dalam batas-batas wilayahnya. Indonesia merasa
berkepentingan dengan temuan tersebut untuk mengukuhkan P. Sipadan dan P. Ligitan. Maka
dicarilah dasar hukum dan fakta historis serta bukti lain yang dapat mendukung kepemilikan
dua pulau tersebut. Pada waktu yang sama Malaysia mengklaim bahwa dua pulau tersebut
sebagai miliknya sesuai peta unilateral 1979 malaysia serta mengemukakan sejumlah alasan,
dalil hukum dan fakta. Namun kedua belah pihak untuk sementara sepakat mengatakan dua
pulau tersebut dalam status quo. Pada tahun 1989, masalah P. Sipadan dan P. Ligitan baru
dibicarakan kembali oleh kedua negara.
Indonesia dan Malaysia sepakat menyelesaikan masalah ini secara bilateral yang diawali
dengan pertemuan pejabat tinggi kedua negara pada tahun 1992. Hasil pertemuan pejabat
tinggi menyepakati perlunya dibentuk Komisi Bersama dan Kelompok Kerja Bersama (Joint
Commission/JC & Joint Working Groups/JWG). Namun dari serangkaian pertemuan JC dan
JWG yang dilaksanakan tidak membawa hasil, kedua pihak berpegang pada prinsipnya
masing-masing yang berbeda untuk mengatasi kebutuan. Pertemuan pada tgl. 6-7 Oktober
1996 di Kuala Lumpur Presiden Soeharto dan PM. Mahathir menyetujui rekomendasi wakil
khusus dan selanjutnya tgl. 31 Mei 1997 disepakati Special Agreement for the Submission to
the International Court of Justice the Dispute between Indonesia & Malaysia concerning the
Sovereignty over P. Sipadan and P. Ligitan. Special Agreement itu kemudian disampaikan
secara resmi ke Mahkamah International (MI) pada 2 Nopember 1998. Dengan itu proses
ligitasi P. Sipadan dan P. Ligitan di MI mulai berlangsung. Kedua negara memiliki kewajiban
menyampaikan posisi masing-masing melalui Written pleading kepada Mahkamah
Memorial pada 2 Nopember 1999 diikuti, Counter Memorial pada 2 Agustus 2000 dan
reply pada 2 Maret 2001. Selanjutnya proses Oral hearing dari kedua negara bersengketa
pada 312 Juni 2002.
2.1 Bentuk penyelesaian sengketa wilayah antara Indonesia dan Malaysia terhadap
Pulau Sipadan dan Pulau Ligitan melalui International Court of Justice (ICJ)
ICJ kemudian menyatakan bahwa ukuran yang obyektif dalam menentukan kepemilikan
pulau-pulau tersebut adalah dengan menerapkan doktrin effective occupation sebagai pisau
analisis tersebut. Aspek penting dalam penentuan effective occupation ini ada Dua yaitu
keputusan adannya cut-off date dan bukti-bukti hukum yang ada. Cut-off date yang
ditentukan oleh Mahkamah Internasional adalah 1969. Maksudnya adalah semua kegiatan
setelah tahun 1969 seperti pembangunan resort dianggap tidak berdampak hukum sama
sekali. Mahkamah internasional melihat hanya berdasarkan bukti hukum sebelum 1969. Dapat
dimengerti bilamana hampir semua Juri MI yang terlibat sepakat menyatakan bahwa P.
Sipadan dan P. Ligitan jatuh kepada pihak Malaysia karena kedua pulau tersebut tidak begitu
jauh dari Malaysia dan faktanya Malaysia telah membangun beberapa prasarana pariwisata di
pulau-pulau tersebut.
Effective Occupation sendiri adalah doktrin hukum internasional yang berasal dari hukum
Romawi kuno. Effective occupation tidak bisa diterapkan kepada wilayah yang diatur
oleh perjanjian, keputusan hakim, keputusan arbitrasi, atau registrasi kepemilikan dengan
hukum yang jelas. Elemen kuncinya dalam aplikasi doktrin effective occupation adalah
ada tidaknya suatu perundang-undangan, peraturan hukum, atau regulasi terkait status
wilayah tersebut. Hal ini tentunya sejalan dengan makna dari occupatio (baca okupatio)
yang berarti tindakan administratif dan bukan berarti pendudukan secara fisik. Karena
temasuk doktrin internasional, effective occupation dikategorikan sebagai sumber hukum
materiil yang merujuk pada bahan-bahan/materi yang membentuk atau melahirkan
kaidah atau norma yang mempunyai kekuatan mengikat; dan menjadi acuan bagi
terjadinya sebuah perbuatan hukum
Mahkamah Internasional juga menolak argumentasi Indonesia bahwa kedua pulau sengketa
merupakan wilayah berada di bawah kekuasaan Belanda berdasarkan penafsiran atas pasal IV
Konvensi 1891. Penafsiran Indonesia terhadap garis batas 4 10 LU yang memotong P.
Sebatik sebagai allocation line dan berlanjut terus ke arah timur hingga menyentuh kedua
pulau sengketa juga tidak dapat di terima Mahkamah. Kejelasan perihal status kepemilikan
kedua pulau tersebut juga tidak terdapat dalam Memori van Toelichting (MvT).
Mahkamah Internasional juga menolak dalil alternatif Indonesia mengingat kedua pulau
sengketa tidak disebutkan di dalam perjanjian kontrak 1850 dan 1878 sebagai bagian dari
wilayah Kesultanan Bulungan yang diserahkan kepada Pemerintah Kolonial Belanda.
Penguasaan efektif dipertimbangkan sebagai masalah yang berdiri sendiri dengan tahun 1969
sebagai cut-off date mengingat argumentasi hukum RI maupun argumentasi hukum Malaysia
tidak dapat membuktikan klaim kepemilikan masing-masing atas kedua pula yang
bersengketa.
Dalam mengkaji bukti-bukti hukum sebelum 1969 yang menunjukkan adanya effective
occupation atas pulau-pulau Sipadan-Ligitan, Mahkamah mempertimbangkan bukti-bukti
yang diajukan kedua negara, yakni:
a. Indonesia mengajukan bukti-bukti adanya patroli AL Belanda di kawasan ini dari
tahun 1895 hingga 1928, termasuk kehadiran kapal AL Belanda Lynx ke Sipadan pada
November-December 1921; dan adanya survei hidrografi kapal Belanda Macasser di
perairan Sipadan Ligitan pada Oktober-November 1903. Patroli ini dilanjutkan oleh
patroli TNI-AL. Selain itu, bukti yang diajukan adalah adanya kegiatan perikanan
nelayan Indonesia pada tahun 1950-1960an dan bahkan awal 1970an.

Area Batas Laut International, sumber: UNCLOS
Dalam hukum laut internasional, the United Nations Convention on the Law of the Sea
(UNCLOS), mengdefinisikan sebuah pulau sebagai kawasan yang secara alami berbentuk
daerah tanah, dikelilingi oleh air, yang berada di atas air dalam keadaan air pasang (high
tides). Dalam kasus ini, tidak ada spesifikasi khusus tentang ukuran dan luas.
Disisi lain, karena hukum laut mengikuti prinsip Daratan, jadi secara inherently setiap pulau
mungkin memiliki beberapa tambahan zona atas laut seperti radius 12-mil dari laut
Teritorial (Territorial Sea/TS) 200 mil Zona Ekonomi Eksklusif (ZEE) atau dalam
beberapa kasus 350-mil diperpanjang oleh Continental Shelf (CS). Oleh karena itu,
meskipun pulau ini hanya sebuah titik pada peta, itu masih dapat menghasilkan mil
persegi 144 TS dan 40.000 mil persegi ZEE

PENUTUP
3.1 Kesimpulan
Argumentasi Indonesia bahwa kedua pulau sengketa merupakan wilayah berada di bawah
kekuasaan Belanda berdasarkan penafsiran atas pasal IV Konvensi 1891 itu juga ditolak oleh
mahkamah internasional. Penafsiran Indonesia terhadap garis batas 4 10' LU yang memotong
P. Sebatik sebagai allocation line dan berlanjut terus ke arah timur hingga menyentuh kedua
pulau sengketa juga tidak dapat di terima Mahkamah. Kejelasan perihal status kepemilikan
kedua pulau tersebut juga tidak terdapat dalam Memori van Toelichting. Peta Memori van
Toelichting yang memberikan ilustrasi sebagaimana penafsiran Indonesia atas pasal IV
tersebut dinilai tidak memiliki kekuatan hukum karena tidak menjadi bagian dari konvensi
1891. mahkamah juga menolak dalil alternatif Indonesia mengingat kedua pulau sengketa
tidak disebutkan di dalam perjanjian kontrak 1850 dan 1878 sebagai bagian dari wilayah
Kesultanan Bulungan yang diserahkan kepada Pemerintah Kolonial Belanda.
Penguasaan efektif dipertimbangkan sebagai masalah yang berdiri sendiri dengan tahun 1969
sebagai cut-off date mengingat argumentasi hukum RI maupun argumentasi hukum Malaysia
tidak dapat membuktikan klaim kepemilikan masing-masing.
3.2 Saran
Sebagai Pembelajaran dari kekalahan indonesia dalam sengketa Pulau Sipadan dan Ligitan
hendaknya menjadi pelajaran berharga bagi Indonesia. Langkah selanjutnya yang harus
dilakukan Indonesia dengan pembuatan peta yang memadai untuk didepositkan ke Sekjen
PBB, mengingat pentingnya kejelasan posisi batas-batas wilayah negara terutama batas-batas
lautnya. Agar memiliki kekuatan secara hukum internasional dan mengidentifikasi pulau-
pulau terluar yang termasuk dalam wilayah Indonesia. Hal ini dikarenakan posisi pulau-pulau
terluar dijadikan sebagai titik-titik pengukuran garis pangkal.

On behalf of the Government of the Republic of Indonesia and the Government of Malaysia,
and in accordance with Article 40, paragraph 1, of the Statute of the International Court of
Justice, we have the honour to transmit to you:
(1) a certified true copy of the Special Agreement for Submission to the International Court of
Justice of the Dispute between the Republic of Indonesia and Malaysia concerning
Sovereignty over Pulau Ligitan and Pulau Sipadan, signed at Kuala Lumpur on 31 May 1997;
(2) a certified true copy of the Procs-Verbal of the Exchange of Instruments of Ratification
between the Republic of Indonesia and Malaysia, signed at Jakarta on 14 May 1998.
The aforesaid Special Agreement entered into force, pursuant to its Article 6, paragraph 1, on
the date of exchange of instruments of ratification, i.e., on 14 May 1998.
In accordance with Article 35 of the Rules of Court, both Governments (the Government of
the Republic of Indonesia and the Government of Malaysia) hereby notify the Court of their
intention to exercise the power conferred by Article 31 of the Statute of the Court to choose a
judge ad hoc in these proceedings.
We further have the honour to inform you, in accordance with Article 40 of the Rules of
Court, that:
(1) H.E. Mr. Nugroho Wisnumurti, Director-General for Political Affairs, Department of
Foreign Affairs of the Republic of Indonesia, and the Ambassador Extraordinary and
Plenipotentiary of the Republic of Indonesia to the Kingdom of the Netherlands (whose name
will be communicated later to the Court) have been appointed as Agent and Co-Agent for the
Republic of Indonesia for the purpose of the present case, and their address for service at the
seat of the Court shall be: H.E. Mr. Nugroho Wisnumurti, Agent of the Republic of Indonesia,
and the Indonesian Ambassador to the Kingdom of the Netherlands, Co-Agent of the
Republic of Indonesia, before the International Court of Justice, Embassy of the Republic of
Indonesia to the Kingdom of the Netherlands, Tobias Asserlaan 8, 2517 KC The Hague.
(2) H.E. Datuk Abdul Kadir Mohamad, Secretary-General of the Ministry of Foreign Affairs,
Malaysia, and H.E. Mr. A. Ganapathy, Ambassador Extraordinary and Plenipotentiary of
Malaysia to the Kingdom of the Netherlands, have been appointed as Agent and Co-Agent for
Malaysia for the purpose of the present case and their address for service at the seat ofthe
Court shall be: H.E. Datuk Abdul Kadir Mohamad, Agent of Malaysia, and H.E. Mr. A.
Ganapathy, Co-Agent of Malaysia, before the International Court of Justice, Embassy of

1. SPECIAL AGREEMENT
The Government of the Republic of Indonesia and the Government of Malaysia, hereinafter
referred to as "the Parties";
Considering that a dispute has arisen between them regarding sovereignty over Pulau Ligitan
and Pulau Sipadan;
Desiring that this dispute should be settled in the spirit of friendly relations existing between the
Parties as enunciated in the 1976 Treaty of Amity and Co-operation in Southeast Asia; and
Desiring further, that this dispute should be settled by the International Court of Justice (the
Court),
Article 1
Submission of Dispute
The Parties agree to submit the dispute to the Court under the terms of
Article 2
Subject of the Litigation
The Court is requested to determine on the basis of the treaties, agreements and any other
evidence furnished by the Parties, whether sovereignty over Pulau Ligitan and Pulau
Sipadan belongs to the Republic of Indonesia or to Malaysia.
Article 3
Procedure
1. Subject to the time-limits referred to in paragraph 2 of this Article, the proceedings shall
consist of written pleadings and oral hearings in accordance with Article 43 of the Statute of
the Court.
2. Without prejudice to any question as to the burden of proof and having regard to Article 46
of the Rules of Court, the written pleadings should consist of:
(a) a Memorial presented simultaneously by each of the Parties not later than 12 months
afterthe notification of this Special Agreement to the Registry of the Court;
(b) a Counter-Memorial presented by each of the Parties not later than 4 months after the date
on which each has received the certified copy of the Memorial of the other Party;
(c) a Reply presented by each of the Parties not later than 4 months after the date on which
each has received the certified copy of the Counter-Memorial of the other Party; and
(d) a Rejoinder, if the Parties so agree or if the Court decides ex officio or at the request of
one of the Parties that this part of the proceedings is necessary and the Court authorizes or
prescribes the presentation of a Rejoinder.
3. The above-mentioned written pleadings and their annexes presented to the Registrar will
not be transmitted to the other Party until the Registrar has received the part of the written
pleadings corresponding to the said Party.
4. The question of the order of speaking at the oral hearings shall be decided by mutual
agreement between the Parties or, in the absence of that agreement, by the Court. In all cases,
however, the order of speaking adopted shall be without prejudice to any question regarding
the burden of proof.
Article 4
Applicable Law
The principles and rules of international law applicable to the dispute shall be those
recognized in the provisions of Article 38 of the Statute of the Court.
Article 5
Judgment of the Court
The Parties agree to accept the Judgment of the Court given pursuant to this
Special Agreement as final and binding upon them.
Article 6
Entry into Force
1. This Agreement shall enter into force upon the exchange of instruments of ratification. The
date of exchange of the said instruments shall be determined through diplomatic channels.
2. This Agreement shall be registered with the Secretariat of the United Nations pursuant to
Article 102 of the Charter of the United Nations, jointly or by either of the Parties.
Article 7
Notification
In accordance with Article 40 of the Statute of the Court, this Special Agreement shall be
notified to the Registrar of the Court by a joint letter from the Parties as soon as possible after
it has entered into force.
In witness whereof the undersigned, being duly authorized thereto by their respective
Governments, have signed the present Agreement.
Done in four originals in the English language at Kuala Lumpur on the thirty-first day of
May 1997.

The undersigned have met today for the purpose of exchanging the Instruments of Ratification
of the Special Agreement for Submission to the International Court of Justice of the Dispute
between Indonesia and Malaysia concerning Sovereignty over Pulau Ligitan and Pulau
Sipadan signed at Kuala Lumpur, Malaysia, on the 31st of May, 1997.
These Instruments, having been examined and found to be in due form, have been exchanged
today.
Done at Jakarta, this fourteenth day of May, in the year one thousand nine hundred and
ninety-eight, in duplicate.

Whereas, the "Special Agreement between the Government of the Republic of Indonesia and
the Government of Malaysia for Submission to the International Court of Justice of the
Dispute between Indonesia and Malaysia concerning Sovereignty over Pulau Ligitan and
Pulau Sipadan" was signed by the Minister for Foreign Affairs of the Republic of Indonesia
and the Minister for Foreign Affairs of Malaysia at Kuala Lumpur, Malaysia, on 31 May
1997;
And whereas, the Government of the Republic of Indonesia, in accordance with Article 6,
paragraph 1, of the Agreement, and having examined and considered the aforesaid
Agreement, has decided to ratify the said Agreement;
Now therefore, be it known, that the Government of the Republic of Indonesia do hereby
confirm and ratify the said Agreement and undertake to perform and carry out all the
stipulations therein contained;
In witness whereof, this Instrument of Ratification is signed and sealed by the Minister for
Foreign Affairs of the Republic of Indonesia;
Done at Jakarta this fourth day of May in the year one thousand nine hundred and ninety-
eight.

Annex 2
Whereas, the Special Agreement for Submission to the International Court of Justice of the
Dispute between Malaysia and Indonesia concerning Sovereignty over Pulau Ligitan and
Pulau Sipadan was signed at Kuala Lumpur on the thirty-first day of May, in the year one
thousand, nine hundred and ninety-seven;
And whereas, the Government of Malaysia in accordance with Article 6 of the Agreement has
decided to ratify the said Agreement;
Now therefore, the Government of Malaysia, having considered the said Agreement, hereby
confirms and ratifies the same and undertakes faithfully to perform and carry out all the
stipulations therein contained.
In witness thereof, this Instrument of Ratification is signed and sealed by the Minister of
Foreign Affairs, Malaysia.
Done at Kuala Lumpur this 24th day of April, in the year one thousand, nine hundred and
ninety-eight.
