1.0 INTRODUCTION

The Applicant, Smorgasburg Productons, LLC, is seeking site plan and special permit approval from the
City of Kingston Planning Board to construct and operate Smorgasburg Upstate, a seasonalflea market
and food vending use on the City of Kingston waterfront at the former Hutton Brickworks located at 200
North Street (p/o tax parcel48.84-L-4). The 20.8-acre project site is part of a76.7-aue tax parcelthat is
currently owned by North Street Brickworks, LLC, and which will be leased to the Applicant for the
operation of Smorgasburg as well as occasional smaller one-time events.

The proposed action is scheduled to run on Saturdays beginning August 6,2016 through October 2016,
and will operate between the hours of L0 AM and 8 PM, or dark. Buildings #6 and #7 (existing buildings
located on the project site) will be rehabilitated and utilized for flea market and food vending purposes.

The project site will be improved with new walkways (including ADA-compliant parking and walkways),
driveways, stormwater management facilities, including green infrastructure practices such as
bioretention areas and 331 gravel parking spaces (including eight paved parking spaces for the physically
challenged) and an additional 203 unpaved parking spaces. No new buildings will be constructed.

Seventy-five temporary food vendor and flea market stalls will occupy Buildings #6 and #7, which will
serve as cooking areas and storefronts for retail. Vendors will supply their own cooking apparatus. An
existing open area, adjoining the Hudson River, will be available for public use at the northeast corner of
the site providing open lawn area for picnicking and other passive and active recreation use.

The Full Environmental Assessment Form (FEAF) was provided to the City of Kingston on March 23,
2016, and the City of Kingston Planning Board (Board) declared themselves to be Lead Agency on May 9,
20L6, pursuant to GNYCRR , Part 6L7. A Board Resolution dated May LO,2016 was released in support of
the proposal to redevelop 200 North Street for the proposed Smorgasburg Upstate. The application is
scheduled for a special meeting of the Board on May 23,2016, and the following documentation is
intended to supplement information previously provided in response to questions posed by the Board
and City Planning and Public Works Staff. A revised FEAF dated May 20, 2016 is also being submitted in
response to comments received.

2.O EVENT OPERATIONS AND DETAILS

Hours ond Days of Operation


Smorgasburg Upstate will run on Saturdays beginning August 6,201.6 through October 20L6, and will
operate between the hours of 10 AM and 8 PM, or dark.

Description of Vendors
Smorgasburg Upstate will feature approximately 75 vendors each week. Vendors will be comprised of
approximately 5O% food vendors (both prepared and packaged) and 5O%flea market vendors, which
include a broad range of categories including, but not limited to antiques, vntage clothing, and
handmade items.

The majority of vendors will come from the Hudson Valley, and several are from the immediate Kingston
area. All vendors must apply on the Smorgasburg website,l and are vetted by the Smorgasburg team. To
date, over 250 vendors have applied.

The approved food vendors to date will offer fare representing the following categories: pizza, BBQ"
pulled pork sandwiches, rice bowls, ramen burgers, grilled cheese, hot dogs with asian toppings, lobster
rolls, and sausages,

The bars (Smorgasburg-operated) will feature only New York State producers of beer, wines and liquor.
There will be a dedicated full-time bar manager onsite at all times, plus an additional one to three
bartenders per active bar depending on the number of customers. All bar staff are trained to double-
check lDs if there is any doubt about proof of age; not to serve anyone who appears intoxicated; and to
assess every customer on a constant basis to ensure legal purchase and consumption of alcohol.

lDs will be checked at the registers-located at the bar-by our staff. At busier times, a stand-alone lD
station may be set up. Staff will constantly monitor the seating areas indoors and outdoors to guard
against pass-offs to underage patrons. Our security staff will watch closely to ensure that no underage
patrons buy or consume alcohol at any time. We will use branded beverage cups to clearly identify
anyone drinking alcohol. Anyone underage caught doing so will be expelled from the premises
immediately.

Staffing
It is anticipated that there will be two employees per vendor for a total of l5O-vendor related staff and
IO - 12 pre-trained Smorgasburg employees. The total staff on site would be approximately 162.

The Smorgasburg staff will arrive at 7 AM on Saturday mornings to set up the site for operations and
organize the vendors, and will remain after closing to perform a site-wide clean-up and close down the
site.

3.0 SECURITY AND CIRCULATION

Security
A new front gate, wider to allow large emergency equipment, will be installed at the southern end of the
site on North Street to close the project site offfrom the public when Smorgasburg is not in operation.
The main gate will be opened to vendors at 8 AM and the public at L1 AM and will be closed at 8 PM or
da rk.

The gate will be equipped with a "Knox Box" which will allow the Fire Department access to the site
24/7.he eastern shoulder of North Street will be cleared of brush and any other obstruction for not
less than 10 feet from the existing edge of pavement. This will allow for traffic to pull over onto the
shoulder to provide a clear passage for emergency vehicles. Each driveway entrance onto North Street
and each parking lot will be numbered and each structure named with signage to allow for ease of
communication, The Fire and Police Departments will be provided with a map identifying the various
different building names and driveway numbers. The Fire and Police Departments will also be given
telephone numbers for primary and back-up emergency contact persons.

One of the staff members will be designated as the "first responder" to assess any incidents that occur
on-site and will be responsible for communications with emergency services, if necessary. ln the event
emergency services need to be deployed, traffic managers will make certain that North Street is opened
for clear passage and the gate nearest the incident will be cleared for access as well. A clear passage on
North Street will be maintained until emergency services have exited the site.

Staff members will be positioned at the following locations: intersection of Delaware Avenue and North
Street (if active duty policeman not available), main gate at the entrance to the site, vendor/accessible
lot gate and main parking lot gate. Two staff members will be positioned in the parking lot area to direct
drivers to open spaces and to make certain that cars are parked in an orderly manner. The balance of
the staff members will be stationed around the Smorgasburg site.

A chief staff member will be obligated to prepare a daily report noting estimated attendance, traffic and
parking conditions and any incidents such as a need for emergency services, injuries that occurred
during the day and how the matter was resolved, if necessary. Each staff member will be issued a two-
way radio for communications during the event.

The entire site will be maintained on weekly basis. The maintenance will include grass cuttng, garbage
and recycling pick-up, restroom cleaning, wash down of floors if necessary and replacement of light
bulbs. lt is likely that construction operations will continue during the week as permitted restoration of
the on-site structures continues.

Lighting Plon
Operational lighting (Seven (7) 65-watt, LED, Dark Sky Friendly, historic-style lamp posts) will be
provided on the site using new and existing L8-foot high poles, and will be down lit and shielded to
prevent glare and spill over outside of the project site. See Figure l for the location of lighting on site,
and Figure 2 for the lighting detail.

The website and all advertisements for Smorgasburg at the Hutton Brickyards will provide directions to
the site from Route 9W to Garraghan Drive to Broadway to East Strand Street to North Street. This route
will be provided to limit the potential effect of heavy traffic on residential neighborhoods and dangerous
curves along Delaware Avenue. However, it is understood that most cars are equipped with navigation
systems which will provide the drivers with directions which may be different.

New gravel driveway access will be provided off North Street onto the site, including separate site
entrances for vendors and patrons. There will be an entry drop-off featuring a traffic circle providing
access to parking and more convenient access to Buildings #6 and 7. An additional entry will be provided
off North Road to additional parking areas (see Figure 3).

Staff members will be postoned at crtcal locations on and off-site to keep traffic flow moving into and
out of the parking lots on-site. The staff member located at the intersection or North Street and
Delaware Avenue will be required to have previous experience with directing traffic. Each staff member
will have a two-way radio for regular communications with each other to assess whether parking lots
have reached capacity. lf and when the on-site lots are at capacity, traffic will be directed east on
Delaware Avenue to the City parking lot at Kingston Point.

Shuttle busing from the Strand and Kingston Point is currently being investigated to provide alternatives
to parking on-site. ln addition, the site will be pedestrian friendly with the provision of a walking path
along North Street into the center of the Smorgasburg site. Bike racks will be provided on site to make
the venue friendly to cyclists.

Off-Site Woyfinding and on Site Signage Plan


Temporary signage will be placed at main routes into the City directing traffic to the site. See Figure 4 for
a detail of the signage.

Signs will be installed throughout the site to ease pedestrian and vehicular circulation, see Figure 1.. The
vendor and accessible parking entry will be indicated as such with signs, and a more general entry sign
will point north towards the entry drop-off circle and again towards the additional parking entry. Stop
and exit signs will be provided where applicable as shown, and accessible parking will be marked by

4.O WATER/SEWER AND SUSTATNABTLTTY

The project site is located in the City of Kngston Water and Sewer District. The project is anticipated to
use an estimated 14,230 gallons per day (GPD) for water and wastewater. Restroom facilities (featuring
eight stalls, six toilets, and two urinals) will be available within Building #64, and additional portable
restrooms may be provided on site, as needed. Three, 3-basin commercial sinks will be made available
for vendor use in accordance with applicable health codes.

Water
Per information provided by the Kingston Water Department, there is a water main located on North
Street that has three service taps that feed the site: 1) 8-inch tap that ends at a hydrant along the river's
edge; 2) 2-inch tap that ends in the vicinity of Building #7; and 3l %-inch tap that serves Building #2.

An existing tee off of the 8-inch tap currently provides potable water to Building #64. The 8-inch service
into Building #64 will be reduced to 2 inches, and the service line will be fitted with a meter, backflow
prevention device, and any other necessary appurtenances within the mechanical room that is located
in the southwest corner of the building.

The 2-inch line running from North Street towards Building #7, is disconnected from the buildings and
will not be used by the project.

The water service to Building #2 would be provided with a meter and reduced pressure backflow device
(located within the building) should the building be utilized in the future. For now, Building #2 will
remain unoccupied, and the existing 2-inch tap will not be used for this project.

Figure 3 shows the 8-inch water line intended for use as part of the project, the location of the meter
and the reduced pressure backflow device. Figure 5 provides the installation details for the reduced
pressure backflow device, and Figure 6 provides a detail of the reduced pressure zone assembly.
Coordination with City of Kingston's Water Department is underway.

Sewer
Buiiciing 64 has an existing sewer that wiii remain ior this project, ancj aii sanitary waste generated
within the proposed structures will discharge through this existing sewer. The building sewer is
connected to an existing sanitary wet well on site, of which some contents are in disrepair. The wet well
basin is in working condition, and new pumps, plumbing, and wiring will be provided to make the wet
well suitable for use by this project,

Sustainobility
The project will result in an overall land disturbance of L2.9 acres, and will increase the amount of
impervious surface on the site from 3.1 acres to 3.4 acres. As such, a Storm Water Pollution Prevention
Plan (SWPPP)was prepared. Section 4.3 of the NYS Storm Water Design Manual requires runoff
reduction of the total water quality volume by application of green infrastructure techniques that
reduce contributing area or runoff volume to the maximum extent practicable.

A description of runoff reduction practices and other sustainability measures is as follows

o Bioretention filters: to provide water quality treatment of gravel parking lots;


o Stone drainage trench: to alleviate drainage/ponding issues adjacent to existing buildings;
o Soil restoration: to improve the infiltration capacty of disturbed soils;
Reuse of existing buildings: to minimize impervious surfaces;
o Reduction of clearing and grading: to minimize disturbance and maintain the natural hydrology
of the site; and
o Reuse of brick material: on walkways and in parking lots.
