Grimmett, P#7056, being first duly sworn, deposes and says: That he is a Homicide Detective with the Las Vegas Metropolitan Police Department, being so employed for a period of 16 years, assigned to investigate the crime(s) of Murder with the Use of a Deadly Weapon, committed on November 4, 2017, which investigation has developed Andres GARCIALEAL, 1D#7038699, as the perpetrator thereof. THAT DECLARANT DEVELOPED THE FOLLOWING FACTS IN THE COURSE OF THE INVESTIGATION OF SAID CRIME, Tow: On April 4, 2017, at 2019 hours, LVMPD received a 911 call from Alexandra Hernandez, from the phone number EB Hernandez reported a male had been shot outside the Crown Liquor store located at 605 E Twain Avenue Patrol Officers responded and located a male, who was later identified as Jordan Taitano, on the walkway directly infront of Crown Liquor, just east of the store's entrance. Taitano was suffering from two gunshot wounds. Paramedics transported Taitano to the Sunrise Hospital, where he succumbed to his injures. LVMPD Homicide Detectives responded and assumed responsibility of the investigation Detectives conducted several interviews and canvassed the area for witnesses and video surveillance. During the canvass, your affiant spoke with Joe Bahnan, the owner of Bu's Market and Crown Liquor. Bahnan stated prior to the shooting, both of the involved parties were in a physical altercation earlier that ‘morning in the parking lot. Bahnan explained he had exterior surveillance cameras on both businesses that had captured the physical altercation and the shooting, (On 04-05-2017 Patro} Officer M. Dredla P#8049 came in contact with Eric Smart who advised he was willing to provide information about the shooting. Homicide Detective S. Tooley P#6224, met with Smart and obtained a recorded statement. Smart stated on the afternoon of 04-04-2017, he had face to face conversation with Drew Garcia (true name Andres GARCIALEAL). GARCIALEAL had a busted lip and ‘ro 31 v.80) WORD 2010LAS VEGAS METROPOLITAN POLICE DEPARTMENT CONTINUATION Event# ___ 170404-3867 claimed Taitano had struck him during a verbal argument earlier that day. GARCIALEAL was angered and vowed revenge. Smart was not present during verbal altercation or shooting, but stated GARCIALEAL is known to carry a firearm. During your affiant’s review of the surveillance footage, Taitano and GARCIALEAL appear to be in a verbal altercation during the early morning hours of 04-04-2017. Your affiant observed Taitano punch GARCIALEAL in the face and the two part ways. At approximately 2010 hours, GARCIALEAL returned to east end of the parking lot of 605 E. Twain Avenue, near Roma Pizza and appeared to be wearing a dark colored jacket with light colored sleeves. Minutes later, Taitano arrived and observed GARCIALEAL on east end of the parking lot near Roma Pizza. Taitano's attention appeared to be focused on GARCIALEAL's position as the two exchanged words across the parking lot. Taitano eventually entered Crown Liquor and exited a short time later. Upon his exit, Taitano remained focus on GARCIALEAL's last know position, the east end of the parking lot. At approximately 2016 hours, GARCIALEAL departed the area on his bicycle toward the rear of the businesses as Taitano remained near the entrance of Crown Liquor. Taitano mounted his bicycle and remained facing an eastbound direction. GARCIALEAL reappeared on video surveillance near the far west end of the parking lot, to the rear of Taitano. As GARCIALEAL peddled past Taitano, GARCIALEAL fired two shots, striking and killing Taitano. On 04-07-2017, your affiant and Homicide Detective Tooley met with Manuel Aguirre-Ontiveros who Provided the following information: Aguirre-Ontiveros had a causal relationship with GARCIALEAL aka Drew Garcia and Taitano and was familiar with the physical appearance of both. Aguirre-Ontiveros was not present during the physical altercation nor did he witness the shooting. Aguirre-Ontiveros claimed he had been told by others that GARCIALEAL was involved in physical altercation with Taitano during the morning hours of 04-04-2017, and GARCIALEAL threatened to kill Taitano after being punched. Aguirre-Ontiveros suspected GARICALEAL had followed through with the threat that night, and was responsible for the death of Taitano, Aguirre-Ontiveros agreed to review the surveillance footage of the physical altercation and the shooting. During the review, Aguirre-Ontiveros identified Taitano as the person who punched GARCIALEAL during the physical altercation and identified GARCIALEAL as the person who shot and killed Taitano. Based on the information obtained throughout the investigation, it has been determined GARCIALEAL, committed the crime of Murder with Use of a Deadly Weapon. Wherefore, Declarant prays that a Warrant of Arrest be issued for suspect Andres GARCIALEAL, 1D#7038699, on the charge(s) of Murder with Use of a Deadly Weapon.
