Dear Sirs,

1.0 We have pleasure in enclosing the following tender documents for the above work and
would invite you to submit your best binding offers.
i) Technical Specification, BOQ & Drawing - Annexure-I
ii) Commercial Terms & Conditions - Annexure-II
iii) Un-Priced Price Bid/Price Schedule Format - Annexure-III
iv) No-deviation Certificate - Annexure-IV
v) Bank Guarantee in lieu of EMD - Annexure-V
PRE-BID MEETING
The interested parties may visit the site to satisfy themselves about the local
conditions and site restrictions, physical/administrative/access etc., if any, before
submission of bid. Pre-bid conference shall be conducted at MECON Head Office on
11.09.2014 at 3.00 PM. Bidders desirous of obtaining clarifications on clauses of the
tender enquiry (Technical as well as Commercial) are requested to ensure their
participation in the pre-bid conference. Failure to visit the site and attend pre-bid meeting
shall not, under any circumstances whatsoever, at a later date, constitute a ground for
mitigation of the terms of this contract
2.0 SUBMISSION OF TENDER

2.1 Cost of Tender Document

The tender (techno-commercial part) must be accompanied by Cost of Tender Document,


which is non-refundable, in the form of a Demand Draft/At Par Cheque drawn on any
Nationalised Bank in favour of MECON Limited, Ranchi for a value of Rs.1,000/-
(Rupees One thousand). Tender not accompanied by Cost of Tender shall be liable for
rejection.
SSI/Firms Registered with NSIC are exempted from submission of Cost of Tender.
Tenderer claiming for such exemption shall submit copy of valid Registration Certificate.

2.2 Earnest Money Deposit (EMD)

Tender must be accompanied by Earnest Money Deposit (EMD) for Rs.10,000/- (Rupees
Ten thousand only) in the form of a demand draft drawn on any Nationalized/ Schedule
Bank in favour of MECON LIMITED, or a Bank Guarantee (in prescribed proforma
enclosed) from a Nationalized/ Schedule Bank. The earnest money shall be kept deposited
or the Bank Guarantee shall be kept valid (as the case may be) upto a period of four month
beyond the validity of the Tender. The earnest money will not earn any interest. If the
Bidder after submitting his Tender resiles from his offer or modifies the terms and
conditions thereof in a manner not acceptable to MECON, the Earnest Money/Bank
Guarantee shall be liable to be forfeited/ encashed. Tenders not accompanied by Earnest
Money/ Bank Guarantee shall be rejected. On acceptance of the Tender (but not earlier
than the expiry date of validity of Tender), the Earnest Money/Bank Guarantee will be
returned to the unsuccessful Bidders on request.

2.3 Tender shall be prepared and submitted in SEPARATE SEALED COVERS IN TWO
PARTS as follows:
Part-I: COMPLETE TENDER (BLANKING THE PRICE FIGURES)

Tenderer is requested to submit Tender Part-I under a covering letter indicating clearly
details of tender, chapters, annexure/schedules of complete Tender. Tenderer is also
requested to submit Price Part along with Part-I, blanking the prices but with all other
details as indicated in Annexure-v.
Part-II: PRICE PART
2.4 Price portion should indicate the detailed break-up of price and shall be submitted as per
schedule of quantities indicated in the Annexure.
Both sealed packet of Part-I & part-II shall be sent in a cover duly sealed indicating Tender
No., Description and Due date of opening.

2.5 TENDERER IS REQUESTED TO QUOTE BEST BINDING LOWEST PRICE.


2.6 Tender must be submitted as under:
Part-I in 2(two) copies separately.
And
Part-II in 1(one) copy separately in Sealed Cover as mentioned above, superscribing the
Code No., Part No. i.e. Part-I or Part-II, the last date of receipt of tender and validity of
tender on the cover.
Both sealed packet of Part-I & Part-II shall be sent in a cover duly sealed indicating
Tender No., Description and due date of submission.
2.7 Insertion, post-script, addition and alteration shall not be recognized unless confirmed by
tenderer's signature and stamp.
2.8 Incomplete tender or tenders (not submitted as per requirement of MECON as indicated in
the `Invitation to Tender') are likely to be rejected.
2.9 Tenderer shall submit Cost of Tender Document along with Part-I for consideration of the
offer.

2.10 The tenders as submitted will consist of the following:


i) Invitation to Tender (ITT) and Commercial Terms & Conditions duly signed on
each page as a token of acceptance of all terms and conditions mentioned therein.
ii) Printed Brochure/ Leaflets/ Detailed Specification of the equipment.
iii) CST/VAT/TIN Regn./PAN.
iv) Deviation to the Technical Specification/Commercial terms, if any.
v) Copy of supporting document as required under Eligibility Criteria.
vi) Un-priced Copy of Price Bid/Price Schedule Format.
vii) No Deviation Certificate.

3.0 ELIGIBILITY CRITERIA

3.1 Tenderer should be either manufacturer and Authorised dealer of the manufacturer.

3.2 Tenderer should have successfully executed at least one work during last seven years
preceding 31.08.2014 and the value of single order should not be less than Rs. 8 Lacs.

4.0 OPENING OF BIDS BY PURCHASER


4.1 The purchaser shall open bids in the presence of bidders or their authorized representatives
who chose to attend, on the specified date & time. The bidders representatives, who are
present, shall sign in an attendance register. Authority letter to this effect shall be
submitted by the bidders before they are allowed to participate in bid opening.
4.2 A maximum of two representatives of any bidder shall be authorized and permitted to
attend the bid opening.
4.3 The bidders names, bid prices, modifications, bid withdrawals and such other details as
the purchaser, at its discretion, may consider appropriate will be announced at the time of
opening.
4.4 The date fixed for opening of bids, if subsequently declared as holiday by MECON, the
revised date of schedule will be notified. However, in absence of such notification, the
bids will be opened on next working day, time and venue remaining unaltered.

4.5 The Bids will be opened in two stages i.e. the techno-commercial bid on the date of tender
opening given in NIT and the price bids (price schedule) at a later date after evaluation of
the techno-commercial bids. The date of opening of price bid will be communicated to
the techno-commercially acceptable bidder.

4.6 Any query or grievance by a tenderer received upto one day before the due date of price
opening shall be addressed directly to Director (Commercial) who may at his discretion
extend the due date of opening of price and thus revised date shall be intimated later on.
Query or grievance received after due date of opening of price bid with respect to above
shall not be entertained.

4.7 In case of non-receipt of competitive bids, the said bid opening may be suspended and
further extension of due date of submission of offer may be given or re-tendered, at the
discretion of the Purchaser.

5.0 SCOPE OF WORK

5.1 The scope of work shall be as per Technical Specification, BOQ & Drawing enclosed at
Annexure-I.
5.2 The Tenderer shall carefully check the specification and shall satisfy himself regarding the
technical requirement and completeness of furniture

6.0 PRICE

6.1 The Tenderer shall quote unit rate for the items indicated in the technical specification (as
per price schedule format) Rates quoted shall be firm and binding and shall not be subject
to any variation whatsoever on any account. Total price is to be quoted for delivery on
FOR MECON, Stores, Ranchi basis and inclusive of all taxes, duties etc. All applicable
taxes & duties may be indicated separately.
7.0 TAXES AND DUTIES

7.1 Applicability of VAT/CST(without C Form) and Service Tax shall be indicated


separately. Presently, MECON is not in a position to provide Road Permit. The tenderer
shall take into account the VAT/CST (without C Form) and Service Tax as payable, for
delivery & fixing of materials at MECON, Ranchi.

7.2 In case the tenderer fails to submit copy of Sales Tax Registration Certificate, price will be
loaded with prevailing rate of Purchase Tax for evaluation.

7.3 All prevalent tax deductions shall be applicable. Any new deductions, if introduced by the
government, during the course of execution, shall be done at source.

7.4 The tax structure as quoted by you in your offer shall remain firm and binding on you till
completion of supply & fixing, except statutory variation in taxes, as declared by Govt.
subsequent to submission of your offer. Any request for upward revision other than
statutory variation in the percentage of tax on any item, after opening of price bid/award of
order will not be entertained by the purchaser and the additional liability on account of
taxes & duties, if any, shall be solely borne by the successful tenderer.
8.0 TERMS OF PAYMENT
Subject to any deduction which MECON may be authorised to make under the contract,
the contract price shall be payable as indicated in the Commercial Terms & Conditions
(Annexure-II).
9.0 COMPLETION DATE
Time of completion is the most important activity of the contract. Tenderer shall complete
entire work as per the scope of work in accordance with the Time Schedule indicated in
this Invitation to Tender. Time of completion shall be firm and binding.

10.0 LIQUIDATED DAMAGES
Liquidated Damages shall be applicable as enclosed in Commercial Terms & Conditions.
11.0 PERIOD OF VALIDITY OF TENDER
Unless otherwise specified, the Tenderer shall keep their tender valid initially for a period
of 120 (One hundred twenty) days from the due date of receipt of the tender.
12.0 NO CLAIM OR COMPENSATION FOR SUBMISSION OF TENDER
The Tenderer whose Tender is not accepted shall not be entitled to claim any costs,
charges, expenses of and incidental to or incurred by him through or in connection with his
submission of Tenders, even though MECON may elect to withdraw the Invitation to
Tender.
13.0 LOWEST TENDER NOT NECESSARY TO BE ACCEPTED
MECON reserves the right not to accept the lowest or any quotation and has also the right
for acceptance of the whole or any part of the tender or portion of the item offered.
MECON also reserves the right to cancel the tender at its own discretion.
14.0 TENDER EVALUATION CRITERIA
The tenderers are requested to note that the tender for the items will be evaluated
separately on respective item basis i.e. taking into account the total cost of Conference
Table(Item No. 1(a) & 1(b) together including fixing charges plus all applicable taxes &
duties and Conference Chair i.e Item No.2, 3 & 4 together including fixing charges Plus all
applicable taxes & duties as indicated in Price Schedule Format (Anexure-III).
15.0 COMPLIANCE & DEVIATION
The tenderer shall submit along with techno-commercial part, statement of compliance on
the technical and commercial terms & conditions point-wise. Deviations, if any, no matter
how minor must also be indicated. Not listing out any deviation explicitly shall mean
compliance to the Tender Enquiry.

TECHNICAL SPECIFICATION
FOR CONFERENCE TABLE & CHAIR, BOQ & DRAWING

PREAMBLE

1. Sample of all materials shall be brought by the successful tenderer to MECON for
approval before use at his own cost.
2. This preamble to the schedule of quantities is an integral part of the schedule and shall
have as much force as though this is incorporated into the description of the items
themselves.

3. Tenderers rate for any items of work, in the Schedule of Quantities shall, unless otherwise
stated, be held to include the cost of all materials including wastage, conveyance and
delivery, up to the site of work unloading, storing, fabrication, hoisting, working at any
height or depth (within the general scope of the work envisaged), for all labour for
finishing to required shape and size tools and plant, fuel, consumables, all taxes, royalties
other revenue expenses, setting out, fitting and fixing in position, rectification of all
defects, replacement of defective materials and work, interruptions to work required to
accommodate the work of other agencies working on the site, bye-work necessary to
complete any work as per direction of MECON, overhead, supervision, profit and other
incidental charges etc. complete.

4. The quantity furnished is approximate. Tenderers shall quote firm unit rates for the period
of contract. No claim in respect of the actual quantities of individual items varying or
deleted from those furnished in the schedule or the total quantum of work varying, will be
entertained.

5. Lift shall not be allowed for carrying and removing materials from site.

6. The unit rates quoted shall include minor details of construction which are obvious and
fairly intended, and which may not have been referred to in these documents but are
essential for the satisfactory completion of the work.

7. STANDARD SPECIFICATIONS
Unless otherwise specified elsewhere in this contract, all work under this contract shall be
carried out in accordance with the CPWD specification and the latest issue of the Indian
Standard Specification applicable to the particular class of work. If Indian Standards are
not formulated for any particular material or work, the relevant British Standard
Specification shall apply. In case of any confusion or dispute regarding the meaning and
interpretation of any specification for the respective works, the decision of Mecon shall be
final and binding on the Tenderer.

8. Deviation
Tenderer should submit deviations separately, if any in the tender.
9. Permission has to be taken from Mecon before placing/installation of the deviated items.

10. Warranty for a furnitures shall be 1(one) years from the date of installation.

13. Test certificate for all the materials shall be submitted before dispatch to Mecon office.

SCOPE OF WORK

1.0 Scope of Work covers complete execution of the furniture works including manufacturing,
providing, supplying & installation etc. as per Drawing, SOR, and Specification. This
includes providing & fixing conference tables, chairs etc.,

The layout shown in the tender drawing is indicative only. The detail layout / shop drg.
should be prepared by the successful bidder and get it approved from the MECON
before implementation.

Any clarification regarding items scope of work etc. should be cleared during the pre-bid
meeting. Consolidated queries, if any, should reach MECON, Ranchi at least two days
before the pre-bid meeting.

1.1 Materials & Workmanship

All materials, brand, colour scheme etc. should be pre approved by MECON before start of
the job.

All furniture hardwares etc. shall adhere to the specifications & details mentioned in
relevant BOQ item.

1.2 Completion certificate

Completion certificate shall be issued after full satisfaction of Owner and after all defects
have been rectified.
1.5.1 Supply of furniture including chair will be made to Mecon, Ranchi Office, as per the BOQ.

Commercial Terms & Conditions
1.0 SCOPE OF WORK
1.1 The scope of work includes complete execution of the furniture works (Conference Tables
and Chairs) including manufacturing, providing, supplying & installation etc. at MECON
Limited, Ranchi as per the Specification, BOQ & Drawing enclosed as Annexure-I
2.0 CONTRACT PRICE

2.1 Contract Price for the scope of work enumerated above is for Supply & Installation of all
furniture in full & good condition at MECON, Ranchi. Contract Price also includes all
charges towards packing & forwarding, Excise Duty as applicable and Sales Tax on
finished equipment, and freight including door delivery charges and insurance. Contract
Price shall remain firm and binding till completion of supply and shall not be subject to
any variation whatsoever on any account except for statutory variation in taxes/duties or
fresh imposition of the same within contractual delivery period.

3.0 TIME SCHEDULE


3.1 You shall be required to complete the supply & installation of all furniture within 30
(thirty) days from the date of LOI/order from MECON. Time for completion of supply &
installation is the essence of the Contract and shall be firm and binding.
3.2 In the event the supplied material is not conforming to the ordering specification and
approved sample the material so supplied will be rejected without paying any
price/compensation. The decision of MECON in this regard will be final.

4.0 TERMS OF PAYMENT

No advance payment shall be paid for the supply.


4.1 Subject to the deduction which MECON may be authorized to make under the contract,
100% payment shall be released as follows:
a) 90% of the total contract price as indicated in Price Schedule shall be released against
supply of all materials against submission of bill in three copies, delivery challan &
acceptance certificate to be issued by MECON.
b) Balance 10% of the total contract price shall be released within 30 days after installation of
the furniture and acceptance by MECON against submission of PBG of 10% of Contract
price to be kept valid till completion of warranty period.

5.0 INSURANCE

All required insurance for all the equipment supplied including transit insurance shall be
arranged by the Contractor.
6.0 LIQUIDATED DAMAGES
6.1 For Non-Fulfillment of Time Schedule

Time and date stipulated in the Purchase Order for completion of delivery of all Items and
its installation shall be deemed to be the essence of the Contract. The contractor shall
complete the entire work in accordance with the schedule stipulated in the Purchase Order.
If however, the contractor fails to fulfill the delivery, installation and commissioning in
accordance with the time schedule, or within such extended time schedule as may be
further granted, the contractor shall be liable to pay as liquidated damages and not by way
of penalty, a sum of 0.5% of the contract price per week of delay or part thereof, and such
liquidated damages shall be limited to a maximum ceiling of 5% of the contract price.
However, if the reason for delay in completion of work is not attributable to the
Contractor, the LD Clause will not be applicable.

7.0 WARRANTY

7.1 All Furniture supplied by the contractor shall be covered under comprehensive free onsite
warranty against defects for a period of 12 months from the date of fixing/ installation.
7.2 The warranty shall cover faulty design, improper material, manufacturing defects and
unsatisfactory performance of the equipment.
7.3 During the warranty period, any breakdown, malfunctioning and unsatisfactory
performance of the above unit shall be attended to by the Contractor immediately and
equipment shall be made to work, free of any charge at MECON's premises. All defective
components shall be replaced by the Contractor with same or better parts free of cost.

8.0 COMPLETENESS
8.1 Any equipment, materials or supplies which may not be specifically mentioned but are
necessary for carrying out the contract work are in the scope of the Contractor and the
systems must be complete in all respects with guaranteed performance. as per the
Technical specification and published documents.

9.0 RIGHTS TO VARY OR CANCEL THE CONTRACT


9.1 MECON shall have power to vary or alter the extent, scope and/or technical character of
the work under the Contract and the Contractor shall be bound thereby as if the same
occurred in the technical specifications.

10.0 NEGLIGENCE, DEFAULT AND RISK PURCHASE
10.1 If the Contractor fails to execute the contract with due diligence or expedition or shall
refuse or neglect to comply with any order given in writing by MECON under the
Contract, MECON may give notice in writing to the Contractor to make good the failure,
neglect or contravention within such time as may be deemed reasonable and in default of
the compliance with the said notice, MECON without prejudice to its rights under the
Contract, may rescind or cancel the contract holding the Contractor liable for the damages
that MECON may sustain in this regard.
Should the Contractor fail to comply with such notice within a reasonable period from the
date of serving thereof, MECON shall have the option and shall be at liberty to take the
supply work wholly or in part out of the Contractors scope and may get the same executed
by alternate agency at Contractors risk and cost. This shall be without prejudice to
MECONs rights under other clauses of this Contract.

11.0 SUSPENSION AND TERMINATION


MECON may at any time temporarily stop the supply under the Contract or any part
thereof by serving notice in writing to the Contractor. Supply so suspended shall be
resumed by the Contractor on receipt of instructions from MECON in writing. MECON
will not be liable to the Contractor for any damage or loss caused by such period of
suspension of supply.
MECON will be at liberty to terminate the Contract without prejudicing its right and
affecting the obligations of the Contractor by giving 15 days notice in writing in the
following events:
(a) If the Contractor fails to comply with the provision/provisions of the Contract.
.

(b) If the Contractor is involved in any action involving moral turpitude.

12.0 ARBITRATION
12.1 All disputes or differences, whatsoever, arising between the parties out of or in relation to
the construction, meaning and operation or effect of this contract or breach there of shall
be settled amicably. If, however, the parties are not able to resolve them amicably, the
same shall be referred to a sole Arbitrator to be appointed by CMD, MECON to settle the
disputes whose decisions shall be final, conclusive and binding on both the parties and
Rules of Arbitration of the Indian Council of Arbitration shall be deemed to apply.
Work under this contract shall be continued by the contractor during the arbitration
proceedings, unless authorise directed in writing by MECON or unless matter is such that
the progress of work can not possibly be continued until the decision of the arbitrator is
obtained.
The venue of arbitration proceeding shall be at Ranchi.

13.0 CORRESPONDENCE
13.1 All correspondences with regard to this purchase order shall be made in duplicate to the
