CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:


Cristeta C. Aya-ay of legal age, presently residing at 1055 Lualhati St., Tondo Metro
Manila and hereinafter referred to as the LESSOR.

-and-

MS. BILLIE JEAN GONZALES of legal age, single/married, and resident of Blk. 2 Lot
48 Phase 2, Garden City Subd., Paranaque City and hereafter referred to as the LESSEE.

W I T H N E S S E T H:

That the LESSOR is the absolute owner of the 1 unit of the residential containing 1
Bedrooms with laminated & painted cabinets, 1 toilet and bathroom and is now being rented by
the LESSEE.

That the term of this lease is for RENTAL commencing on MARCH 26, 2015 and shall
be terminated on MARCH 26, 2016 Renewal of this lease shall be made yearly at the option of
the LESSOR.

That I, Mr./Ms. MS. BILLIE JEAN GONZALES, LESSEE for and in consideration of
this lease, do hereby bind and obligate myself to pay unto the said AMOUNT at the latters
residence stipulated rentals.

Whereas, LESSOR agrees to provide LESSEE an acknowledged copy of this LEASE


contract; to issue receipts showing the LESSEES name and address to occupy and/or rent the
above mentioned premises; to pay rent promptly and in advance to the LESSOR; to ensure that
the premises are use only as residence and to take special care of the premises.

NOW, THEREFORE, for and in consideration of the foregoing agreements or mutual


covenants as well as the terms and condition her and after set forth and for other good and
valuable considerations, the parties hereto, hereby agree as follows:

TERMS AND CONDITION OF LEASE

1. AMOUNT. The amount of lease per month is EIGHTEEN THOUSAND PESOS ONLY
(P 18,000.00) PESOS ONLY.

2. ADVANCE AND DEPOSITS. Two (2) months Month in deposit and One (1) month
advance, LESSE agrees to pay LESSOR at his residence before occupancy of the above
mentioned prem. and that said advances and deposits shall NOT in any case be touched nor paid
as rental except in the liquidation or termination of this lease. The said month rental deposits
shall be forfeited if LESSE fails to occupy with ONE-YEAR TERM.
3. TERMS OF PAYMENT. The LESSEE should give the LESSOR twelve (12) Post-dated
checks as his/her payment for rental of the unit. In the event the monthly rental is not paid on
time or has been delayed for more than one month, it shall mean the termination of this lease.
4. ORDERLINESS AND CLEANLINESS/SANITATION. In all instances LESSEE
should maintain orderliness and cleanliness/sanitation of the premises (See provision on the
foregoing instructions)

ORDERLINESS:

a. LESSEE agrees that nailing on the wall should be avoided the same if made make
permanent damage to the edifice;

b. LESSEE agrees that any improvement, renovation, repair he introduce shall remain the
property of the LESSOR;

c. LESSEE agrees not to affix additional locks to the door, cabinet covers, nor changing the
combination of any existing locks without the written consent of the LESSOR;

d. LESSEE agrees not to erect signs and antenna without the written consent of the
LESSOR;

e. LESSEE agrees to do no marking to/or de facing any part of the premises which involve
painting of fixing posters on the walls without the written consent of the LESSOR;

f. LESSEE agrees not to permit any child/children under his control to play on the street or
in any part of the premises unless the child/children is accompanied by an adult exercising
effective control to be on areas dangerous to children.

g. LESSEE agrees to ensure that nothing is done that might prejudge any insurance which
the LESSOR has in relation to the premises;

h. LESSEE agrees to avoid any disturbances, nuisance, and annoyance to neighbors whether
by noise, behavior, obstruction or other action on the party of the LESSEE or of persons on the
premises with his consent, to be in particular; having social gatherings which caused annoyance
in the neighborhood like drinking liquor, beer or other beverages and playing radios and stereos
very loud on the street and sidewalks.

i. LESSEE agrees that keeping any animals which are harmful to children should be
avoided.

j. LESSEE agrees that keeping combustible materials inside any articles inside the
bedrooms or on areas visible from the street should be avoided.

k. LESSEE agrees that all floors in the premises, except in the kitchen, bathrooms, lavatory
and laundry areas are sufficiently covered to prevent wear and tear.

l. LESSEE agrees that the obstruction of lawful use of street sidewalks and other common
areas by a thing or large vehicle or any person should avoided.

CLEANLINESS AND SANITATION

a. LESSEE agrees to keep exterior glass windows and wooden doors always clean and tidy;

b. LESSEE agrees to ensure that tin cans and similar items are completely drained and other
garbage securely and wrapped;

c. LESSEE agrees to place garbage containers in the area set aside for disposal before the
time garbage is normally collected;
d. LESSEE agrees not to keep any animals or bird in the premises without the written
consent of the LESSOR.

e. LESSEE agrees to keep the premises always clean and free from rubbish with special
attention to the kitchen, bathroom, and appliances;

f. LESSEE agrees to avoid vandalism whether caused by persons in the household of with
his consent to maintain the good morals and values of the children of the future;

5. TERMS OF HOUSEHOLDS. LESSEE is allowed to have a total of four (4) members


in the household only. In the event that the LESSEE shall accept additional persons in the
premises in excess of the number here required, the LESSOR shall have the right to declare the
lease of contract terminated by making written notice to the LESSEE thereof.

6. SUBLEASE. In no case the LESSEE shall sublease the premises, otherwise, it may be
the sole ground for terminations of this lease and once the termination is made the LESSEE and
the members of the household should leave the premises being occupied to the LESSORS
residence.

7. MAINTENANCE. Maintenance of the leased premises shall be taken cared of by the


LESSEE. Any loss and/or damage of toilet facilities; lavatory, basins, drainage, doors,
doorknobs, and locks, cabinets and tiles of kitchen and comfort rooms; water faucets; water
bulbs and pipes; electric light bulbs and the likes; electric light switches and circuit breakers, the
clogging of toilet bowls, sewerage systems, lavatory drainage; leaking lavatory basins; worn out
electric wires thru shortage caused by defective house equipment and appliances, the LESSEE
agrees to shoulder the necessary repair or restoration expenses for its reinstitution.

8. WATER, ELECTRIC, AND TELEPHONE/COMMUNICATION BILLS. Water,


electric, telephone/communication bills and/or consumptions shall be shouldered by the
LESSEE. The corresponding deposits for/at MWSS, Meralco, and PLDT or any other
communication firms shall be shouldered or paid by the LESSEE and the same if made shall be
transferred in the name of the LESSEE.

9. INSPECTION AND VISITATION OF THE PREMISES. In all instances LESSEE


agrees to allow LESSOR or his representative to inspect and visit the premises at any time or
prior to the commencement of the lease to note his conditions, about cleanliness/sanitation and
state of repair and working order of appliances to ensure and preserve security of the edifice and
to make sure that the premises are free from any hazardous materials like combustible liquids,
gas, and chemicals, pests like termites, cockroaches, rats, mice, etc.

10. CLAIMS. LESSEE agrees to compensate or meet all claims of the LESSOR for the loss
of/or damage to parts or whole of the premises; any person for the loss of/or damage to his
personal property; any person for the loss of/and or any injury as result of neglect or deliberate
careless act in the premises; or breach of any terms and condition of this lease by the LESSEE or
of persons in LESSEE should meet all the claims by forfeiture of the advances and deposits and
termination of this lease, whether they are made directly against the LESSOR.

11. WARRANTY. LESSEE promises and agrees to comply to all the terms and conditions
stipulated in this lease and shall keep the premises clean and free from any hazardous materials
and orderly like that of a prudent and good father of a family.

12. LESSEES RIGHT AND PREVILEGES TO THE PREMISES. LESSEE right and
privileges to the premises is hereby guaranteed and as provided by law.

13. VENUE. Any legal action arising from this contract of lease shall fall under the
jurisdiction of the proper court of Manila, or as provided by law.
14. PENALTY AND ATTORNEYS FEE. LESSEE agrees to pay the amount equivalent to
three percent of the whole overdue or in arrears as stipulated penalty plus twenty five percent of
the total amount due as and for attorneys fees in case of litigation.

15. GIVING ADVANCE NOTICE. In case the LESSEE wishes to vacate the said
apartment, before or after the termination of the contract, the LESSEE must give at least one
month ADVANCE NOTICE.

IN WITNESS WHEREOF, the parties have hereunto set their hands on this

MUTAL AGREEMENT OF PARTIES

In view of the urgency of herein LESSEE to transfer to this


property known as Blk. 2 Lot 48 Phase 2, Garden City Subd.,
Paranaque City and due to financial constraints of the herein
LESSOR, the latter agrees add hereby agreed that the expenses
for the necessary repairs to all the external and internal damages
of the structure/house, the re-piping of water installations and
other repairs necessary and important in order that the house is
considered habitable will be shouldered by the LESSEE and that
the total amount spent by the LESSEE shall be deducted from the
monthly rental of ( P 18,000.00) until the said total amount is
returned or considered paid back to the herein LESSEE. A
separate Memorandum of Agreement is hereby signed and
executed by the parties stating the terms of payment.
