3. Purposeoftheinspectionanditsjustification
a)Pertainingtoaperson,whoisnotaparty,therighttoinspectdecisionsand
judgmentsisclearinIsraelilaw.TheRegulationsoftheCourtsInspectionof
CourtFiles(2003),Regulation2(b),says:
Everypersonispermittedtoinspectdecisionsthatarenotlawfully
prohibitedforpublication.
Thematterisfurtherelaboratedinthe2009JudgmentinAssociationforCivil
RightsinIsraeletalvMinisterofJusticeetal(5917/97):
Regulation2(b)expandsthepublicsrighttoinspectwithno
requirementtofilearequestwiththecourt,butonlyrelativetocourt
decisions,andonlyrelativetosuchthatarenotlawfullyprohibitedfor
publication.[emphasisintheoriginaljz]
b)Instantcourtfileisofthehighestpublicpolicysignificance.Untilrecentlythe
courtfilewaslistedasOpentothePublicunsealedinNetHaMishpat(Figure
1).electronicsystemdeniespublicaccesstothiscourtfiletoday,asstatedabove
(Figure1).However,adecisionrecordfromthiscourtfilehasalreadybeen
publishedintherelatedfilefromtheRishonMagistrateCourt.
c)Today,ontheotherhand,publicaccesstoinstantcourtfileisentirelyblockedin
NetHaMishpat(Figure2).
