ADMINISTRATIVE ORDER

In the interest of service and in line with the implementation of the I3BM-
approved DENR Rationalization Plan pursuant to Executive Order 366, a Manual of
Authorities on Human Resources Development and Administrative Matters is hercby
prescribed.
This Order shall take effect immediately and supersedelrevoke all orders and
issuances inconsistent herewith.

In line with the thrust ofthe government to comply with the administrative reforms
for good governance, the Department of Environment and Natural Resources (DENR)
adopts this Manual of Authorities to define the limits of authority at various levels of
management from the Secretary down to the lowest level of supervision. All other
approving authoriies not included in this Manual remain with the Secretary.
The DENR Manual of Authorities is in compliance with the provisions of the Anti-
Red Tape Act of 2007 (RA 9485) and other pertinent Civil Service Commissbn (CSC)
Guidelines, Department of Budget and Management (D8M)Issuances, and COA Rules
and Regulations.

Delegated authority set forth in this Manual cannot be further delegated without
prior approval of the Secretary, or the President of the Philippines in cases where
authority is delegated to the Secretary.
The authority pertains to the position rather than the person and is consistent with
the approved hierarchical structure of the organization.
In cases where the relevant issuances or the legal bases are not indicated, it is
understood that the Administrative Order accompanying this Manual of Authorities will
serve as such.

retirement.
6. Optional retirement under the following condihns:
1. When one has rendered at least 15 years of service and is at least 60 years of age at the time of retirement (RA
8291).
2. When one has rendered at lewt 20 years of service (RA 1616).
3. When one reaches magic 87, where the length of service and age at the time of retirement totals 87 (RA 660)

COVERAGE AND GENERAL PROVISIONS
(Republic Act No. 10633 Section 32, entitled, "An Act Appropriating Funds for the Operation of
the Government of the Republic of the Philippines from January 1 to December 31,2014, and for
Other Purposes" or the GAA FY 2014" Sec. 76, General Provisions)
All agencies of Government shall review and formulate their human resource development and
training programs to make the same responsive to their organizational needs, human resource
requirements, and capability development and skills training of their personnel.
Every ofticial or employee assigned or authorized to travel under Executive Order No. 298 dated 23
March 2004 shall, within thirty (30) days afler his return to his permanent ofticial station, submit a report
with his recommendations, if any, on the conference or seminar attended, examination or investigation
conducted, or mission undertaken, to the head of his office. In case of participation in an international
conference or convention abroad in which the Philippines is represented by a delegation, a report of the
delegation shall be submitted to the President of the Philippines through the department head
concerned copy furnished the DFA not later than thirty (30) days afler the closing of the conference or
convention. Any member of the delegation may also submit a supplementary report.

Officials and employees can exercise or practice private profession provided that such practice will not
conflict with their ofticial functions under the following rules:

B. PERSONNEL ACTION
The PERSONNEL SELECTlON BOARD (PSB) shall cover both the recruitment and selection of
employees in the Firstl* and Secondzd Levels of the career service who are entering the civil service
for the first time or are being re-employedlreappointed, and the screening of employees who are
considered for promotion.
The THIRDnD LEVEL PERSONNEL SELECTlON AND PROMOTION BOARD acts on the selection
and promotion of all applications for salary grades 27 and above positions.
1. These rules shall apply only to employees appointed to first and second level positions
in the career and noncareer services. Reassignment of third level appointees is
governed by the provisions of Presidential Decree No. 1.
4. If an appointment is not station-specific, the oneyear maximum period shall not apply.
Thus, reassignment of employees whose appoinlments do not specifically indicate the
particular office or place of work has no definite period unless otherwise revoked or
recalled by the Head of Agency, the Civil Senrice Commission or a competent court

The General PayroB shall be used for the payment of salaries, wages, Representation and
Transportation Allowance (RATA), overtime pay, honoraria and other emoluments of government
officers and employees. This form shall be prepared in triplicate copies to be disttibuted as follows:

The maximum number of employees that maybe granted to Step Incrementh Due to Meritorious
Performance in any given year shall be limited to five percent (5%) of all incumbent officials and
employees in an agency,
Two (2) Step Increments Due to Meritorious Performance may be granted to a qualified
official or employee who has attained two (2) ratings of "outstanding" during the two (2) rating
periods within a calendar year.
One (I)
Increment Due to M t o r i o u s Performance may be granted to a qualified officialor
employee who has attained one (I)rating of "Outstanding" and one (I) rating of 'Very
Satisfactory", or h o (2)ratings of "Very Satisfactow during the two (2) rating periods within a
calendar year.
One (1) Step Increment Due to Length of Sewice shall be granted to qualifA personnel for
every three (3) years of continuous satisfactory service in the present position
The actual salary (in a given step of a salary grade of a position) of an incumbent who is
qualified to be granted one (1) or two (2) Step Incrementh Due to Meritorious Performance or
to one (1) Step Increment Due to Length of Sewice shall be adjusted to the salary
corresponding to the next step or the second next step, as the case may be, but only up to
Step 8, in the Salary Schedule under the implementation.

Travel Expensa Travel expenses incurred by government officials and employees on official travel,
either domestic or foreign. They indude per diems, actual transportation fares, road tolls, parking fees,
and such other similar or incidental expenses en route to the destination and back to permanent official
station (Section 7-1 (20),CA 246).
Pursuant to Section 1(d) of Matacafiang Administrative Order No, 103, dated 31 August 2004,
"Directing the Continued Adoption of Austerity Measures in the Government", the Civil Senrice
Commission (CSC) and Department of Budget and Management (DBM) issued Joint Circular No. 2
dated 04 October 2004 on the 'Non-Monetary Remuneration for Overtime Services Rendered", which is
hereby promulgated and adopted in the DENR Central Office, Bureaus, Regional Offices, PENROs and
CENROs.
The overtime services may be authorized for the following activities:
1. Completion of infrastructure and other projects with set deadlines when due to
unforeseen events the deadline cannot be met without sorting to overtime work;
2. Relief, rehabilitation, reconstnrction and other related work or services during
calamities and disasters;
3. Seasonal work such as budget preparation and rendition of annual reports to meet
scheduled deadlines;
4. Preparation of specialfinanciallaccountabitityreports required occasionally by central
monitoring agencies like the Congress of the Philippines, Office of the President,
Commission on Audit, Department of Budget and Management, and National
Economic and Development Authority;
5. The pmvision of essential public services during emergency situations, such as power
and energy, water, distribution and control of basic staples, communication and
transportation, medical and health services, peace and order, and security;
6, implementation of special programslprojects embodied in Presidential directives and
authorizations and with specific dates to complete, which are in addition to the regular
duties of the employees;
7. Legal service to facilitate the dissolution of caseslresolutionddecisions;
8. Services rendered by drivers and other immediate staff of officials when required to
keep the same working hours as thdr superiors; and
9. Such other activities as may be detemined by the Head of Agency.

Procurement related activities are likewise authorized to render Overtime Services as per revised IRR
of RA 9184.
The Compensatory Overtime Credits (COCs) should be u s d as time-of! within the year and these are
earned until the immediately succeeding year. Thereafter, any utilized COCs are deemed forfeited.
Issues or conflicts on the accrual of COCs and availment of Compensatory Time Off (CTOs) shall be
referred to CSC for resolution, while other issues on the implementation of the aforesaid CSC-DBM
Joint Circular shall be resolved by DBM.

C. PERSONNEL DISCIPLINE
The general rule in the law on Public mcers is that the power to appoint carries with it the power to
remove an employee. The Civil Service laws,rules and regulations govern administrative pmedings
including imposition of penalties,
The Personnel Division Chief, Assistant Division Chief and other staff shall act as Secretariat and shall
be the custodian of all records of the Committee.
The Committee is hereby authorized to seek the assistance of any DENR official or employee and shall
be guided by CSC MC. 02,Series of 2001, Code of Conduct and Ethical Standards of the Department,
0No 80 entitled 'Directing the Adoption of a Performanoe-Based Incentive System for Government
Employees: and CSC MC No. 6, s. 2012 entitled "Guidelines in the Establishment and Implementation
of Agency Strategic Performancen in the performance of its functions. It shal find the best way to
address specific grievances.
In accordance with CSC Memorandum Circular No. 02, Series of 2001, regional offices may create its
own respective Grievance Committee through the issuance of a Regional Special Order (RSO) creating
such a committee to be chaired by the Chief or Head of Administrative Division. This committee will
hear out and decide upon complaints of an employeeloffcer against fellow employeeslobrs, in all
grade levels.

Preventive suspension of a civil sewice employee or officer pending an investigation can be ordered
even without a hearing because such suspension is not a penalty but only a preliminary step in an
administrative investigation. further, if found not guilty, procedural guidelines shall be formulated
separately by the Legal Service.
However, when a respondent's guilt is confirmed, preventive suspension is punitive and is considered
part of the penalty, pending hislher appeal. The purpose is to prevent the u s e d from using his
position or ofice to inflmce prospective witnesses or tamper with the records which may be vital in the
prosecution of the case against him. Alonzo V. Capulong, (G. R. No. 1 f 0590, May 10, 1995).

The Appointing Authority in any Department, Bureau,Regional Offices, etc. may preventively suspend
any subordinate officer or employee pending an investigation, if the charge against such officer or
employee involves dishonesty, oppression or grave misconduct, or neglect in the prformance of duty,
or if there are reasons to believe that the respondent is guilty of charges which would warrant his
removal h m the service (Section 51, Executive Order No. 292,1987).

"Supplies" include everything, except real estate which may be needed in the transaction of
public businesses, or in the pursuit of any undertaking, project, or activity, whether in the
manner of equipment, furniture, stationary materials for construction or personal property of
any sod, including non-personal or contractual services such as the repair and maintenance of
equipment or furniture, as well as trucking, hauling, janitorial, security, and related analogous
services (Section 357 (c) RA 7160).
Except as othenvise provided in the General Appropriations Act, the stock on hand of supplies,
materials and equipment, spare parts, acquired through ordinary and emergency purchase,
shall at no time, exceed the normal three-month requirements, subject to pertinent rules and
regulations issued by competent authority.
A.d EQUIPMENT
Memorandum Circular No. 401 defines obligation for Equipment Outlay as follows: "This
account shall include the cost of property, other than structures and fixed facilities, which has a
life of more than one (1) year. This does not include property falling in this classification having
a value of P10,000.00or less, where such property shall be classified as "Supplies and
Materials".
ASSIGNMENT OF LlABlLifY
'In the assignment of liability for a disallowed overprice, the auditor shall carefully study the procedures
in processing the questioned transaction and determine those officialslemployeeswho had direct
participation in the fixing of the pricelpriws of the same. Officia!slemploy~swhose signature or initials
may appear on the vouchers andlor transaction documents, who are determined to have had no
participation in the fixing of the price shall not be included among those to be held liable for the
disallowance."

Section 46 to 54 Republic Act No. 9184 and its IRR provide for exceptional cases where the

AGENCY ESTIMATE
The agency estimate of construction cost shall be prepared by official(s)duly designated by the
head of the officelagencylcorporationconcerned or by his duty authorized representative for his
subsequent approval.
In cases where the Agency Estimate is held confidential, it shall be finalized on the day of the
bidding after all bids have been received and shall be held confidential and signed, sealed and
ready for presentation on the day of the opening of the bidsltenders.
The estimate should show for each major wok item, such as earthwork, roadwork and massive
concreting, the components of equipment rentals, fuel, labor, materials and overhead.
