included in the price list or bespoke goods (special sizes,finishes, electrics,...) cannot be returned. Return costs shall be borne by the buyer.
Please note that a 20% depreciation charge will be deducted from your refund for administrative costs and handling of goods. This will not
be the case when the reason for the return is a delivery error by the company. In this case, LEDS-C4 shall be responsible for the return costs.
6 | Refunds. Refunds will be deducted from the first bill (or a bankers draft will be sent) as long as the customers payments are up-to-date.
7 | Samples. Samples must be ordered and paid for. If the samples are returned (note that return costs must be paid for by the customer)
and the goods are in perfect condition, the price of the sample will be refunded.
8 | Jurisdiction
Any dispute which may arise between the parties shall be determined by the Courts of Cervera (Lleida, Spain). The buyer hereby waives
their own jurisdiction, in accordance with article 55 of the L.E.C (Spanish Civil Procedure Law).
9 | Reservation of ownership
LEDS-C4 shall retain ownership of the goods supplied until full payment for the goods has been received,
Todos los pedidos cursados implican la aceptacin integra, por parte del comprador, de las siguientes Condiciones Generales de Venta:
0 | Validez. Tarifa vlida a partir del 13/03/2016.
1 | Precios. Se aplicarn las tarifas vigentes en la fecha de recepcin del pedido (precios P.V.P.R., IVA no incluido).
2 | Plazos. Los plazos de entrega se confirmarn en el momento de cursar el pedido y sern siempre a ttulo orientativo.
3 | Transporte Para pedidos superiores a 360 (importe neto), la mercanca viajar a portes pagados (en pennsula). Para pedidos por un
importe inferior se cargar en factura 10 , viajando la mercanca a portes pagados hasta destino (en pennsula). El transporte se realizar
a travs de nuestra agencia de transporte habitual. Se podr solicitar el transporte a travs de otras agencias, pero en tal caso el trans-
porte ser a portes debidos. El comprador tiene la obligacin de revisar a la entrega la mercanca recibida y de conformar el albarn del 45
transportista con el sello de la empresa y fecha de recepcin. En el caso de existir anomalas, se deber dejar constancia en el albarn y
reclamar en un plazo mximo de 4 das hbiles tras la recepcin de la misma.
4 | Anulacin de pedidos. Una vez cursado el pedido e iniciado el proceso de fabricacin, no ser posible cursar la cancelacin de dicho pedido.
5 | Devoluciones Cualquier devolucin de mercanca deber ser previamente autorizada por el departamento comercial de LEDS-C4. Solo
se aceptarn devoluciones de mercanca en tarifa vigente y en perfecto estado, manteniendo los embalajes, etiquetas y precintos origi-
nales. No se aceptarn devoluciones de mercanca fuera de catlogo y ejecuciones especiales (medidas, acabados, electrificado...). Los
portes de devolucin corrern a cargo del solicitante y se aplicar un 20% de depreciacin en concepto de gastos de administracin y
manipulacin de la mercanca. Dicha depreciacin no se aplicar cuando la devolucin sea debida a un error de suministro por parte de
la empresa, corriendo los portes a cargo de sta.
6 | Abonos Los abonos que por diversas causas se puedan producir sern descontados de la primera factura que se origine (o se enviar
un cheque bancario al cliente), siempre que el cliente est al corriente de sus obligaciones de pago.
7 | Muestras Las muestras de material debern ser solicitadas mediante pedido y sern facturadas. En el caso de que sean devueltas (por-
tes a cargo del comprador) y la mercanca est en perfecto estado, el importe correspondiente ser pertinentemente abonado.
8 | Jurisdiccin En caso de litigio, se considerarn competentes los Juzgados y Tribunales de Cervera (Lleida), renunciando el comprador
a su propio fuero de conformidad con lo dispuesto en el artculo 55 de la L.E.C.
9 | Reserva de propiedad LEDS-C4 se reserva el derecho de propiedad de la mercanca suministrada hasta que el comprador haya satis-
fecho el pago total de la misma.
10 | Directiva sobre aparatos elctricos y electrnicos (RAEE)
El cargo RAEE consiste en un ingreso para financiar la gestin de los Residuos de Aparatos Elctricos y Electrnicos (RAEE) a nivel nacio-
nal. No es ningn impuesto o tasa, sino un coste inherente a la gestin de residuos que deber ser mostrado a los consumidores de forma
separada en el momento de la venta.
Segn el Real Decreto 2008/2005, el cargo RAEE deber aparecer en los documentos de venta, as como en las facturas emitidas por el
fabricante, y repercutidas posteriormente por el usuario final, ya sea instalador o distribuidor. La Legislacin Espaola con el R.D. 208//200/
(RAEE) establece tres categoras distintas de cargos RAEE en funcin de los pesos de los aparatos:
Categora A: <750 gr. - 0,25/unidad
Categora B: de 750 gr. hasta 5Kg. - 0,50/unidad
Categora C: >5Kg - 0,70/unidad
El cargo RAEE no es de aplicacin sobre partes de luminarias, ya sean recambios o componentes, sino slo sobre luminarias completas.
En caso de suministrar lmparas fluorescentes o de descarga en los aparatos, se repercutir un cargo RAEE de 0,20/ unidad adicional,
independientemente de la potencia de la lmpara en cuestin, siendo para lmparas led 0,12/unidad.
