REGULATION ORDINANCE NO. 2008-393

AN ORDINANCE AMENDING ORDINANCE NO. 78, SERIES OF 1977,
"AN ORDINANCE IMPOSING PENALTIES ON DRIVERS AND
CONDUCTORS OF MOTOR VEHICLES IN VIOLATION OF THE
MISCELLANEOUS TRAFFIC RULES AND REGULATION, AND
PROVIDING SCHEDULE OF FINES AND PENALTIES THEREOF

Sponsored by Councilor Erwin J. Plagata

And seconded by Councilors Armand S. Parcon and Lyndon V. Acap

WHEREAS, Article II, Section 458 of Republic Act 7160, otherwise known as the Local
Government Code, empowers the Sangguniang Panlungsod to regulate the use of streets, and
regulate traffic, and providing penalties, thereof;

WHEREAS, in terms of compliance to traffic ordinances, the fines and penalties

provided under Ordinance No. 78, Series of 1977, have outlived the objectives for which they
were enacted and have become monetarily insignificant, making traffic ordinances open to
wanton violations by drivers and operators.

WHEREAS, it is the recommendation of the Technical Working Group on Traffic to

revise the schedule of fines and penalties for traffic violators, in order to give more teeth to
traffic ordinances of Iloilo City and subsequently put order back to the streets.

BE IT ORDAINED, by the Sangguniang Panlungsod of the City oflloilo that:

Section 1. Prohibition on the Miscellaneous Traffic Rules and Regulations

(Moving Violations)

A. i. Recklessly cutting in and out of traffic lanes.

ii. Making a U-turn at areas with "NO U-TURNS" signs
iii. Making a LEFT turn towards a street with "NO LEFT TURN" sign
iv. Disregarding signal lights, hand signals by the traffic enforcers, traffic signages
and markings
v. Making left or right turn from a wrong lane

PENALTY : P 200.00

B. i. Motor vehicle racing on roads or streets

ii. Entering a "ONE WAY" street
iii. Driving without the use of a functional headlights during night time
iv. Driving without functional stop lights, signal lights, horns, mufflers
v. Driving with dysfunctional/defective breaks
vi. Unauthorized use of sirens
vii. Allowing passengers on board in excess of the registered seating capacity
viii. Allowing passengers to ride on the running board, atop the roof, or hood of a
moving vehicle or allowing hitching unto a moving vehicle
ix. Failure to display a red flag (cloth or the like) at the rear of the vehicle with
protruding cargoes one (1) meter beyond the body or bed of the vehicle

PENALTY : P 300.00

C. i. Driving without a valid drivers license or expired Temporary Operators Permit

ii. Operating a private motor vehicle to solicit passengers for a fee
iii. Operating out of line within the city without a special permit issued by the Land
Transportation Franchising and Regulatory Board to go out of authorized line
iv. Operating a motor vehicle loaded with soil, gravel, sand, stones, boulder, debris or
other similar materials without proper covering
v. Driving recklessly or driving without reasonable caution considering that width of
the street, traffic volume, intersections, curvatures, visibility and other road
conditions
vi. Driving a motor vehicle without proper and updated documentation and plates
from the Land Transportation Franchising and Regulatory Board, from the City
Government (For Hire Motorized Tricycles)

PENALTY : P 500.00 and/or imprisonment of not more than

five (5) days

D.i. Driving under the influence of intoxicating or prohibited substances as validated by

any acceptable police and/or legal standard

PENALTY : P 5,000.00 and/or imprisonment of five (5) days

at the discretion of the court

Section 2. Prohibitions on the Miscellaneous Provisions of Traffic Rules and

Regulations (Non-Moving Violations/Obstructions/Parking)

A. i. Obstructing or impending the free passage of other vehicles

11. LOADING/UNLOADING within fifteen (15) meters of the corner of any street or
intersection

PENALTY : P 200.00

B. i. PARKING within the fifteen ( 15) meters of the corner of any street or intersection
11. PARKING to obstruct vehicular driveways
111. PARKING at no parking areas I

iv. PARKING at sidewalks, alleys, paths not intended for parking I

v. Repair of a stalled/broken vehicle on the side of the street for over one ( 1) hour I
v1. Failure to install/display Early Warning Devices (EWD) four (4) meters before and
after a temporarily stalled/or broken motor vehicle along the street or road.
v11. Unjustified use of blinkers (emergency blinkers) in order to park in NO I
PARKING/LOADING and UNLOADING AREAS l
PENALTY : P 300.00

Section 3. Separability Clause - If any portion of this Ordinance or the application
thereof to any person or circumstances is held invalid, the remainder of this Ordinance and the
application of such provision to other persons or circumstances shall not be affected thereby. I
Section 4. Repealing Clause - All ordinances, resolutions, executive orders or parts
-
thereof in conflict with provisions of this Ordinance are hereby repealed, amended or modified
accordingly.

Section 5. Effectivity Clause - This ordinance shall take effect upon approval and
publication.
