An Act to provide for the control of rents and evictions and of rates of hotels and lodging houses, and for the lease of vacant premises to
Government,incertainareasintheUnionterritoryofDelhi.

BeitenactedbyParliamentintheNinthYearoftheRepublicofIndiaasfollows:

INTRODUCTION
Mostofthepersonslivinginurbanareasaresomehowdirectlyorindirectlyaffectedbythelawofrentcontrolwhichisprovincialinnatureandit
differsfromStatetoState,ThelawwhichwasapplicabletoDelhiwasDelhiandAjmerRentControlAct,1952(38of1952).Duringthecourseofits
applicabilitymanydifficultieswerebeingfacedanditwasconsiderednecessarytoenactacomprehensivelawforDelhi.Inordertoachievethis
objectivetheDelhiRentControlBillwasintroducedintheParliament.

TheDelhiRentControlBillhavingbeenpassedbyboththeHousesofParliamentreceivedtheassentofthePresidenton31stDecember,1958.It
cameintoforceon9thFebruary,1959asTHEDELHIRENTCONTROLACT,1958(59of1958).

Chapter I Preliminary

(1)ThisActmaybecalledtheDelhiRentControlAct,1958.

(2)ItextendstotheareasincludedwithinthelimitsoftheNewDelhiMunicipalCommitteeandtheDelhiCantonmentBoardandtosuchurban
areaswithinthelimitsoftheMunicipalCorporationofDelhiasarespecifiedintheFirstSchedule:

ProvidedthattheCentralGovernmentmay,bynotificationintheOfficialGazette,extendthisActoranyprovisionthereof,toanyotherurbanarea
includedwithinthelimitsoftheMunicipalCorporationofDelhiofexcludeanyarefromtheoperationofthisActoranyprovisionthereof.

COMMENTS

The Delhi Rent Control Act, 1958 is beneficial as also restrictive in nature. The courts are under a legal compulsion to harmoniously read the
provisionsoftheActsoastobalancetherightsofthelandlordandtheobligationsofthetenanttowardeachotherkeepinginmindthatoneofthe
subjectsofthelegislaturewhileenactingtheActwastocurbthetendancyofthegreedylandlordstothrowoutthetenants,payinglowerrent,inthe
nameofpersonaloccupationandrentoutthepremisesatthemarketrateM/s.RahabharProductionsPvt.Ltd.v.RajendraK.Tandon,AIR1998SC
1639.

2.Definitions.

InthisAct,unlessthecontextotherwiserequires

(a)Basicrent,inrelationtopremisesletoutbeforethe2nddayofJune,1944,meansthebasicrentofsuchpremisesasdeterminedinaccordance
withtheprovisionsoftheSecondSchedule

(b)ControllermeansaControllerappointedundersubsection(1)ofsection35andincludesanadditionalControllerappointedundersubsection
(2)ofthatsection

(c)Fairratemeansthefairratefixedundersection31andincludestherateasrevisedundersection32

(d)Hotelorlodginghousemeansabuildingorpartofabuildingwherelodgingwithorwithoutboardorotherservicesisprovidedforamonetary
consideration

(e)Landlordmeansapersonwho,forthetimebeingisreceiving,orisentitledtoreceive,therentofanypremises,whetheronhisownaccountor
onaccountoforonbehalfof,orforthebenefitof,anyotherpersonorasatrustee,guardianorreceiverforanyotherpersonorwhowouldso
receivetherentrobeentitledtoreceivetherent,ifthepremiseswerelettoatenant

(f)LawfulincreasemeansanincreaseinrentpermittedundertheprovisionsofthisAct
(g)Managerofahotelincludesanypersoninchargeofthemanagementofthehotel

(h)Ownerofalodginghousemeansapersonwhoreceivesorisentitledtoreceivewhetheronthisownaccountoronbehalfofhimselfandothers
orasanagentoratrusteeforanyotherperson,anymonetaryconsiderationfromanypersononaccountofboard,andlodgingorotherservices
providedinthelodginghouse

(i)premisesmeansanybuildingorpartofabuildingwhichis,orisintendedtobe,letseparatelyforuseasaresidenceorforcommercialuseor
foranyotherpurpose,andincludes.

(i)thegarden,groundsandouthouses,ifany,appertainingtosuchbuildingorpartofthebuilding

(ii)anyfurnituresuppliedbythelandlordforuseinsuchbuildingorparofthebuildingbutdoesnotincludearoominahotelorlodginghouse

(j)prescribedmeansprescribedbyrulesmadeunderthisAct

(k)standardrent,inrelationtoanypremises,meansthestandardrentreferredtoinsection6orwherethestandardrenthasbeenincreased
undersection7,suchincreasedrent

[(l)(Note:Subs.byAct18of1976,sec.2,forclause(1)(w.e.f.1121975))tenantmeansanypersonbywhomoronwhoseaccountorbehalftherent
ofanypremisesis,or,butforaspecialcontract,wouldbe,payable,andincludes

(i)asubtenant

(ii)anypersoncontinuinginpossessionaftertheterminationofhistenancyand

(iii)intheeventofthedeathofthepersoncontinuinginpossessionaftertheterminationofhistenancy,subjecttotheorderofsuccessionandto
thisclause,suchoftheaforesaidpersons

(a)spouse,

(b)sonordaughter,or,wheretherearebothsonanddaughter,bothofthem,

(c)parents,

(d) daughterinlaw, being the widow of his predeceased son, as had been ordinarily living in the premises with such person as a member or
membersofhisfamilyuptothedateofhisdeath,butdoesnotinclude,

(A)anypersonagainstwhomanorderordecreeforevictionhasbeenmade,exceptwheresuchdecreeororderforevictionisliabletobereopened
undertheprovisoofsection3oftheDelhiRentControl(Amendment)Act,1976(18of1976)

(B)anypersontowhomalicence,asdefinedbysection52oftheIndianEasementsAct,1882(5of1882),hasbeengranted.

Explanation1.Theorderofsuccessionintheeventofthedeathofthepersoncontinuinginpossessionaftertheterminationofhistenancyshallbe
asfollows:

(a)firstly,hissurvivingspouse

(b)secondly,hissonordaughter,orboth,ifthereisnosurvivingspouse,orifthesurvivingspousedidnotordinarilylivewiththedeceasedperson
asamemberofhisfamilyuptothedateofhisdeath

(c)thirdly,hisparents,ifthereisnosurvivingspouse,sonordaughteroranyofthem,didnotordinarilyliveinthepremisesasamemberofthe
familyofthedeceasedpersonuptothedateofhisdeathand

(d)fourthly,hisdaughterinlaw,beingthewidowofhispredeceasedson,ifthereisnosurvivingspouse,son,daughterorparentsofthedeceased
person,orifsuchsurvivingspouse,son,daughterorparents,oranyofthem,didnotordinarilyliveinthepremisesasamemberofthefamilyofthe
deceasedpersonuptothedateofhisdeath.

Explanation II. If the person, who acquires, by succession, the right to continue in possession after the termination of the tenancy, was not
financiallydependentonthedeceasedpersononthedateofhisdeath,suchsuccessorshallacquiresuchrightforalimitedperiodofoneyearand
ontheexpiryofthatperiod,oronhisdeath,whicheverisearlier,therightofsuchsuccessortocontinueinpossessionaftertheterminationofthe
tenancyshallbecomeextinguished.

ExplanationIII.Fortheremovalofdoubts,itisherebydeclaredthat,

(a) where, by reason of Explanation II, the right of any successor to continue in possession after the termination of the tenancy becomes
extinguished, such extinguished shall not affect the right of any other succession of the same category to continue in possession after the
terminationofthetenancybutifthereisnoothersuccessorofthesamecategory,therighttocontinueinpossessionaftertheterminationofthe
tenancyshallnot,onsuchextinguishments,passontoanyothersuccessor,specifiedinanylowercategoryorcategories,asthecasemaybe

(b)therightofeverysuccessor,referredtoinExplanationI,tocontinueinpossessionaftertheterminationofthetenancy,shallbepersonaltohim
andshallnot,onthedeathofsuchsuccessor,developonanyofhisheirs]

(m).urbanareahasthesamemeaningasintheDelhiMunicipalCorporationAct,1957(66of1957).

COMMENTS

(i)HeirsofstatutorytenantareentitledtosameprotectionagainstevictionasaffordabletotenantundertheDelhiRentControlAct.Asthereisno
provisionregulatingtherightsofheirstointentthetenancyrightsofthetenantinrespectofthepremises,whichareofcommercialnature,the
tenancyrightwhichisheritabledevolvesontheheirsundertheordinarylawofsuccessionKeshavDassv.PremNath,AIR1996Del47.

(ii)Theprovisionsinsection2(I)(iii)oftheact,whichseektorestrictorlimittherightoftheheirs,insofarasthestatutorytenantsofresidential
premisesareconcernedandtotheextentprovidedtherein,arenotinganywaydiscriminatoryanddonotoffendtheguaranteeunderArticle14of
theConstitution.Theresidentialtenancyandthecommercialtenancyarenotsimilarlyplaced.Theybelongtotwodifferentcategorieswithdistinct
featuresandcharacteristicsoftheirown.NoquestionofdiscriminationarisesGauriShankarv.UnionofIndia,AIR1995SC55.
3.Actnottoapplytocertainpremises.
NothinginthisActshallapply

(a)ToanypremisesbelongingtotheGovernment(Note:ThewordoromittedbyAct57of1988,sec.2(w.e.f.1121988).

(b)ToanytenancyorotherlikerelationshipcreatedbyagrantfromtheGovernmentinrespectofthepremisestakenonlease,orrequisitioned,by
theGovernment:

[(Note: Added by Act 4 of 1963, sec.2 (with retrospective effect) Provided that where any premises belonging to Government have been or are
lawfullyletbyanypersonbyvirtueofanagreementwiththeGovernmentorotherwise,then,notwithstandinganyjudgment,decreeororderofany
courtorotherauthority,theprovisionsofthisActshallapplytosuchtenancy]

[(c)(Note:Ins.byAct37of1988,sec.2(w.e.f.1121988)Toanypremises,whetherresidentialornot,whosemonthlyrentexceedstherethousand
andfivehundredrupeesor

dateofcompletionofsuchconstruction]

COMMENTS

Section3(c)isonlyprospectiveincharacterandhasnoretrospectiveoperation,andassuch,itwillnotapplytothependingactionsorproceedings.
ThependingactionsandproceedingsshallcontinuetobegovernedbytheRentActasifinrespectofthependingmatters,section3(c)isnotonthe
statutebookMrs.NirmaljitArorav.M/sBharatSteelTubesLtd.,AIR1991Del160.

Chapter II Provisions Regarding Rent

4.Rentinexcessofstandardrentnotrecoverable.
(1)Exceptwhererentisliabletoperiodicalincreasebyvirtueofanagreemententeredintobeforethe1stdayofJanuary,1939,notenantshall,
notwithstandinganyagreementtothecontrary,beliabletopaytohislandlordfortheoccupationofanypremisesanyamountinexcessofthe
standardrentofthepremises,unlesssuchamountisalawfulincreaseofthestandardrentinaccordancewiththeprovisionsofthisAct.

(2)Subjecttotheprovisionofsubsection(1)anyagreementforthepaymentofrentinexcessofthestandardrentshallbeconstruedasifitwerean
agreementforthepaymentofthestandardrentonly.

5.Unlawfulchangesnottobeclaimedorreceived.

(1)SubjecttotheprovisionsofthisAct,nopersonshallclaimorreceiveanyrentinexcessofthestandardrent,notwithstandinganyagreementto
thecontrary.

(2)Nopersonshall,inconsiderationofthegrant,renewalorcontinuanceofatenancyorsubtenancyorsubtenancyofanypremises,

(a)Claimorreceivethepaymentofanysumaspremiumorpugreeofclaimorreceiveanyconsiderationwhatsoever,incashorinkind,inaddition
totherentor

(b)ExceptwiththepreviouspermissionoftheController,claimorreceivethepaymentofanysumexceedingonemonthsrentofsuchpremisesas
rentinadvance.

(3)Itshallnotbelawfulforthetenantoranyotherpersonactingorpurportingtoactonbehalfofthetenantorasubtenanttoclaimorreceiveany
paymentinconsiderationoftherelinquishment,transferorassignmentofhistenancyorsubtenancy,asthecasemaybe,ofanypremises.

(4)Nothinginthissectionshallapply

(a)Toanypaymentmadeinpursuanceofanagreemententeredintobeforethe1stdayofJanuary,1939or

(b)Toanypaymentmadeunderanagreementbyanypersontoalandlordforthepurposeoffinancingtheconstructionofthewholeorpartofany
premisesonthelandbelongingtotakenonleaseby,thelandlord,ifoneoftheconditionsoftheagreementisthatthelandlordistolettothat
personthewholeorpartofthepremiseswhencompletedfortheuseofthatpersonoranymemberofhisfamily:

Providedthatsuchpaymentdoesnotexceedtheamountofagreedrentforaperiodoffiveyearsofthewholeorpartofthepremisestobeletto
suchperson.

Explanation. For the purpose of clause (b) of this subsection, member of the family of a person means, in the case of an undivided Hindu
Family,anymemberofthefamilyofthatpersonandinthecaseofanyotherfamily,thehusband,wife,son,daughter,father,mother,brother,
sisteroranyotherrelativedependentonthatperson.

6.Standardrent.
(1)Subjecttotheprovisionsofsubsection(2),standardrent,inrelationtoanypremisesmeans

(A)Inthecaseofresidentialpremises

(1)Wheresuchpremiseshavebeenletoutatanytimebeforethe2nddayofJune,1944,

(a)Ifthebasicrentofsuchpremisesperannumdoesnotexceedsixhundredrupees,thebasicrentor

(b)Ifthebasicrentofsuchpremisesperannumexceedssixhundredrupees,thebasicrenttogetherwithtenpercent,ofsuchbasicrent
(2)Wheresuchpremiseshavebeenletoutatanytimeonorafterthe2nddayofJune,1994,

(a)InanycasewheretherentofsuchpremiseshasbeenfixedundertheDelhiandAjmerMerwaraRentControlAct,1947(19of1947),ortheDelhi
andAjmerRentControlAct,1952(37of1952),

(i)Ifsuchrentperannumdoesnotexceedtwelvehundredrupees,therentsofixedor

(ii)Ifsuchrentperannumexceedstwelvehundredrupees,rentsofixedtogetherwithtenpercent.ofsuchrent

(b)Inanyothercase,therentcalculatedonthebasisof[(Note:Subs.byAct57of1988,sec.3,forsevenandonehalfpercent.(w.e.f.1121988)
tenpercent].perannumoftheaggregateamountofthe[(Note:Subs.byAct57of1988,sec.3,forreasonable(w.e.f.1121988)actual]costof
constructionandthemarketpriceofthelandcomprisedinthepremisesonthedateofthecommencementoftheconstruction:

(B)Inthecaseofpremisesotherthanresidentialpremises

(1)Wherethepremiseshavebeenletoutatanytimebeforethe2nddayofJune,1944,thebasicrentofsuchpremisestogetherwithtenpercent.of
suchbasicrent:

Providedthatwheretherentsocalculatedexceedstwelvehundredrupeesperannum,thisclauseshallhaveeffectasifforthewordstenpercent.,
thewordsfifteenpercent.hadbeensubstituted

(2)Wherethepremiseshavebeenletoutatanytimeonorafterthe2nddayofJune,1944,

(a)InanycasewheretherentofsuchpremiseshasbeenfixedundertheDelhiandAjmerMerwaraRentControlAct,1947(19of1947)ortheDelhi
andAjmerRentControlAct,1952(38of1952),

(i)Ifsuchrentperannumdoesnotexceedtwelvehundredrupees,therentsofixedor

(ii)Ifsuchrentperannumexceedstwelvehundredrupees,therentsofixedtogetherwithfifteenpercent.ofsuchrent

(b)Inanyothercase,therentcalculatedonthebasisof[(Note:Subs.byAct57of1988,sec.3,forsevenandonehalfpercent(w.e.f.1121988)ten
per cent] per annum of the aggregate amount of the [(Note: Subs. by Act 57 of 1988, sec.3, for reasonable (w.e.f. 1121988) actual] cost of
constructionandthemarketpriceofthelandcomprisedinthepremisesonthedateofthecommencementoftheconstruction:

(2)Notwithstandinganythingcontainedinsubsection(1),

(a)Inthecaseofanypremises,whetherresidentialornot,constructedonorafterthe2nddayofJune,1951,butbeforethe9thdayofJune,1955,
theannualrentcalculatedwithreferencetotherentatwhichthepremiseswereletforthemonthofMarch,1958,oriftheywerenotsolet,with
reference,totherentatwhichtheywerelastletout,shallbedeemedtobestandardrentforaperiodofsevenyearsfromthedateofthecompletion
oftheconstructionofsuchpremises(Note:ThewordandomittedbyAct57of1988,sec.3(w.e.f.1121988)

(b)Inthecaseofanypremises,whetherresidentialorno,constructedonorafterthe9thdayofJune,1955,includingpremisesconstructedafterthe
commencement of this Act [(Note: Ins. by Act 57 of 1988, sec.3 (w.e.f. 1121988) but before the commencement of the Delhi Rent Control
(Amendment)Act,1988],theannualrentcalculatedwithreferencetotherentagreeduponbetweenthelandlordandthetenantwhensuchpremises
werefirstletoutshallbedeemedtobethestandardrentforaperiodoffiveyearsfromthedateofsuchlettingout.

[(c) (Note: Ins. by Act 57 of 1988, sec.3 (w.e.f. 1121988) In the case of any premises, whether residential or not, constructed on or after the
commencementoftheDelhiRentControl(Amendment)Act,1988andtowhichtheprovisionsofthisActaremadeapplicablebyvirtueofclauses

(d)ofsection3,therentcalculatedonthebasisoftenpercent,perannumoftheaggregateamountoftheactualcostofconstructionofthepremises
andthemarketpriceofthelandcomprisedinthepremisesonthedateofcommencementoftheconstruction,ofthepremisesshallbedeemedtobe
thestandardrent]

(3)Forthepurposeofthissection,residentialpremisesincludepremisesletoutforthepurposeofapublichospital,aneducationalinstitution,a
publiclibrary,readingroomoranorphanage.

COMMENTS

Forthepurposeoffindingoutreasonablerent,theassessingauthorityhastokeepinviewtheprinciplesofstandardrentasdeduciblefromthe
provisions of Rent Control Law which permits cost of construction being adopted as basis for calculating the retable value in the case of self
occupiedproperties.Itisfairandreasonableiftheassessingauthorityworksoutthecostoflandbyreferencetothedateofcommencementof
constructionandthereasonableamountspentinconstruction.Thatexerciseisbyitselftimeconsumingexercise,yetonceitisdonethefactsfound
would be relatable to the facts as actually exist. The Delhi Rent Control Act nowhere contemplates such an exercise being undertaken for the
purposeoffindingoutstandardrentsoastoascertainthereasonablelettingvalueMunicipalCorporationofDelhiv.RavishChandraRastogi,AIR
1998Del23.

6A.Revisionofrent.
NotwithstandinganythingcontainedinthisAct,thestandardrent,or,wherenostandardrentisfixedundertheprovisionsofthisActinrespectof
anypremises,therentagreeduponbetweenthelandlordandthetenant,maybeincreasedbytenpercent.everythreeyears.

COMMENTS

Section6AoftheActcannotbesaidtoberetrospectivesimplyforthereasonthatifapartywantstoimmediatelygiveeffecttoit,relianceistobe

7.Lawfulincreaseofstandardrentincertaincasesandrecoveryofothercharges.

(1)Wherealandlordhasatanytime,beforethecommencementofthisActwithorwithouttheapprovalofthetenantorafterthecommencementof
thisActwiththewrittenapprovalofthetenantoroftheController,incurredexpenditureforanyimprovement,additionorstructuralalterationin
thepremises,notbeingexpenditureondecorationortenantablerepairsnecessaryorusualforsuchpremises,andthecostoftheimprovement,
additionoralterationhasnotbeentakenintoaccountindeterminingtherentofthepremises,thelandlordmaylawfullyincreasethestandardrent
peryearbyanamountnotexceeding[(Subs.byAct57of1988,sec.3,forsevenandonehalfpercent.(w.e.f.1121988)tenpercent.]ofsuchcost.

(2)Wherealandlordpaysinrespectofthepremisesanychargeforelectricityorwaterconsumedinthepremisesoranyotherchargeleviedbya
localauthorityhavingjurisdictionintheareawhichisordinarilypayablebythetenant,hemayrecoverfromthetenanttheamountsopaidbyhim
butthelandlordshallnotrecoverfromthetenantwhetherbymeansofanincreaseinrentorotherwisetheamountofanytaxonbuildingorland
imposedinrespectofthepremisesoccupiedbythetenant:

Providedthatnothinginthissubsectionshallaffecttheliabilityofanytenantunderanagreemententeredintobeforethe1stofJanuary1952,
whetherexpressorimplied,topayfromtimetotimetheamountofanysuchtaxasaforesaid.

8.Noticeofincreaseofrent.
(1)Wherealandlordwishestoincreasetherentofanypremises,heshallgivethetenantnoticeofhisintentiontomaketheincreaseandinsofaras
suchincreaseislawfulunderthisAct,itshallbedueandrecoverableonlyinrespectoftheperiodofthetenancyaftertheexpiryofthirtydaysfrom
thedateonwhichthenoticeisgiven.

(2)Everynoticeundersubsection(1)shallbeinwritingsignedbyoronbehalfofthelandlordandgiveninthemannerprovidedinsection106of
theTransferofPropertyAct,1982(4of1882).

9.Controllertofixstandardrent,etc.

(1)TheControllershall,onanapplicationmadetohiminthisbehalf,eitherbythelandlordorbythetenant,intheprescribedmanner,fixinrespect
ofanypremises

(i)Thestandardrentreferredtoinsection6or

(ii)Theincrease,ifany,referredtoinsection7.

(2) In fixing the standard rent of any premises of the lawful increase thereof, the Controller shall fix an amount which appears to him to be
reasonablehavingregardtotheprovisionsofsection6orsection7andthecircumstancesofthecase:

[(Note:Ins.byAct57of1988,sec.6(w.e.f.1121988)Providedthatinworkingoutthecostofconstructionofanypremisesorthemarketpriceof
thelandcomprisedinsuchpremisesforthepurposeofsection6,orthecostofimprovement,additionoralterationreferredtoinsection7,the
ControllermaytaketheassistanceofanyvaluerapprovedbytheCentralGovernmentinaccordancewithsuchrulesasmaybeprescribedandthe
assessmentshallbemadebysuchvaluerinthemannerprescribed.]

(3)Infixingthestandardrentofanypremisespartofwhichhasbeenlawfullysublet,theControllermayalsofixthestandardrentofthepartsub
let.

(4)Whereforanyreasonitisnotpossibletodeterminethestandardrentofanypremisesontheprinciplessetforthundersection6,theController
mayfixsuchrentaswouldbereasonablehavingregardtothesituation,localityandconditionofthepremisesandtheamenitiesprovidedtherein
andwheretherearesimilarornearlysimilarpremisesinthelocality,havingregardalsotothestandardrentpayableinrespectofsuchpremises.

(5)Thestandardrentshallinallcasesbefixedforatenancyoftwelvemonths:

Providedthatwhereanypremisesareletorreletforaperiodoflessthantwelvemonths,thestandardrentforsuchtenancyshallbearthesame
proportiontotheannualstandardrentastheperiodoftenancybearstotwelvemonths.

(6)Infixingthestandardrentofanypremisesunderthissection,theControllershallfixthestandardrentthereofinanunfurnishedstateandmay
alsodetermineanadditionalchargetobepayableonaccountofanyfittingsorfurnituresuppliedbythelandlordanditshallbelawfulforthe
landlordtorecoversuchadditionalchargefromthetenant.

(7)Infixingthestandardrentofanypremisesunderthissection,theControllershallspecifyadatefromwhichthestandardrentsofixedshallbe
deemedtohaveeffect:

Providedthatinnocasethedatesospecifiedshallbeearlierthanoneyearpriorofthedateofthefilingoftheapplicationforthefixationofthe
standardrent.

10.Fixationofinterimrent.
Ifanapplicationforfixingthestandardrentorfordeterminingthelawfulincreaseofsuchrentismadeundersection9,theControllershall,as
expeditiouslyaspossible,makeanorderspecifyingtheamountoftherentorthelawfulincreasetobepaidbythetenanttothelandlordpending
finaldecisionontheapplicationandshallappointthedatefromwhichtherentorlawfulincreasesospecifiedshallbedeemedtohaveeffect.

11.Limitationofliabilityofmiddlemen.
Nocollectorofrentormiddlemanshallbeliabletopaytohisprincipal,inrespectofanypremises,anysumbywayofrentalchargeswhichexceeds,
theamountwhichheisentitledunderthisActtorealizefromthetenantortenantsofthepremises.

12.Limitationforapplicationforfixationofstandardrent.
AnylandlordortenantmayfileanapplicationtotheControllerforfixingthestandardrentofthepremisesorfordeterminingthelawfulincreaseof
suchrent,

(a)Inthecaseofanypremiseswhichwerelet,orinwhichthecauseofactionforlawfulincreaseofrentarose,beforethecommencementofthisAct,
withintwoyearsfromsuchcommencement

(b)InthecaseofanypremisesletafterthecommencementofthisAct[butbeforethecommencementoftheDelhiRentControl(Amendment)Act,
1988],

(i)Wheretheapplicationismadebythelandlord,withintwoyearsfromthedateonwhichthepremiseswerelettothetenantagainstwhomthe
applicationismade

(ii)Wheretheapplicationismadebythetenant,withintwoyearsfromthedateonwhichthepremiseswerelettothattenant[(Note:Clause(d)has
beeninsertedbyAct57of1988,sec.7.Asaresultofthisinsertionthewordandoftheendofsubclause(ii)ofclause(b)oughttohavebeen
omittedandaddedattheendofclause(c),whichhasnotbeendonebyAct57of1988.Theirregularityhassetright.(Ed.))and]

(c)InthecaseofanypremisesinwhichthecauseofactionoflawfulincreaseofrentarisesafterthecommencementofthisAct,withintwoyears
fromthedateonwhichthecauseofactionarises,[(Note:Clause(d)hasbeeninsertedbyAct57of1988,sec.7.Asaresultofthisinsertiontheword
andoftheendofsubclause(ii)ofclause(b)oughttohavebeenomittedandaddedattheendofclause(c),whichhasnotbeendonebyAct57of
1988.Theirregularityhassetright.(Ed.))and]

twoyearsfromthedateofsuchapplication]

ProvidedthattheControllermayentertaintheapplicationaftertheexpiryofthesaidperiodoftwoyears,ifheissatisfiedthattheapplicantwas
preventedbysufficientcausefromfilingtheapplicationintime.

13.Refundofrent,premium,etc.,notrecoverableundertheAct.

Whereanysumorotherconsiderationhasbeenpaid,whetherbeforeorafterthecommencementofthisAct,byoronbehalfofatenanttoa
landlord,incontraventionofanyoftheprovisionsofthisActoroftheDelhiandAjmerRentControlAct,1952(38of1952),theControllermay,on
anapplicationmadetohimwithinaperiodofoneyearfromthedateofsuchpayment,orderthelandlordtorefundsuchsumorthevalueofsuch
considerationtothetenantororderadjustmentofsuchsumorthevalueofsuchconsiderationagainsttherentpayablebythetenant.

Chapter III Control of Eviction of Tenants

14.Protectionoftenantagainsteviction.
(1) Notwithstanding anything to the contrary contained in any other law or contract, no order or decree for the recovery of possession of any
premisesshallbemadebyandcourtorControllerinfavourofthelandlordagainstatenet:

ProvidedthattheControllermay,onanapplicationmadetohimintheprescribedmanner,makeanorderfortherecoveryofpossessionofthe
premisesononeormoreofthefollowinggroundsonly,namely:

(a)Thatthetenanthasneitherpaidnortenderedthewholeofthearrearsoftherentlegallyrecoverablefromhimwithintwomonthsofthedateon
whichalandlordinthemannerprovidedinsection106oftheTransfersof

PropertyAct,1882(4of1882)

(b)Thatthetenanthas,onorafterthe9thdayofJune,1952,sublet,assignedorotherwisewithoutobtainingtheconsentinwritingofthelandlord

(c)Thatthetenanthasusedthepremisesforpurposeotherthanthatforwhichtheywerelet

(i)Ifthepremiseshavebeenletonorafterthe9thdayofJune,1952,withoutobtainingtheconsentinwritingofthelandlordor

(ii)Ifthepremiseshavebeenletbeforethesaiddatewithoutobtaininghiscorisent

(d)Thatthepremiseswereletforuseasaresidenceandneitherthetenantnoranymemberofhisfamilyhasbeenresidingthereinforaperiodof
sixmonthsimmediatelybeforethedateofthefilingoftheapplicationfortherecoveryofpossessionthereof

(e)Thatthepremisesletforresidentialpurposearerequiredbonafidebythelandlordforoccupationasaresidenceforhimselforforanymember
ofhisfamilydependentonhim,ifheistheownerthereof,orforanypersonforwhosebenefitthepremisesareheldandthelandlordorsuch
personhasnootherreasonablysuitableresidentialaccommodation

Explanation.Forthepurposeofthisclause,premisesletforresidentialpurposeincludeanypremiseswhichhavingbeenletforuseasaresidence
are,withouttheconsentofthelandlord,usedincidentallyforcommercialorotherpurposes

(f)Thatthepremiseshavebecomeunsafeorunfitforhumanhabitationandarerequiredbonafidebythelandlordforcarryingoutrepairswhich
cannotbecarriedoutwithoutthepremisesbeingvacated

(g)Thatthepremisesarerequiredbonafidebythelandlordforthepurposebuildingorrebuildingormakingtheretoanysubstantialadditionsor
alterationsandthatsuchbuildingorrebuildingoradditionoralterationcannotbecarriedoutwithoutthepremisesbeingvacated

(h)Thatthetenanthas,whetherbeforeorafterthecommencementofthisAct,(Note:ThewordbuiltomittedbyAct57of1988,sec.8(w.e.f.112
1988))acquiredvacantpossessionof,orbeenallotted,aresidence

[(hh)(Note:Ins.byAct57of1988,sec.8(w.e.f.1121988))Thatthetenanthas,afterthecommencementoftheDelhiRentControl(Amendment)
Act,1988,builtaresidenceandtenyearshaveelapsedthereafter]

(i)Thatthepremiseswerelettothetenantforuseasaresidencebyreasonofhisbeingintheserviceoremploymentofthelandlord,andthatthe
tenanthasceased,whetherbeforeorafterthecommencementofthisAct,tobeinsuchserviceoremployment
(j) That the tenant has, whether before or after the commencement of this Act, caused or permitted to be caused substantial damage to the
premises

(k)Thatthetenanthas,notwithstandingpreviousnotice,usedordealtwiththepremisesinamannercontrarytoanyconditionimposedonthe
landlordbytheGovernmentortheDelhiDevelopmentAuthorityortheMunicipalCorporationofDelhiwhilegivinghimaleaseofthelandonwhich
thepremisesaresituate

(i)ThatthelandlordrequiresthepremisesinordertocarryoutanybuildingworkattheinstanceoftheGovernmentortheDelhiDevelopment
AuthorityortheMunicipalCorporationofDelhiinpursuanceofanyimprovementschemeordevelopmentschemeandthatsuchbuildingwork
cannotbecarriedoutwithoutthepremisesbeingvacated.

(2)Noorderfortherecoveryofpossessionofanypremisesshallbemadeonthegroundspecifiedinclause(a)oftheprovisotosubsection(1)if
thetenantmakespaymentordepositasrequiredbysection15:

Providedthatnotenantshallbeentitledtothebenefitunderthissubsection,if,havingobtainedsuchbenefitonceinrespectofanypremises,he
againmakesadefaultinthepaymentofrentofthosepremisesforthreeconsecutivemonths.

(3)Noorderfortherecoveryofpossessioninanyproceedingundersubsection(1)shallbebindingonanysubtenantreferredtoinsection17who
hasgivennoticeofhissubtenancytothelandlordundertheprovisionsofthatsection,unlessthesubtenantismadeapartytotheproceedingand
theorderforevictionismadebindingonhim.

(4)Forthepurposeofclause(b)oftheprovisotosubsection(1),anypremiseswhichhavebeenletforbeingusedforthepurposeofbusinessor
professionshallbedeemedtohavebeensubletbythetenant,iftheControllerissatisfiedthatthetenantwithoutobtainingtheconsentinwriting
ofthelandlordhas,afterthe16thdayofAugust,1958,allowedanypersonisapartnerofthetenantinthebusinessorprofessionbutreallyforthe
purposeofsublettingsuchpremisestotheperson.

(5)Noapplicationfortherecoveryofpossessionofanypremisesshalllieundersubsection(1)onthegroundspecifiedinclause(c)oftheproviso
thereto,unlessthelandlordhasgiventothetenantanoticeintheprescribedmannerrequiringhimtostopthemisuseofthepremisesandthe
tenanthasrefusedorfailedtocomplywithsuchrequirementwithinonemonthofthedateofserviceofthenoticeandnoorderforevictionagainst
thetenantshallbemadeinsuchacase,unlesstheControllerissatisfiedthatthemisuseofthepremisesisofsuchanaturethatitisapublicnuisance
orthatitcausesdamagetothepremisesorisotherwisedetrimentaltotheinterestofthelandlord.

(6)Wherealandlordhasacquiredanypremisesbytransfer,noapplicationfortherecoveryofpossessionofsuchpremisesshalllieundersub
section(1),onthegroundspecifiedinclause(e)oftheprovisothereto,unlessaperiodoffiveyearshaveelapsedfromthedateoftheacquisition.

(7)Whereanorderfortherecoveryofpossessionofanypremisesismadeonthegroundspecifiedinclause(c)oftheprovisotosubsection(1),the
landlordshallnotbeentitledtoobtainpossessionthereofbeforetheexpirationofaperiodofsixmonthsfromthedateoftheorder.

(8)Noorderfortherecoveryorpossessionofanypremisesshallbemadeonthegroundspecifiedinclause(g)oftheprovisotosubsection(1),
unless the Controller is satisfied that the proposed reconstruction will not radically after the purpose for which the premises were let or such
ramidically alteration is in the public interest, and that the plans and estimates of such reconstruction have been properly prepared and that
necessaryfundforthepurposeareavailablewiththelandlord.

(9)Noorderfortherecoveryofpossessionofanypremisesshallbemadeonthegroundspecifiedinclause(I)oftheprovisotosubsection(1),if
the Controller is of opinion that there is any bona fide dispute as to whether the tenant has ceased to be in the service or employment of the
landlord.

(10)Noorderfortherecoveryofpossessionofanypremisesshallbemadeonthegroundspecifiedinclause,(i)oftheprovisotosubsecond(1)if
thetenant,withinsuchtimeasmaybespecifiedinthisbehalfbytheController,carriesoutrepairstothedamagecausedtothesatisfactionofthe
ControllerorpaystothelandlordsuchamountbywayofcompensationastheControllermaydirect.

(11)Noorderfortherecoveryofpossessionofanypremisesshallbemadeonthegroundspecifiedinclause(k)oftheprovisoofsubsection(1),if
thetenant,withinsuchtimeasmaybespecifiedinthisbehalfbytheController,complieswiththeconditionimposedonthelandlordbyanyofthe
authoritiesreferredtointhatclauseorpaystothatauthoritysuchamountbywayofcompensationastheControllermaydirect.

COMMENTS

(i)Paymentofrentormonetaryconsiderationbysubtenanttotenantmayhavebeenmadesecretly,thelawdoesnotrequiresuchpaymenttobe
provedbyaffirmativeevidenceandthecourtispermittedtodrawitsowninferenceuponthefactsofthecaseprovedatthetrial,includingthe
deliveryofexclusivepossessiontoinferthatthepremisesweresubletM/sBharatSalesLtd.v.LifeInsuranceCorporationofIndia,AIR1998SC

(ii)Itissettledprincipleoflawthatifatenantedpremisesisahousethenitmeansthatlettingwasforresidingandhousemeansadwellingplace.If
tenantgivesaddressofhishouseforcommercialcommunicationorcorrespondence,thenitwouldnotmeancommercialuserShriKishanLalv.

(iv) Subsection (11) of section 14 enables the Controller to give an another opportunity to the tenant to avoid an order of eviction. Where the
authority concerned requires stoppage of misuser then an order to that effect has to be passed, but where the authority merely demands
compensationformisuserthenonlyinsuchacasewouldtheControllerbejustifiedinpassinganorderforpaymentofcompensationaloneDr.K.

14A.Righttorecoverimmediatepossessionofpremisestoaccruetocertainpersons.
(1)Wherealandlordwho,beingapersoninoccupationofanyresidentialpremisesallottedtohimbytheCentralGovernmentoranylocalauthority
isrequired,by,orinpursuanceof,anygeneralorspecialordermadebythatGovernmentorauthority,tovacatesuchresidentialaccommodation,
orindefault,toincurcertainobligations,onthegroundthatheowns,intheUnionterritoryofDelhi,aresidentialaccommodationeitherinhisown
name or in the name of his wife or dependent child, there shall accrue, on and from the date of such order, to such landlord, notwithstanding
anythingcontainedelsewhereinthisActorinanyotherlawforthetimebeinginforceorinanycontract(whetherexpressorimplied),customor
usagetothecontrary,arighttorecoverimmediatelypossessionofanypremisesletoutbyhim:

Providedthatnothinginthissectionshallbeconstruedasconferringarightonalandlordowning,intheUnionterritoryofDelhi,twoormore
dwellinghouseswhetherinhisownnameorinthenameofhiswifeordependentchildtorecoverthepossessionofmorethanonedwellinghouse
anditshallbelawfulforsuchlandlordtoindicatethedwellinghouse,possessionofwhichhiintendstorecover.

(2)NotwithstandinganythingcontainedelsewhereinthisActorinanytherelawforthetimebeinginforceorinanycontract,customorusageto
thecontrary,wherethelandlordexercisestherightofrecoveryconferredonhimbysubsection(1),nocompensationshallbepayablebyhimtothe
tenant or any person claiming through or under him and no claim for such compensation shall be entertained by any court, tribunal or other
authority:

Providedthatwherethelandlordhadreceived,

(a)anyrentinadvancefromthetenant,heshall,withinaperiodofninetydaysfromthedateofrecoveryofpossessionofthepremisesbyhim,
refundtothetenantsuchamountasrepresentstherentpayablefortheunexpiredportionofthecontract,agreementorlease

(b)anyotherpayment,heshall,withintheperiodaforesaid,refundtothetenantasumwhichshallbearthesameproportiontothetotalamount
receivedastheunexpiredportionofthecontractoragreement,orleasebearstothetotalperiodofcontractoragreementorlease:

Providedfurtherthat,ifanydefaultismadeinmakinganyrefundasaforesaid,thelandlordshallbeliabletopaysimpleinterestattherateofsix
percent.perannumontheamountwhichhehasomittedorfailedtorefund

14B.Righttorecoverimmediatepossessionofpremisestoaccruetomembersofthearmedforces,etc.

(1)Wherethelandlord

(a)isareleasedorretiredpersonfromanyarmedforcesandthepremisesletoutbyhimarerequiredforhisownresidenceor

(b)isadependentofamemberofanyarmedforceswhohadbeenkilledinactionandthepremisesletoutbysuchmemberarerequiredforthe
residenceofthefamilyofsuchmember,suchpersonor,asthecasemaybe,thedependantmay,withinoneyearfromthedateofhisreleaseor
retirement from such armed forces or, as the case may be, the date of death of such member, or within a period of one year from the date of
commencement of the Delhi Rent Control (Amendment) Act, 1988, whichever is later, apply to the Controller for recovering the immediate
possessionofsuchpremises.

(2)Wherethelandlordisamemberofanyofthearmedforcesandhasaperiodoflessthanoneyearprecedingthedateofhisretirementandthe
premisesletoutbyhimarerequiredforhisownresidenceafterhisretirement,hemay,atanytime,withinaperiodofoneyearbeforethedateof
hisretirement,applytotheControllerforrecoveringtheimmediatepossessionofsuchpremises.

(3)Wherethelandlordreferredtoinsubsection(1)orsubsection(2)hasletoutmorethanonepremises,itshallbeopentohimtomakean
applicationunderthatsubsectioninrespectofonlyoneofthepremiseschosenbyhim.

Explanation.For the purpose of this section, armed forces means an armed force of the Union constituted under an Act of Parliament and
includesamemberofthepoliceforceconstitutedundersection3oftheDelhiPoliceAct,1978(34of1978).

14C. Right to recover immediate possession of premises to accrue to Central Government and Delhi
Administrationemployees.
(1)WherethelandlordisaretiredemployeeoftheCentralGovernmentoroftheDelhiAdministration,andthepremisesletoutbyhimarerequired
for his own residence, such employee may, within one year from the date of his retirement or within a period of one year from the date of
commencement of the Delhi Rent Control (Amendment) Act, 1988, whichever is later apply to the Controller for recovering the immediate
possessionofsuchpremises.

(2)WherethelandlordisanemployeeoftheCentralGovernmentoroftheDelhiAdministrationandhasaperiodoflessthanoneyearpreceding
thedateofhisretirementandthepremisesletoutbyhimarerequiredbyhimforhisownresidenceafterhisretirement,hemay,atanytimewithin
aperiodofoneyearbeforethedateofhisretirement,applytotheControllerforrecoveringtheimmediatepossessionofsuchpremises.

(3)Wherethelandlordreferredtoinsubsection(1)orsubsection(2)hasletoutmorethanonepremises,itshallbeopentohimtomakean
applicationunderthatsubsectioninrespectofonlyoneofthepremiseschosenbyhim.

14D.Righttorecoverimmediatepossessionofpremisestoaccruetoawidow.
(1)Wherethelandlordisawidowandthepremisesletoutbyher,orbyherhusband,arerequiredbyherforherownresidence,shemayapplyto
theControllerforrecoveringtheimmediatepossessionofsuchpremises.

(2)Wherethelandlordreferredtoinsubsection(1)hasletoutmorethanonepremises,itshallbeopentohertomakeanapplicationunderthat
subsectioninrespectofanyoneofthepremiseschosenbyher.

15Whenatenantcangetthebenefitofprotectionagainsteviction.

16.Restrictionsonsubletting.
(1)Whereatanytimebeforethe9thdayofJune,1952,atenanthassubletthewholeoranypartofthepremisesandthesubtenantis,atthe
commencementofthisAct,inoccupationofsuchpremises,thennotwithstandingthattheconsentofthelandlordwasnotobtainedforsuchsub
letting,thepremisesshallbedeemedtohavebeenlawfullysublet.
(2)Nopremiseswhichhavebeensubleteitherinwholeorinpartonorafterthe9thdayofJune,1952,withoutobtainingtheconsentinwritingof
thelandlord,shallbedeemedtohavebeenlawfullysublet.

(3)AfterthecommencementofthisAct,notenantshall,withoutthepreviousconsentinwritingofthelandlord,

(a)Subletthewholeoranypartofthepremisesheldbyhimasatenantor

(b)transferorassignhisrightsinthetenancyorinanypartthereof.

(4)Nolandlordshallclaimorreceivethepaymentofanysumaspremiumorpugreeorclaimorreceiveanyconsiderationwhatsoeverincashorin
kindforgivinghisconsenttothesublettingofthewholeoranypartofthepremisesheldbethetenant.

17.Noticeofcreationandterminationofsubtenancy.
(1)Whoever,afterthecommencementofthisAct,anypremisesaresubleteitherinwholeorinpartbythetenantwiththepreviousconsentin
writingofthelandlord,thetenantorthesubtenanttowhomthepromisesaresubletmay,intheprescribedmanner,givenoticetothelandlordof
thecreationofthesubtenancywithinonemonthofthedateofsuchsublettingandnotifytheterminationofsuchsubtenancywithinonemonthof
suchtermination.

(2)Where,beforethecommencementofthisAct,anypremiseshavebeenlawfullysubleteitherinwholeorinpartbythetenant,thetenantorthe
subtenanttowhomthepremiseshavebeensubletmay,intheprescribedmanner,givenoticetothelandlordofthecreationofthesubtenancy
withinsixmonthsofthecommencementofthisAct,andnotifytheterminationofsuchsubtenancywithinonemonthofsuchtermination.

(3)Whereinanycasementionedinsubsection(2),thelandlordconteststhatthepremiseswerenotlawfullysublet,andanapplicationismadeto
theControllerinthisbehalf,eitherbythelandlordorbythesubtenant,withintwomonthsofthedateofthereceiptofthenoticeofsublettingby
thelandlordortheissueofthisnoticebythetenantorthesubtenant,asthecasemaybe,theControllershalldecidethedispute.

18.Subtenanttobetenantincertaincases.
(1)Whereanorderforevictioninrespectofanypremisesismadeundersection14againstatenantbutnotagainstasubtenantreferredtoin
section17andanoticeofthesubtenancyhasbeengiventothelandlord,thesubtenantshall,witheffectfromthedateoftheorder,bedeemedto
becomeatenantholdingdirectlyunderthelandlordinrespectofthepremisesinhisoccupationonthesametermsandconditionsonwhichthe
tenantwouldhaveheldfromthelandlord,ifthetenancyhadcontinued.

(2)Where,beforethecommencementofthisAct,theinterestofatenantinrespectofanypremiseshasbeendeterminedwithoutdeterminingthe
interestofanysubtenanttowhomthepremiseshasbeendeterminedwithoutdeterminingtheinterestofanysubtenanttowhomthepremises
eitherinwholeorinparthadbeenlawfullysublet,thesubtenantshall,witheffectfromthedateofthecommencementofthisAct,bedeemedto
havebecomeatenantholdingdirectlyunderthelandlordonthesametermsandconditionsonwhichthetenantwouldhaveheldfromthelandlord,
ifthetenancyhadcontinued.

19.Recoveryofpossessionforoccupationandreentry.

(1)Wherealandlordrecoverspossessionofanypremisesfromthetenantinpursuanceofanordermadeunderclause(c)oftheprovisotosub
section(1)ofsection14[orundersections14A,14B,14C,148and21],thelandlordshallnot,exceptwiththepermissionoftheController,obtained
intheprescribedmanner,reletthewholeoranypartofthepremiseswithinthreeyearsfromthedateofobtainingsuchpossession,andingranting
suchpermission,theControllermaydirectthelandlordtoputsuchevictedtenantinpossessionofthepremises.

(2)Wherealandlordrecoverspossessionofanypremisesasaforesaidandthepremisesarenotoccupiedbythelandlordorbythepersonforwhose
benefitthepremisesareheld,withintwomonthsofobtainingsuchpossession,orthepremiseshavingbeensooccupiedare,atanytimewithinthree
yearsfromthedateofobtainingpossession,relettoanypersonotherthantheevictedtenantwithoutobtainingthepermissionoftheController
undersubsection(1)orthepossessionofsuchpremisesistransferredtoanotherpersonforreasonswhichdonotappeartotheControllertobe
bonafide,theControllermay,onanapplicationmadeonhiminthisbehalfbysuchevictedtenantwithinsuchtimeasmaybeprescribed,directthe
landlordtoputthetenantinpossessionofthepremisesortopayhimsuchcompensationastheControllerthinksfit.

20.Recoveryofpossessionforrepairsandrebuildingandreentry.

(1) In making any order on the grounds specified in clause (f) or clause (g) of the proviso to subsection (1) of section 14, the Controller shall
ascertainfromthetenantwhetherheelectstobeplacedinoccupationofthepremisesorpartthereoffromwhichheistobeevictedandifthetenant
soelects,shallrecordthefactoftheelectionintheorderandspecifythereinthedateonorbeforewhichheshalldeliverpossessionsoastoenable
thelandlordtocommencetheworkofrepairsorbuildingorrebuilding,asthecasemaybe.

(2)Ifthetenantdeliverspossessiononorbeforethedatespecifiedintheorder,thelandlordshall,onthecompletionoftheworkofrepairsof
buildingorrebuilding,placethetenantinoccupationofthepremisesorpartthereof.

(3)If,afterthetenanthasdeliveredpossessiononorbeforethedatespecifiedintheorder,thelandlordfailstocommencetheworkofrepairsor
buildingorrebuildingwithinonemonthofthespecifieddateorfailstocompletetheworkinareasonabletimeorhavingcompletethework,fails
toplacethetenantinoccupationofthepremisesinaccordancewithsubsection(2),theControllermay,onanapplicationmadetohiminthisbehalf
bythetenantwithinsuchtimeasmaybeprescribed,orderthelandlordtoplacethetenantinoccupationofthepremisesorpartthereofortopayto
thetenantsuchcompensationastheControllerthinksfit.

21.Recoveryofpossessionincaseoftenanciesforlimitedperiod.
(1)Wherealandlorddoesnotrequirethewholeoranypartofanypremisesforaparticularperiod,andthelandlord,afterobtainingthepermission
oftheControllerintheprescribedmanner,letsthewholeofthepremisesorpartthereofasaresidenceforsuchperiodasmaybeagreedtoin
writingbetweenthelandlordandthetenantandthetenantdoesnotontheexpiryofthesaidperiod,vacatesuchpremisesthen,notwithstanding
anythingcontainedinsection14orinanyotherlaw,theControllermay,onanapplicationmadetohiminthisbehalfbythelandlordwithinsuch
timeasmaybeprescribed,placethelandlordinvacantpossessionofthepremisesorpartthereofbyevictingthetenantandeveryotherpersonwho
maybeinoccupationofsuchpremises.

(2)Whilemakinganorderundersubsection(1),theControllermayawardtothelandlordsuchdamagesfortheuseoroccupationofthepremises
atsuchdamagesfortheuseoroccupationofthepremisesatsuchratesheconsidersproperinthecircumstancesofthecasefortheperiodfromthe
dateofsuchordertillthedateofactualvacationbythetenant.

22.Specialprovisionforrecoveryofpossessionincertaincases.
Where the landlord in respect of any premises is any company or other body corporate or any local authority or any public institution and the
premises are required for the use of employees of such landlord or in the case of a public institution, for the furtherance activities, then,
notwithstandinganythingcontainedinsection14oranyotherlaw,theControllermay,onanapplicationmadetohiminhisbehalfbysuchlandlord,
placethelandlordinvacantpossessionofsuchpremisesbyevictingthetenantandeveryotherpersonwhomaybeinoccupationthereof,ifthe
Controllerissatisfied

(a)thatthetenanttowhomsuchpremiseswereletforuseasaresidenceatatimewhenhewasintheserviceoremploymentofthelandlord,has
ceasedtobeinsuchserviceoremploymentor

(b)thatthetenanthasactedincontraventionoftheterms,expressorimplied,underwhichhewasauthorisedtooccupysuchpremisesor

(c)thatanyotherpersonisinunauthorisedoccupationofsuchpremisesor

(d)thatthepremisesarerequiredbonafidebythepublicinstitutionforthefurtheranceofitsactivities.

Explanation.Forthepurposesofthissection,publicinstitutionincludesanyeducationalinstitution,library,hospitalandcharitabledispensary
[butdoesnotincludeanysuchinstitutionsetupbyanyprivatetrust

23.Permissiontoconstructadditionalstructures.
Wherethelandlordproposestomakeanyimprovementin,orconstructanyadditionalstructureon,anybuildingwhichhasbeenlettoatenantand
thetenantrefusestoallowthelandlordtomakesuchimprovementorconstructsuchadditionalstructureandtheController,onanapplication
madetohiminthisbehalfbythelandlord,issatisfiedthatthelandlordisreadyandwillingtocommencetheworkandthatsuchworkwillnotcause
anyunduehardshiptothetenant,theControllermaypermitthelandlordtodosuchworkandmaymakesuchotherorderashethinksfitinthe
circumstancesofthecase.

24.Specialprovisionregardingvacantbuildingsites.
Notwithstandinganythingcontainedinsection14,whereanypremiseswhichhavebeenletcomprisevacantlanduponwhichitispermissibleunder
thebuildingregulationsormunicipalbyelaws,forthetimebeinginforce,toerectanybuilding,whetherforuseasaresidenceorforanyother
purposeandthelandlordproposingtoerectsuchbuildingisunabletoobtainpossessionofthelandfromthetenantbyagreementwithhimandthe
Controller,onanapplicationmadetohiminthisbehalfbythelandlord,issatisfiedthatthelandlordisreadyandwillingtocommencetheworkand
thatseveranceofthevacantlandfromtherestofthepremiseswillnotcauseunduehardshiptothetenant,theControllermay

(a)Directseverance

(b)Placethelandlordinpossessionofthevacantland

(c)Determinetherentpayablebythetenantinrespectoftherestofthepremisesand

(d)Makesuchotherorderashethinksfitinthecircumstancesofthecase.

25.Vacantpossessiontolandlord
Notwithstandinganythingcontainedinanyotherlaw,wheretheinterestofatenantinanypremisesisdeterminedforanyreasonwhatsoeverand
anyorderismadebytheControllerunderthisActfortherecoveryofpossessionofsuchpremisestheordershall,subjecttotheprovisionsof
section18,bebindingonallpersonswhomaybeinoccupationofthepremisesandvacantpossessionthereofshallbegiventothelandlordby
evictingallsuchpersontherefrom:

Providedthatnothinginthissectionshallapplytoanypersonwhohasanindependenttitletosuchpremises.

Chapter III A Summary Trial of Certain Applications

25A.ProvisionsofthisChaptertohaveoverridingeffect.
TheprovisionsofthisChapteroranyrulemadethereundershallhaveeffectnotwithstandinganythinginconsistenttherewithcontainedelsewhere
inthisActorinanyotherlawforthetimebeinginforce.

25B Special procedure for the disposal of applications for eviction on the ground of bona fide
requirement.
(1)Everyapplicationbyalandlordfortherecoveryofpossessionofanypremisesonthegroundspecifiedinclause(e)oftheprovisotosubsection
(1)ofsection14,orundersection14A[orundersection14Borundersection14Corundersection14D]shallbedealtwithinaccordancewiththe
procedurespecifiedinthissection.
(2)TheControllershallissuesummons,inrelationtoeveryapplicationreferredtoinsubsection(1),intheformspecifiedintheThirdSchedule.

(3)(a)TheControllershall,inadditionto,andsimultaneouslywith,theissueofsummonsforserviceonthetenant,alsodirectthesummonstobe
servedbyregisteredpost,acknowledgmentdue,addressedtothetenantorhisagentempoweredtoaccepttheserviceattheplacewherethetenant
orhisagentactuallyandvoluntarilyresidesorcarriesonbusinessorpersonallyworksforgainandmay,ifthecircumstancesofthecasesorequire,
alsodirectthepublicationofthesummonsinanewspapercirculatinginthelocalityinwhichthetenantislastknowntohaveresidedorcarriedon
businessorpersonallyworkedforgain.

(b)WhenanacknowledgementpurportingtobesignedbythetenantorhisagentisreceivedbytheControllerortheregisteredarticlecontaining
thesummonsisreceivedbackwithanendorsementpurportingtohavebeenmadebyapostalemployeetotheeffectthatthetenantorhisagenthad
refusedtotakedeliveryoftheregisteredarticle,theControllermaydeclarethattherehasbeenavalidserviceofsummons.

(4)Thetenantonwhomthesummonsisdulyserved(whetherintheordinarywayorbyregisteredpost)intheformspecifiedintheThirdSchedule
shall not contest the prayer for eviction from the premises unless he files and affidavit stating the grounds on which he seeks to contest the
application for eviction and obtains leave from the Controller as hereinafter provided and in default of his appearance in pursuance of the
summonsorhisobtainingsuchleave,thestatementmadebythelandlordintheapplicationforevictionshallbedeemedtobeadmittedbythe
tenantandtheapplicantshallbeentitledtoanorderforevictiononthegroundaforesaid.

(5)TheControllershallgivetothetenantleavetocontesttheapplicationiftheaffidavitfiledbythetenantdisclosessuchfactsaswoulddisentitle
thelandlordfromobtaininganorderfortherecoveryofpossessionofthepremisesonthegroundspecifiedinclause(c)oftheprovisotosub
section(1)ofsection14,orundersection14A.

(6) Where leave is granted to the tenant to contest the application, the Controller shall commence the hearing of the application as early as
practicable.

(7)Notwithstandinganythingcontainedinsubsection(2)ofsection37,theControllershall,whileholdingandinquiryinaproceedingtowhichthis
Chapterapplies,followthepracticeandprocedureofaCourtofSmallCauses,includingtherecordingofevidence.

(8)NoappealorsecondappealshalllieagainstanorderfortherecoveryofpossessionofanypremisesmadebytheControllerinaccordancewith
theprocedurespecifiedinthissection:

ProvidedthattheHighCourtmay,forthepurposeofsatisfyingitselfthatanordermadebytheControllerunderthissectionisaccordingtolaw,
callfortherecordsofthecaseandpasssuchorderinrespecttheretoasitthinksfit.

(9)WherenoapplicationhasbeenmadetotheHighCourtonrevision,theControllermayexercisethepowersofreviewinaccordancewiththe
provisionsofOrderXLVIIoftheFirstScheduletotheCodeofCivilProcedure,1908(5of1908).

(10)SaveasotherwiseprovidedinthisChapter,theprocedureforthedisposalofanapplicationforevictiononthegroundspecifiedinclause(e)of
theprovisotosubsection(1)ofsection14,orundersection14A,shallbethesameastheprocedureforthedisposalofapplicationsbyControllers.

25CActtohaveeffectinamodifiedforminrelationtocertainpersons.
(1)Nothingcontainedinsubsection(6)ofsection14shallapplytoalandlordwho,beingapersoninoccupationofanyresidentialpremisesallotted
tohimbytheCentralGovernmentoranylocalauthorityisrequiredbyorinpursuanceof,anordermadebythatGovernmentorauthoritytovacate
suchresidentialaccommodation,or,indefault,toincurcertainobligations,orthegroundthattheownsaresidentialaccommodationeitherinhis
ownnameorinthenameofhiswifeordependentchildintheUnionterritoryofDelhi.

(2)Inthecaseofalandlordwhom,beingapersonofthecategoryspecifiedinsubsection(1)hasobtained,onthegroundspecifiedinclause(e)of
theprovisotosubsection(1)ofsection14,orundersection14A,anorderfortheevictionofatenantfromanypremises,theprovisionsofsub
section(7)ofsection14shallhaveeffectasifforthewordssixmonths,occurringtherein,thewordstwomonthsweresubstituted.

Chapter IV Deposit of Rent

26.Receipttobegivenforrentpaid.
(1)Everytenantshallpayrentwithinthetimefixedbycontractorintheabsenceofsuchcontract,bythefifteenthdayofthemonthnextfollowing
themonthforwhichitispayable[andwhereanydefaultoccursinthepaymentofrent,thetenantshallbeliabletopaysimpleinterestattherateof
fifteenpercent.perannumfromthedateonwhichsuchpaymentofrentisduetothedateonwhichitispaid.

(2) Every tenant who makes a payment of rent to his landlord shall be entitled to obtain forthwith from the landlord or his authorised agent a
writtenreceiptfortheamountpaidtohim.,signedbythelandlordorhisauthorisedagent:

Providedthatitshallbeopentothetenanttoremittherenttohislandlordsbypostalmoneyorder.

(3)Ifthelandlordorhisauthorisedagentrefusesorneglectstodelivertothetenantareceiptreferredtoinsubsection(2),theControllermay,on
anapplicationmadetohiminthisbehalfbythetenantwithintwomonthsfromthedateofpaymentandafterhearingthelandlordorhisauthorised
agent,byorderdirectthelandlordorhisauthorisedagenttopaytothetenant,bywayofdamages,suchsumnotexceedingdoubletheamountof
rentpaidbythetenantandthecostsoftheapplicationandshallalsograntacertificatetothetenantinrespectoftherentpaid.

27.Depositofrentbythetenant.
(1)Wherethelandlorddoesnotacceptanyrenttenderedbythetenantwithinthetimereferredtoinsection26ofrefusesorneglectstodelivera
receiptreferredtothereinorwherethereisabonafidedoubtastothepersonorpersonstowhomtherentispayable,thetenantmaydepositsuch
rentwiththeControllerintheprescribedmanner:

Providedthatincasewherethereisabonafidedoubtastothepersonorpersonstowhomtherentispayable,thetenantmayremitsuchrenttothe
Controllerbypostalmoneyorder.

(2)Thedepositshallbeaccompaniedbyanapplicationbythetenantcontainingthefollowingparticulars,namely:
(a)thepremisesforwhichtherentisdepositedwithadescriptionsufficientforidentifyingthepremises

(b)theperiodforwhichtherentisdeposited

(c)thenameandaddressofthelandlordorthepersonorpersonsclaimingtobeentitledtosuchrent

(d)thereasonsandcircumstancesforwhichtheapplicationfordepositingtherentismade

(e)suchotherparticularsasmaybeprescribed.

(3)Onsuchdepositoftherentbeingmade,theControllershallsendintheprescribedmanneracopyorcopiesoftheapplicationtothelandlordor
personsclaimingtobeentitledtotherentwithanendorsementofthedateofthedeposit.

(4)Ifanapplicationismadeforthewithdrawalofanydepositofrent,theControllershall,ifsatisfiedthattheapplicantisthepersonentitledto
receivetherentdeposited,ordertheamountoftherenttobepaidtohiminthemannerprescribed:

ProvidedthatnoorderforpaymentofanydepositofrentshallbemadebytheControllerunderthissubsectionwithoutgivingallpersonsnamed
by he tenant in his application under subsection (2) as claiming to be entitled to payment of such rent being decided by a court of competent
jurisdiction.

(5) If at the time of filing the application under subsection (4), but not after the expiry of thirty days from receiving the notice of deposit, the
landlordorthepersonorpersonsclaimingtobeentitledtotherentcomplainsorcomplaintotheControllerthatthestatementsinthetenants
applicationofthereasonsandcircumstanceswhichledhimtodeposittherentareuntrue,theController,aftergivingthetenantanopportunityof
beingheard,maylevyonthetenantafinewhichmayextendtoanamountequaltotwomonthsrent,iftheControllerissatisfiedthatthesaid
statementsweremateriallyuntrueandmayorderthatasumoutofthefinerealisedbepaidtothelandlordascompensation.

(6)TheControllermay,onthecomplaintofthetenantandaftergivinganopportunitytothelandlordofbeingheard,levyonthelandlordafine
whichmayextendtoanamountequaltotwomonthsrent,iftheControllerissatisfiedthatthelandlord,withoutanyreasonablecause,refusedto
acceptrentthoughtenderedtohimwithinthetimereferredtoinsection26andmayfurtherorderthatasumoutofthefinerealisedbepaidtothe
tenantascompensation.

28.Timelimitofmakingdepositandconsequencesofincorrectparticularsisapplicationfordeposit.
(1)Norentdepositedundersection27shallbeconsideredtohavebeenvalidlydepositedunderthatsection,unlessthedepositismadewithin
twentyonedaysofthetimereferredtoinsection26forpaymentoftherent.

(2)Nosuchdepositshallbeconsideredtohavebeenvalidlymade,ifthetenantwillfullymakesanyfalsestatementinhisapplicationfordepositing
the rent, unless the landlord has withdrawn the amount deposited before the date of filing an application for the recovery of possession of the
premisesfromthetenant.

(3)Iftherentisdepositedwithinthetimementionedinsubsection(1)anddoesnotceasetoisvaliddepositforthereasonmentionedinsub
section(2),thedepositshallconstitutepaymentofrenttothelandlord,asiftheamountdepositedhadbeenvalidlytendered.

29.Savingastoacceptanceofrentforfeitureofrentindeposit.
(1) The withdrawal of rent deposited under section 27 in the manner provided therein shall not operate as an admission against the person
withdrawing it of the correctness of the rent, the period of default, the amount due, or of any other facts stated in the tenants application for
depositingtherentunderthesaidsection.

(2) Any rent in deposit which is not withdrawn by the landlord or by the person or persons entitled to receive such rent shall be forfeited to
GovernmentbyanordermadebytheController,ifitisnotwithdrawnbeforetheexpirationoffiveyearsfromthedateofpostingofthenoticeof
deposit.

(3)BeforepassingasorderofforfeituretheControllershallgivenoticetothelandlordorthepersonorpersonsentitledtoreceivetherentin
depositbyregisteredpostatthelastknownaddressofsuchlandlordorpersonorpersonsandshallalsopublishthenoticeinhisofficeandinany
localnewspaper.

Chapter V Hotels and Lodging Houses

30.ApplicationoftheChapter.
TheProvisionsofthisChaptershallapplytoallhotelsandlodginghousesintheareaswhich,immediatelybeforethe7thdayofApril,1958,were
includedintheNewDelhiMunicipalCommittee,MunicipalCommittee,DelhiandtheNotifiedAreaCommittee,CivilStation,Delhiandmaybe
appliedbytheCentralGovernment,bynotificationintheOfficialGazette,tohotelsandlodginghouseswithinthelimitsofsuchotherurbanareof
theMunicipalCorporationofDelhiasmaybespecifiedinthenotification:

ProvidedthatiftheCentralGovernmentisofopinionthatitwouldnotbedesirableinthepublicinteresttomaketheprovisionsofthisChapter
applicabletoanyclassofhotelsorlodginghouses,itmay,bynotificationintheOfficialGazette,exemptsuchclassofhotelsorlodginghousesor
lodginghousesfromtheoperationofthisChapter.

31.Fixingoffairrate.

(1)WheretheController,onawrittencomplaintorotherwise,hasreasontobelievethatthechargesmadeforboardorlodgingoranyotherservice
providedinanyhotelorlodginghousesareexcessive,hemayfixafairratetobechargedforboard,lodgingorotherservicesprovidedinthehotel
orlodginghouseandinfixingsuchfairrate,specifiedseparatelytherateforlodging,boardorotherservices.

(2)Indeterminingthefairrateundersubsection(1),theControllershallhaveregardtothecircumstancesofthecaseandtotheprevailingrateof
chargesforthesameorsimilaraccommodation,boardandservice,duringthetwelvemonthsimmediatelyprecedingthe1stdayofJune,1951,and
toanygeneralincreaseinthecostoflivingafterthatdate.

32.Revisionoffairrate.
Onawrittenapplicationfromthemanagerofahotelortheownerofalodginghouseorotherwise,theControllermay,fromtimetotime,revisethe
fairratetobechargedforboard,lodgingorotherserviceinahotelorlodginghouse,andfixsuchrateashemaydeemfithavingregardtoany
generalriseorfallinthecostoflivingwhichmayhaveoccurredafterthefixingoffairrate.

33.Chargesinexcessoffairratenotrecoverable.
WhentheControllerhasdeterminedthefairrateofchargesinrespectofahotelorlodginghouse,

(a)Themanagerofthehotelortheownerofthelodginghouse,asthecasemaybe,shallnotchargeanyamountinexcessofthefairrateandshall
not,exceptwiththepreviouswrittenpermissionoftheController,withdrawfromthelodgeranyconcessionorserviceallowedatthetimewhenthe
Controllerdeterminedthefairrate

(b)Anyagreementforthepaymentofanychargesinexcessofsuchfairrateshallbevoidinrespectofsuchexcessandshallbeconstruedasifitwere
anagreementforpaymentofthesaidfairrate

(c)Anysumpaidbyalodgerinexcessofthefairrateshallberecoverablebyhimatanytimewithinaperiodofsixmonthsfromthedateofthe
paymentfromthemanagerofthehotelortheownerofthelodginghouseorhislegalrepresentativesandmay,withoutprejudicetoanyothermode

34.Recoveryofpossessionbymanagerorahotelortheownerofalodginghouse.
NotwithstandinganythingcontainedinthisAct,themanagerofahotelortheownerofalodginghouseshallbeentitledtorecoverpossessionofthe
accommodationprovidedbyhimtoalodgeronobtainingacertificatefromtheControllercertifying

(a)Thatthelodgerhasbeenguiltyofconductwhichisanuisanceorwhichcausedannoyancetoanyadjoiningorneighboringledger

Explanation.Forthepurposesofthisclauses,nuisanceshallbedeemedtoincludeanyactwhichconstitutesanoffenceundertheSuppressionof
ImmoralTrafficinWomenandGirlsAct,1956(104of1956)

(b)Thattheaccommodationisreasonablyandbonafiderequiredbytheownerofthehotelorlodginghouse,asthecasemaybe,eitherforhisown
occupationorfortheoccupationofanypersonforwhosebenefittheaccommodationisheld,oranyothercausewhichmaybedeemedsatisfactory
totheController

(c)Thatthelodgerhasfailedtovacatetheaccommodationontheterminationoftheperiodoftheagreementinrespectthereof

(d)Thatthelodgerhasdoneanyactwhichininconsistentwiththepurposeforwhichtheaccommodationwasgiventohimorwhichislikelytoaffect
adverselyorsubstantiallytheownersinteresttherein

(e)Thatthelodgerhasfailedtopaytherentduefromhim.

Chapter VI Appointment of Controllers and their power and functions and appeals

35.AppointmentofControllersandAdditionalControllers.
(1)TheCentralGovernmentmay,bynotificationintheOfficialGazette,appointasmanyControllersasitthinksfit,anddefinethelocallimitswithin
which,orthehotelsandlodginghousesinrespectofwhich,eachControllershallexercisethepowersconferred,andperformthedutiesimposed,on
ControllersbyorunderthisAct.

(2)TheCentralGovernmentmayalso,bynotificationintheOfficialGazette,appointasmanyadditionalControllersasitthinksfitandanadditional
ControllershallperformsuchofthefunctionsoftheControllerasmay,subjecttothecontroloftheCentralGovernment,beassignedtohimin
writing by the Controller and in the discharge of these functions, an additional Controller shall have and shall exercise the same powers and
dischargethesamedutiesastheController.

(3)ApersonnotbequalifiedforappointmentasaControlleroranadditionalController,unlesshehasforatleastfiveyearsheldajudicialofficein
IndiaorhasforatleastsevenyearsbeenpracticingasanadvocateorapleaderinIndia.

36.PowersofController.
(1)theControllermay

(a)TransferanyproceedingpendingbeforehimfordisposaltoanyadditionalController,or

(b)WithdrawanyproceedingpendingbeforeanyadditionalControlleranydisposeitofhimortransfertheproceedingfordisposaltoanyother
additionalController.

(2)TheControllershallhavethesamepowersasarevestedinacivilcourtundertheCodeofCivilProcedure,1908(5of1908),whentryingasuit,in
respectofthefollowingmatters,namely:

(a)Summoningandenforcingtheattendanceofanypersonandexamininghimonoath

(b)Requiringthediscoveryandproductionofdocuments
(c)Issuingcommissionsfortheexaminationofwitnesses

(d)Anyothermatterwhichmaybeprescribed,

AndanyproceedingbeforetheControllershallbedeemedtobeajudicialproceedingwithinthemeaningofsection193andsection228ofthe
IndianPenalCode(45of1860),andtheControllershallbedeemedtobeacivilcourtwithinthemeaningofsection480andsection482oftheCode
ofCriminalProcedure,1898(5of1898).

(3)ForthepurposesofholdinganyinquiryordischarginganydutyunderthisAct,theControllermay,

(a)Aftergivingnotlessthantwentyfourhoursnoticeinwriting,enterandinspectorauthoriseanyofficersubordinatetohimtoenterandinspect
anypremisesatanytimebetweensunriseandsunsetor

(b)Bywrittenorder,requireanypersontoproduceforhisinspectionallsuchaccounts,bookorotherdocumentsrelevanttotheinquiryatsuch
timeandatsuchplaceasmaybespecifiedintheorder.

(4)TheControllermay,ifhethinksfit,appointoneormorepersonhavingspecialknowledgeofthematterunderconsiderationasanassessoror
assessorstoadvisehimintheproceedingbeforehim.

37.ProceduretobefollowedbyController.
(1)NoorderwhichprejudiciallyaffectsanypersonshallbemadebytheControllerunderthisActwithoutgivinghimareasonableopportunityof
showingcauseagainsttheorderproposedtobemadeanduntilhisobjection,ifany,andanyevidencehemayproduceinsupportofthesamehave
beenconsideredbytheController.

(2)SubjecttoanyrulesthatmaybemadeunderthisAct,theController,shall,whileholdinganinquiryinanyproceedingbeforehim,followasfar
asmaybethepracticeandprocedureofaCourtofSmallCauses,includingtherecordingofevidence.

(3)Inallproceedingsbeforehim,theControllershallconsiderthequestionofcostsandawardsuchcoststooragainstanypartyastheController
considersreasonable.

38.AppealtotheTribunal.
(1)AnappealshallliefromeveryorderoftheControllermadeunderthisAct[onlyonquestionsoflaw]totheRentControlTribunal(hereinafter
referredtoastheTribunal)consistingofonepersononlytobeappointedbytheCentralGovernmentbynotificationintheOfficialGazette:

ProvidedthatnoappealshallliefromanorderoftheControllermadeundersection21.

(2)Anappealundersubsection(1)shallbepreferredwithinthirtydaysfromthedateoftheordermadebytheController:

Provided that the Tribunal may entertain the appeal after the expiry of the said period of thirty days, if it is satisfied that the appellant was
preventedbysufficientcausefromfilingtheappealintime.

(3)TheTribunalshallhaveallthepowervestedinacourtundertheCodeofCivilProcedure,1908(5of1908),whenhearinganappeal.

(4) Without prejudice to the provisions of subsection (3), the Tribunal may, on an application made to it or otherwise, by order transfer any
proceedingpendingbeforeanyControlleroradditionalControllertoanotherControlleroradditionalControllerandtheControlleroradditional
Controllertowhomtheproceedingissotransferredmay,subjecttoanyspecialdirectionsintheorderoftransfer,disposeoftheproceeding.

(5)ApersonshallnotbequalifiedforappointmenttotheTribunal,unlessheis,orhasbeenadistrictjudgeorhasforatleasttenyearshelda
judicialofficeinIndia.

38A.AdditionalRentControlTribunals.
(1)Fortheexpeditiousdisposalofappealsandapplicationsundersection38,theCentralGovernmentmay,bynotificationintheOfficialGazette,
constituteasmanyAdditionalRentControlTribunalsasitdeemfitandappointtoeachsuchAdditionalRentControlTribunal(hereinafterreferred
to as the Additional Tribunal) on person qualified for appointment to the Tribunal in accordance with the provisions of subsection (5) of that
section.

(2)Notwithstandinganythingcontainedinsection38,theTribunal,may,by

orderinwriting,

(a) Specify the appeals or classes of appeals under subsection (1) of that section which may be preferred to an disposed of by each Additional
TribunalandtheclassesofcasesinwhicheachAdditionalTribunalmayexercisethepowersoftheTribunalundersubsection(4)ofthatsection

(b)Transferanyappealorproceedingpendingbeforeitfordisposalto,anyAdditionalTribunalor

(c)WithdrawanyappealorproceedingpendingbeforeanyAdditionalTribunalanddisposeitofitselfortransfertheappealorproceedingfor
disposaltoanyotherAdditionalTribunal.

(3)TheProvisionsofsubsection(2)and(3)ofsection38shallapplyinrelationtoanAdditionalTribunalastheyapplyinrelationtotheTribunal.

accidentalsliporomissionmay,atanytime,becorrectedbytheControlleror[theTribunalonanAdditionalTribunal]onamapplicationreceived
inthisbehalffromanyofthepartiesorotherwise.

41.Controllertoexercisepowersofamagistrateforrecoveryoffine.
AnyfineimposedbyaControllerunderthisActshallbepaidbythepersonfindwitnessedsuchtimeasmaybetheControllerandtheController
may,forgoodandsufficientreason,extendthetime,andindefaultofsuchpayment,theamountshallberecoverableasafineundertheprovisions
of the Code of Criminal Procedure, 1898, and the Controller shall be deemed to be a magistrate under the said code for the purposes of such
recovery.

42.Controllertoexercisepowersofcivilcourtforexecutionofotherorders.
Saveasotherwiseprovidedinsection41,anordermadebytheControlleroranorderpassedonappealunderthisActshallbeexecutablebythe
Controllerasadecreeofacivilcourtandforthispurpose,theControllershallhaveallthepowersofacivilcourt.

43.Finalityoforder.
SaveasotherwiseexpresslyprovidedinthisAct,everyordermadebytheControlleroranorderpassedonappealunderthisActshallbefinaland
shallnotbecalledinquestioninanyoriginalsuit,applicationorexecutionproceeding.

Chapter VII Provisions regarding special obligations of Landlords and Penalties

44.Landlordsdutytokeepthepremisesingoodrepair.
(1)Everylandlordshallbeboundtokeepthepremisesingoodandtenantablerepairs.

(2)Ifthelandlordneglectsorfailstomake,withinareasonabletimeafternoticeinwriting,anyrepairswhichheisboundtomakeundersub
section (1) the tenant may make the same himself and deduct the expenses of such repairs from the rent or otherwise recover them from the
landlord:

Providedthattheamountsoddeductedorrecoverableinanyyearshallnotexceedonetwelfthoftherentpayablebythetenantforthatyear.

(3)Whereanyrepairswithoutwhichthepremisesarenothabitableorusableexceptwithundueinconveniencearetobemadeandthelandlord
neglectsorfailstomakethemafternoticeinwriting,thetenantmayapplytotheControllerforpermissiontomakesuchrepairshimselfandmay
submittotheControlleranestimateofthecostofsuchrepairs,and,thereupon,theControllermay,aftergivingthelandlordanopportunityof
beingheardandafterconsideringsuchestimateofthecostandmakingsuchinquiresashemayconsidernecessary,byanorderinwriting,permit
thetenanttomakesuchrepairsatsuchcostasmaybespecifiedintheorderanditshallthereafterbelawfulforthetenanttomakesuchrepairs
himself and to deduct the cost thereof, which shall in no case exceed the amount so specified, from the rent or otherwise recover it from the
landlord:

Providedthattheamountsodeductedorrecoverableinanyyearshallnotexceedonehalfoftherentpayablebythetenantforthatyear:

ProvidedfurtherthatifanyrepairsnotcoveredbythesaidamountarenecessaryintheopinionoftheController,andthetenantagreestobearthe
excesscosthimself.,theControllermaypermitthetenanttomakesuchrepairs.

45.Cuttingofforwithholdingessentialsupplyorservice.
(1)Nolandlordeitherhimselforthroughanypersonpurportingtoactonhisbehalfshallwithoutjustandsufficientcausecutofforwithholdany
essentialsupplyorserviceenjoyedbythetenantinrespectofthepremiseslettohim.

(2) If a landlord contravenes the provisions of subsection (1), the tenant may make an application to the Controller complaining of such
contravention.

(3)IftheControllerissatisfiedthatessentialsupplyorservicewascutofforwithheldbythelandlordwithaviewtocompelthetenanttovacatethe
premisesortopayanenhancedrent,theControllermaypassanorderdirectingthelandlordtorestoretheamenitiesimmediately,pendingthe
inquiryreferredtoinsubsection(4).

Explanation.Aninterimordermaybepassedunderthissubsectionwithoutjustandsufficientcausecutofforwithholdanyessentialsupplyor
serviceenjoyedbythetenantinrespectofthepremiseslettohim.

(2) If a landlord contravenes the provisions of subsection (1), the tenant may make an application to the Controller complaining of such
contravention.
(3)IftheControllerissatisfiedthatessentialsupplyorservicewascutofforwithheldbythelandlordwithaviewtocompelthetenanttovacatethe
premisesortopayanenhancedrent,theControllermaypassanorderdirectingthelandlordtorestoretheamenitiesimmediately,pendingthe
inquiryreferredtoinsubsection(4).

Explanation.Aninterimordermaybepassedunderthissubsectionwithoutgivingnoticetothelandlord.

(4)IftheControlleroninquiryfindsthattheessentialsupplyorserviceenjoyedbythetenantinrespectofthepremiseswascutofforwithheldby
thelandlordwithoutjustandsufficientcause,heshallmakeanorderdirectingthelandlordtorestoresuchsupplyorservice.

(5)TheControllermayinhisdiscretiondirectthatcompensationnotexceedingfiftyrupees

(a)bepaidtothelandlordbythetenant,iftheapplicationundersubsection(2)wasmadefrivolouslyorvexatiously

(b)bepaidtothetenantbythelandlord,ifthelandlordhadcutofforwithheldthesupplyorservicewithoutjustandsufficientcause.

Explanation1.Inthissectionessentialsupplyorserviceincludessupplyofwater,electricity,lightsinpassagesandonstaircases,conservancyand
sanitaryservices.

Explanation II.For the purposes of this section, withholding any essential supply or service shall include acts or omissions attributable to the
landlordofaccountofwhichtheessentialsupplyorserviceiscutoffbythelocalauthorityoranyordercompetentauthority.

46.LandlordsdutytogivenoticeofnewconstructiontoGovernment.
Whenever, after the commencement of this Act, any premises are constructed, the landlord shall, within thirty days of the completion of such
construction, give intimation thereof in writing to the [Director of Estates] or to such other officer as may be specified in this behalf by the
Government.

47.LeasesofvacantpremisestoGovernment.
(1)Theprovisionsofthissectionshallapplyonlyinrelationtopremisesintheareaswhich,immediatelybeforethe7thdayofApril,1958,were
includedintheNewDelhiMunicipalCommitteeandwhichare,orareintendedtobe,letforuseasaresidence.

(2)Wheneveranypremisesthestandardrentofwhichisnotlessthantwothousandandfourhundredrupeesperyearbecomesvacanteitherbythe
landlordceasingtooccupythepremisesorbytheterminationofatenancyorbytheevictionofatenantorbythereleaseofthepremisesfrom
requisitionorotherwise,

(a)thelandlordshall,withinsevendaysofthepremisesbecomingvacant,giveintimationthereofinwritingtothe[DirectorofEstate]

(b)whetherornotsuchintimationisgiven,the[DirectorofEstates]mayserveonthelandlordbypostorotherwiseanotice

(i)informinghimthatthepremisesarerequiredbytheGovernmentforsuchperiodasmaybespecifiedinthenoticeand

(ii) requiring him, and every person claiming under him, to deliver possession of the premises forthwith to such officer or person as may be
specifiedinthenotice:

Providedthatwherethelandlordhasgiventheintimationsrequiredbyclause(a),nonoticeshallbeissuedbytheDirectorofEstates]underclause
(b)morethansevendaysafterthedeliverytohimoftheintimation:

Providedfurtherthatnothinginthissubsectionshallapplyinrespectofanypremisesthepossessionofwhichhasbeenobtainedbythelandlord
onthebasisofanyordermadeonthegroundsetforthinclause(e)oftheprovisotosubsection(1)ofsection14orinrespectofanypremiseswhich
havebeenreleasedfromrequisitionfortheuseandoccupationofthelandlordhimself.

(3)Upontheserviceofanoticeunderclause(b)ofsubsection(2),thepremisesshallbedeemedtohavebeenleasedtotheGovernmentforthe
period specified in the notice, as from the date of the delivery of the intimation under clause (a) of subsection (2) or in case where no such
intimationhasbeengiven,asfromthedateonwhichpossessionofthepremisesindeliveredinpursuanceofthenotice,andtheothertermsofthe
lease shall be such as may be agreed upon between the Government and the landlord or in default of agreement, as may be determined by the
Controller,inaccordancewiththeprovisionsofthisAct.

(4)Ineverycasewherethelandlordhasinaccordancewiththeprovisionsofsubsection(2)givenintimationofanypremisesbecomingvacantand
thepremisesarenottakenonleasebytheGovernmentunderthissection,theGovernmentshallpaytothelandlordasumequaltoonefiftysecond
ofthestandardrentperyearofthepremises.

(5)AnypremisestakenofleasebytheGovernmentunderthissectionmaybeputtoanysuchuseastheGovernmentthinksfit,andinparticulars,
theGovernmentmaypermittheuseofthepremisesforthepurposesofanypublicinstitutionoranyforeignembassy,legationorconsulateorany
HighCommissionerorTradeCommissioner,orasaresidencebyanyofficerintheserviceoftheGovernmentorofaforeignembassy,legationor
consulateorofaHighCommissionerorTradeCommissioner.

48.Penalties.
(1)Ifanypersoncontravenesanyoftheprovisionsofsection5,heshallbepunishable

(a)Inthecaseofacontraventionoftheprovisionsofsubsection(1)ofsection5,withsimpleimprisonmentforatermwhichmayextendtothree
months,orwithfinewhichmayextendtoasumwhichexceedstheunlawfulchargeclaimedorreceivedundersubsectionbyonethousandrupees,
orwithboth

(b)Inthecaseofacontraventionoftheprovisionsofsubsection(2)orsubsection(3)ofsection5,withsimpleimprisonmentforatermwhichmay
extendtosixmonths,orwithfinewhichmayextendtoasumwhichexceedstheamountorvalueorunlawfulchargeclaimedorreceivedunderthe
saidsubsection(2)orsubsection(3),asthecasemaybe,byfivethousandrupees,orwithboth.
(2)Ifanytenantsubletsassignsorotherwisepartswiththepossessionofthewholeorpartofanypremisesincontraventionoftheprovisionsof
clause(b)oftheprovisotosubsection(1)ofsection14,heshallbepunishablewithfinewhichmayextendtoonethousandrupees.

(3)Ifanylandlordreletsortransfersthewholeoranypartofanypremisesincontraventionoftheprovisionsofsubsection(1)orsubsection(2)
ofsection19heshallbepunishablewithimprisonmentforatermwhichmayextendtosixmonths,orwithfine,orwithboth.

(4) If any landlord contravenes the provisions of subsection (1) of section 45, he shall be punishable with imprisonment for a term which may
extendtothreemonthsorwithfine,orwithboth.

(5)Ifanylandlordfailstocomplywithprovisionsofsection46heshallbepunishablewithfinewhichmayextendtoonehundredrupees.

(6)Ifanypersoncontravenestheprovisionsofclause(a)ofsubsection(2)ofsection47,orfailstocomplywitharequirementunderclause(b)
thereof, he shall be punishable with simple imprisonment for a term which may extend to three months, or with fine which may extend to one
thousandrupees,orwithboth.

49.Cognizanceofoffences.
(1)Nocourtinferiortothatof[MetropolitanMagistrate]shalltryanyoffencepunishableunderthisAct.

(2)NocourtshalltakecognizanceofanoffencespunishableunderthisAct,unlessthecomplaintinrespectoftheoffenceshasbeenmadewithin
threemonthsfromthedateoftheoffencehasbeenmadewithinthreemonthsfromthedateofthecommissionoftheoffence.

(3)Notwithstandinganythingcontainedin[section29oftheCodeofCriminalProcedure,1973(2of1974)]itshallbelawfulforany[Metropolitan
Magistrate]topassasentenceoffineexceeding[fivethousandrupees]onapersonconvictedofanoffencepunishableunderthisAct.

Chapter VIII Miscellaneous

50.Jurisdictionofcivilcourtsbarredinrespectofcertainmatters
(1) Save a otherwise expressly provided in this Act, no civil court shall entertain any suit or proceeding in so far as it relates to the fixation of
standardrentinrelationtoanypremisestowhichthisActappliesortoevictionofanytenanttherefromortoanyothermatterwhichtheController
isempoweredbyorunderthisActtodecide,andnoinjunctioninrespectofanyactiontakenortobetakenbytheControllerunderthisActshallbe
grantedbyanycivilcourtorotherauthority.

(2)If,immediatelybeforethecommencementofthisAct,thereisanysuitorproceedingpendinginanycivilcourtfortheevictionofanytenant
fromanypremisestowhichthisActappliesandtheconstructionofwhichhasbeencompletedafterthe1stdayofJune,19951,butbeforethe9th
dayofJune,1955,suchsuitorproceedingshall,onsuchcommencement,abate.

(3)If,inpursuanceofanydecreeorordermadebyacourt,anytenanthasbeenevictedafterthe16thdayofAugust,1958,fromanypremisesto
whichthisActappliesandtheconstructionofwhichhasbeencompletedafterthe1stdayofJune,1951,butbeforethe9thdayofJune,1955,then,
notwithstandinganythingcontainedinanyotherlaw,theControllermay,onanapplicationmadetohiminthisbehalfbysuchevictedtenantwithin
sixmonthsfromthedateofeviction,directthelandlordtoputthetenantinpossessionofthepremisesortopayhimsuchcompensationasthe
Controllerthinksfit.

(4)Nothinginsubsection(1)shallbeconstruedasprevailingacivilcourtfromentertaininganysuitorproceedingforthedecisionofanyquestion
oftitletoanypremisestowhichthisActappliesoranyquestionastothepersonorpersonswhoareentitledtoreceivetherentofsuchpremises.

51.Controllerstobepublicservants.
AllControllersandadditionalControllersappointedunderthisActshallbedeemedtobepublicservantswithinthemeaningofsection21ofthe
IndianPenalCode(45of1860).

52.Protectionofactiontakeningoodfaith.
Nosuit,prosecutionorotherlegalproceedingshalllieagainstanyControlleroradditionalControllerinrespectofanythingwhichisingoodfaith
doneorintendedtobedoneinpursuanceofthisAct.

appliesissoughttobeexecutedonthecenserofoperationofthatActinrelationtothosepremises,thecourtexecutingthedecreeofordermay,on
theapplicationofthepersonagainstwhomthedecreeororderhasbeenpassedorotherwise,reopenthecaseandifitissatisfiedthatthedecreeor
ordercouldnothavebeenpassedifthisActhadbeeninforceonthedateofdecreeororder,thecourtmay,havingregardtotheprovisionsofthis
Act,setasidethedecreeororderorpasssuchotherorderinrelationtheretoasitthinksfit.

56.Powertomakesrules.
(1)TheCentralGovernmentmay,bynotificationintheOfficialGazette,makerulestocarryoutthepurposesofthisAct.
