JUDICIAL AFFIDAVIT OF
PIERRE Y. ESTEFAN

I, Pierre Y. Estefan of legal age, married to Kristine W. Alonzo, and living at Pangada, Sta.

Catalina, Ilocos Sur, petitioner in this case, state under oath as follows:

PRELIMINARY STATEMENT

The person examining me is Atty. Maria Linda R. Raras with address at Galleria de Vigan,

Vigan City, Ilocos Sur. The examination is being held at the same address. I am answering her

questions fully conscious that I do so under oath and may face criminal liability for false

testimony and perjury.

This affidavit/testimony of petitioner Pierre Y. Estefan is being offered to prove that the

respondent Antonio T. Resurreccion is indebted to plaintiff the sum of Five Hundred Twenty Five

Thousand Pesos (Php 525,000.00), Philippine Currency. The petitioners testimony is also

offered to prove that defendant Antonio T. Resurreccion unlawfully refused to pay the lawful

demand of the plaintiff.

1. Q. Please state your name and other personal circumstances for the record.

A. I am Pierre Y. Estefan, 45 years old, pensioner and residing in Pangada, Sta. Catalina,

Ilocos Sur
2. Q. Are you the same Pierre Y. Estefan, the petitioner in this case?

A. Yes maam.

3. Q. Do you know a certain Antonio T. Resurreccion?

A: Yes maam. He borrowed money from me in the sum of Php 525,000.00

4. Q: When did Antonio borrow money from you?

A: February 10, 2016

5. Q: Do you have any proof that indeed Antonio borrowed money from you on the said date?

A: Yes maam. He executed a check dated February 10, 2016 amounting to Php525,0000 with
PNB, Vigan City Branch as the drawee bank signed by Antonio T. Resurrection payable on
August 10.2016, (Exhibit A)

6. Q: Did Antonio pay his indebtedness on August 10.2016?

A: He failed to pay the said obligation on due date. I sought payment of the check from the
bank, but it was returned with the inscription on the check Account Closed. (ExhibitB)

7. Q: How did you settle this matter?

A: I went to Antonio at their house at Bayubay, San Vicente, Ilocos Sur and sought payment.

8. Q: Did he answer your demand?

A: He failed to comply with such demand and pleaded that he be given another 6 months to

settle the same as his wife has decided to retire from the government service and Antonio hopes

that the retirement can cover the payment for the loan. And in order to finance the processing of

the retirement papers of his wife, he pleaded to Pierre and asked for another Php25,000.00 where

Antonio issued another check. (Exhibit C)

9. Q: What did you do next?

A: After 6 months, on February 10, 2017, I sought payment on the 2 nd check on the bank but it

was returned with the inscription on the check Account Closed. (ExhibitD)

I again went to the house of Antonio and sought payment but the latter was drunk and refused

payment. We have a heated argument and I sustained a broken leg which had to be amputated

immediately.
10. Q: What did you do next?

A: I tried to settle the matter with him to the level of the proper lupon of Bayubay Sur,San

Vicente, Ilocos Sur but he refused to settle it.

10. Q: Do you have any proof that Antonio indeed refused to settle his indebtedness?

A: Yes maam .Certificate to file Action (Exhibit E)

answers;
