ISSUE:
Request Board Approval of an Intergovernmental Agreement with the City of Tybee Island for
$1,711,836 for Beach Improvements.
BACKGROUND:
The 2014 2020 Special Purpose Local Option Sales Tax included funding for Tybee Island
Beach and Facility Improvements. Previously the Board of Commissioners conveyed
$1,050,000 to Tybee Island for improvements to the North Beach area. The restroom facilities
and parking were improved or upgraded.
FACTS AND FINDINGS:
1. The City of Tybee Island sustained considerable damage from Hurricane Matthew in
October 2016. Much of the re-nourishment work complete previously was damaged as
part of the storm.
2. A portion for the funding of this project will come from Tybee Island. The county
funding will come from the previous account set up for Intergovernmental Agreements
with the City of Tybee Island.
3. The Intergovernmental Agreement specifies the amount to be conveyed to the City of
Tybee Island in the amount of $1,711,836 for the project. The project is the
responsibility of the City of Tybee Island.
4. The Intergovernmental Agreement was submitted to the County Attorney on May 17,
2017, for approval as to legal form.
BLUEPRINT ALIGNMENT:
1.4.2.4.1 Create clearer process of use of SPLOST funding in regards to neighborhood
improvements, infrastructure, parks and community centers.
FUNDING:
Funds are available in 2014-2020 SPLOST (Fund 325, Project 3260790, Tybee Island Beach and
Facility Improvements). (Pending Board Approval)
ALTERNATIVES:
1. The Board approve an Intergovernmental Agreement with the City of Tybee Island for
$1,711,836 for Beach Improvements.
2. The Board not approve the Agreement.
POLICY ANALYSIS:
The Board of Commissioners must approve Intergovernmental Agreements.

INTERGOVERNMENTAL AGREEMENT FOR THE DISTRIBUTION OF SPECIAL PURPOSE


LOCAL OPTION SALES TAX PROCEEDS BY THE COUNTY TO THE CITY OF TYBEE
ISLAND FOR THE PURPOSE OF BEACH IMPROVEMENTS

THIS AGREEMENT made and entered into this ______ day of ______________ , 2017, by and
between the MAYOR AND ALDERMEN OF THE CITY OF TYBEE ISLAND, a municipal
corporation organized and existing under the laws of the State of Georgia (hereinafter referred to as the
City), and the BOARD OF COMMISSIONERS OF CHATHAM COUNTY, a political subdivision
of the State of Georgia, (hereafter referred to as the County).

WHEREAS, the County is collecting SPLOST funds for the purpose of beach renourishment and other
related capital outlay projects which would include Beach Improvements (hereinafter referred to as the
Project); and

WHEREAS, the Project is entirely within the jurisdiction of the City of Tybee Island.

NOW THEREFORE, in consideration of the mutual benefits to the parties, the City and County agree as
follows:

1. The County agrees to convey Special Purpose Local Option Sales Tax (SPLOST) VI funds to the
City to construct the Project.

2. The City will act as the project agent and manager for the Project.

a. The County will convey funds Not to Exceed $1,711,836 from the 2014-2020 SPLOST
to the City when the construction contract is awarded to a responsive contractor.

b. The City will be responsible for all financial oversight related to this Project. The City
will be responsible for construction procurement and construction management of this
project.

c. The City shall not co-mingle SPLOST funds with non-SPLOST funds and shall hold all
SPLOST funds in a segregated account with the funds being identified to be used only for
this Project. City will be responsible for improper spending of SPLOST funds.

d. The City will keep records of all SPLOST expenditure and County may audit such
SPLOST accounts to ensure compliance with SPLOST law.

IN WITNESS WHEREOF, the City and County have caused this Agreement to be duly executed by
their proper officers and so attested with their corporate seals affixed hereto set forth in multiple originals
as of the date written above:
