There were total 14183 prisoners as on 31.12.2015, thus an increase of 333 prisoners over the last year population.

4. TRENDS OF OVERCROWDING
The prison population as on 31.12.2015 has increased by 2.40% in comparison to the

population as on 31.12.2014. The increase in this year population is because of increase

in undertrial population by (6.96%). A decrease of 11.76% in convict population has been

observed in comparison to last year population.

In year 2014, occupancy of prisons vis--vis sanctioned capacity was 222% whereas

in the year 2015 an occupancy of 227% was observed.

The trend of overcrowding of Delhi Prisons during the preceding 10 years is depicted in the

graph below:-

5. PRISONERS PROFILE
PRISON POPULATION CATEGORY WISE AS ON 31.12.2015.

As on 31.12.2015 there were 10879 (76.70% ) undertrials, 3242(22.86%) convicts and

detenues & others 62 (0.44%) as compare to 10171 (73.44%) undertrials, 3674(26.53%)

convicts, 5(0.04%) detenues & others respectively. Category wise prison population as on

31.12.2015 is shown in table below :-

The figure includes 342 foreign prisoners majority of whom were from Nigeria(140),
Nepal(59), Bangladesh(32), Afganistan(30) and Pakistan(14) etc.

The national average of undertrial prisoners in Indian jails was 67.6* and in Delhi the
percentage of undertrial population was 76.70%, much above the national average.

The national average of convicts in Indian jails was around 31.4%* whereas in Delhi
Jails it was 22.86% thus below the national average.

6. DEMOGRAPHIC DETAILS OF PRISONERS:-


Prison administration compiles demographic details of the prisoners on the basis of information supplied by them at the time of their admission
into the jail.

A. Marital Status :-
As per figures available married prisoners constitute 54.16% of total male population whereas unmarried form 48.84%. In the female prisoner
91.02% of female population were married and 8.98% were unmarried. The population wise marital status is shown below:-

B. Educational Standard :-

As per data compiled, majority of the prison population (around 64%) has education below class-X, thus proving the linkage between educational
standard and criminality. Lesser the literacy more the crime seems to be the trend. The illiterates population constitute only 21.27% of the
total population because of literacy programme being vigorously carried out in jails.. Most of the prisoners in this category are new comers.

The Prison administration is taking every possible step to increase the literacy rate of the prisoners. There are centers of National Institutes of
Open Schooling and Indira Gandhi National Open University to impart education to prisoners. More emphasis on Academic education is given in
adolescents and female prisoners. Adult education classes are being organized in every jail. Table-B reflects the education standards of the
prisoners at the time of their admission in jail.

The low percentage of illiterates is only because of adult literacy programme (Padho Aur Padhao) being

vigorously pursued in all jails.

C. Domicile :-
Delhi being a cosmopolitan city, there is mixture of prisoners from Delhi and outside Delhi. The following were the salient

features on the domicile of prisoners:


Around 72.16% of prison population belong to Delhi, an increase of 0.67% as compared to last year-2014
population.
25.43% belongs to outside States like UP, Haryana, Bihar and Rajasthan etc.
Remaining 2.41% are foreigners.

The majority segment of prisoners which is around 84%, comes from the lower income strata of society where the monthly
income does not exceed Rs.8000/- p.m. thus establishing the linkage between poverty and criminality.

Around 49% of the prison population comprises of people who earn an annual income below Rs.50,000/- at the time of their
arrest.

Majority of the prison population (around 50%) was in the age group of 21-30 years.

Prisoners in the age group of 30-50 years constituted 37% of the total prison population.

Around 1.20% of the prisoners were more than 65 years of age.

The Prison Administration regularly takes up cases of seriously sick and aged prisoners with the concerned trial courts so that, if the
court considers it fit, they can be released on bail.

8. RECIDIVISM DURING THE YEAR 2015.

Around 35% of the prison population admitted during the year comprised of repeaters/habitual offenders. These prisoners are kept separate
from first time offenders from the very first day of their admission. They are not allowed to come in contact with other prisoners.
Table A and B show the recidivism rate in the convicts and undertrials.

Around 35% of the both convict and undertrial population admitted are repeater /habitual prisoners to the crime. Thus an increase of
11% as compared to previous year population.

Of the male population of convicts 11.07% were repeaters whereas from the female population it was
0.45%.
Similarly, from the undertrial population, 38.14% were male repeaters whereas from the female
population it was 11.31%.
65% of the total admission is first time offenders who are kept in separate wards and are not allowed to come in contact with others.

9. OFFENCE WISE POPULATION OF PRISONERS


A. UNDERTRIALS :-

The undertrial population is divided into two categories: one comprises undertrials who are facing charges under Indian Penal Code (IPC)
offences and others who are facing charges under Local and Special Act Cases. (L & S A Cases).

A decrease of 0.89% was observed in the percentage population of IPC cases with similar increase in special and local law
cases as compared to previous years population.

The analysis & comparison of this year undertrial prisoners profile with that of year 2014 shows that in
Indian Penal Code(IPC) cases

There is a decrease of 1.94% in murder cases. In other cases there is negligible variation (less than 1%).

In Local and Special Law cases

In all cases, there is negligible variation (less than 1%).

B. CONVICTS
The convict population is similarly divided into two categories, one comprising convicts, who have been convicted under the offences of Indian
Penal Code (IPC) and others who are convicted under Local and Special Act Cases.

In the male prisoner population, convicts constituted 22.62% (3242) and amongst females convicts constituted 28.50% (165).

The average percentage of convict population in Delhi Prisons in the year 2014 was 26.53% whereas in the year 2015 it stood at
22.86%, thus a decrease of 3.67% over the last year.

The analysis & comparison of this year convict prisoners profile with that of year 2014 shows that in IPC
cases

In convict population, there is an increase of 2.25% in Murder followed by Robbery 1.05% while Attempt
to Commit Murder shows a decline of 2.71% followed by Dacoity 1.46% and in other cases there is
negligible variation .

In Local and Special Laws cases


N.D.P.S. has shown an increase of 1.40% and in other cases, there is negligible variation(less than 1%).

The analysis and comparison of this table shows that positive variation signifies higher percentage of convicts as compared to
undertrials. From above table we can establish that in IPC case
Murder and Kidnapping & Abduction shows positive variation of 13.43% and 0.69 respectively thereby showing higher
conviction in these cases where as Thefts, Rape and Attempt to Commit Murder shows a negative variation of 10.01%, 1.62% &
1.15% respectively thereby showing less convictions in these cases. In other cases variation is less than 1%.

In Local & Special Law cases

N.D.P.S. cases and Prevention of Corruption shows a positive variation of 1.91% and 1.13% respectively thus showing more
convictions whereas Arms and Excise shows a negative variation of 1.68% & 0.87% respectively thereby showing less
conviction in these cases. In other cases the variation is less than 1%.

11. DETAILS OF SENTENCE AS ON 31.12.2015.


Details of number of convicts undergoing various sentence is shown in table below.

In the year 2015, there were 1375 convicts undergoing life imprisonment and 9 prisoners were facing death penalty. In the
year 2014, there were 1438 life convicts and 10 prisoners facing death penalty thus a decrease of 63 life convicts and a
decrease of 01 in death penalty convicts.

12. Overcrowding of Undertrials.


The undertrial population comprises 76.70% of the total jail population. Therefore, a major challenge before the prison administration is to take
necessary steps to reduce undertrial population with the help of judiciary. Additionally, new jails are being constructed to reduce overcrowding.
A number of steps have been taken to decongest undertrial population, some of which are as under:-

There is timely and complete production of undertrials before the court so that a trial is not prolonged because of non attendance of a
prisoner. The escort for the prisoners is being provided by Delhi Armed Police.

Special courts are being regularly organized at Tihar Court Complex for disposal of minor offences where the undertrial is ready to
confess his crime before the Magistrate who is holding the court on every third Saturday. Care is taken so that no habitual prisoner may
take advantage of special courts for which the list of prisoners is first scanned by fingerprint bureau of crime branch, Delhi Police.

A list of undertrials who have been granted bail by the courts but are unable to furnish surety is being compiled on weekly basis so that if
the court thinks it proper the prisoner could be released on relax surely condition or on personal bond.

Cases of seriously sick prisoners are being taken up with trial courts for their release on bail as per law.

Directions have been issued to Jail Superintendents to ensure that no prisoner is unnecessarily detained by the staff because of
inaccuracy of case particulars on release warrants. In this regard, detailed guidelines have been issued by Prison Headquarters.

The below mentioned table reflect the average period of detention of undertrials as on 31.12.2015.

Around 36.11% of the undertrial population is released within three months of their arrival.
There were 104 undertrials who were in prison for more than 5 years. Such prisoners are facing trial in heinous oences
like murder, rape, terrorist activities.
Legal aid advocates are visiting jails and imparting legal aid to needy prisoners so that they may not languish in jails.

For every rupee spent on inmates 51 paise goes for their secured custody by deployment of TSP and ITBP, 14 paise goes for
food, 13 paise on Water & Electricity, 09 paise for their medical well being and 13 paise as miscellaneous expenditure.
