1) Single House Bill (introduced and printed separately in either or
both houses). Uni-Bill (introduced simultaneously in both houses and printed

1 Section 1. The executive law is amended by adding a new section 204 to

2 read as follows:

204. Chief procurement officer. 1. Definitions. For the purposes of

this section:

a. "covered agency" shall mean all executive branch agencies, depart-

6 ________________________________________________________________________
ments, divisions, officers, boards and commissions, and public authori-

7 ________________________________________________________________________
ties (other than multi-state or multi-national authorities) and public

8 _______________________________________________________________________
benefit corporations, the heads of which are appointed by the governor.

9 ______________________________________________________________________
b. "state affiliated nonprofit organization" shall mean an organiza-

10 ________________________________________________________________________
tion or foundation formed under the not-for-profit corporation law, or

11 ________________________________________________________________________
any other entity formed for the benefit of or controlled by the state

12 ________________________________________________________________________
university of New York or the city university of New York or its respec-

13 ________________________________________________________________________
tive universities, colleges, community colleges, campuses or subdivi-

14 ________________________________________________________________________
sions, including the research foundation of the state university of New

15 ________________________________________________________________________
York and the research foundation of the city university of New York, to

16 ________________________________________________________________________
assist in meeting the specific needs of or providing a direct benefit to

17 ________________________________________________________________________
the respective university, college, community college, campus or subdi-

18 ________________________________________________________________________
vision or the university as a whole, that has control of, manages or

19 ________________________________________________________________________
receives one hundred thousand dollars or more annually, including alumni

20 ________________________________________________________________________
associations. For the purposes of this section, such term shall not

21 ________________________________________________________________________
include a student-run organization comprised solely of enrolled students

22 ____________________________________________________________
and formed for the purpose of advancing a student objective.

23 ______________________________________________________________________
c. "state procurement" shall mean any funds, loans, contracts or grant

24 ________________________________________________________________________
agreements approved, entered into, certified, released, managed,

25 ________________________________________________________________________
distributed or authorized for distribution, and any communication under-

26 ________________________________________________________________________
taken in furtherance of such, by a covered agency or state affiliated

nonprofit organization.

2. Appointment. There shall be a chief procurement officer for the

2 ________________________________________________________________________
state of New York appointed by the governor, by and with the advice and

consent of the senate.

4 ______________________________________________________________________
3. Duties. a. The chief procurement officer shall serve as the princi-

5 ________________________________________________________________________
pal officer tasked with oversight of all state procurements undertaken

6 ________________________________________________________________________
by a covered agency or state affiliated nonprofit organization, whose

7 ________________________________________________________________________
duties shall include, but not be limited to, ensuring the wise and

8 ________________________________________________________________________
prudent use of public money in the best interest of the taxpayers of the

9 ________________________________________________________________________
state and guarding against favoritism, corruption, fraud, criminal

10 ________________________________________________________________________
activity, conflicts of interest or abuse in connection with all procure-

11 ________________________________________________________________________
ments of a covered agency. The chief procurement officer shall have the

12 ________________________________________________________________________
authority to review any contract made for or by a covered agency or a

13 ________________________________________________________________________
state affiliated nonprofit organization which is to be paid in whole or

14 ________________________________________________________________________
in part from monies appropriated or assigned by the state, and report

15 ________________________________________________________________________
promptly any suspicion or allegation of favoritism, corruption, fraud,

16 ________________________________________________________________________
criminal activity, conflicts of interest or abuse in any covered agency

17 ________________________________________________________________________
or state affiliated nonprofit organization's state procurement to the

18 ________________________________________________________________________
office of the state inspector general for appropriate action. Prior to

19 ________________________________________________________________________
making such a report, the chief procurement officer shall inform the

20 ________________________________________________________________________
commissioner of general services and the heads of the relevant agencies

21 ________________________________________________________________________
and authorities of such suspicion or allegation and the progress of

22 ________________________________________________________________________
investigations related thereto, unless special circumstances require

23 ________________
confidentiality.

b. The chief procurement officer may also review and examine the poli-

25 ________________________________________________________________________
cies and procedures of covered agencies and state affiliated nonprofit

26 ________________________________________________________________________
organizations with regard to the detection and prevention of favoritism,

27 ________________________________________________________________________
corruption, fraud, criminal activity, conflicts of interest or abuse in

28 ________________________________________________________________________
covered agencies or state affiliated nonprofit organization and recom-

mend actions the covered agency or state affiliated nonprofit organiza-

tion can take to prevent or eliminate favoritism, corruption, fraud,

criminal activity, conflicts of interest or abuse.

4. Removal. The chief procurement officer may be removed by the gover-

5 ________________________________________________________________________
nor for cause after an opportunity to be heard. A statement of the cause

6 ________________________________________________________________________
of his or her removal shall be filed by the governor with the secretary

7 _________
of state.

8 2. This act shall take effect immediately.
