AGNES 4, MAGPALE WHEREAS, Batas Pambansa Blg. 344, which is entitled “AN ACT TO ENHANCE THE MOBILITY OF DISABLED PERSONS BY REQUIRING CERTAIN BUILDINGS, INSTITUTIONS, ESTABLISHMENTS AND PUBLIC UTILITIES TO INSTALL FACILITIES AND OTHER DEVICES”, was signed into iaw by President E. Marcos on July 26, 1982 0 promote the full enjoyment by persons with disabilities (PWDs) of the same rights and privileges readily accessible by those without manifesting physical or mobility impairments; WHEREAS, the Asian Development Bank Country Report 2005 revealed that afier more than 27 years since the enactment of BP 344. PWDs in the Philippines have yet to fee! any significant impact on the accessibility and safety of their built environment, public transport and other inirastructure which are supposedly the immediate intention of the law; WHEREAS, the United Nations Eeonomic and Social Commission for Asia and the Pacific (UNESCAP) has presented a report catitled: “Barrier-free Tourism for People with Disabilities in the ESCAP Region” which identifies the PWD sector as an emerging market 10 jurther strengthen the fast-growing tourism industry in the Asia and Pacitie Regions; plo. No. 2011-09 Page 2 WHEREAS, the UNESCAP report also strongly recommended for governments to adopt policies and programs that favor the PWDs" right to access to tourism facilities and services and promote the same among the private players in the industry; WHEREAS, the Philippines is a state party to the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD), which went into force on May 3. 2008, and which calls for the implementation of universal and inclusive design in the wilt environment in both urban and rural areas and the promotion of Barrier-Free ‘ourism; WHEREAS, accordingly, Barrier-Pree Tourism may be truly achieved by enforcing the recommended universal standard design features in all tourism facilities that remove any mobility and safety constraints on the part of the PWD: WHEREAS, ‘he technical specifications provided under BP 344 need to be upgraded or enhanced as these no longer correspond to universal access standarels under a barrier-free environment; NOW, THEREFORE, on motion of Member, Hon. ARLEIGH JAY C. SITOY, duly seconded by Vice-Governor, Hon. AGNES A. MAGPALE, be it RESOLVED to enaet, as it is hereby ENACTED. the following: Ordinance No. 2011-09 PROMOTING BARRIER-FREF TOURISM (BFT) THROUGH THE ADOPTION/USE OF UNIVERSAL BARRIER-FREE STANDARDS IN ORDER TO HASTEN THE MEANINGFUL CREATION OF BARRIER-FREE ENVIRONMENTS (BFE) IN THE PROVINCE OF CEBU FOR THE BENEFIT OF THE ELDERLY, PERSONS WITH DISABILITIES (PWD), WOMEN AND CHILDREN. Be it ORDAINED by the Sangguniang Panlalawigan of Cebu that: Section 1. TITLE. This ordinance shall be known and referred to as the “BARRIER-FREE TOURISM ORDINANCE OF THE PROVINCE OF CEBU 2011” Section 2. POLICY STATEM ‘The Cebu Provincial Government recognizes that the tourism industry plays a major role in the economy of the entire country as well as that of the Province. I, further, recognizes the PWD sector, both local and foreign, as one of the key markets that would give an added boost to the rapidly growing tourism industry especially in the Province of Cebu, In this regard, the Geba Provincial Government commits to promote Barrier-Free Tourism by exhorting owners and/or operators of tourism-oriented facilities and related service providers to introduce barrier-free features and services into existing and propoved tourist transport systems. buildings, and other basic local infrastructure. No. 2011-09 Page 3 Section 4, UNIVERSAL AND INCLU IVE DESIGN SPECIFICATIONS. ‘The following design specifications (as illustrated in the attached) are hereby recommended as follows: 1 4, Reception Areas. Reception areas in banks, hotels. ticketing offices and the like shall provide low and recessed ot splitlevel counters that would accommodate both standing persons and specially those seated on wheelehaits ‘or persons of short stature, including children. ‘The lower counter shall have a height not exceeding 75 centimet preferred and hereby recommended. s from the floor to the counter top is Interior Doors. Accommodation sites shall provide a “roll-in” shower with Tow= ‘mounted hand-held shower, or if a bathtub exists, provide a stable non-skid seat placed across the tub, There shall also be maintained a threshold of 13 em or ¥s inch or less separating the shower area from the lavatory area in order to prevent the excess water from spillage onto the lavatory floor. All other amenities shall likewise be placed within the safe and comfortable reach of the seated user. Lavatories. Split-level type lavatories convenient for standing and seated users and open space underneath shall be installed for wheelehiirusers. The higher lavatory top shall be constructed preferably at eighty (80) centimeters from the floor while the lower top shall be at 70-75 centimeters Irom the floor. Faucets shall be of lever-type so that amputees or weakened hands may still be able to open the tap. Mirrors shall be lowered or slanted so that wheelchair- users and children may be able to see themselves, All other lavatory amenities shall be within reach of a person in a sitting position. Elevators. Building owners are hereby encouraged to install at least one elevator with PWD-friendly features and which ean accommodate a minimum of two (2) wheelchairs, The following features are hereby recommended, namely: (@) the exterior and interior button panels of elevators shall not exceed 120 centimeters from the floor; (b) the panel buttons, which individually feature braille signs or otherwise embossed with familiar signs for those uneducated in braille, should be spread more horizontally and less vertically; (¢) a speaker system shall also be in place to inform the blind what floor the elevator is currently at; and (d) each cab shall also be equipped with handrails placed on both sides at 70-75 em from the floor. If and where applicable and feasible, swimming pools shall also be made accessible. For sunken pools on the ground, a ramp shall be built alongside the edge leading up to the pool’s shallow entrance such that the height of the poo! edge is around 40 em, which is at least the height of the wheelchair seat, so that the wheelehair-user may transfer quite easily to the raised portion of the pool. Another way is to build a raised pool to at least 40 cm to achieve the same purpose. Tourist Buses. Section 6. REPEALING CLAUSE. Alll ordinances, orders and issuances found inconsistent with the provisions of this ordinance shall be deemed repealed. Section 7. SEPARABILITY CLAUSE. If any part, section or provision of this ‘ordinance shall be held invalid or unconstitutional, no other part. section or provision thereof shal! be affected thereby. Section 8. EFFECTIVITY.
