INFORMATION

The STATE, thru the undersigned Associate Provincial Prosecutor, accuses

XXX as Principal by Direct Participation and YYY as Accomplice of the crime
of Attempted Homicide, defined and penalized under the provisions of Article
249 in relation to Articles 6, 51 and 56 of the Revised Penal Code,
committed as follows:

That on or about 7:00 PM of August 14, 2013, in Sitio Malapay, Brgy.

Bagawines, Vallerhermoso, Negros Oriental, and within the jurisdiction of
this Honorable Court, XXX, with intent to kill, did then and there willfully,
unlawfully, and feloniously attack, assault and use personal violence upon
one ZZZ by hacking him on the head with a bolo, thereby commencing the
commission of the crime of Homicide directly by overt acts but nevertheless
did not perform all the acts of execution which should have produced the
crime of Homicide by reason of cause or causes other than his own
spontaneous desistance.

That accused YYY, although not having participated in the act either as
principal by direct participation, by inducement, or by indispensable
cooperation, nevertheless cooperated in the execution of the offense by
previous or simultaneous acts indicating concurrence with the principal in his
criminal design by wrestling with and holding ZZZs arms as accused XXX
hacked the same.
