Subject:ReservationforthePersonswithDisabilities
Withaviewtoconsolidatingtheexistinginstructions,bringingtheminlinewiththePersonswithDisabilities
(EqualOpportunities,ProtectionofRights&FullParticipation)Act,1995andclarifyingcertainissuesincluding
proceduralmatters,thefollowinginstructionsareissuedwithregardtoreservationforpersonswithdisabilities
(physicallyhandicappedpersons)inpostsandservicesundertheGovernmentofIndia.Theseinstructionsshall
supercedeallpreviousinstructionsissuedonthesubjectsofar.
2.QUANTUMOFRESERVATION
ThreepercentofthevacanciesincaseofdirectrecruitmenttoGroupA,B,C&Dpostsshallbereservedfor
personswithdisabilitiesofwhichonepercenteachshallbereservedforpersonssufferingfrom(i)blindnessor
lowvision,(ii)hearingimpairmentand(iii)locomotordisabilityorcerebralpalsyinthepostsidentifiedforeach
disability
ThreepercentofthevacanciesincaseofpromotiontoGroupD,andGroupCpostsinwhichtheelementofdirect
recruitment,ifany,doesnotexceed75%,shallbereservedforpersonswithdisabilitiesofwhichonepercent
eachshallbereservedforpersonssufferingfrom(i)blindnessorlowvision,(ii)hearingimpairmentand(iii)
locomotordisabilityorcerebralpalsyinthepostsidentifiedforeachdisability.
3.EXEMPTIONFROMRESERVATION:IfanyDepartment/Ministryconsidersitnecessarytoexemptany
establishmentpartlyorfullyfromtheprovisionofreservationforpersonswithdisabilities,itmaymakea
referencetotheMinistryofSocialJusticeandEmploymentgivingfulljustificationfortheproposal.Thegrantof
exemptionshallbeconsiderbyanInterDepartmentalCommitteesetupbytheMinistryofSocialJusticeand
Empowerment.
4.IDENTIFICATIONOFJOBS/POSTS:TheMinistryofSocialJusticeandEmpowermenthaveidentifiedthe
jobs/postssuitabletobeheldbypersonswithdisabilitiesandthephysicallyrequirementforallsuchjobs/posts
videtheirnotificationno.1625/99.NI.Idated3.5.2001.Thejobs/postsgiveninAnnexureIIofthesaid
notificationasamendedfromtimetotimeshallbeusedtogiveeffectto3percentreservationtothepersons
withdisabilities.Itmay,however,benotedthat:
Thenomenclatureusedforanyjob/postshallmeanandincludenomenclatureusedforothercomparable
jobs/postshavingidenticalfunctions.
Thelistofjobs/postsnotifiedbytheMinistryofSocialJustice&Empowermentisnotexhaustive.Theconcerned
Ministries/Departmentsshallhavethediscretiontoidentifyjobs/postsinadditiontothejobs/postsalready
identifiedbytheMinistryofSocialJustice&Empowerment.However,noMinistry/Department/Establishment
shallexcludeanyidentifiedjob/postfromthepurviewofreservationatitsowndiscretion.
Ifajob/postidentifiedforpersonswithdisabilitiesisshiftedfromonegrouporgradetoanothergrouporgrade
duetochangeinthepayscaleorotherwise,thejob/postshallremainidentified.
5.RESERVATIONINPOSTSIDENTIFIEDFORONEORTWOCATEGORIES:Ifapostisidentifiedsuitable
onlyforonecategoryofdisability,reservationinthatpostshallbegiventopersonswiththatdisabilityonly.
Reservationof3%shallnotbereducedinsuchcasesandtotalreservationinthepostwillbegiventopersons
sufferingfromthedisabilityforwhichithasbeenidentified.Likewiseincasethepostisidentifiedsuitablefortwo
categoriesofdisabilities,reservationshallbedistributedbetweenpersonswiththosecategoriesofdisabilities
equally,asfaraspossible.Itshall,however,beensuredthatreservationindifferentpostsintheestablishmentis
distributedinsuchawaythatthepersonsofthreecategoriesofdisabilities,asfaraspossible,getequal
representation.
6.APPOINTMENTAGAINSTUNRESERVEDVACANCIES:Inthepostswhichareidentifiedsuitablefor
personswithdisabilities,apersonwithdisabilitycannotbedeniedtherighttocompeteforappointmentagainst
anunreservedvacancy.Thusapersonwithdisabilitycanbeappointedagainstanunreservedvacancy,provided
thepostisidentifiedsuitableforpersonswithdisabilityoftherelevantcategory.
7.ADJUSTMENTOFCANDIDATESSELECTEDONTHEIROWNMERIT:Personswithdisabilitiesselectedon
theirownmeritwithoutrelaxedstandardsalongwithothercandidates,willnotbeadjustedagainstthereserved
shareofvacancies.Thereservedvacancieswillbefilledupseparatelyfromamongsttheeligiblecandidateswith
disabilitieswhichwillthuscomprisephysicallyhandicappedcandidateswhoarelowerinmeritthanthelast
candidateinmeritlistbutotherwisefoundsuitableforappointment,ifnecessary,byrelaxedstandards.Itwjll
applyincaseofdirectrecruitmentaswellaspromotion,whereverreservationforpersonswithdisabilitiesis
admissible.
8.DEFINITIONSOFDISABILITIES:DefinitionsofcategoriesofdisabilitiesforthepurposeofthisOffice
Memorandumaregivenbelow:
(i)(a)Blindness:"Blindness"referstoaconditionwhereapersonsuffersfromanyofthefollowingconditions,
namely:
totalabsenceofsightor
visualacuitynotexceeding6/60or20/200(snellen)inthebettereyewithcorrectinglensesor
limitationofthefieldofvisionsubtendinganangleof20degreeorworse

(b)Lowvision:"Personwithlowvision"meansapersonwithimpairmentofvisualfunctioningevenafter
treatmentorstandardrefractivecorrectionbutwhousesorispotentiallycapableofusingvisionfortheplanning
orexecutionofataskwithappropriateassistivedevice.
(ii)HearingImpairment:"HearingImpairment"meanslossofsixtydecibelsormoreinthebetterearinthe
conversationalrangeoffrequencies.
(iii)(a)Locomotordisability:"Locomotordisability"meansdisabilityofthebones,jointsormusclesleadingto
substantialrestrictionofthemovementofthelimbsoranyformofcerebralpalsy.
(b)CerebralPalsy:"CerebralPalsy"meansagroupofnonprogressiveconditionsofapersoncharacterisedby
abnormalmotorcontrolpostureresultingfrombraininsultorinjuriesoccurringintheprenatal,perinatalor
infantperiodofdevelopment.
(c)Allthecasesoforthopaedicallyhandicappedpersonswouldbecoveredunderthecategoryof"locomotor
disabilityorcerebralpalsy."
9.DEGREEOFDISABILITYFORRESERVATION:Onlysuchpersonswouldbeeligibleforreservationin
services/postswhosufferfromnotlessthan40percentofrelevantdisability.Apersonwhowantstoavailof
benefitofreservationwouldhavetosubmitaDisabilityCertificateissuedbyacompetentauthorityintheformat
giveninAnnexureI.
10.COMPETENTAUTHORITYTOISSUEDISABILITYCERTIFICATE:Thecompetentauthoritytoissue
DisabilityCertificateshallbeaMedicalBoarddulyconstitutedbytheCentraloraStateGovernment.The
Central/StateGovernmentmayconstituteMedicalBoard(s)consistingofatleastthreemembersoutofwhichat
leastoneshallbeaspecialistintheparticularfieldtorassessinglocomotor/cerebral/visual/hearingdisability,as
thecasemaybe.
11.TheMedicalBoardshall,afterdueexamination,giveapermanentdisabilitycertificateincasesofsuch
permanentdisabilitieswheretherearenochancesofvariationinthedegreeofdisability.TheMedicalBoardshall
indicatetheperiodofvalidityofthecertificate,incaseswheretherearechancesofvariationinthedegreeof
disability.Norefusalofdisabilitycertificateshallbemadeunlessanopportunityisgiventotheapplicantofbeing
heard.Onrepresentationbytheapplicant,theMedicalBoardmayreviewitsdecisionhavingregardtoallthe
factsandcircumstancesofthecaseandpasssuchordersinthematterasitthinksfit..
12.Atthetimeofinitialappointmentandpromotionagainstavacancyreservedforpersonswithdisability,the
appointingauthorityshallensurethatthecandidateiseligibletogetthebenefitofreservation..
13.COMPUTATIONOFRESERVATION:ReservationforpersonswithdisabilitiesincaseofGroupCandGroup
DpostsshallbecomputedonthebasisoftotalnumberofvacanciesoccurringinallGroupCorGroupDposts,as
thecasemaybe,intheestablishment,althoughtherecruitmentofthepersonswithdisabilitieswouldonlybein
thepostsidentifiedsuitableforthem.Thenumberofvacanciestobereservedforthepersonswithdisabilitiesin
caseofdirectrecruitmenttoGroup'C'postsinanestablishmentshallbecomputedbytakingintoaccountthe
totalnumberofvacanciesarisinginGroup'C'postsforbeingfilledbydirectrecruitmentinarecruitmentyear
bothintheidentifiedandnonidentifiedpostsundertheestablishment.ThesameprocedureshallapplyforGroup
'D'posts.Similarly,allvacanciesinpromotionquotashallbetakenintoaccountwhilecomputingreservationin
promotioninGroup'C'andGroup'D'posts.Sincereservationislimitedtoidentifiedpostsonlyandnumberof
vacanciesreservediscomputedonthebasisoftotalvacancies(inidentifiedpostsaswellasunidentifiedposts),it
ispossiblethatnumberof
14.ReservatonforpersonswithdisabilitiesinGroup'A'postsshallbecomputedonthebasisofvacancies
occurringindirectrecruitmentquotainalltheidentifiedGroup'A'postsintheestablishment.Thesamemethod
ofcomputationappliesforGroup'B'posts.
15.EFFECTINGRESERVATIONMAINTENANCEOFROSTERS:
Allestablishmentsshallmaintainseparate100pointreservationrosterregistersintheformatgiveninAnnexure
IIfordetermining/effectingreservationforthedisabledoneeachforGroup'A'postsfilledbydirect
recruitment,Group'B'postsfilledbydirectrecruitment,Group'C'postsfilledbydirectrecruitment,Group'C'
postsfilledbypromotion,Group'D'postsfilledbydirectrecruitmentandGroup'D'postsfilledbypromotion.
Eachregistershallhavecyclesof100pointsandeachcycleofl00pointsshallbedividedintothreeblocks,
comprisingthefollowingpoints:
1stBlockpointNo.1topointNo.33
2ndBlockpointNo.34topointNo.66
3rdBlockpointNo.67topointNo.100
PointsI,34and67oftherostershallbeearmarkedreservedforpersonswithdisabilitiesonepointforeachof
thethreecategoriesofdisabilities.Theheadoftheestablishmentshalldecidethecategoriesofdisabilitiesfor
whichthepointsI,34and67willbereservedkeepinginviewallrelevantfacts.
AllthevacanciesinGroupCpostsfallingindirectrecruitmentquotaarisingintheestablishmentshallbeentered
intherelevantrosterregister.Ifthepostfallingatpointno.1isnotidentifiedforthedisabledortheheadofthe
establishmentconsidersitdesirablenottofillitupbyadisabledpersonoritisnotpossibletofillupthatpostby
thedisabledforanyotherreason,oneofthevacanciesfallingatanyofthepointsfrom2to33shallbetreated
asreservedforthedisabledandfilledassuch.Likewiseavacancyfallingatanyofthepointsfrom34to66or
from67to100shallbefilledbythedisabled.ThepurposeofkeepingpointsI,34and67asreservedistofillup
thefirstavailablesuitablevacancyfrom1to33,firstavailablesuitablevacancyfrom34to66andfirstavailable
suitablevacancyfrom67to100bypersonswithdisabilities.
Thereisapossibilitythatnoneofthevacanciesfrom1to33issuitableforanycategoryofthedisabled.Inthat
casetwovacanciesfrom34to66shallbefilledasreservedforpersonswithdisabilities.Ifthevacanciesfrom34
to66arealsonotsuitableforanycategory,threevacanciesshallbefilledasreservedfromthethirdblock
containingpointsfrom67to100.Thismeansthatifnovacancycanbereservedinaparticularblock,itshallbe
carriedintothenextblock.
Afterallthe100pointsoftherosterarecovered,afreshcycleof100pointsshallstart.
Ifthenumberofvacanciesinayearissuchastocoveronlyoneblockortwo,discretionastowhichcategory'of
thedisabledshouldbeaccommodatedfirstshallvestintheheadoftheestablishment,whoshalldecideonthe

basisofthenatureofthepost,thelevelofrepresentationofthespecificdisabledcategoryintheconcerned
grade/postetc.
AseparaterostershallbemaintainedforgroupCpostsfilledbypromotionandprocedureasexplainedaboveshall
befollowedforgivingreservationtopersonswithdisabilities.Likewisetwoseparaterostersshallbemaintained
forGroupDposts,oneforthepostsfilledbydirectrecruitmentandanotherforpostsfilledbypromotion.
ReservationingroupAandgroupBpostsisdeterminedonthebasisofvacanciesintheidentifiedpostsonly.
SeparaterostersforGroupApostsandGroupBpostsintheestablishmentshallbemaintained.Intherosters
maintainedforGroupAandGroupBposts,allvacanciesofdirectrecruitmentarisinginidentifiedpostsshallbe
enteredandreservationshallbeeffectedthesamewayasexplainedabove.
16.INTERSEEXCHANGEANDCARRYFORWARDOFRESERVATIONINCASEOFDIRECT
RECRUITMENT:
Reservationforeachofthethreecategoriesofpersonswithdisabilitiesshallbemadeseparately.Butifthenature
ofvacanciesinanestablishmentissuchthatapersonofaspecificcategoryofdisabilitycannotbeemployed,the
vacanciesmaybeinterchangedamongthethreecategorieswiththeapprovaloftheMinistryofSocialJustice&
Empowermentandreservationmaybedeterminedandvacanciesfilledaccordingly.
Ifanyvacancyreservedforanycategoryofdisabilitycannotbefilledduetononavailabilityofasuitableperson
withthatdisabilityor,foranyothersufficientreason,suchvacancyshallnotbefilledandshallbecarriedforward
asa'backlogreservedvacancy'tothesubsequentrecruitmentyear.
Inthesubsequentrecruitmentyearthe'backlogreservedvacancy'shallbetreatedasreservedforthecategory
ofdisabilityforwhichitwaskeptreservedintheinitialyearofrecruitment.However,ifasuitablepersonwith
thatdisabilityisnotavailable,itmaybefilledbyinterchangeamongthethreecategoriesofdisabilities.Incaseno
suitablepersonwithdisabilityisavailableforfillingupthepostinthesubsequentyearalso,theemployermayfill
upthevacancybyappointmentofapersonotherthanapersonwithdisability.Ifthevacancyisfilledbyaperson
withdisabilityofthecategoryforwhichitwasreservedorbyapersonofothercategoryofdisabilitybyinterse
exchangeinthesubsequentrecruitmentyear,itwillbetreatedtohavebeenfilledbyreservation.Butifthe
vacancyisfilledbyapersonotherthanapersonwithdisabilityinthesubsequentrecruitmentyear,reservation
shallbecarriedforwardforafurtherperioduptotworecruitmentyearswhereafterthereservationshalllapse.In
thesetwosubsequentyears,ifsituationsoarises,theprocedureforfillingupthereservedvacancyshallbethe
sameasfollowedinthefirstsubsequentrecruitmentyear.
17.Inordertoensurethatcasesof.lapseofreservationarekepttotheminimum,anyrecruitmentofthe
disabledcandidatesshallfirstbecountedagainsttheadditionalquotabroughtforwardfrompreviousyears,ifany,
intheirchronologicalorder.Ifcandidatesarenotavailableforallthevacancies,theoldercarriedforward
reservationwouldbefilledfirstandtherelativelylatercarriedforwardreservationwouldbefurthercarried
forward.
18.CONSIDERATIONZONE.INTERSEEXCHANGEANDFORWARDOFRESERVATIONINCASEOF
PROMOTION
Whilefillingupthereservedvacanciesbypromotionbyselection,thedisabledcandidateswhoarewithinthe
normalzoneofconsiderationshallbeconsideredforpromotion.Whereadequatenumberofdisabledcandidatesof
theappropriatecategoryofhandicaparenotavailablewithinthenormalzone,thezoneofconsiderationmaybe
extendedtofivetimesthenumberofvacanciesandthepersonswithdisabilitiesfallingwithintheextendedzone
maybeconsidered.Intheeventofnonavailabilityofcandidatesevenintheextendedzone,thereservationcan
beexchangedsothatpostcanbefilledbyapersonwithothercategoryofdisability,ifpossible.Ifitisnotpossible
tofillupthepostbyreservation,thepostmaybefilledbyapersonotherthanapersonwithdisabilityandthe
reservationshallbecarriedforwardforuptothreesubsequentrecruitmentyears,whereafteritshalllapse.
Inpostsfilledbypromotionbynonselection,theeligiblecandidateswithdisabilitiesshallbeconsideredfor
promotionagainstthereservedvacanciesandincasenoeligiblecandidateoftheappropriatecategoryofdisability
isavailable,thevacancycanbeexchangedwithothercategoriesofdisabilitiesidentifiedforit.Ifitisnotpossible
tofillupthepostbyreservationevenbyexchange,thereservationshallbecarriedforwardforuptothree
subsequentrecruitmentyearswhereafteritshalllapse.
19.HORIZONTALITYOFRESERVATIONFORPERSONSWITH
DISABILITIES:Reservationforbackwardclassesofcitizens(SCs,STsandOBCs)iscalledverticalreservationand
thereservationforcategoriessuchaspersonswithdisabilitiesandexservicemeniscalledhorizontalreservation.
Horizontalreservationcutsacrossverticalreservation(inwhatiscalledinterlockingreservation)andpersons
selectedagainstthequotaforpersonswithdisabilitieshavetobeplaced.intheappropriatecategory
viz.SC/ST/OBC/Generalcandidatesdependinguponthecategorytowhichtheybelongintherostermeantfor
reservationofSCs/STs/OBCs.Toillustrate,ifinagivenyeartherearetwovacanciesreservedforthepersonswith
disabilitiesandoutoftwopersonswithdisabilitiesappointed,onebelongstoaScheduledCasteandtheotherto
generalcategorythenthedisabledSCcandidateshallbeadjustedagainsttheSCpointinthereservationroster
andthegeneralcandidateagainstunreservedpointintherelevantreservationroster.Incasenoneofthe
vacanciesfallsonpointreservedfortheSCs,thedisabledcandidatebelongingtoSCshallbeadjustedinfuture
againstthenextavailablevacancyreservedforSCs.
20.Sincethepersonswithdisabilitieshavetobeplacedintheappropriatecategoryviz.SC/ST/OBC/Generalin
therostermeantforreservationofSCs/STs/OBCs,theapplicationformforthepostshouldrequirethecandidates
applyingunderthequotareservedforpersonswithdisabilitiestoindicatewhethertheybelongtoSC/ST/OBCor
Generalcategory.
21.RELAXATIONINAGELIMIT:
Upperagelimitforpersonswithdisabilitiesshallberelaxable(a)bytenyears(15yearsforSCs/STsand13years
forOBCs)incaseofdirectrecruitmenttoGroup'C'andGroup'D'posts(b)by5years(10yearsforSCs/STsand
8yearsforOBCs)incaseofdirectrecruitmenttoGroup'A'andGroup'B'postswhererecruitmentismade
otherwisethanthroughopencompetitiveexaminationand(c)by10years(15yearsforSCs/STsand13years
forOBCs)incaseofdirectrecruitmenttoGroupAandGroupBpoststhroughopencompetitiveexamination.
Relaxationinagelimitshallbeapplicableirrespectiveofthefactwhetherthepostisreservedornot,providedthe
postisidentifiedsuitableforpersonswithdisabilities.
22.RELAXATIONOFSTANDARDOFSUITABILITY:Ifsufficientnumberofpersonswithdisabilitiesarenot
availableonthebasisofthegeneralstandardtofillallthevacanciesreservedforthem,candidatesbelongingto
thiscategorymaybeselected0:!1relaxedstandardtofilluptheremainingvacanciesreservedforthemprovided
theyarenotfoundunfitforsuchpostorposts.Thus,totheextentthenumberofvacanciesreservedforpersons
withdisabilitiescannotbefilledonthebasisofgeneralstandards,candidatesbelongingtothiscategorymaybe

takenbyrelaxingthestandardstomakeupthedeficiencyinthereservedquotasubjecttothefitnessofthese
candidatesforappointmenttothepost/postsinquestion.
23.MEDICALEXAMINATION:AsperRule10oftheFundamentalRules,everynewentranttoGovernment
Serviceoninitialappointmentisrequiredtoproduceamedicalcertificateoffitnessissuedbyacompetent
authority.Incaseofmedicalexaminationofapersonwithdisabilityforappointmenttoapostidentifiedas
suitabletobeheldbyapersonsufferingfromaparticularkindofdisability,theconcernedMedicalOfficerorBoard
shallbeinformedbeforehandthatthepostisidentifiedsuitabletobeheldbypersonswithdisabilityofthe
relevantcategoryandthecandidateshallthenbeexaminedmedicallykeepingthisfactinview.
24.EXEMPTIONFROMPAYMENTOFEXAMINATIONFEEANDAPPLICATIONFEE:Personswithdisabilities
shallbeexemptfrompaymentofapplicationfeeandexaminationfee,prescribedinrespectofcompetitive
examinationsheldbytheStaffSelectionCommission,theUnionPublicServiceCommissionetc.forrecruitment
tovariousposts.Thisexemptionshallbeavailableonlytosuchpersonswhowouldotherwisebeeligiblefor
appointmenttothepostonthebasisofstandardsofmedicalfitnessprescribedforthatpost(includingany
concessionspecificallyextendedtothedisabledpersons)andwhoenclosewiththeapplicationform,necessary
certificatefromacompetentauthorityinsupportoftheirclaimofdisability.
25.NOTICEOFVACANCIES:Inordertoensurethatpersonswithdisabilitiesgetafairopportunityin
considerationforappointmenttoanidentifiedpost,thefollowingpointsshallbekeptinviewwhilesendingthe
requisitionnoticetotheEmploymentExchange,theSSC,theUPSCetc.andwhileadvertisingthevacancies:
NumberofvacanciesreservedforSCs/STs/OBCs/ExServicemen/PersonssufferingfromBlindnessorLow
Vision/PersonssufferingfromHearingImpainnentlPersonssufferingfromLocomotorDisabilityorCerebralPalsy
shouldbeindicatedclearly.
Incaseofvacanciesinpostsidentifiedsuitabletobeheldbypersonswithdisability.itshallbeindicatedthatthe
postisidentifiedforpersonswithdisabilitiessufferingfromblindnessorlowvisionhearingimpairmentand/or
locomotordisabilityorcerebralpalsy,asthecasemaybe,andthatthepersonswithdisabilitiesbelongingtothe
category/categoriesforwhichthepostisidentifiedshallbeallowedtoapplyevenifnovacanciesarereservedfor
them.Suchcandidateswillbeconsideredforselectionforappointmenttothepostbygeneralstandardsofmerit.
Incaseofvacanciesinpostsidentifiedsuitableforpersonswithdisabilities,irrespectiveofwhetheranyvacancies
arereservedor
not,thecategoriesofdisabilitiesvizblindnessorlowvision,hearingimpairmentandlocomotordisabilityor
cerebralpalsy,forwhichthepostisidentifiedsuitablealongwithfunctionalclassificationandphysical
requirementsforperformingthedutiesattachedtothepostshallbeindicatedclearly.

employeesinthepostswhichhavebeenidentifiedsuitableforpersonswithdisabilitiesandnumberofemployees
sufferingfromblindnessorlowvision,hearingimpairment,andlocomotordisabilityorcerebralpalsyasonthe1
stJanuaryoftheyear,and
PWDReportIIintheprescribedproforma(AnnexureIV)showingthenumberofvacanciesreservedforpersons
sufferingfromblindnessorlowvision,hearingimpairment,andlocomotordisabilityorcerebralpalsyandnumber
ofsuchpersonsactuallyappointedduringtheprecedingcalendaryear.
(ii)TheadministrativeMinistry/Departmentshallscrutinizetheinformationreceivedfromallappointing
authoritiesunderitandsendconsolidatedPWDReportIandPWDReportIIinprescribedperformainrespectof
theMinistry/Departmentincludinginformationinrespectofallattachedandsubordinateofficesunderitscontrol
totheDepartmentofPersonnelandTrainingbythe31stMarchofeachyear.
(iii)ThefollowingpointsmaybekeptinviewwhilesendingthereportstotheDepartmentofPersonnel&
Training:
ThereportssenttotheDOPTshouldnotincludeinformationinrespectofpublicsectorundertakings,statutory,
semiGovernmentandautonomousbodies.Statutory,semiGovernmentandautonomousbodiesshallfurnish

Sub:ReservationforthePersonswithDisabilities
TheundersignedisdirectedtosaythatthePersonswithDisabilities(EqualOpportunities,ProtectionofRightsand
FullParticipation)Act,1995whichcameintoexistenceon1.1.1996providesforreservationforpersonswith
disabilityinthepostsidentifiedforthreecategoriesofdisabilitiesnamely(i)blindnessorlowvision,(ii)hearing
impairmentand(iii)locomotordisabilityorcerebralpalsy.InstructionshavealsobeenissuedbythisDepartment
forprovidingreservationforsuchpersons.InspiteoftheActandtheinstructionsofthisDepartment,vacancies
werenotearmarkedreservedorwerenotfilledbyreservationinsomeestablishments.
2.Thematterhasbeenconsideredcarefullyandithasbeendecidedthatreservationforpersonswithdisabilities
shouldbeimplementedinrightearnestandthereshouldbenodeviationfromtheschemeofreservation,
particularlyaftertheActcameintoeffect.Inorderachievethisobjective,alltheestablishmentsshouldprepare
thereservationrosterregistersasprovidedinthisDepartment'sO.M.No.36035/3/2004Estt(Res)dated
29.12.2005startingfromtheyear1996andreservationforpersonswithdisabilitiesbeearmarkedasper
instructionscontainedinthatO.M.ifsomeorallthevacanciessoearmarkedhadnotbeenfilledbyreservation
andwerefilledbyablebodiedpersonseitherforthereasonthatpointsofreservationandwerefilledbyable
bodiedpersonseitherforthereasonthatpointsofreservationhadnotbeenearmarkedproperlyatthe
appropriatetimeorpersonswithdisabilitiesdidnotbecomeavailable,suchunutilizedreservationmaybetreated
ashavingbeencarriedforwardtothefirstrecruitmentyearoccuringafterissueofthisO.M.andbefilledassuch.
Ifitisnotpossibletofillupsuchreservedvacanciesduringthesaidrecruitmentyear,reservationwouldbe
carriedforwardforfurthertwoyears,whereafteritmaybetreatedaslapsed.
3.Ithasbeenobservedthatsomerecruitingagenciesdeclareintheiradvertisementsthatblind/partiallyblind
candidatesneednotapplyandthatseparateexaminationswouldbeconductedforvisuallyhandicapped
candidates.Attentionisinvitedtopara7ofthisDepartment'sO.M.No.36035/3/2004Estt(Res)dated
29.12.2005whichprovidesthatpersonswithdisabilitiesselectedontheirownmeritwillnotbeadjustedagainst
thereservedshareofvacancies.Itmeansthatpersonswithdisabilitieswhoareselectedontheirownmerithave
tobeadjustedagainsttheunreservedvacanciesandreservationhastobegiveninaddition.ifvisually
handicappedcandidatesoranyothercategoryofhandicappedcandidatesaredebarredfromapplyingonthe
groundthataseparateexaminationwouldbeconductedforthem,chancesofhandicappedcandidatesbeing
selectedontheirownmeritwouldbeeliminated.Thusdebarringofanycategoryofhandicappedcandidatesin
theabovemannerisagainsttheprovisionscontainedintheaforsaidO.M.Itis,therefore,requestedthatpersons
withdisabilitiesshouldnotbedebarredfromapplyingforthepostsidentifiedsuitableforthemandshouldbe
providedopportunitytocompetefortheunreservedvacanciesaswellbyholdingacommonexamination.
