    ShouldthedismissalofanappealbytheSupremeCourtagainstajudgementofthehigh
    courtinliminebeconstruedasconfirmationorapprovaloftheverdict,isanimportant
    questionoflawansweredbytheapexcourtinnegative.

    Thedismissalofthespecialleavepetition(SLPappeal)inlimine(insnaphearing)bythe
    SupremeCourtdoesnotmeanthatthereasoningofthejudgementofthehighcourt
    standsaffirmed,abenchofJusticesB.S.ChauthanandSwatanterKumarsaid,allaying
    thecommonmisconceptiononthisaspect.
    Makingthepositionofthelawratherclearonthisimportantquestionforthebenefitofthe
    commonman,thebenchsaidtheorderoftheapexcourtdismissingtheSLPwould
    neithermergewiththejudgementpassedbythehighcourttogiveitthefinality.
    TherulingliftstheveilonapopularnotionthatoncetheSupremeCourthasdismissedan
    appealagainstthehighcourtsjudgementevenatthethresholdofthehearing,would
    maketheHCverdictfinalandtherewouldbenofurtherscopetochallengeit.The
    dismissaloftheSLPinliminesimplymeansthattheSupremeCourtdidnotconsiderthe
    caseworthexaminingforthereasons,whichmaybeotherthanthemeritsofthecase,nor
    suchanorderofapexcourtoperatesasresjudicata(afinalverdict),thebenchheld.
    AnorderrejectingtheSLPatthresholdwithoutdetailedreasons(byapexcourttherefore,
    doesnotconstituteanydeclarationoflaworabindingprecedent,thebenchheld.
    Manytimes,thepetitionerwithdrawstheSLPaftertheapexcourtexplainsthereasonsfor
    notentertainingitandsuchpetitionsaredeclareddismissedaswithdrawnonthis
    question,thebenchclarifiedthatsuchorderswouldalsonotamounttoconfirmationof
    theHCjudgement.
    ExplaininganotheraspectrelatedtotheSLPs,thebenchsaidifoneofthesimilarly
    placedpersonswasgivenreliefbythehighcourtinadvertentlyorbymistake,itwould
    notmaketheothersentitledtothesamerelief.
    TherulingcameontheSLPofFuljitKaurfromPunjab,whohadsoughtthesamereliefin
    allotmentofaplotgiveninadvertentlytoanotherallotteebytheHCagainstwhichthe
    stateinitiallyfiledanappealbutpreferredtowithdrawit.
