Introduction

There is a fantastic talk on last Friday 19/05/2016 at management and science university.
The talk consult by professor Jeong Chun Phuoc. There is two slot presented by professor
Jeong, first slot is about how to use intellectual property for business promotion and
expenture and the second slot is about protecting your legal rights in interprenuership. The
talk was going on for two and half hours.
Slot 1 - Intellectual property for business

The introduction strong understanding on intellectual property is on types of intellectual


property and how intellectual property could be commercialised to create powerful portfolio
for business success and strategic competition.

Intellectual property

An intangible personal property resulting from mental processes and protecting of the
owners right to protect or profit from the use of his or her property. The creations of the mind
which are given legal protections similar to real and personal property. intellectual property
referred to those bundle of rights recognized under intellectual property law:

- Patents, trademark , copyright


- Trade secret/ confidential information

Rights and use of intellectual property

Intellectual property law grant individuals and businesses property in rights and protection in
using intellectual property assets and full opportunity to commercialise intellectual property
for business profits.

Patents

- Granted by government and give the inventor/assignee the right to exclude all others
from making, using, selling, offering to sell or importing the invention within the us
and its territories for 20 years. No rights to make use or sell the invention only the
right to exclude others from doing so. The legal monopoly granted by government. I
also allows the inventor an exclusive right in make, use and sell an invention for
twenty years. Patent applicant must show to MYIPO Patents office that the invention
is:
New non obvious
Novel inventive step
Useful industrial application
Copyrights

- Protects original works of authorship by authors, artists and others from unauthorized
copying. Copyright protection extends broadly to include literary, musical and
dramatic works, sound recordings, computer programs. Copyrights protect
expression not ideas patent law. The copyright protection attract investment to the
production and distribution of literary and artistic works by promising authors and
artists exclusive rights for a limited period.

Trademark

- Usually a word phrase or a symbol or combination there of that is used to distinguish


goods and services. A service mark is the same as a trademark, except that it
identifies the sources of a service rather than a product. It also assists customer in
identifying a product without confusion. If a business uses the trademark of another,
consumers are misied as to who made the goods.

Trade secrets

- A trade secret is a formula, device, process method or compitation of information that


when used in business gives the owner a advantage over competitors who do not
know it.

Agreement/ contracts

- A document that describes a relationship between two parties, such as a buyer and
seller, that is defined by an agreement about their respective rights and
responsibilities.

Negotiating to protect your legal rights

- Agreement must provide workable framework that facilitaters work


- Mutually acceptable agreement
- To set a positive tone for business relationship
- To negotiate a contract that is consistent with the institutions policies and
procedures.

Remember a contract is a binding agreement and your institution has


a legal obligation to perform.
